which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to require transportation planners to consider projects and strategies to reduce greenhouse gas emissions, and for other purposes.</official-title></form><legis-body id="H9525075C9E1B45A4AF9773A0206C8977" style="OLC"><section id="HE2712EB94D79498A8CE22E70AB669264" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Generating Resilient, Environmentally Exceptional National Streets Act</short-title></quote> or the <quote><short-title>GREEN Streets Act</short-title></quote>.</text></section><section id="HD43A75B2E70946C89BB863C1F6D80865"><enum>2.</enum><header>Consideration of projects and strategies to reduce greenhouse gas emissions</header><subsection id="H97E11473695846AC8401072FC2D2B801"><enum>(a)</enum><header>National goals and performance management measures</header><text>Section 150 of title 23, United States Code, is amended—</text><paragraph id="H5777A365973E4C72B33A74E2F8ACF1A5"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H612D379244ED4E368F1B1B1BC2618931"><enum>(A)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></subparagraph><subparagraph id="HC6C969529047437386614885FEA8C203"><enum>(B)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block display-inline="no-display-inline" id="H0648110CBD0D421D8AB3201F0FD3EAAE" style="OLC"><paragraph id="H0BB6058A6F1A4D1896631EDE26104436"><enum>(7)</enum><header>Combating climate change</header><text>To reduce carbon dioxide and other greenhouse gas emissions and improve the resilience of the transportation system.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF1176A8DF7DA430CBB09AD224C6E6F8D"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph commented="no" id="H79D6AA81796B4996BB840B85D9EF98D2"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" id="H18356F10DD504AB782B801B039CF33FA"><enum>(i)</enum><text>by striking the paragraph designation and all that follows through <quote>Not later</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HF35A202F72D546DFB94751CC3AF5207F" style="OLC"><paragraph commented="no" id="H363794CA058D4760A2A541C9274EA575"><enum>(1)</enum><header>Rulemaking</header><subparagraph commented="no" id="HA36A547A337249C1817809373D43A004"><enum>(A)</enum><header>In general</header><text>Not later</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" id="HBA70BB73AEF14FE5A4632D513B8F564D"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8E0E0D0B0C33497697EC1F220C0EA380" style="OLC"><subparagraph commented="no" id="H79FCE3CF86D446BFA1019CA4F36D1B44"><enum>(B)</enum><header>Updates</header><text>The Secretary shall periodically update the rulemaking promulgated under subparagraph (A) as necessary, including to implement the amendments made to this section by the <short-title>GREEN Streets Act</short-title>.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="H9D0A02964B2F45B78361844F5C04C68A"><enum>(B)</enum><text>in paragraph (5)—</text><clause commented="no" id="H0250820AD8454486B2DE33EF026595DF"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" id="H6DA1232456F74EE2AC28BF0CFF3C2CFE"><enum>(ii)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" id="H2FDE3038D4C44AB1BC1134C32E3BB436"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H04634D51501D4514991E5D18B39A4919" style="USC"><subparagraph commented="no" id="HBC4F2ABB4B7C4708B7F26D8C66C0E351"><enum>(C)</enum><text>transit accessibility (as defined in section 5326(a) of title 49);</text></subparagraph><subparagraph commented="no" id="H02C68CE14EA34E1ABBCD9BDE59B0393A"><enum>(D)</enum><text>transit stop distance (as defined in section 5326(a) of title 49); and</text></subparagraph><subparagraph commented="no" id="H5E6E280E3F52496DA39ECA1716FA94F2"><enum>(E)</enum><text>transit mode share (as defined in section 5326(a) of title 49).