which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit Executive agencies from using the derogatory term <quote>alien</quote> to refer to an individual who is not a citizen or national of the United States, to amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">chapter 1</external-xref> of title 1, United States Code, to establish a uniform definition for the term <quote>foreign national</quote>, and for other purposes.</official-title></form><legis-body id="H92627433F4CB4490A7F29B43CED13A92" style="OLC"><section id="H402A796E1F6142648B99BFF1DC548EC6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Correcting Hurtful and Alienating Names in Government Expression (CHANGE) Act</short-title></quote>.</text></section><section id="HFBB18607EE57478CA42A34D58BB65BA2"><enum>2.</enum><header>Modernization of language referring to individuals who are not citizens or nationals of the United States</header><text display-inline="no-display-inline">An Executive agency (as defined in section 105 of title 5, United States Code) shall not use the following terms in any proposed or final rule, regulation, interpretation, publication, other document, display, or sign issued by the agency after the date of the enactment of this Act, except to the extent that the term is used in quoting or reproducing text written by a source other than an officer (as defined in section 2104 of title 5, United States Code) or employee (as defined in section 2105 of title 5, United States Code) of the agency:</text><paragraph id="H0CE3BEE190374A32B88FD0B73D3FE135"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>alien</term>, when used to refer to an individual who is not a citizen or national of the United States.</text></paragraph><paragraph id="HEB5061B732EB4DEEAEC7A81AF9B413D7"><enum>(2)</enum><text>The term <term>illegal alien</term> when used to refer to an individual who is unlawfully present in the United States or who lacks a lawful immigration status in the United States.</text></paragraph></section><section id="H0A2C39A9119E4576A7812937182BEFA6"><enum>3.</enum><header>Uniform definition</header><subsection id="H752DA4AAAD1C48DDA669138A897D13ED"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">Chapter 1</external-xref> of title 1, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H3AA99C7981324958BA60F3E185151458" style="USC"><section id="H00E5459F1B9C4125B50E63CCDBB69877"><enum>9.</enum><header>Definition of <quote>foreign national</quote></header><text display-inline="no-display-inline">In determining the meaning of any Act of Congress, or of any ruling, regulation, or interpretation of various administrative bureaus and agencies of the United States, the term <term>foreign national</term> means any individual other than an individual—</text><paragraph id="H963B6C78D5D44D2297CE652EEE8B5978"><enum>(1)</enum><text display-inline="yes-display-inline">who is a citizen of the United States; or</text></paragraph><paragraph id="HEE3926CA3C074A509EE678CFAB636A23"><enum>(2)</enum><text>though not a citizen of the United States, who owes permanent allegiance to the United States.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H351A7E7E4F6C4734B73589E68878F572"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">chapter 1</external-xref> of title 1, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H6D7C5DEE19A84FA8981A4014ED38958C" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">9. Definition of <quote>foreign national</quote>. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H807DA2466AB8436186F496B839281120"><enum>4.</enum><header>References</header><subsection id="H7BB8950814744913BD9BEAC8AB3F538E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any reference in any Federal statute, rule, regulation, Executive order, publication, or other document of the United States—</text><paragraph id="H58FEEE73319B4888BBAD152458B270F0"><enum>(1)</enum><text display-inline="yes-display-inline">to the term <term>alien</term>, when used to refer to an individual who is not a citizen or national of the United States, is deemed to refer to the term <term>foreign national</term>; and</text></paragraph><paragraph id="H3ECF617603B64B2CA63BFCBFDCFB2EE5"><enum>(2)</enum><text display-inline="yes-display-inline">to the term <term>illegal alien</term>, when used to refer to an individual who is unlawfully present in the United States or who lacks a lawful immigration status in the United States, is deemed to refer to the term <term>undocumented foreign national</term>.