Maloney of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 41, United States Code, and the Internal Revenue Code of 1986, to ensure availability of personal protective equipment during pandemics and other public health emergencies through stockpile requirements and domestic manufacturing incentives, and for other purposes.</official-title></form><legis-body id="H0B9312A3D2C24B13A584B826635C734E" style="OLC"><section id="HB8639CD5FFB04C798D52AE4DF777C6DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Made in America Pandemic Preparedness Act</short-title></quote>.</text></section><section id="H66654166126B4E1EAB3AB9AFE2AB70AF"><enum>2.</enum><header>Requirement to maintain sufficient personal protective equipment stockpile and domestic supply chains for national security purposes</header><subsection id="HEF2FAEC105824DC58B249EDADDEFBED8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">Chapter 83</external-xref> of title 41, United States Code, is amended by adding after section 8302 the following:</text><quoted-block style="USC" id="H1A037826323F4795910ED3A6CFDA1BFD" display-inline="no-display-inline"><section id="H394338383193435F945433D649678817"><enum>8302A.</enum><header>Personal protective equipment stockpile and domestic supply chains</header><subsection id="HEF4D222E75E64DC5AEF78A4FC4BC93E1"><enum>(a)</enum><header>Domestic content requirement</header><paragraph id="H626C52AC78FC4AC0B31BED168F46C544"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To ensure strategic domestic supply chain capabilities for national security purposes, all personal protective equipment procured for the Strategic National Stockpile shall be personal protective equipment that is produced in the United States.</text></paragraph><paragraph id="H1B49937EBBA64566A7B38C6FBF4EAAE5" commented="no"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to the procurement of an item that is personal protective equipment if the Secretary determines that—</text><subparagraph id="H75D38E145CE640E280C360544E7B73F3" commented="no"><enum>(A)</enum><text>applying such paragraph would be inconsistent with the public interest or national security interest; </text></subparagraph><subparagraph id="H504667090F7640AFA8F8DF2990CA5E0D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">such item is not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; </text></subparagraph><subparagraph id="HC8C828003A8D40FDAFAC0C43B2198E86" commented="no"><enum>(C)</enum><text>applying paragraph (1)—</text><clause id="H7CC09ACFAD714C6D90F91A4A4A73CE4B" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a contract, cooperative agreement, or transaction to be entered into on or before the date that is 5 years after the date of the enactment of the <short-title>Made in America Pandemic Preparedness Act</short-title>, will increase the cost of such contract, cooperative agreement, or transaction by more than 50 percent; and</text></clause><clause id="H349AC377A5954C6583EF240F594B18AB"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to a contract, cooperative agreement, or transaction to be entered into after the date that is 5 years after the date of the enactment of the <short-title>Made in America Pandemic Preparedness Act</short-title>, will increase the cost of such contract, cooperative agreement, or transaction by more than 25 percent; or</text></clause></subparagraph><subparagraph id="H0ECA1C8674B1408D9473A902995722F5" commented="no"><enum>(D)</enum><text>such item is, or includes, materials determined to be nonavailable in accordance with section 25.104 of the Federal Acquisition Regulation.</text></subparagraph></paragraph><paragraph id="H5EA9C8CADDCB4B90B6072A0B219F7B7F"><enum>(3)</enum><header>Notification of noncompliance required</header><text display-inline="yes-display-inline">If the Secretary determines that the requirement in paragraph (1) is not satisfied, the Secretary shall—</text><subparagraph id="H31E666A803844F2292F845F287CA7C36"><enum>(A)</enum><text>submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives quarterly—</text><clause id="HAEB6BCA1300D4674B9A995DAABFE6B7A"><enum>(i)</enum><text display-inline="yes-display-inline">a notification stating that such requirement has not been satisfied; and</text></clause><clause id="HBD449E39E206493FA646033237406D4B"><enum>(ii)</enum><text>a report on—</text><subclause id="HCF691738A81844788ED4392059A7F467" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">the