Maloney of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, to require Executive agencies to establish and implement an AI strategy, objectives, and metrics plan for trustworthy artificial intelligence adoption to better achieve the missions of such agencies to serve the people of the United States, and for other purposes.</official-title></form><legis-body id="H2AFFF93BAE454765BB7E4FA8E37E62FA" style="OLC"><section id="H3027F2CAC8CE485ABBA52C726E0A874E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Artificial Intelligence for Agency Impact Act</short-title></quote> or the <quote><short-title>AI for Agency Impact Act</short-title></quote>.</text></section><section id="HAC980470E77C46288016924247BB0E00"><enum>2.</enum><header>AI strategy, objectives, and metrics plans</header><subsection id="HFB7C34F8EDA742A29D23D77D5B32A94D"><enum>(a)</enum><header>Amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">Chapter 3</external-xref> of title 5, United States Code, is amended by adding at the end the following new subchapter:</text><quoted-block id="HB5E526B6620E4936B407B7357B5AE3DA" style="USC"><subchapter id="HBE3CC35F2BDC46DF81E756F4F2B50D0C"><enum>III</enum><header>Artificial Intelligence</header><section id="HD089623AE06E48DC9AFDC9F003577CD3"><enum>321.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="HEEDA59CE70FD4E309C3AE9F6442E705C" commented="no"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given that term in paragraph (1) section 3502 of title 44, United States Code, except that term shall not include independent regulatory agencies (as defined in paragraph (5) of such section).</text></paragraph><paragraph id="H868D8330DB024580A497FF40EA88BAA5"><enum>(2)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Oversight and Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></paragraph><paragraph id="H4A850B4AD0434A24B94040A1FB7AFB2C" commented="no"><enum>(3)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <term>artificial intelligence</term> has the meaning given that term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note).</text></paragraph><paragraph id="H46EB00D4A1894522B8BAEA1272F0B268"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph><paragraph id="H4C3F8074476E4D9A871CF887150B8BE8" commented="no"><enum>(5)</enum><header>Reliability</header><text display-inline="yes-display-inline">The term <term>reliability</term> means, with respect to the artificial intelligence, the extent to which—</text><subparagraph id="H6BE98A5716BD469E833450C0AE7DC9B2"><enum>(A)</enum><text>data collected for use by the artificial intelligence is a valid measure of the underlying concepts addressed in the objectives of using the artificial intelligence;</text></subparagraph><subparagraph id="H536AD540E10D43FF842112C565A24264"><enum>(B)</enum><text>the safety, security, and robustness has been tested and assured across each phase of development and use of the artificial intelligence according to defined objectives;</text></subparagraph><subparagraph id="H3625119A8C8E46E9B471BDE193122826"><enum>(C)</enum><text>data records and fields are present and sufficiently populated; and</text></subparagraph><subparagraph id="HDBC2EE7B17304E7998D473D40A01E671"><enum>(D)</enum><text>data records reflect the actual underlying information.</text></subparagraph></paragraph><paragraph id="H00190FAB91E34594A444BF2C14D08A14"><enum>(6)</enum><header>Representativeness</header><text display-inline="yes-display-inline">The term <term>representativeness</term> means the extent to which data sets used for training the artificial intelligence is representative of the population or operational environment to be assessed by the artificial intelligence.</text></paragraph></section><section id="H0232109AE77F4B01B06E968E2E1869E7"><enum>322.</enum><header>AI Strategy, Objectives, and Metrics Plan</header><subsection id="H3B813D54C1544E1DA49ADD50F2A01739" display-inline="no-display-inline"><enum>(a)</enum><header>AI Strategy, Objectives, and Metrics Plan</header><text display-inline="yes-display-inline">The head of each agency shall establish an AI Strategy, Objectives, and Metrics Plan that contains strategies, objectives, and metrics for the trustworthy adoption of artificial intelligence by the agency to better achieve the mission of the agency to serve the people of the United States, including the following:</text><paragraph id="HA7C079266E0647679AF8C4C71CFC8D3E"><enum>(1)</enum><text>Defined roles, responsibilities, and delegation of authority for the use and oversight of artificial intelligence used by the agency, including oversight of compliance with relevant laws, regulations, standards, and guidance.</text></paragraph><paragraph id="H842BECEFF86645FAA456E4AFAC2AA405"><enum>(2)</enum><text>Defined values, ethics, and principles to foster public trust and responsible use of artificial intelligence by the agency.