case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a categorical exclusion to improve or restore National Forest System land or public land or reduce the risk of wildfire, and for other purposes.</official-title></form><legis-body id="H69688F440A8749618A82C1AA6ECB0CB0" style="OLC"><section id="HB70DC5AAE1444D3E96FC336F0F890568" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Causing Alarming Tree, Air, and Soil Trauma Resulting from Obstructive Progressives’ and Hypocritical Environmentalists’ Schemes Act</short-title></quote> or the <quote><short-title>Stop CATASTROPHES Act</short-title></quote>.</text></section><section id="H249B60F1DA2146278FB4218FAA979310"><enum>2.</enum><header>Categorical exclusion to improve or restore national forest system lands or public land or reduce the risk of wildfire</header><subsection id="H8CBBCE884C9844DD922C6A43A878DED2"><enum>(a)</enum><header>Categorical exclusion established</header><text>Forest management activities described in subsection (b) are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection><subsection id="H0B553CCFFB6D4952A8CA727999AB2B75"><enum>(b)</enum><header>Forest management activities designated for categorical exclusion</header><paragraph id="H52A30A6E75A9497EA483BF2499FB283E"><enum>(1)</enum><header>Designation</header><text>The forest management activities designated under this section for a categorical exclusion are forest management activities described in paragraph (2) that are carried out by the Secretary concerned on National Forest System Lands or public lands where the primary purpose of such activity is to improve or restore such lands or reduce the risk of wildfire on such lands.</text></paragraph><paragraph id="H181A6944796C409397B317153ED41F62"><enum>(2)</enum><header>Activities authorized</header><text>The following activities may be carried out pursuant to the categorical exclusion established under subsection (a):</text><subparagraph id="H11706AB4B38B41F4A4ED0666C6AC88C2"><enum>(A)</enum><text>Removal of noxious weeds through late-season livestock grazing, targeted livestock grazing, prescribed burns, or mechanical treatments.</text></subparagraph><subparagraph id="H9C96137DEDF94D4ABBAE643F512E3296"><enum>(B)</enum><text>Performance of hazardous fuels management.</text></subparagraph><subparagraph id="H8E35647A434740E0812BF6BFCF267BA0"><enum>(C)</enum><text>Creation of fuel and fire breaks.</text></subparagraph><subparagraph id="HCDC83CC0DD9843849F4CCC5F887BD661"><enum>(D)</enum><text>Modification of existing fences in order to distribute livestock and help improve wildlife habitat.</text></subparagraph><subparagraph id="HCF6D857BD35B4D7BAF3ABCD166464357"><enum>(E)</enum><text>Installation of erosion control devices.</text></subparagraph><subparagraph id="H8AB196ACB5FB401B9A40BC172B55A6E3"><enum>(F)</enum><text>Construction of new permanent infrastructure and maintenance of existing permanent infrastructure, including stock ponds, water catchments, and water spring boxes used to benefit livestock and improve wildlife habitat.</text></subparagraph><subparagraph id="H516141C0FAE443FA9F8B818D2721B9C7"><enum>(G)</enum><text>Performance of soil treatments, native and non-native seeding, and planting and transplanting of sagebrush, grass, forb, shrub, and other species of grass.</text></subparagraph><subparagraph id="HFC72C337760A49A7A63E2FCA41E48892"><enum>(H)</enum><text>Use of herbicides, so long as the Secretary concerned determines that the activity is otherwise conducted consistently with any forest plan applicable to the area covered by the activity.</text></subparagraph></paragraph></subsection><subsection id="H5892F54C80934952B95FCDAF43FCFAE0"><enum>(c)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text></subsection><subsection id="HD6387C16A07B41C3AEF5193B081D0240"><enum>(d)</enum><header>Acreage limitations</header><text>A forest management activity covered by the categorical exclusion established under subsection (a) may not exceed 10,000 acres.