which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a biochar demonstration project for federally recognized Indian Tribes and Alaska Native corporations to support the development and commercialization of biochar.</official-title></form><legis-body id="H6CC6AC51096C427D87B6447ED7CDC97A" style="OLC"><section id="HD48CC50F082D41FCB7CAFC7DAD307E70" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Biochar Promotion Act of 2021</short-title></quote>.</text></section><section id="H0D9DB87E8C9045F1BBD0C0E17EB0FD7F" section-type="subsequent-section"><enum>2.</enum><header>Tribal and Alaska Native Biochar Demonstration Project</header><text display-inline="no-display-inline">The Tribal Forest Protection Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/25/3115a">25 U.S.C. 3115a et seq.</external-xref>) is amended as follows:</text><paragraph id="HD47C2D0AD3B04322B9517B7A13A05A9C"><enum>(1)</enum><text>In section 2—</text><subparagraph id="H70EE2B2F15A54BC6A9A2BAD74E4A969E"><enum>(A)</enum><text>by striking subsection (a);</text></subparagraph><subparagraph id="H75E6A015D9A343158D14040D90F39822"><enum>(B)</enum><text>by redesignating subsections (b) through (g) as subsections (a) through (f), respectively,</text></subparagraph><subparagraph id="HA1A038453D5A4A11BB8E263EFE22B7E1"><enum>(C)</enum><text>by striking <quote>subsection (b)</quote> each place it appears and inserting <quote>subsection (a)</quote>; and</text></subparagraph><subparagraph id="HBD6A293C65E74039AA429593DBCB2786"><enum>(D)</enum><text>by striking <quote>subsection (c)</quote> each place it appears and inserting <quote>subsection (b)</quote>. </text></subparagraph></paragraph><paragraph id="HB29C80E962E349738ADCB0B40F59D67B"><enum>(2)</enum><text>By adding at the end the following:</text><quoted-block id="H696A8B6736FF41348DF493B5EAF47700" style="OLC"><section id="HB7FBBD9DF43A4B07954B8234980FA6F8"><enum>3.</enum><header>Tribal and Alaska Native Biochar Demonstration Project</header><subsection id="HE7483C5E779F4E699281C8A7E3E0D053"><enum>(a)</enum><header>Stewardship contracts or similar agreements</header><text>For each of fiscal years 2021 through 2030, the Secretary shall enter into stewardship contracts or similar agreements (excluding direct service contracts) with Indian Tribes or Tribal organizations to carry out demonstration projects to support the development and commercialization of biochar on Indian forest land or rangeland and in nearby communities by providing reliable supplies of feedstock from Federal land.</text></subsection><subsection id="H009790D9452045F09BFFB424012458E0"><enum>(b)</enum><header>Demonstration projects</header><text>In each fiscal year for which demonstration projects are authorized under this section, not less than 4 new demonstration projects that meet the eligibility criteria described in subsection (c) shall be carried out under contracts or agreements described in subsection (a).</text></subsection><subsection id="HB16C49D690024522AD2AE94039436D65"><enum>(c)</enum><header>Eligibility Criteria</header><text>To be eligible to enter into a contract or agreement under this section, an Indian Tribe shall submit to the Secretary an application that includes—</text><paragraph id="HAF902E2E20BF421BB61BEED6F335EA7E"><enum>(1)</enum><text>a description of—</text><subparagraph id="H6645D078438448CA99394D8C0DDA4698"><enum>(A)</enum><text>the Indian forest land or rangeland under the jurisdiction of the Indian Tribe; and</text></subparagraph><subparagraph id="H33779F0BBBAC43D0932A63981477605D"><enum>(B)</enum><text>the demonstration project proposed to be carried out by the Indian Tribe; and</text></subparagraph></paragraph><paragraph id="H58BA08E40BEF4DC897FDD4E5FE6EA1C5"><enum>(2)</enum><text>such other information as the Secretary may require.</text></paragraph></subsection><subsection id="H27572A5476DC4F24A81598FE2BFAE5A2"><enum>(d)</enum><header>Selection</header><text>In evaluating the applications submitted under subsection (c), the Secretary shall—</text><paragraph id="H749D8342071D472BB6FCE34C611DF09A"><enum>(1)</enum><text display-inline="yes-display-inline">take into consideration whether a proposed project—</text><subparagraph id="HFDC171A7B0B54D30BC2DBF100CE9A9EB"><enum>(A)</enum><text>creates new jobs and enhances the economic development of the Indian Tribe;</text></subparagraph><subparagraph id="HB3E14971CD004C19960C537CCE5CACB8"><enum>(B)</enum><text>demonstrates new and innovative uses of biochar, viable markets for cost effective biochar-based products, or ecosystem services of biochar;</text></subparagraph><subparagraph id="H01354EF78B8A4A10B813810AFD96BFC2"><enum>(C)</enum><text>improves the forest health or watersheds of Federal land or Indian forest land or rangeland;</text></subparagraph><subparagraph id="HF6F015B2CF2243D6B7DF497C6F7B8CAF"><enum>(D)</enum><text>demonstrates new investments in biochar infrastructure or otherwise promotes the development and commercialization of biochar;</text></subparagraph><subparagraph id="HAFEEA585D26544A3851F8A5220CBFA36"><enum>(E)</enum><text>is located in an area with—</text><clause id="H78DE75A3F96F45C8AAA402B38941AF45"><enum>(i)</enum><text>nearby lands identified as having a high, very high, or extreme risk of wildfire;</text></clause><clause id="H1769508039EB42E796D173DCF5795023"><enum>(ii)</enum><text>availability of sufficient quantities of feedstock; or</text></clause><clause id="HAB9E0B39E19B44D09C0D00B13ED42FEC"><enum>(iii)</enum><text>a high level of demand for biochar or other commercial byproducts of biochar; or</text></clause></subparagraph><subparagraph id="HC7BC2DE04C0346A19DD4381E00AF41B2"><enum>(F)</enum><text>any combination of purposes specified in subparagraphs (A) through (E); and</text></subparagraph></paragraph><paragraph id="H9509B5CED5D74B2D99DBB15029B296AB"><enum>(2)</enum><text>exclude from consideration any merchantable logs that have been identified by the Secretary for commercial sale.