R. 4484</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210716">July 16, 2021</action-date><action-desc><sponsor name-id="R000602">Miss Rice of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to provide for certain succession reforms, and for other purposes.</official-title></form><legis-body id="H49751E4A01254971B9DEBF9EC0F8D572" style="OLC"><section id="HA05D149FF6D04EEFB58F950704F3C67B" section-type="section-one"><enum>1.</enum><header>Succession reforms</header><text display-inline="no-display-inline">Subsection (g) of section 103 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/113">6 U.S.C. 113</external-xref>) is amended—</text><paragraph id="HFE8EAC162B424BB19760E91DFA8C297F"><enum>(1)</enum><text>in paragraph (1), by striking <quote>neither the Secretary nor Deputy Secretary is</quote> and inserting <quote>the Secretary, Deputy Secretary, or Associate Secretary are not</quote>; and</text></paragraph><paragraph id="H3F4D60D9AB3647CA98A44CA0B7F91E10"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following new paragraphs:</text><quoted-block id="HF752AB8E7A704E50AF6E2C30E5FBE8B0" style="OLC"><paragraph id="H3C32D40F48EE44B6A549538DA7F479F3"><enum>(2)</enum><header>Further order of succession</header><text>Notwithstanding section 3345 of title 5, United States Code, the Secretary may designate such other official of the Department—</text><subparagraph id="H1F6BD6B66FBB4786921770B0571A4410"><enum>(A)</enum><text>in further order of succession, to perform the functions and duties of the Secretary, provided that such official has served in the Department for at least 90 days prior to such designation in either—</text><clause id="H4A409A8ABA9E40CD84CE50FD21F871D2"><enum>(i)</enum><text>the position of the head of a component; or</text></clause><clause id="HD6E2E99516BB4A84AFEAB4D884480828"><enum>(ii)</enum><text>in another position by and with the advice and consent of the Senate;</text></clause></subparagraph><subparagraph id="H9F4D49D8DADB48C28129CB8E0879333B"><enum>(B)</enum><text>in the event that the Secretary position is vacant and an official meeting the criteria set forth in subparagraph (A) is not available, the President may designate an officer or employee in the Department to perform the functions and duties of the Secretary, if—</text><clause id="H86D190CF6B5049DD96A3B65B8F6C4043"><enum>(i)</enum><text>prior to such designation, the officer or employee served in a position in the Department for not less than 90 days; and</text></clause><clause id="H0A88CE8BF7184BB6BD1699C13E5886BA"><enum>(ii)</enum><text>the rate of pay for the position referred to in clause (i) is equal to or greater than the minimum rate of pay payable for a position at GS–15 of the General Schedule; and</text></clause></subparagraph><subparagraph id="H9FFD004856BA43B5854B936B7465A725"><enum>(C)</enum><text>in the event the head of a Department component is vacant, the Secretary may designate an officer or employee of the Department to perform the functions and duties of such vacant position, if—</text><clause id="H243CDA026CCA43FF95DF39C2EC94F8D8"><enum>(i)</enum><text>prior to such designation, the officer or employee served in a position in the Department for not less than 90 days; and</text></clause><clause id="H0B18E61FCED94341803491B47EA81DD5"><enum>(ii)</enum><text>the rate of pay for the position referred to in clause (i) is equal to or greater than the minimum rate of pay payable for a position at GS–15 of the General Schedule.</text></clause></subparagraph></paragraph><paragraph id="H08AF295C1F8B4BDCADA43C601D7140B1"><enum>(3)</enum><header>Applicability of other provisions of law</header><text>Sections 3346 through 3349d of title 5, United States Code, shall apply to any individual serving in an acting capacity under this subsection in the same manner and to the same extent as such sections are applicable to an individual serving as an acting officer described under section 3345 of such title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