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HBE5C16A78ABE4AC892B2D8C8E59ABF9E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0E3B7D74C8D24A3D80216B7C1E2A32C8" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HF9D79C6893124AAAB7540284D65C7F5D"><enum>(7)</enum><header display-inline="yes-display-inline">Greenhouse gas emissions on public roads</header><text display-inline="yes-display-inline">For the purpose of carrying out section 119(f)(3), the Secretary shall establish—</text><subparagraph id="H3C00F98EA64F43C4BCD59560E297031C"><enum>(A)</enum><text>minimum standards for States to use in decreasing per capita vehicle miles traveled on public roads, including through—</text><clause id="H12E9B0ED02824FB69999583A4944717D"><enum>(i)</enum><text>alignment of zoning and land use policy and planning;</text></clause><clause id="H1D0803161DE7409D95A2B1BD7228853B"><enum>(ii)</enum><text>investment in active and safe transportation infrastructure, such as sidewalks, trails, and bike lanes; and</text></clause><clause id="H1D2AB5638F3B4566AA86D7D310278BC0"><enum>(iii)</enum><text>public transit;</text></clause></subparagraph><subparagraph id="H0B33A0C4CEF44546B39289E07C5C9835"><enum>(B)</enum><text>minimum standards for States to use in improving the resilience of public roads;</text></subparagraph><subparagraph id="H404F7EE2B7874E43B5A986264554CD7A"><enum>(C)</enum><text>in consultation with the Administrator of the Environmental Protection Agency, minimum standards for the reduction of greenhouse gas emissions on public roads, with the goal of achieving net-zero emissions; and</text></subparagraph><subparagraph id="H0E2A1DD5AA944AB4897C0395D883657A"><enum>(D)</enum><text>measures for States to use to assess—</text><clause id="H2C2569BCD8D5400EBD02F1D0D0B49314"><enum>(i)</enum><text>carbon dioxide emissions on public roads; and</text></clause><clause id="HBF7364AB84C640F1B343D467B544A796"><enum>(ii)</enum><text>any other greenhouse gas emissions on public roads, as determined to be appropriate by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H9B33BC6DAC564204BD870970A3171651"><enum>(3)</enum><text>in subsection (d)(1)—</text><subparagraph commented="no" id="H3CEDE3041C4E496E8A1426CAF18CF860"><enum>(A)</enum><text>by striking <quote>subsection (c), each State shall set</quote> and inserting <quote>subsection (c)(1)(A), and not later than 1 year after each update of that rulemaking under subsection (c)(1)(B), each State shall set or update, as applicable,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2656E199DF404575BC35923BF23B4E42"><enum>(B)</enum><text>by striking <quote>and (6)</quote> and inserting <quote>(6), and (7)</quote>.</text></subparagraph></paragraph></subsection><subsection id="H9DA05EE9289044A88AC6B957FAFFCE6F"><enum>(b)</enum><header>Metropolitan transportation planning</header><paragraph id="HEFF55EC5373842FAB9C1DBE445DDAECD"><enum>(1)</enum><header>Federal-aid highways</header><text>Section 134(h) of title 23, United States Code, is amended—</text><subparagraph id="H3CAE0D422DB04D0D835F89D42DD10E17"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HDC84FCF834A24C0FB7AAEE909A5BE7B1"><enum>(i)</enum><text>by redesignating subparagraphs (F) through (J) as subparagraphs (H) through (L), respectively; and</text></clause><clause id="H69AE0F6441074C289E1A5612FB549234"><enum>(ii)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block display-inline="no-display-inline" id="HF5D346AC4E714339B2D645E77E999B66" style="OLC"><subparagraph id="H556E2F0C626D42889D8240778D38D04D"><enum>(F)</enum><text>reduce carbon dioxide and other greenhouse gas emissions;</text></subparagraph><subparagraph id="HD849ECDC4D9E414EAB1732A08263EA75"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H7728CAA559FB45A280B14691D53835AF"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H0CEDD3428FE7484494D6DF23610AC54C" style="OLC"><paragraph id="HDCE9E005843D46F1A44A82C048FCF05A"><enum>(4)</enum><header>Analysis of projects that increase traffic capacity</header><text>In furtherance of the planning goals described in subparagraphs (F) and (G) of paragraph (1), a metropolitan planning organization shall conduct and publish an analysis of the impact on per capita vehicle miles traveled, mobile source