R. 4583</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210720">July 20, 2021</action-date><action-desc><sponsor name-id="S000185">Mr. Scott of Virginia</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to expand the requirement for States to suspend, rather than terminate, an individual’s eligibility for medical assistance under the State Medicaid plan while the individual is an inmate of a public institution, to apply to inmates of any age.</official-title></form><legis-body id="H44F4F4D15F7D4EEFAE88BAB008E18771" style="OLC"><section id="H4CE02AD54C10492481B4E30E079BF53D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Positive Outcomes After Release Act</short-title></quote>.</text></section><section id="H0BCE2385C1D8481BA47C2BD69C40B9F9"><enum>2.</enum><header>Suspension of Medicaid benefits for inmates of public institutions</header><subsection id="HE5D2CE4DC38F49B8ADE43501A27BEE53"><enum>(a)</enum><header>In general</header><text>Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text><paragraph id="H5D6B0B2F97794FB3A3995D446F16F0B1"><enum>(1)</enum><text>in subsection (a)(84)—</text><subparagraph id="H9B0A91E2422B4C95834D9B163454B25F"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>individual who is an eligible juvenile</quote> and all that follows through <quote>inmate;</quote> and inserting <quote>eligible individual (as defined in subsection (nn)(1)) because the individual is an inmate of a public institution (as defined in subsection (nn)(2)), but may suspend coverage during the period the individual is such an inmate;</quote>;</text></subparagraph><subparagraph id="H6C495DB36C41412BAC3AF41DB4F31EB0"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>individual who is an eligible juvenile described in paragraph (2)(A)</quote> and inserting <quote>eligible individual who is described in paragraph (1)(A)</quote>; and</text></subparagraph><subparagraph id="H3F5F175B53654E67B3BED190FC75776B"><enum>(C)</enum><text>in subparagraph (C), by striking <quote>individual who is an eligible juvenile described in paragraph (2)(B)</quote> and inserting <quote>eligible individual who is described in paragraph (1)(B)</quote>; and</text></subparagraph></paragraph><paragraph id="HE60D6CE51DCD49938A7DF8505D012682"><enum>(2)</enum><text>by amending subsection (nn) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H957B6215EA44475C95A5E047AEAD7145" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="HE9DDE94593994F3F9517569B8A4BCE46"><enum>(nn)</enum><header display-inline="yes-display-inline">Eligible individual; public institution</header><text display-inline="yes-display-inline">For purposes of subsection (a)(84) and this subsection:</text><paragraph commented="no" display-inline="no-display-inline" id="HF28873D0F7514F9BA95CAEEBF740ECD5"><enum>(1)</enum><header>Eligible individual</header><text>The term <term>eligible individual</term> means an individual who is an inmate of a public institution and who—</text><subparagraph id="HD0EC8E2A043C46B7AFE209B001DE0A8B"><enum>(A)</enum><text>was determined eligible for medical assistance under the State plan immediately before becoming an inmate of such a public institution; or</text></subparagraph><subparagraph id="H561BB26366CD41F780BD8D3411326337"><enum>(B)</enum><text>is determined eligible for such medical assistance while an inmate of a public institution.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H67B2ACDE5D4F4A3482ED1A4EB7852383"><enum>(2)</enum><header>Inmate of a public institution</header><text>The term <term>inmate of a public institution</term> has the meaning given such term for purposes of applying the subdivision (A) following paragraph (30) of section 1905(a), taking into account the exception in such subdivision for a patient of a medical institution.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1672CA74E1064362A10C123571F74D67"><enum>(b)</enum><header>Retroactive effective date</header><text>The amendments made by subsection (a) shall take effect as included in the enactment of section 1001 of the SUPPORT for Patients and Communities Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/271">Public Law 115–271</external-xref>).</text></subsection></section></legis-body></bill>
