Maloney of New York</sponsor> (for herself, <cosponsor name-id="L000562">Mr. Lynch</cosponsor>, and <cosponsor name-id="R000606">Mr. Raskin</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name>, and in addition to the Committees on <committee-name committee-id="HHM00">Homeland Security</committee-name>, <committee-name committee-id="HJU00">the Judiciary</committee-name>, and <committee-name committee-id="HIG00">Intelligence (Permanent Select)</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Intelligence Reform and Terrorism Prevention Act of 2004 to strengthen the ability of the Privacy and Civil Liberties Oversight Board to provide meaningful oversight and governance related to the use of artificial intelligence technologies for counterterrorism purposes, and for other purposes.</official-title></form><legis-body id="H8E4F8111729F42F7B49C2558AAAB90CB" style="OLC"><section id="HC8C54F2CF74244ECA8BEB13E191FC174" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This act may be cited as the <quote><short-title>AI in Counterterrorism Oversight Enhancement Act</short-title></quote>.</text></section><section id="HF5E1529FE4374DF392034F7D2C59B0E9" section-type="subsequent-section"><enum>2.</enum><header>Oversight of use of artificial intelligence-enabled technologies by executive branch for counterterrorism purposes</header><subsection id="HE7B4130A219D40798730CCFBA5D29642"><enum>(a)</enum><header>Amendments to authorities and responsibilities of the Privacy and Civil Liberties Oversight Board</header><text display-inline="yes-display-inline">Section 1061 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ee">42 U.S.C. 2000ee</external-xref>) is amended—</text><paragraph id="HEC72E4C0BEFC4E56B7B28DD606E7C100"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H591352950C284FD9903A81FF1C813119"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H887CCDFB35844D6DAABD6BE682A418B0"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HF54D074214524A0EB9DF322F9227AA2C"><enum>(ii)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text></clause><clause id="H11AFD23595134EC0B557567BE6AE3CE8" commented="no"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" id="H8D4F6EB5638B4426BFE2A49CA0894D15" display-inline="no-display-inline"><subparagraph id="H9D74D75540E74131A9389DD07B7A43BE" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">artificial intelligence-enabled technologies to protect the Nation from terrorism to determine whether they appropriately protect privacy and civil liberties and adhere to policies regarding privacy and civil liberties; and</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H42367221DEB3451A96EC51E344C1051E"><enum>(2)</enum><text> in subsection (g)(1)—</text><subparagraph id="HB0428630F01242979D8EF4B5D56DD3D6"><enum>(A)</enum><text>by redesignating paragraphs (2) through (5) as subparagraphs (3) through (6); and</text></subparagraph><subparagraph id="HC03E0BE8AA3144D9A902B990DC9B9E16"><enum>(B)</enum><text>by inserting after paragraph (1) the following new paragraph:</text><quoted-block style="OLC" id="H7D1BD599094F4A93BFF0BAEF277897D5" display-inline="no-display-inline"><paragraph id="H4AA6A2C63838463FA2F4ADFE433EAFD6"><enum>(2)</enum><header>Inclusion of certain information related to artificial intelligence</header><text display-inline="yes-display-inline">Relevant material and information to which the Board is authorized to have access under subparagraph (A) of paragraph (1) or to subpoena under subparagraph (D) of such paragraph may include information on artificial intelligence-enabled technologies that are in use by, or that have been proposed to be acquired by the executive branch, such as materials documenting—</text><subparagraph id="H24608321E8124CC580AB1D3E61DBFC04"><enum>(A)</enum><text display-inline="yes-display-inline">the processes for data collection related to artificial intelligence-enabled technologies, for obtaining consent related to the use of such technologies, or for the disclosure of the use of such technologies;</text></subparagraph><subparagraph id="HB25C0744E3C74915AD8C4F3F383B1805"><enum>(B)</enum><text display-inline="yes-display-inline">the models of such technologies in use or that have been proposed to be acquired; and</text></subparagraph><subparagraph id="H1A1A2374A53A48888A21F11A60F9C1E7"><enum>(C)</enum><text display-inline="yes-display-inline">processes for training and testing related to such technologies.</text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF9DF2BD9453E49A89E31EF0A2A93D479"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HA4FB2E561832461998CC3AFDD6FE0732" display-inline="no-display-inline"><paragraph id="H979DCF82B45943319645A6ADFD729C96"><enum>(n)</enum><header>Definition</header><text display-inline="yes-display-inline">In this subtitle, the term <quote>artificial intelligence</quote> has the meaning given that term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBCFCA2E538664FDF82ADF1E48F63F70F"><enum>(b)</enum><header>Amendments to authorities and responsibilities of privacy and civil liberties officers</header><text display-inline="yes-display-inline">Section 1062 of the Intelligence Reform and Terrorism Prevention Act of 2004 (42 U.S.C 2000ee–1) is amended—</text><paragraph id="H5F9F0E70BA78459DB612482D47A91E71"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HFB0753791E3F4234AF3873DA4B5BCFF6"><enum>(A)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5); and</text></subparagraph><subparagraph id="HF72FF6CC42D34C4894AFCFF9228ABC41" commented="no"><enum>(B)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block style="OLC" id="H35790EAE98564A41AD38DC37DF756C71" display-inline="no-display-inline"><paragraph id="H3A48CCC0883D404D8BE810C9C2ED90F1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">provide to the Privacy and Civil Liberties Oversight Board—</text><subparagraph id="H7A7EA78FC9E8411A96872C4BE125F17D"><enum>(A)</enum><text>notice of the use by such department, agency, or element of any artificial intelligence-enabled technologies to protect the Nation from terrorism (including classified technologies) that may have an impact on privacy or civil liberties; and</text></subparagraph><subparagraph id="H324CC9B8CF8F4F1C8C52847FDA30CE51"><enum>(B)</enum><text>access to associated impact statements, including system of record notices, privacy impact assessments, and civil liberties impact assessments.</text></subparagraph></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBE58D00A94584BC1AE456FEB05C51034"><enum>(2)</enum><text>in subsection (d)(1), by inserting <quote>(including as described under subsection (a)(3))</quote> after <quote>officer</quote>. </text></paragraph></subsection><subsection id="HDF3C227A506C4DB6A845A936E4C1C530"><enum>(c)</enum><header>Self-Assessment by Privacy and Civil Liberties Board</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Privacy and Civil Liberties Oversight Board under section 1061 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000ee">42 U.S.C. 2000ee</external-xref>) shall provide to the appropriate committees (as described in subsection (e) of such section) a self-assessment of any change in resources or organizational structure that may be necessary to carry out the requirements related to artificial intelligence-enabled technologies under sections 1061 and 1062 of such Act, as amended by this section.</text></subsection></section></legis-body></bill>