</text></paragraph><paragraph id="H6F08DF54E90843E3A4EEFD1C4337D19A"><enum>(3)</enum><text>Procedures—</text><subparagraph id="HD85B39475C3444FDA87343B05059399F"><enum>(A)</enum><text>to ensure the security and privacy of data used by artificial intelligence used by the agency; and </text></subparagraph><subparagraph id="H9EEE5EC741EF47619F459562CC7D35CF"><enum>(B)</enum><text>for human supervision of, and accountability for, artificial intelligence used by the agency. </text></subparagraph></paragraph><paragraph id="H972D25EEF44244EEBCDB28B80544DBB1"><enum>(4)</enum><text display-inline="yes-display-inline">For each artificial intelligence used by the agency at the time the plan is established—</text><subparagraph id="H67D3E28F9514478DA8E119B3B794A6FC"><enum>(A)</enum><text>performance objectives and accompanying metrics that clearly reflect or convey the intended purpose of the artificial intelligence; </text></subparagraph><subparagraph id="H471CBCCEF7294377AB5DBA41890749B5"><enum>(B)</enum><text display-inline="yes-display-inline">a process—</text><clause id="H8310E3F8E54A4BE2A49A257385CCE8B7"><enum>(i)</enum><text>for the continuous or routine monitoring and assessment the performance of the artificial intelligence against the objectives and metrics established for the artificial intelligence under subparagraph (A) to ensure that the artificial intelligence functions as intended and carries out the goals and objectives of using the artificial intelligence; and</text></clause><clause id="HA1DD6BAAB3C44E0DAA23F38FC50A2928"><enum>(ii)</enum><text>that includes a plan to systematically identify, analyze, and mitigate any risks associated with the artificial intelligence; and</text></clause></subparagraph><subparagraph id="H398B4903709349C3B1EF40A7EBE36ADD" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">documentation demonstrating that the artificial intelligence relies on high quality, reliable, representative data, including—</text><clause id="HCAFE8ECCB2CA4EAF867E6460906C7D2F" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the sources and origins of data used to train each artificial intelligence; and</text></clause><clause id="HC18D4FB850E542FDB73F23EA7EBAD739" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">assessments of the reliability, quality, and representativeness of—</text><subclause id="H349BF734FEFD42D39F5C8EC90691F3CB" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">data used to train the artificial intelligence;</text></subclause><subclause id="H37B24967ACAD432E819340C15F6A3A0A" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">attributes used to categorize data; </text></subclause><subclause id="H9379343D73D04DB49C4F689732E76529" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">data variables used by the artificial intelligence; and</text></subclause><subclause id="H42572EF15A584DACA1B57A84B93C3142" commented="no"><enum>(IV)</enum><text>interconnectivities and dependencies of data streams that operationalize the artificial intelligence; and </text></subclause></clause><clause id="H9BCD756CF290474BBFA361771FE485B8" commented="no"><enum>(iii)</enum><text>a description of the range of data and model drift that is acceptable for each artificial intelligence.</text></clause></subparagraph></paragraph><paragraph id="H75E4ED2D52634DF3AFC050D9E1974247"><enum>(5)</enum><text display-inline="yes-display-inline">Performance objectives and accompanying metrics, for each opportunity identified by the agency to incorporate the use of artificial intelligence into the platforms, processes, and operations of the agency. </text></paragraph><paragraph id="H9DAC394CFDA3482FA54D5437C08CB38E"><enum>(6)</enum><text display-inline="yes-display-inline">A description of how artificial intelligence used by the agency are monitored, including a description of any actions taken to correct the functioning or performance of the artificial intelligence.</text></paragraph><paragraph id="H9B1EDA96F4EE4328A3B3F399BE635227" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">A description of how information on the design, operation, limitations, and updates of the artificial intelligence is made available to the public. </text></paragraph></subsection><subsection id="H701A6D5143FF4DDB85D7E05B2268923C"><enum>(b)</enum><header>Relationship to Executive Order 13859, memoranda</header><text display-inline="yes-display-inline">A plan developed under subsection (a) by an agency shall be consistent with—</text><paragraph id="H41A0A46A50C64CC7A1150BE6D4E457F6"><enum>(1)</enum><text>section 3 of Executive Order 13960 (89 Fed. Reg. 13859) titled <quote>Promoting the Use of Trustworthy Artificial Intelligence in the Federal Government</quote>, issued on December 8, 2020; and</text></paragraph><paragraph id="HBDB25F6405F04F47A90765D9F768F86A"><enum>(2)</enum><text>the memorandum issued by the Director to the agency under section 