personal protective equipment in the Strategic National Stockpile;</text></subclause><subclause id="HE6B706EA994745B5B0AC57BFD0AABDBE"><enum>(II)</enum><text>any contract, cooperative agreement, or other transaction entered into in the prior quarter for the procurement of personal protective equipment not produced in the United States, including the exception under subsection (a)(5) applied with respect to such contract; and</text></subclause><subclause id="HA24A7C5CA94C4B1690A746212D2792A6"><enum>(III)</enum><text>any actions taken by the Secretary to ensure that the requirement under paragraph (1) is satisfied; and</text></subclause></clause></subparagraph><subparagraph id="HC3E1E7CEA19E4115B0E4A4F98ABC1231"><enum>(B)</enum><text display-inline="yes-display-inline">post on the website maintained by the Administrator of General Services at SAM.gov (or any successor site) each notification required by subparagraph (A)(i), except for any information that is exempt from mandatory disclosure under section 552 of title 5, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H651DB4460F2D4AEEA946E5095AC3CB7E"><enum>(b)</enum><header>Sufficiency of strategic national stockpile</header><text>The Director shall work with the Secretary to issue a biannual report to Congress that includes the following:</text><paragraph id="H0FE90477A3A9443AB62A3EA5854D1EFA"><enum>(1)</enum><text>The state of personal protective equipment inventory in the Strategic National Stockpile.</text></paragraph><paragraph id="HC6EA36C326FF49039C8226A40CBE95C4"><enum>(2)</enum><text>The state of personal protective equipment inventory in stockpiles of other Federal agencies.</text></paragraph><paragraph id="H25E83CE8D9AD45E7B5B514C9AECB2AC6"><enum>(3)</enum><text>Estimates of the state of personal protective equipment inventory of non-Federal entities.</text></paragraph><paragraph id="H4D049157540D439A95649BBE3E3F8BED"><enum>(4)</enum><text>Estimates of the quantities of personal protective equipment that would be required for an array of possible emergencies, including a pandemic or other emergency declared under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) and that could last at least a year.</text></paragraph></subsection><subsection id="H94E9AD028AAC44C68565658B6BA3222F"><enum>(c)</enum><header>Website</header><text display-inline="yes-display-inline">The Administrator of General Services shall post on the website maintained by the Administrator at SAM.gov (or any successor site) information that identifies suppliers that can provide personal protective equipment that is produced in the United States for the Strategic National Stockpile.</text></subsection><subsection id="H3FA4F03F4FEB4364B0F613F7871EC8CD"><enum>(d)</enum><header>Application</header><text>This section shall be applied in a manner consistent with United States obligations under international agreements.</text></subsection><subsection id="H8B98DE1B9E0247EBBF08557B480B058B"><enum>(e)</enum><header>Definition</header><text>In this section—</text><paragraph id="H300948C624084C9F95CB6F8CCC0FCB22"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="HBB58E879AC0443F28600517555D99077"><enum>(2)</enum><header>Personal protective equipment</header><text display-inline="yes-display-inline">The term <term>personal protective equipment</term> means an item designed to protect the wearer or user from the spread of infection or other health hazard, or to protect other individuals from possible infection by the wearer, including a facemask, face covering, face shield, gown, coverall, glove, goggle, respirator, protective eyewear, biohazard container, shoe cover, hood, helmet, sleeve, scrub suit, surgical drape, human remains bag, towel, disinfecting wipe, triage tent, medical tent, or hand sanitizer. </text></paragraph><paragraph id="HCCC2CA940BA7445A8B29DA4D4142EA8A"><enum>(3)</enum><header>Produced in the United States</header><text display-inline="yes-display-inline">The term <term>produced in the United States</term> means, with respect to an item—</text><subparagraph id="HE0F0F277F3B54C9EADE6C9D8642F8158"><enum>(A)</enum><text>the item that is manufactured or assembled in the United States; and</text></subparagraph><subparagraph id="H81DB24FDE3E241CC8099E6377357328D"><enum>(B)</enum><text>the total value of the parts or components contained in the item that are not grown, reprocessed, reused, manufactured, or assembled in the United States does not exceed 25 percent of the total purchase price of the item.