greenhouse gas emissions, and non-single-occupancy-vehicle trips, including trips by bicycle, pedestrian travel, public transportation, and passenger rail, prior to approval of each project within the metropolitan planning area that—</text><subparagraph id="H1DDBC0B70C0C4283A161381D04AF904A"><enum>(A)</enum><text>uses funds made available under this title to increase traffic capacity, including—</text><clause id="HD03A3E766AC3473ABE0EE1BB53884D7F"><enum>(i)</enum><text>by adding new travel lanes, including on an existing road; or</text></clause><clause id="H52B9626B5AB44D089B3FD853C1C1C845"><enum>(ii)</enum><text>by converting shoulder lanes into new travel lanes; and</text></clause></subparagraph><subparagraph id="H0A1FDC9004E74DB39D774181648BE531"><enum>(B)</enum><text>is projected to receive not less than $25,000,000 of Federal funds made available under this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H004D1695D7FE4531BF738E198681EC43"><enum>(2)</enum><header>Public transportation</header><text>Section 5303(h)(1) of title 49, United States Code, is amended—</text><subparagraph id="HE3F5BA251B96404FB873CE05296DC2B6"><enum>(A)</enum><text>by redesignating subparagraphs (F) through (I) as subparagraphs (H) through (K), respectively; and</text></subparagraph><subparagraph id="H349961D87BE24085A5B613E0CE56FB31"><enum>(B)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block display-inline="no-display-inline" id="H6EA332C7777F44CA9D509D84179E45CE" style="OLC"><subparagraph id="HEFFE61A71F5B42698CC0AD996FAF1E0E"><enum>(F)</enum><text>reduce carbon dioxide and other greenhouse gas emissions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H661696796046476C809B0B6ECBB15DA3"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H91C134C1B3F4426CA0177CEFD0021950"><enum>(c)</enum><header>Statewide and nonmetropolitan transportation planning</header><paragraph id="H68060E9495764B7A8077FA606283CE86"><enum>(1)</enum><header>Federal-aid highways</header><text>Section 135(d) of title 23, United States Code, is amended—</text><subparagraph id="H42724172E8374C0794860CEE1A1590B8"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HF796096A5FFC4B2FBA557C716609D35A"><enum>(i)</enum><text>by redesignating subparagraphs (F) through (J) as subparagraphs (H) through (L), respectively; and</text></clause><clause id="H483E12D7B6A64AE68BAA485D780D7123"><enum>(ii)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block display-inline="no-display-inline" id="HB55CBBE9BCA349639A676F103547BB38" style="OLC"><subparagraph id="HF58FF6B090284B01960DF37D05317927"><enum>(F)</enum><text>reduce carbon dioxide and greenhouse gas emissions;</text></subparagraph><subparagraph id="H21163C5960D540B58D391E12327DE8FB"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H54AAB52B652B406987137246AD9AC073"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1E5197ADE5284DC7985602C16E0DCFDC" style="OLC"><paragraph id="HDAFF29B50C8F4D6CBB386C9815A12E4F"><enum>(4)</enum><header>Analysis of projects that increase traffic capacity</header><text>In furtherance of the planning goals described in subparagraphs (F) and (G) of paragraph (1), a State shall conduct and publish an analysis of the impact on per capita vehicle miles traveled, mobile source greenhouse gas emissions, and non-single-occupancy-vehicle trips, including trips by bicycle, pedestrian travel, public transportation, and passenger rail, prior to approval of each project within the State that—</text><subparagraph id="H51F5EA6148834862B3A682F11C3A7633"><enum>(A)</enum><text>uses funds made available under this title to increase traffic capacity, including—</text><clause id="HA03162A64E474396BD483842B5FBFF60"><enum>(i)</enum><text>by adding new travel lanes, including on an existing road; or</text></clause><clause id="H2598C4CAE1B54D02BFBF9650BDD8A860"><enum>(ii)</enum><text>by converting shoulder lanes into new travel lanes; and</text></clause></subparagraph><subparagraph id="H0A9D9BDD0ACC4E228DEE7EE0E4DD1C96"><enum>(B)</enum><text>is projected to receive