104 of the AI in Government Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note). </text></paragraph></subsection><subsection id="H8EF94D7E9191415C85A5E8E6DD1DC080"><enum>(c)</enum><header>Reports</header><paragraph id="H85E2D3E4BAAC4B6EBB3D467C3A71144C" commented="no"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 180 days after the memorandum required by section 104(a) of the AI in Government Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note) is issued, the head of each agency shall submit to the Director, the Inspector General of the agency, and the appropriate congressional committees a report that contains—</text><subparagraph id="H1F4D0B8C12D845658BEE5809611F307D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the AI Strategy, Objectives, and Metrics Plan established by the agency under subsection (a); </text></subparagraph><subparagraph id="H6BCF783A5D9A497FB3D37694B6BCFC62" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">an inventory (including a catalogue of model and non-model components, specifications, and parameters) of all artificial intelligence in use by the agency, in accordance with the guidance issued under paragraph (3); and </text></subparagraph><subparagraph id="H1195D54A4EB9405189CBCBA6A52970DB" commented="no"><enum>(C)</enum><text>a description and assessment of opportunities to incorporate the use artificial intelligence into the platforms, processes, and operations of the agency to enhance the effectiveness of the agency in accomplishing the mission, operations, and programs of the agency.</text></subparagraph></paragraph><paragraph id="H95A7B114F1854BFE83497ECB723DF133"><enum>(2)</enum><header>Progress reports</header><text>In 2023, and every two years thereafter until 2033, the head of each agency shall submit to the Director and the appropriate congressional committees a report—</text><subparagraph id="HBDA4CB65694646F383A2C4D19746D16F"><enum>(A)</enum><text display-inline="yes-display-inline">on the implementation of the AI Strategy, Objectives, and Metrics Plan established by the agency under subsection (a); and</text></subparagraph><subparagraph id="H7A2E5464C78848388C0A08CB11EDF52F"><enum>(B)</enum><text>that identifies and assesses any opportunities for, and risks any associated with, the use, or potential use, of artificial intelligence by the agency.</text></subparagraph></paragraph><paragraph id="H16574652399440C09166994D5C5D76F7" commented="no"><enum>(3)</enum><header>Agency inventory guidance</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Chief Information Officers Council shall issue, and make publicly available, guidance that includes the criteria, format, and mechanisms for the inventory required to be included in the report under paragraph (1). </text></paragraph><paragraph id="H09E940992A9246B88E31937C4824555E" commented="no"><enum>(4)</enum><header>Reporting reciprocity</header><text display-inline="yes-display-inline">The reports required by paragraphs (1) and (2) shall fulfill the requirements of the AI in Government Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note) and subsections (b) and (c) of section 5 of Executive Order 13960 (89 Fed. Reg. 13859) titled <quote>Promoting the Use of Trustworthy Artificial Intelligence in the Federal Government</quote>, issued on December 8, 2020, and shall include all information required by such provisions.</text></paragraph></subsection><subsection id="H39EC535D237F4577BA548B6063E3311D"><enum>(d)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing a plan required to be submitted under subsection (a) and the reports required by subsection (c), the head of the agency shall consult with the National Cyber Director and the heads of the National Artificial Intelligence Initiative Office, the National Artificial Intelligence Advisory Committee, the Artificial Intelligence Center of Excellence. </text></subsection><subsection id="H7ED70674398C45FCBB0338826C9CDD22"><enum>(e)</enum><header>Classified annex</header><text>The reports required by paragraphs (1) and (2) of subsection (b) shall be made publicly available upon submission to the entities described in such paragraphs, but such reports may include a classified annex.</text></subsection><subsection id="HF007DDF9E1AD49039D41BFD4B679E41A"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this subchapter may be construed as authorizing the use by agencies of, or an appropriation for, artificial intelligence. </text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H56A3ED39647F41D6A471D00A4980E224"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, is amended by adding after the item relating to section 315 the following:</text><quoted-block style="USC" id="HE877083175C7421986F8478F5C8FA57F" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="subchapter">Subchapter III—Artificial Intelligence </toc-entry><toc-entry level="section">321.
