R. 4500</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210719">July 19, 2021</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> (for herself, <cosponsor name-id="S001196">Ms. Stefanik</cosponsor>, <cosponsor name-id="M000317">Ms. Malliotakis</cosponsor>, <cosponsor name-id="G000597">Mr. Garbarino</cosponsor>, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, and <cosponsor name-id="P000599">Mr. Posey</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To incentivize States to provide robust qualified immunity to law enforcement officers, and for other purposes.</official-title></form><legis-body id="H5A2A1299EE1042F898C0C955CEE7CECC" style="OLC"><section id="H5186DCD7EE4547FEB99686382B62E1D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Law Enforcement Protection Act of 2021</short-title></quote>. </text></section><section id="HA267E92C860D4DD4A948793900CDA6B1"><enum>2.</enum><header>Qualified immunity requirement for receipt of certain grant funds</header><subsection id="H3704C528DFC748B09BC78885F8AB8F92"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Beginning in the first fiscal year that begins after the date of enactment of this Act, in order to be eligible to receive a grant under a covered grant program, a State or unit of local government certify, along with the application for each such grant, that the State or unit of local government does not have in place a law that provides less qualified immunity to law enforcement officers than is described in the holding in Saucier v. Katz (533 U.S. 194 (2001)).</text></subsection><subsection id="H4FC50F2F225C4983BA041CE122191E3A"><enum>(b)</enum><header>Covered grant program</header><text>In this section, the term <term>covered grant program</term> means each of the following:</text><paragraph id="H94F05929A7F147B580383A9D1895585A" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The Community Development Bock Grant Program under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>). </text></paragraph><paragraph id="H4D9A7836A1064B43A1EB5B070E4C8C4C" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Community facility direct and guaranteed loans under paragraph (1) of section 306(a) of the Consolidated Farm and Rural Development Act. </text></paragraph></subsection></section></legis-body></bill>