not less than $25,000,000 of Federal funds made available under this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H21B6CED0CFA6462D93F3ED3D77710648"><enum>(2)</enum><header>Public transportation</header><text>Section 5304(d)(1) of title 49, United States Code, is amended—</text><subparagraph id="HF094B229883B4FD7B6375884CDCF2BD5"><enum>(A)</enum><text>by redesignating subparagraphs (F) through (I) as subparagraphs (H) through (K), respectively; and</text></subparagraph><subparagraph id="H8D6CCC736D87405983B1D950B7CE4679"><enum>(B)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block display-inline="no-display-inline" id="H955A66B2F5824F5A825A8D8DFBEA2589" style="OLC"><subparagraph id="HA6AD2F10C12B4211850E741A204DA8FE"><enum>(F)</enum><text>reduce carbon dioxide and other greenhouse gas emissions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HADC9A92BD07C4E0CB1ADE9E9C1411255"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H7D4B4D90E89648BA93B1DA71E29A5906"><enum>(d)</enum><header>National highway performance program</header><text>Section 119(f) of title 23, United States Code, is amended—</text><paragraph id="HCE721154A8994E29A448B80686C620BD"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="USC">conditions</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">conditions; greenhouse gas emissions on public roads</header-in-text></quote>; and</text></paragraph><paragraph id="HB6304D0F72D24AC6AC7E58DE285ACF22"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF5D893BAD6D44C11883EAEDC0827CA61" style="OLC"><paragraph id="HD25B4E3F63C64495A10148DD18372765"><enum>(3)</enum><header>Greenhouse gas emissions on public roads</header><subparagraph id="H1C731B524EE74B8B8ADF574629EB2053"><enum>(A)</enum><header>Penalty</header><clause id="H6B6C3D41CE1C4A7C9D58703D90598F16"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), if a State reports, in a performance target report under section 150(e), that the State has not achieved the targets of the State for performance measures described in section 150(d) pertaining to the minimum standards for public roads established by the Secretary under section 150(c)(7), the State shall be required, during the following fiscal year—</text><subclause id="HC2B537B3E0094374AA655DA6E392C6E9"><enum>(I)</enum><text>to obligate, from the amounts apportioned to the State under section 104(b)(1), an amount that is not less than the amount of funds apportioned to the State for fiscal year 2009 under the Interstate maintenance program for the purpose of achieving the targets through projects on Federal-aid highways; and</text></subclause><subclause id="HE9C3208AFFF04DC68B3AFFF127C62B68"><enum>(II)</enum><text>to obligate, from the amounts apportioned to the State under section 104(b)(2) (other than amounts suballocated to metropolitan areas and other areas of the State under section 133(d)), an amount equal to 10 percent of the amount of funds apportioned to the State for fiscal year 2009 under the Interstate maintenance program for the purpose of achieving the targets through projects on Federal-aid highways.</text></subclause></clause><clause id="H65CD20C2E6024BE783A5A4664CE172C2"><enum>(ii)</enum><header>Increase</header><text>Each fiscal year after the date of enactment of this paragraph, the amount required to be obligated under clause (i)(I) shall be increased by 2 percent over the amount required to be obligated in the previous fiscal year.</text></clause></subparagraph><subparagraph id="H20B49025DEB1415693463D5F77251FB7"><enum>(B)</enum><header>Restoration</header><text>The obligation requirement in subparagraph (A)(i)(I) for a fiscal year shall remain in effect for each subsequent fiscal year until the date on which the Secretary determines that the State has achieved the targets of the State for performance measures described in section 150(d) pertaining to the minimum standards for public roads established by the Secretary under section 150(c)(7).