which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to make certain projects and activities eligible for financial assistance under a State water pollution control revolving fund, and for other purposes.</official-title></form><legis-body id="HAF5998CD1F63496AA3DD7C3E81C8BDF0" style="OLC"><section id="H9F9F79027F034F6F8E677450BE5FC2A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Water SRF Parity Act</short-title></quote>.</text></section><section id="H2078492D0A7F4EC389C181D93E611901" section-type="subsequent-section"><enum>2.</enum><header>Projects and activities eligible for assistance</header><text display-inline="no-display-inline">Section 603 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383</external-xref>) is amended—</text><paragraph id="H45EBCBCDD9A846D38A575FE59DB42CFB"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="H26BC834906544B7EA563504E2FA70599"><enum>(A)</enum><text>in paragraph (11)(B) by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HDE4F42ABC5F040C886315C9B4E8A1BA4"><enum>(B)</enum><text>in paragraph (12)(B) by striking the period at the end and inserting <quote>; and</quote>; and </text></subparagraph><subparagraph id="HFBC3A191AB8C43B0B4839D613A78A729"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H27C2C0F0313947268AFBA012D9F0EFA7" display-inline="no-display-inline"><paragraph id="HCB8FB818CF99435AA95A26305CEB7B69"><enum>(13)</enum><text display-inline="yes-display-inline">to any qualified nonprofit entity, as determined by the Administrator, to provide assistance for the construction or acquisition of, or improvements to, a treatment works, or for any other activity described in paragraphs (1) through (10). </text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5195DE42438748EAB0A1320DA03BCEC7"><enum>(2)</enum><text>in subsection (i)(3), by adding at the end the following:</text><quoted-block style="USC" id="HA2045D2866ED4E36A3E1765A1DDF1056" display-inline="no-display-inline"><subparagraph id="H1E2951DE670549BDA034F1FFCEA6A7D4"><enum>(E)</enum><header>Certain activities ineligible</header><text display-inline="yes-display-inline">A State may not provide additional subsidization under this subsection to a qualified nonprofit entity for assistance described in subsection (c)(13) or to the owner or operator of a privately owned treatment works for assistance described in subsection (k). </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H286AF2A7EFCE4FB4B6F0A43C1EB9CE29"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HCEBA7F60854847EABB795A7E583BB64C" display-inline="no-display-inline"><subsection id="HAEBE40F1E4DF4ADA8A062DCDA046EBCF"><enum>(k)</enum><header>Special rule for privately owned treatment works</header><paragraph id="H72CD9E594B9E4F54B43AECC15FFB4EF7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In any fiscal year for which the total amount appropriated to carry out this title exceeds $1,638,826,000, any such amounts appropriated in excess of $1,638,826,000 for such fiscal year may be used to provide financial assistance under this section to the owner or operator of a privately owned treatment works for—</text><subparagraph id="HA8D73E54817E4F89854ACDBC37AC09AD"><enum>(A)</enum><text>improvements to such privately owned treatment works; </text></subparagraph><subparagraph id="H27568E42D7064BB3A55A9C783D31C626"><enum>(B)</enum><text>the construction of, or improvements to, another privately owned treatment works;</text></subparagraph><subparagraph id="H63275E675FED438BB6C7750A55F0E2F5"><enum>(C)</enum><text>measures to reduce the demand for privately owned treatment works capacity through water conservation, efficiency, or reuse;</text></subparagraph><subparagraph id="HBEEA4ADCB40A428BA1F120477D2A9C21"><enum>(D)</enum><text>measures to reduce the energy consumption needs for privately owned treatment works;</text></subparagraph><subparagraph id="H012C986A6A4C4948A82B44B4327389E8"><enum>(E)</enum><text>measures to increase the security of privately owned treatment works; and</text></subparagraph><subparagraph id="HA3F7269EA4A647D89E5E01955CA72B98"><enum>(F)</enum><text>any other activity described in paragraphs (1) through (10) of subsection (c).</text></subparagraph></paragraph><paragraph id="H68E11CC11A2B45F1B73FFC425E067AD1"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Financial assistance may only be provided under this subsection to the owner or operator of a privately owned treatment works for activities described in paragraph (1) that primarily and directly benefit the individuals or entities served by the privately owned treatment works, and not the shareholders or owners of the treatment works, as determined by the instrumentality of the State responsible for administering the water pollution control revolving fund through which such financial assistance is provided.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
