which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a categorical exclusion to expedite certain critical response actions, and for other purposes.</official-title></form><legis-body id="H6AEFB984BAFB4B7C8FC11F52D43F8585" style="OLC"><section id="HEA7E2EC077D4424AA9E809412DE51015" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting and Restoring Our Trees by Enhancing Conservation and Treatments Act</short-title></quote> or the <quote><short-title>PROTECT Act</short-title></quote>.</text></section><section id="H63D399567D8B43FF9CEB02CB7B155D76"><enum>2.</enum><header>Categorical exclusion to expedite certain critical response actions</header><subsection id="HC0FB164770784BAD8308D7BE37946697"><enum>(a)</enum><header>Categorical exclusion established</header><text>Forest management activities described in subsection (b) are a category of actions hereby designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection><subsection id="H6DCAA77EED6544E2A42E23C93B117D2B"><enum>(b)</enum><header>Forest management activities designated for categorical exclusion</header><text>The forest management activities designated under this section for a categorical exclusion are forest management activities carried out by the Secretary concerned on National Forest System lands or public lands where the primary purpose of such activity is—</text><paragraph id="H17DC749B9B4445468CE3EEBF570F739E"><enum>(1)</enum><text>to address an insect or disease infestation;</text></paragraph><paragraph id="HC35B674702E64247939F2883D6EDA57B"><enum>(2)</enum><text>to reduce hazardous fuel loads;</text></paragraph><paragraph id="H94D916101E104F8C82CECA6E765FCAC7"><enum>(3)</enum><text>to protect a municipal water source;</text></paragraph><paragraph id="H642189D580534996B0C3ACFBFBA82619"><enum>(4)</enum><text>to maintain, enhance, or modify critical habitat to protect such habitat from catastrophic disturbances;</text></paragraph><paragraph id="H896D8EF0071849AD8C2457B9FF814A47"><enum>(5)</enum><text>to increase water yield;</text></paragraph><paragraph id="H7F3C32558B66402CB272FEF76CD40204"><enum>(6)</enum><text>to remove dead or dying trees or trees at high risk of dying;</text></paragraph><paragraph id="H5997BD3047E544D79444A238195146B3"><enum>(7)</enum><text>to facilitate native species restoration; or</text></paragraph><paragraph id="HEDA5A58A289341D3AE19ACB1197DFF1E"><enum>(8)</enum><text>any combination of the purposes specified in paragraphs (1) through (7).</text></paragraph></subsection><subsection id="HA4AE280FA2434E29BA787A5CF440540F"><enum>(c)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text></subsection><subsection id="H01A7B1A788DA45A0A8185DEB092B0B38"><enum>(d)</enum><header>Acreage limitations</header><paragraph id="H73148C63440E4E3ABD92929AD6B560FB"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a forest management activity covered by the categorical exclusion established under subsection (a) may not contain treatment units exceeding a total of 10,000 acres.</text></paragraph><paragraph id="H17743FE946554C7B8B88EC7D2C5AD09E"><enum>(2)</enum><header>Larger areas authorized</header><text>A forest management activity covered by the categorical exclusion established under subsection (a) may contain treatment units exceeding a total of 10,000 acres but not more than a total of 30,000 acres if the forest management activity is—</text><subparagraph id="H7D3DCE941B4547EBAC27E4716E0D30E3"><enum>(A)</enum><text>developed through a collaborative process;</text></subparagraph><subparagraph id="H8C06497DCC87499C9CACEAAEC750E444"><enum>(B)</enum><text>proposed by a resource advisory committee; or</text></subparagraph><subparagraph id="H9A80C74F07514C8DB827C168C223F1E8"><enum>(C)</enum><text>covered by a community wildfire protection plan.</text></subparagraph></paragraph></subsection><subsection id="H81BC06F6F76345A0930F0F698CDB5C1C"><enum>(e)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The authorities provided by this Act do not apply with respect to any National Forest System lands or public lands—</text><paragraph id="HC97BB24A1C084FF7910E1B5BC8130135"><enum>(1)</enum><text>that are included in the National Wilderness Preservation System;</text></paragraph><paragraph id="HF69A8102A6F1446EA07D6D9C2D1F8105"><enum>(2)</enum><text>that are located within a national or State-specific inventoried roadless area established by the Secretary of Agriculture through regulation, unless—</text><subparagraph id="H92D14BD759544F8497E87DD5A0990262"><enum>(A)</enum><text>the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; or</text></subparagraph><subparagraph id="H64F112978D724F81B0FE9C0A8064CD25"><enum>(B)</enum><text>the Secretary concerned determines the activity is allowed under the applicable roadless rule governing such lands; or</text></subparagraph></paragraph><paragraph id="HC1E1A400858047B1848FF7105FD652AB"><enum>(3)</enum><text>on which timber harvesting for any purpose is prohibited by Federal statute.</text></paragraph></subsection><subsection id="H4D4A9EE5B14B43ACA50F2452CCCAEC83"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0B92C07C3E154EAE889849D421F29EF0"><enum>(1)</enum><header>Collaborative process</header><text>The term <term>collaborative process</term> means a process relating to the management of National Forest System lands or public lands by which a project or forest management activity is developed and implemented by the Secretary concerned through collaboration with multiple interested persons representing diverse interests.</text></paragraph><paragraph id="H8C3A045D536745C6B3114BB1A95E38FB"><enum>(2)</enum><header>Community wildfire protection plan</header><text>The term <term>community wildfire protection plan</term> has the meaning given that term in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>).</text></paragraph><paragraph id="H764EDF803BA244ACBC1C328179FCB664"><enum>(3)</enum><header>Forest management activity</header><text>The term <term>forest management activity</term> means a project or activity carried out by the Secretary concerned on National Forest System lands or public lands consistent with the forest plan covering such lands.</text></paragraph><paragraph id="HB41B3E53F486410CB5B9D3077BD397A0"><enum>(4)</enum><header>Forest plan</header><text>The term <term>forest plan</term> means—</text><subparagraph id="H79D1BBAA6C0446CB8BEFA117A5020E64"><enum>(A)</enum><text>a land use plan prepared by the Bureau of Land Management for public lands pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>); or</text></subparagraph><subparagraph id="H9E1C83D2B51D471CBB228E744620B0BB"><enum>(B)</enum><text>a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></subparagraph></paragraph><paragraph id="HBC130666AAF14E4C826F981F4D868E39"><enum>(5)</enum><header>National forest system</header><text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H7714664499064C93ADB22AB94DE80048"><enum>(6)</enum><header>Public lands</header><text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>), except that the term includes Coos Bay Wagon Road Grant lands and Oregon and California Railroad Grant lands.</text></paragraph><paragraph id="H8F5721A8989742448E17F1B450749BB4"><enum>(7)</enum><header>Resource advisory committee</header><text>The term <term>resource advisory committee</term> has the meaning given that term in section 201 of the Secure Rural Schools and Community Self-Determination Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/7121">16 U.S.C. 7121</external-xref>).</text></paragraph><paragraph id="H18DBA4D5879F4218862EE85C5D3FE456"><enum>(8)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="H4842B030005C4D4283C21FBE460B8265"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph><subparagraph id="H8BC0E36B604F4A76983BDB91ACD3C052"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