</text></paragraph></subsection><subsection id="H246426305047475299DC8FDE94D7ACC6"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="H6C98E30E5B8E4202AA05F6D813F0ADCA"><enum>(1)</enum><text display-inline="yes-display-inline">Section 421(5)(A)(ii)(II) of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/658">2 U.S.C. 658(5)(A)(ii)(II)</external-xref>) is amended by striking <quote>illegal aliens</quote> and inserting <quote>undocumented foreign nationals</quote>.</text></paragraph><paragraph id="H7F2DB0AABA4C41E0A3A1AE2D70D7BA6A"><enum>(2)</enum><text display-inline="yes-display-inline">Section 432(e) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/240">6 U.S.C. 240(e)</external-xref>) is amended by striking <quote>illegal alien</quote> and inserting <quote>undocumented foreign national</quote>.</text></paragraph><paragraph id="HA8D54F1317DF481A8F1C2CEC7BFEE210"><enum>(3)</enum><text display-inline="yes-display-inline">Section 439 of the Antiterrorism and Effective Death Penalty Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1252c">8 U.S.C. 1252c</external-xref>) is amended in the section heading by striking <quote><header-in-text level="section" style="OLC">illegal aliens</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">undocumented foreign nationals</header-in-text></quote>.</text></paragraph><paragraph id="HDA09B36DB6664477A2938B0EEA922354"><enum>(4)</enum><text display-inline="yes-display-inline">Section 280(b)(3)(A)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1330">8 U.S.C. 1330(b)(3)(A)(iii)</external-xref>) is amended by striking <quote>illegal aliens</quote> and inserting <quote>undocumented foreign nationals</quote>.</text></paragraph><paragraph id="H49B23A543F8E43A2A21A5F6C549009C8"><enum>(5)</enum><text display-inline="yes-display-inline">Section 286(r)(3)(ii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(r)(3)(ii)</external-xref>) is amended by striking <quote>illegal aliens</quote> and inserting <quote>undocumented foreign nationals</quote>.</text></paragraph><paragraph id="H7AB64B277A9F42D383F202D807C0C9B1"><enum>(6)</enum><text display-inline="yes-display-inline">Section 501 of the Immigration Reform and Control Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/8/1365">8 U.S.C. 1365</external-xref>) is amended—</text><subparagraph id="H6B0839810A3F4988A487F36F65909642"><enum>(A)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="OLC">illegal aliens</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">undocumented foreign nationals</header-in-text></quote>;</text></subparagraph><subparagraph id="H497CC34E58A147AAA1E9E0E03A005BFE"><enum>(B)</enum><text>in the subsection heading for subsection (b), by striking <quote><header-in-text level="subsection" style="OLC">Illegal aliens</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Undocumented foreign nationals</header-in-text></quote>; and</text></subparagraph><subparagraph id="HDAC413235DAC41EB954B52887C430087"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>illegal alien</quote> each place such term appears and inserting <quote>undocumented foreign national</quote>.</text></subparagraph></paragraph><paragraph id="H635F65C4413B4B71B977907708B4184B"><enum>(7)</enum><text display-inline="yes-display-inline">Section 332 of the Omnibus Consolidated Appropriations Act, 1997 (<external-xref legal-doc="usc" parsable-cite="usc/8/1366">8 U.S.C. 1366</external-xref>) is amended by striking <quote>illegal aliens</quote> each place such term appears and inserting <quote>undocumented foreign nationals</quote>.</text></paragraph><paragraph id="HE59B2C026A94411CB6DD62945928AA7C"><enum>(8)</enum><text display-inline="yes-display-inline">Section 411(d) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1621">8 U.S.C. 1621(d)</external-xref>) is amended in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">illegal aliens</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">undocumented foreign nationals</header-in-text></quote>.</text></paragraph><paragraph id="H2CD81B18FEBC4BE59DA5C13A1250DFC5"><enum>(9)</enum><text display-inline="yes-display-inline">Section 106(e) of the Public Works Employment Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/42/6705">42 U.S.C. 6705(e)</external-xref>) is amended in the subsection heading by striking <quote><header-in-text level="subsection" style="OLC">illegal aliens</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">undocumented foreign nationals</header-in-text></quote>.</text></paragraph><paragraph id="H8A94E29CA2834BA0B64662277748E040"><enum>(10)</enum><text display-inline="yes-display-inline">Section 40125(a)(2) of title 49, United States Code, is amended by striking <quote>illegal aliens</quote> and inserting <quote>undocumented foreign nationals</quote>.</text></paragraph></subsection></section></legis-body></bill>