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H04E6AF36A233430FB27CBB77677AAA23"><enum>(e)</enum><header>Transit accessibility</header><paragraph commented="no" id="H0D78F8D09D114FAB8AF89A3E9750D79D"><enum>(1)</enum><header>Transit access</header><text>Section 5326 of title 49, United States Code, is amended—</text><subparagraph commented="no" id="H3408FA44F81D459EB2DF279B345F054C"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="USC">and accessibility</header-in-text></quote> after <quote><header-in-text level="section" style="USC">management</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" id="HBB719ABF19C442FAB36E6BFEDDDFDEC4"><enum>(B)</enum><text>in subsection (a)—</text><clause commented="no" id="H74F1CC53AE534CF68960DCD9D618DAE7"><enum>(i)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (4) and (5), respectively; and</text></clause><clause commented="no" id="H6536070055A54E969D39B4D0D6BBE4B5"><enum>(ii)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block display-inline="no-display-inline" id="H60DC5E38BEB14EE8AEDAEAFBCD2AB855" style="OLC"><paragraph commented="no" id="HA6A541AABB624958A2BE005D37D608C7"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text><subparagraph commented="no" id="HACDE9A9B18544E6094DB174F48FAFB52"><enum>(A)</enum><text>any metropolitan planning area with a population of not fewer than 250,000 individuals on the date of enactment of the <short-title>GREEN Streets Act</short-title>; and</text></subparagraph><subparagraph commented="no" id="HF9809C5901DF4F9B8F383B86CCF510A3"><enum>(B)</enum><text>any State in which there exists a metropolitan planning area with a population of not fewer than 250,000 individuals on the date of enactment of the <short-title>GREEN Streets Act</short-title>.</text></subparagraph></paragraph><paragraph commented="no" id="H92EB00F5A67D4EA1AA5B5C816483FDFB"><enum>(3)</enum><header>Transit accessibility</header><text>The term <term>transit accessibility</term> means the share of jobs, health care facilities, grocery stores and other food suppliers, schools, and other destinations accessible by public transportation in any 45-minute period.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="H37B576B4467040B881A19F888D54A7CD"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H571C72FE41D54F399965DC8597C5371B" style="OLC"><paragraph commented="no" id="H678108A2E3054FFFB1A3B667A9AC27F8"><enum>(6)</enum><header>Transit mode share</header><text>The term <term>transit mode share</term> means the percentage of trips taken by public transportation for both commuting and noncommuting trips.</text></paragraph><paragraph commented="no" id="HA4B08180BD994E70B45AB5EB3F65CBDB"><enum>(7)</enum><header>Transit stop distance</header><text>The term <term>transit stop distance</term> means the average distance by census block to the nearest transit stop, passenger station, or terminal providing regularly scheduled service.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="HAC47C4241C134DA383D7E5442B042195"><enum>(D)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></subparagraph><subparagraph commented="no" id="HFD626F9E61C9465D922ECE3D612E28C5"><enum>(E)</enum><text>by inserting after subsection (b) the following:</text><quoted-block display-inline="no-display-inline" id="HAA3F3FEFEC9F425A854ABA2F2BB485EF" style="OLC"><subsection commented="no" id="HE51F1F103C6043F0A3BAD8B8B07F2AFA"><enum>(c)</enum><header>Transit access</header><paragraph commented="no" id="HEA317C3BCF1D4ED58E5838446F8EA85D"><enum>(1)</enum><header>Standards and performance measures</header><text>Not later than 1 year after the date of enactment of the <short-title>GREEN Streets Act</short-title>, the Secretary shall establish national transit access standards and performance measures for—</text><subparagraph commented="no" id="H961D7CE9D42846AD9E730D6AA2200B93"><enum>(A)</enum><text>transit accessibility;</text></subparagraph><subparagraph commented="no" id="HEF0EB0F5EF384D8BA4BB5DB73535B1E7"><enum>(B)</enum><text>transit stop distance; and</text></subparagraph><subparagraph commented="no" id="H9610F98B59D5442EA3185481FB3BD7B8"><enum>(C)</enum><text>transit mode share.