</text></subparagraph></paragraph><paragraph id="H63FFCF6F72B7418BA74459675C83974C"><enum>(4)</enum><header>Strategic National Stockpile</header><text display-inline="yes-display-inline">The term <term>Strategic National Stockpile</term> means the Strategic National Stockpile under section 319F–2 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d-6b">42 U.S.C. 247d–6b</external-xref>).</text></paragraph><paragraph id="HD40B13F19314411C8D2765A28C99A10F"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="H73C40DEF2E8647FBA6FDCD1257068C57"><enum>(f)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to limit the private distribution, purchase, or sale of personal protective equipment from sources other than the Strategic National Stockpile.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H89ED46062EBD468DAB038F334F17AC76"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section, and the amendments made by this section, shall take effect on the date that is six months after the date on which this section is enacted.</text></subsection><subsection id="H0CAB00BF087E48709F221C3BF4763020"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41, United States Code, is amended by adding after the item related to section 8302 the following new item:</text><quoted-block style="OLC" id="HEA5C388A928548A8B2E291E32BF79BA6" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">8302A. Personal protective equipment stockpile and domestic supply chains.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HE1F5419D447D491AB888AEB5E58E296C"><enum>3.</enum><header>Pandemic preparation tax credit</header><subsection id="H185AC9533C70479AAF69CD91CF87F45B"><enum>(a)</enum><header>In general</header><text>Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block id="H05F8300E52824B8799AD621CAA79D1FD" style="OLC"><section id="HDCCE2C863211460BA7D7793DD58F1C92"><enum>45U.</enum><header>Pandemic preparation tax credit</header><subsection id="HFDF8809A64294D2E908D6E12ACFBA651"><enum>(a)</enum><header>Allowance of credit</header><text>For purposes of section 38, the pandemic preparation tax credit determined under this section for the taxable year is an amount equal to 20 percent of the expenses paid or incurred by the taxpayer during such taxable year for purposes of producing personal protective equipment (including manufacturing technology upgrades, workforce training expenses, components, parts, or raw material used to make personal protective equipment) that qualifies for addition to the Strategic National Stockpile under section 8302A(a)(1) of title 41, United States Code.</text></subsection><subsection id="HAA0055FBDDF84B50B66E0E05166FEA8E"><enum>(b)</enum><header>Denial of double benefit</header><text display-inline="yes-display-inline">No deduction or credit shall be allowed under any other provision of this chapter with respect to any amount taken into account in determining the credit allowed to a taxpayer under this section.</text></subsection><subsection id="H8D8EF3ABC4EA4490A88C059A4ED93693"><enum>(c)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall prescribe such regulations as are necessary or appropriate to carry out the purpose of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB2E7CEA75FE24A27B28156E7652787E9"><enum>(b)</enum><header>Credit made part of general business credit</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/38">Section 38(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>plus</quote> at the end of paragraph (32), striking the period at the end of paragraph (33) and inserting <quote>, plus</quote>, and adding at the end the following new paragraph:</text><quoted-block id="HBB426202909D4085AA8FEB47E6A7C56E" style="OLC"><paragraph id="HB937435B2D984561BFC1F9C76BEF2B3A"><enum>(34)</enum><text>the pandemic preparation credit determined under section 45U.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9E8DC865AA644E528B823AF2230F58EF"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subpart D of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following new item:</text><quoted-block id="H964D97987F914D8B8230E5B2BCDE4FB4" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 45U. Pandemic preparation tax credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3A45755884EA4E29BF26B38C921E8B63"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