</text></paragraph></subsection><subsection id="H5A436948B8724CF58359048135058060"><enum>(e)</enum><header>Implementation</header><text>The Secretary shall—</text><paragraph id="H5CBDD50271A14793922AC2F737B1CE24"><enum>(1)</enum><text>ensure that the criteria described in subsection (c) are publicly available by not later than 120 days after the date of the enactment of this section; and</text></paragraph><paragraph id="H8238C4E96D8344E5AF0C33BCA96F2EF6"><enum>(2)</enum><text>to the maximum extent practicable, consult with Indian Tribes and appropriate intertribal organizations likely to be affected in developing the application and otherwise carrying out this section.</text></paragraph></subsection><subsection id="HE9A33513F4924C608C09A36374ECAE1F"><enum>(f)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this section and every year thereafter, the Secretary shall submit to Congress a report that describes, with respect to the reporting period—</text><paragraph id="HC26C83E3507842D8914673E754BCB95A"><enum>(1)</enum><text>each individual Tribal application received under this section; and</text></paragraph><paragraph id="HF30E947A06CB43798D7A825819513D0F"><enum>(2)</enum><text>each contract and agreement entered into pursuant to this section.</text></paragraph></subsection><subsection id="H90BCC481A2E74535A0C17C5AB9192616"><enum>(g)</enum><header>Incorporation of management plans</header><text display-inline="yes-display-inline">To the maximum extent practicable, on receipt of a request from an Indian Tribe, the Secretary shall incorporate into a contract or agreement with that Indian Tribe entered into pursuant to this section, management plans (including forest management and integrated resource management plans and Indian Trust Asset Management Plans) in effect on the Indian forest land or rangeland of that Indian Tribe.</text></subsection><subsection id="H4DB5A549C08947FDB890DFDE7D105FD3"><enum>(h)</enum><header>Term</header><text>A contract or agreement entered into under this section—</text><paragraph id="HCE811F69E26A4701B759A866E2D020FB"><enum>(1)</enum><text>shall be for a term of not more than 20 years; and</text></paragraph><paragraph id="H2E335A1E520041B78F519CD067AC7647"><enum>(2)</enum><text>may be renewed in accordance with this section for not more than an additional 10 years.</text></paragraph></subsection></section><section id="H03449C088ABC4388ACCD7A98A4DD23FE"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="H7FAF4D00E7A0462FB9CD76B1BD31420C"><enum>(1)</enum><header>Biochar</header><text>The term <term>biochar</term> means carbonized biomass produced by converting feedstock through reductive thermal processing for non-fuel uses.</text></paragraph><paragraph id="H081F435EEBD64A13BD6B11C78A41B59A"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="H9977BEA6DBCB45F291DE341EFC218F3A"><enum>(A)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>) administered by the Secretary of Agriculture, acting through the Chief of the Forest Service; and</text></subparagraph><subparagraph id="H1755574065B04D8190C61B56A5A570ED"><enum>(B)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)), the surface of which is administered by the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></subparagraph></paragraph><paragraph id="H0471BEFBA7574574A10C8ABA1E2EB1F8"><enum>(3)</enum><header>Feedstock</header><text>The term <term>feedstock</term> means excess biomass in the form of plant matter or materials that serves as the raw material for the production of biochar.</text></paragraph><paragraph id="H1FA9497B21E142DCB950BA6AA96240D2"><enum>(4)</enum><header>Indian forest land or rangeland.</header><text display-inline="yes-display-inline">The term <term>Indian forest land or rangeland</term> means land that—</text><subparagraph id="H36F2A32B68CD48A7AF2BFC343319EEDA"><enum>(A)</enum><text>is held in trust by, or with a restriction against alienation by, the United States for an Indian Tribe or a member of an Indian Tribe; and</text></subparagraph><subparagraph id="H3B8E502D292A4D1990238D8DA628C362"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H5F09090909474AF3AF47D518C246CFE1"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H66CF3A9343AB470D89C9D3C0272A2CD6"><enum>(I)</enum><text>is Indian forest land (as defined in section 304 of the National Indian Forest Resources Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3103">25 U.S.C. 3103</external-xref>)); or</text></subclause><subclause id="HC7B3D447065C4FB8A2BA8DF9AE3546D6" indent="up2"><enum>(II)</enum><text>has a cover of grasses, brush, or any similar vegetation; or</text></subclause></clause><clause id="H272F3A5636F649949D26241A6288C5D2" indent="up1"><enum>(ii)</enum><text>formerly had a forest cover or vegetative cover that is capable of restoration.</text></clause></subparagraph></paragraph><paragraph id="HDCDE4E4FC2C14D1FA1B5A772FCB403EC"><enum>(5)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HDDDB11531F324C169547BB8E11E303B5"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means—</text><subparagraph id="H9E89235E30CB462F9771A1FD9F573532"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to land under the jurisdiction of the Forest Service; and</text></subparagraph><subparagraph id="H8222F8B295D540CE8EF2659C5C788E3E"><enum>(B)</enum><text>the Secretary of the Interior, with respect to land under the jurisdiction of the Bureau of Land Management.</text></subparagraph></paragraph><paragraph id="H65B1DAF6C9664BB196E705F5B0CCA9BF"><enum>(7)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
