which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require that only two alternatives be considered with respect to certain proposed collaborative forest management activities, and for other purposes.</official-title></form><legis-body id="H993427F41AB645859F1497891C9ACA50" style="OLC"><section id="H66FD66C9313A4743A514EE1EC3E2E148" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Action Versus No Action Act</short-title></quote>.</text></section><section id="HB4A22F3C7152476483DA348E5C8E3BB4"><enum>2.</enum><header>Analysis of only two alternatives (action versus no action) in proposed collaborative forest management activities</header><subsection id="HA663697495B84093A18867F3821258DB"><enum>(a)</enum><header>Application to certain environmental assessments and environmental impact statements</header><text>This section shall apply whenever the Secretary concerned prepares an environmental assessment or an environmental impact statement pursuant to section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>) for a forest management activity that—</text><paragraph id="HD7A8FEBD6CDE4AD88C640DD3919EA481"><enum>(1)</enum><text>will occur on lands identified as the Secretary concerned as suitable for timber production; and</text></paragraph><paragraph id="H9E526C7E305E4C419619E3781EA3D525"><enum>(2)</enum><text>meets at least one of the following conditions:</text><subparagraph id="H19B0E66C013B4F44BB5034BF1CEDBEFC"><enum>(A)</enum><text>The forest management activity will occur on lands designated by the Secretary (or designee thereof) pursuant to section 602(b) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591a">16 U.S.C. 6591a(b)</external-xref>), notwithstanding whether such forest management activity is initiated prior to the date of enactment of this Act. </text></subparagraph><subparagraph id="HE5BF2CB9EBFD45268B95DE547737EE3D"><enum>(B)</enum><text>The forest management activity is developed through a collaborative process.</text></subparagraph><subparagraph id="H8FB8789C9FEC4E95AA47CE4EB7D135C2"><enum>(C)</enum><text display-inline="yes-display-inline">The forest management activity is proposed by a resource advisory committee.</text></subparagraph><subparagraph id="HD8D6CDF4F0294953A59A8C3B4412BB61"><enum>(D)</enum><text display-inline="yes-display-inline">The forest management activity is covered by a community wildfire protection plan.</text></subparagraph></paragraph></subsection><subsection id="H70856878005444D991AD23DFDC642831"><enum>(b)</enum><header>Consideration of alternatives</header><text>In the case of an environmental assessment or environmental impact statement described in subsection (a), the Secretary concerned shall study, develop, and describe only the following two alternatives:</text><paragraph id="H4807D04598554BD7B4E3D4EE855C78C7"><enum>(1)</enum><text>The forest management activity.</text></paragraph><paragraph id="HBB1DC9DDB5BE44C0878A21B96B223CF4"><enum>(2)</enum><text>The alternative of no action.</text></paragraph></subsection><subsection id="H0AE28EB3B5594A228105B60C2A012D26"><enum>(c)</enum><header>Elements of no action alternative</header><text>In the case of the alternative of no action described in subsection (b)(2), the Secretary concerned shall consider whether to evaluate—</text><paragraph id="H4900CE6B0E414031B20E196E6FE93C71"><enum>(1)</enum><text>the effect of no action on—</text><subparagraph id="H51AD76351CF94075AE97EB8BC7F56801"><enum>(A)</enum><text>forest health;</text></subparagraph><subparagraph id="H920CA2284D834A93B5681D4A1A4ABE62"><enum>(B)</enum><text>potential losses of life and property;</text></subparagraph><subparagraph id="HE78672D20E4548B194CA6E93CDBD025A"><enum>(C)</enum><text>habitat diversity;</text></subparagraph><subparagraph id="H97869731800041E0B871C7250BA4F2AC"><enum>(D)</enum><text>wildfire potential;</text></subparagraph><subparagraph id="HFD816ED63F244D1DBCF5B0E30CB1730E"><enum>(E)</enum><text>insect and disease potential; and</text></subparagraph><subparagraph id="H21A20A7865914B66A5F03E8E91B55AB9"><enum>(F)</enum><text>timber production; and</text></subparagraph></paragraph><paragraph id="H327B4157D87648479B7A449417CF7406"><enum>(2)</enum><text>the implications of a resulting decline in forest health, loss of habitat diversity, wildfire, or insect or disease infestation (given fire and insect and disease historic cycles) on—</text><subparagraph id="H729B2DAC7C384076809779581BD4B536"><enum>(A)</enum><text>potential losses of life and property;</text></subparagraph><subparagraph id="H9B7F989862204DB1A35F5438AC174831"><enum>(B)</enum><text>domestic water supply in the project area;</text></subparagraph><subparagraph id="H79672D02F9484FCBA6B1B93C400408E9"><enum>(C)</enum><text>wildlife habitat loss; and</text></subparagraph><subparagraph id="HDB23413324B74EFBA48108EB71316F4C"><enum>(D)</enum><text>other economic and social factors.</text></subparagraph></paragraph></subsection><subsection id="H16CC930159BC48C5B270217EFE819CB1"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H75960533DAC84D7DB594F0669D7F5D0E"><enum>(1)</enum><header>Collaborative process</header><text>The term <term>collaborative process</term> means a process relating to the management of National Forest System lands or public lands by which a project or forest management activity is developed and implemented by the Secretary concerned through collaboration with interested persons, as described in section 603(b)(1)(C) of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591b">16 U.S.C. 6591b(b)(1)(C)</external-xref>).</text></paragraph><paragraph id="H2DD9756D16404A31941C4273FF16EFE6"><enum>(2)</enum><header>Community wildfire protection plan</header><text display-inline="yes-display-inline">The term <term>community wildfire protection plan</term> has the meaning given the term in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph><paragraph id="H18F3A545E88F4BBEBAC4F4F0BC9B9B25"><enum>(3)</enum><header>Resource advisory committee</header><text display-inline="yes-display-inline">The term <term>resource advisory committee</term> has the meaning given the term in section 201 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7121">16 U.S.C. 7121</external-xref>).</text></paragraph><paragraph id="HCDBB025B3BD34DC8ADB3AEF42C22AD9D"><enum>(4)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="H193434D1ECA54FB182B165D433145C07"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph><subparagraph id="H1FB9842504FC4026BB70A680FEEDCBE9"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
