which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require a new supplemental environmental impact statement for oil and gas development in the Bakersfield Field Office planning area, and for other purposes.</official-title></form><legis-body id="HF6F84EE9AE004D9DA23F26B5112F5F44" style="OLC"><section id="HA139B00D05D745C3B4DD2CE75E5F9DBC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>California Land Protection Act</short-title></quote>.</text></section><section id="HD510A9A748FC43AEACE1060CC4CEFCE0"><enum>2.</enum><header>Delay of oil and gas development in the Bakersfield Field Office planning area</header><subsection id="H239E86A127C34D6981F5E3E64B1EE2D6"><enum>(a)</enum><header>New supplemental environmental impact statement required</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Record of Decision for the Bakersfield Field Office Hydraulic Fracturing published on December 12, 2019, shall have no force or effect until the Director of the Bureau of Land Management completes and circulates for public comment a new supplemental environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>) that considers the environmental effects of all oil and gas development in the Bakersfield Field Office planning area, as such area is described by the Director of the Bureau of Land Management, including considering the effects on—</text><paragraph id="H1BDA596DC9DB48549D51140F41A7156F" display-inline="no-display-inline"><enum>(1)</enum><text>air quality;</text></paragraph><paragraph id="H3348C13CF5BA4DE49FAD2F4FA8631396"><enum>(2)</enum><text>greenhouse gas emissions and the climate;</text></paragraph><paragraph id="HBB16AF944DA64E2B8FAD4CFFAAC630E4"><enum>(3)</enum><text>groundwater quality and availability;</text></paragraph><paragraph id="H38A4E6BBB3D54C47ABA9DE773EDDF15A"><enum>(4)</enum><text>surface water quality and availability;</text></paragraph><paragraph id="HDF802A3A81A442D48670E71CC7865F81"><enum>(5)</enum><text>seismicity;</text></paragraph><paragraph id="H8944546365DB4F638921B514154FC68C"><enum>(6)</enum><text>wildlife and plant species, including threatened species and endangered species; and</text></paragraph><paragraph id="H2703E6663A9948328FE630D5BEA277FD"><enum>(7)</enum><text>low-income communities, communities of color, and indigenous communities, including federally- and State-recognized Indian Tribes.</text></paragraph></subsection><subsection id="HBAE2C68FD0694AE196BCD8C1E19DB087"><enum>(b)</enum><header>Environmental Protection Agency review</header><paragraph id="HA6BD752A49E348F780AE6096BC2F45F5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the supplemental environmental impact statement required by subsection (a) is published, the Administrator of the Environmental Protection Agency shall review and publish comments regarding such statement, including by—</text><subparagraph id="H3DF691565E4D48C696E431CD3AF624CF" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">identifying whether there would be any significant environmental impacts of oil and gas leasing in the Bakersfield Field Office planning area that should be avoided to adequately protect the natural resources of such area; or</text></subparagraph><subparagraph id="H01EC7A51B3DE4B759FB649BF8AEF269F"><enum>(B)</enum><text display-inline="yes-display-inline">making a determination whether the new supplemental environmental impact statement required by subsection (a) contains sufficient information to assess the environmental impacts of all oil and gas development in the Bakersfield Field Office planning area.</text></subparagraph></paragraph><paragraph id="H8C473799579740FC817999614B06A913"><enum>(2)</enum><header>Effect of determination of insufficient information</header><text>If the Administrator of the Environmental Protection Agency identifies a significant impact under paragraph (1)(A) or determines there is insufficient information under paragraph (1)(B), the Director of the Bureau of Land Management shall consult with the Administrator before taking any action to proceed with Federal oil and gas leasing in the Bakersfield Field Office planning area.</text></paragraph></subsection></section></legis-body></bill>