</text></subparagraph></paragraph><paragraph id="H1D94DEF1F25541A3AE8E45B30AE8BA77"><enum>(2)</enum><header>Performance targets and initial report</header><text>Not later than 180 days after the date on which the Secretary establishes the standards and performance measures under paragraph (1), the Secretary shall—</text><subparagraph id="HD32B665C8F304CD19855C610949E51A5"><enum>(A)</enum><text>require each covered entity to—</text><clause id="HAB9AA247A550414897AC2A6CF29EB140"><enum>(i)</enum><text>establish targets for the covered entity relating to each of the standards and performance measures described in paragraph (1); and</text></clause><clause id="H885FDEE726AB4D94958D3FCA76C323D2"><enum>(ii)</enum><text>submit to the Secretary a report describing—</text><subclause id="H2021FD79D4284F3589432DC4EC869887"><enum>(I)</enum><text>the performance of the covered entity with respect to each of the standards and performance measures described in paragraph (1); and</text></subclause><subclause id="HF4ED5B5E5CD14979934F13C5D7A35FBD"><enum>(II)</enum><text>by functional classification, the share of housing units and roadways in the covered entity that have—</text><item id="H5A05C9EA9D2146B4B51D431FE05ABB30"><enum>(aa)</enum><text>sidewalks;</text></item><item id="HD04C60E84CD14498A3EA69C269A87E23"><enum>(bb)</enum><text>crosswalks;</text></item><item id="HFD5CFB9A7584454988F2B38BBA249D38"><enum>(cc)</enum><text>dedicated bike lanes; or</text></item><item commented="no" display-inline="no-display-inline" id="H1933463FDC1C4574AE0EA372B7CF75C0"><enum>(dd)</enum><text>other forms of dedicated nonmotorized facilities; and</text></item></subclause></clause></subparagraph><subparagraph id="H7D7781692145482088DD37AAA8DEDD64"><enum>(B)</enum><text>provide technical assistance, including analytical tools, to assist a covered entity in—</text><clause id="H6965268515DD434C9ADD899F2F17977A"><enum>(i)</enum><text>establishing targets under subparagraph (A)(i); and</text></clause><clause id="H9050654DC63E4173B128D0FA8EBE36C2"><enum>(ii)</enum><text>reporting on performance under subparagraph (A)(ii).</text></clause></subparagraph></paragraph><paragraph commented="no" id="HA555AA11BCF74F639BE2007928743FB2"><enum>(3)</enum><header>Subsequent reports</header><subparagraph commented="no" id="H80E824B083CE48A09DFF384345CE8774"><enum>(A)</enum><header>Timing</header><text>Not later than 180 days after receipt of the initial report under paragraph (2)(A)(ii), the Secretary shall establish a schedule for the submission of subsequent reports by each covered entity.</text></subparagraph><subparagraph commented="no" id="H1C598AFD3A28414C8910692437060AE9"><enum>(B)</enum><header>Contents</header><text>Each subsequent report under this paragraph shall describe—</text><clause commented="no" id="HE95798B7A50E453088919CB41C54FBB8"><enum>(i)</enum><text>the progress of the covered entity in meeting the targets of the covered entity relating to the standards and performance measures described in paragraph (1), including any change in performance since the submission of the previous report;</text></clause><clause commented="no" id="HF6822F6F9FF94594B519D62B8008EFB1"><enum>(ii)</enum><text>any revision of existing targets or establishment of new targets relating to the standards and performance measures described in paragraph (1); and</text></clause><clause commented="no" id="HA62D4584153B46A1B98BFE722FC75EB6"><enum>(iii)</enum><text>any proposal for the revision of existing targets or the establishment of new targets relating to the standards and performance measures described in paragraph (1).</text></clause></subparagraph><subparagraph commented="no" id="HDE60F5BA17E24B64ADF26DC9E40BE0DE"><enum>(C)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance, including analytical tools, to assist a covered entity in—</text><clause commented="no" id="HF0A31978EFE8478D8691ADFF368B0989"><enum>(i)</enum><text>reporting on performance under this paragraph;