</text></subsection><subsection id="H1003A7336BF74B6B96A70E239BADE3CE"><enum>(e)</enum><header>Exclusions</header><text>The authorities provided by this Act do not apply with respect to any National Forest System lands or public lands—</text><paragraph id="H5F386A715F0A4867A7658E70211B6291"><enum>(1)</enum><text>that are included in the National Wilderness Preservation System;</text></paragraph><paragraph id="H0C0C4098C0F94454BC0600D52356BF1D"><enum>(2)</enum><text>that are located within a national or State-specific inventoried roadless area established by the Secretary of Agriculture through regulation, unless—</text><subparagraph id="H1B1072FF05B44A85866D12EC80EB20B6"><enum>(A)</enum><text>the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; or</text></subparagraph><subparagraph id="H16C087482D0B428A90E344FA3D6D6E9E"><enum>(B)</enum><text>the Secretary concerned determines the activity is allowed under the applicable roadless rule governing such lands; or</text></subparagraph></paragraph><paragraph id="HB83E77BD1A214DC9935F1329D1017990"><enum>(3)</enum><text>on which timber harvesting for any purpose is prohibited by Federal statute.</text></paragraph></subsection><subsection id="HB3C01C8A29AE462F838B97061704FE90"><enum>(f)</enum><header>Definitions</header><text>In this Act—</text><paragraph id="HC5156152AC7F41398DCB7CD9A9286BBF"><enum>(1)</enum><header>Forest management activity</header><text>The term <term>forest management activity</term> means a project or activity carried out by the Secretary concerned on National Forest System lands or public lands consistent with the forest plan covering such lands.</text></paragraph><paragraph id="HC426BA6DAC9F4B30B65CC9DD7275CD1D"><enum>(2)</enum><header>Forest plan</header><text>The term <term>forest plan</term> means—</text><subparagraph id="HCEF7F9E0500E4F4FAAB5CAF85AE3549A"><enum>(A)</enum><text>a land use plan prepared by the Bureau of Land Management for public lands pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); or</text></subparagraph><subparagraph id="HE5122070D8064C87998805C7F8E5C9D4"><enum>(B)</enum><text>a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></subparagraph></paragraph><paragraph id="HDE9062764D66442EAA804C9DFD13835F"><enum>(3)</enum><header>Hazardous fuels management</header><text>The term <term>hazardous fuels management</term> means any vegetation management activities that reduce the risk of wildfire.</text></paragraph><paragraph id="H265A7E0ECBBD4FA0BE1CF725DE73349F"><enum>(4)</enum><header>Late-season grazing</header><text>The term <term>late-season grazing</term> means grazing activities that occur—</text><subparagraph id="HD57D3E0C248E4A928A48957DCDF2550C"><enum>(A)</enum><text>after both the invasive species and native perennial species have completed their current-year annual growth cycle; and</text></subparagraph><subparagraph id="H23F2A6FEABA2429A8C494827B3355BCF"><enum>(B)</enum><text>before new plant growth begins to appear in the following year.</text></subparagraph></paragraph><paragraph id="H33B452044CE74501A09B8179DEA4A3C5"><enum>(5)</enum><header>National forest system</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H1E36436B86B94531A26815081574C24D"><enum>(6)</enum><header>Noxious weeds</header><text>The term <term>noxious weeds</term> includes juniper trees, medusahead rye, conifer trees, piñon pine trees, cheatgrass, and other noxious or invasive weeds specified on a Federal or State noxious weed list.</text></paragraph><paragraph id="H6124EB32171640B0B48C16E871E12C80"><enum>(7)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>), except that the term includes Coos Bay Wagon Road Grant lands and Oregon and California Railroad Grant lands.</text></paragraph><paragraph id="H03F7CBF3AA2540269BAAD176BEDA6C7D"><enum>(8)</enum><header>Targeted livestock grazing</header><text>The term <term>targeted livestock grazing</term> means grazing used for purposes of hazardous fuel management.</text></paragraph><paragraph id="H699676503C3B4F36A978BF74E5633B7B"><enum>(9)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="HA3446B4CE04440BF83E8683113206A8E"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph><subparagraph id="HE2078CAAA8794201A28C993A382E711E"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
