which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a categorical exclusion for certain forest management activities relating to early successional forests and a categorical exclusion for certain activities relating to outdoor recreation, and for other purposes.</official-title></form><legis-body id="HA49B8CA5BE2244C3B44C2AF4C2DF6C2F" style="OLC"><section id="HED46F8D4E1EB4D6EB25A9D3AC04950C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Forests for Hunters Act of 2021</short-title></quote>.</text></section><section id="H66CE1DF8BC5543F48D5124D9999FC29D"><enum>2.</enum><header>Categorical exclusion for early successional forests</header><subsection id="HB680A9095BBE4A0DBDAFAD807A48A72A"><enum>(a)</enum><header>Categorical exclusion established</header><text>Forest management activities described in subsection (b) are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection><subsection id="H783AFA587ACF4CA3A877B9E384506A15"><enum>(b)</enum><header>Forest management activities designated for categorical exclusion</header><text>The forest management activities designated under this section for a categorical exclusion are forest management activities carried out by the Secretary concerned on National Forest System lands or public lands where the primary purpose of such activity is, consistent with the applicable forest plan, to modify, improve, enhance, or create early successional forests for wildlife habitat improvement and other purposes.</text></subsection><subsection id="H6257FF007E63412F9303CA8A4B7681C9"><enum>(c)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text></subsection><subsection id="HC0B2456C1DBD44B4A8DE14124442116F"><enum>(d)</enum><header>Project goals</header><text>To the maximum extent practicable, the Secretary concerned shall design forest management activities described in subsection (b)—</text><paragraph id="HFC2CD0AE907D41EEB9374DA9BF77408E"><enum>(1)</enum><text>to meet early successional forest goals; and</text></paragraph><paragraph id="H53DDEA930C8A47B8A5F4452BF5559D31"><enum>(2)</enum><text>to maximize production and regeneration of priority species, as identified in the forest plan and consistent with the capability of the treatment units.</text></paragraph></subsection><subsection id="H4FEECB12F86B4E6B921E8C5EDB7855D4"><enum>(e)</enum><header>Acreage limitations</header><text>A forest management activity covered by the categorical exclusion established under subsection (a) may not contain treatment units exceeding a total of 10,000 acres.</text></subsection></section><section id="HEC733F2C73AB4B0EBC42E2B54B6E0C3A"><enum>3.</enum><header>Categorical exclusion for outdoor recreation</header><subsection id="HBD791318C6074F3B8DB8ED6E815850D4"><enum>(a)</enum><header>Categorical exclusion established</header><text display-inline="yes-display-inline">Activities described in subsection (b) are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection><subsection id="H66CEC507B96747BDB24DAEE2DCF21FE3"><enum>(b)</enum><header>Activities designated for categorical exclusion</header><text>The activities designated under this section for a categorical exclusion are activities carried out by the Secretary concerned on National Forest System lands or public lands where the primary purpose of such activity is to—</text><paragraph id="H3250A31377A84C3E9D2E09C5130357CB"><enum>(1)</enum><text>issue, amend, replace, or extend the administrative terms of an existing or expired special use authorization, if the holder or applicant of such special use authorization is in full compliance with the terms and conditions of such special use authorization;</text></paragraph><paragraph id="H5C6EA4D4F8274755B1EAC432538EDE6F"><enum>(2)</enum><text display-inline="yes-display-inline">modify, remove, repair, maintain, reconstruct, or replace a facility for an existing special use authorization; </text></paragraph><paragraph id="H6147925BE027466DAC97CB746297E84A"><enum>(3)</enum><text>issue a new special use authorization or amendment to an existing special use authorization for activities that will occur on existing roads, trails, facilities, or areas approved for use in an applicable forest plan or other documented decision; </text></paragraph><paragraph id="H1850A97E857E417DAB119E8B39CDBBE6"><enum>(4)</enum><text>approve, modify, or continue special uses of National Forest System lands or public lands for less than 5 years;</text></paragraph><paragraph id="HB26C0B5A173A449BB34C3DACE69410A2"><enum>(5)</enum><text>approve, modify, or continue special use authorizations on National Forest System land that require less than 20 acres of contiguous land;</text></paragraph><paragraph id="H82343D8E38E344C986498E50F4CFE3C0"><enum>(6)</enum><text>operate, maintain, modify, construct, reconstruct, improve, decommission, relocate, or dispose of buildings, infrastructure, or other improvements at developed recreation sites; </text></paragraph><paragraph id="H7E889DE138C34221957F9D8C71D0E531"><enum>(7)</enum><text>remove hazard trees for the purpose of protecting public health or safety or improving access to a recreation site; or</text></paragraph><paragraph id="H257A0A69DEEB4BCF94D4F45093A54B90"><enum>(8)</enum><text>any combination of the purposes specified in paragraphs (1) through (7).</text></paragraph></subsection><subsection id="H9F8C4644F4994BC2850C716AF8CFCFD4"><enum>(c)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text></subsection></section><section id="H8C612D9690A74C06BE770562F20EF517"><enum>4.</enum><header>Exclusions</header><text display-inline="no-display-inline">The authorities provided by this Act do not apply with respect to any National Forest System lands or public lands—</text><paragraph id="HB2CED416966F49DEBFE376A236D26094"><enum>(1)</enum><text>that are included in the National Wilderness Preservation System;</text></paragraph><paragraph id="H5504D2207E534991A5996D2F429934E9"><enum>(2)</enum><text>that are located within a national or State specific inventoried roadless area established by the Secretary of Agriculture through regulation, unless—</text><subparagraph id="H3F4A811661EC4075901CB609CD4ABFB9"><enum>(A)</enum><text>the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; or</text></subparagraph><subparagraph id="H5C4B0F2661C14B819B994FDB1AE4BD9A"><enum>(B)</enum><text>the Secretary concerned determines the activity is allowed under the applicable roadless rule governing such lands; or</text></subparagraph></paragraph><paragraph id="H6E57B3A554184F55AA23671C0222E0B3"><enum>(3)</enum><text>on which timber harvesting for any purpose is prohibited by Federal statute.</text></paragraph></section><section id="H15A441FF465E4FFE86BA64C3E5239A0A"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H823EC33C071B47C6A069B8DF22FD52F5"><enum>(1)</enum><header>Forest management activity</header><text>The term <term>forest management activity</term> means a project or activity carried out by the Secretary concerned on National Forest System lands or public lands consistent with the forest plan covering such lands.</text></paragraph><paragraph id="H0C898BEC700E4FB59515F330CDFF23FD"><enum>(2)</enum><header>Forest plan</header><text>The term <term>forest plan</term> means—</text><subparagraph id="HECFDF842C2A6401883EFA42B14FFD011"><enum>(A)</enum><text>a land use plan prepared by the Bureau of Land Management for public lands pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); or</text></subparagraph><subparagraph id="H2EC6CE317FC543FDB729BCEEC5BC39B1"><enum>(B)</enum><text>a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></subparagraph></paragraph><paragraph id="H88BED1080F034B70B10BD36EDB78F388"><enum>(3)</enum><header>National forest system</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H74EF820CC1934A76AB733C99BF7C35F7"><enum>(4)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>), except that the term includes Coos Bay Wagon Road Grant lands and Oregon and California Railroad Grant lands.</text></paragraph><paragraph id="HC873283108D04C04B430E5E4EDA97E1B"><enum>(5)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="HBC38CE8B0A0C433197BE27D36D0989A0"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph><subparagraph id="HD6B47BB8E87A45D8A35708742BC53C15"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph></section></legis-body></bill>
