R. 4463</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210716">July 16, 2021</action-date><action-desc><sponsor name-id="L000592">Mr. Levin of Michigan</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Administrator of the Environmental Protection Agency to promulgate regulations regarding disposal of materials containing perfluoroalkyl and polyfluoroalkyl substances or aqueous film forming foam, and for other purposes.</official-title></form><legis-body id="H1B0FAF8E0A6E4410901759AFC0B9889D" style="OLC"><section id="H6A51E39DCA3A4ABBB6D39F620FE8D28C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PFAS Safe Disposal Act</short-title></quote>. </text></section><section id="HC0DFC486008E4F5482C0E6C5DA0E9807"><enum>2.</enum><header>Prohibition on waste incineration of PFAS</header><text display-inline="no-display-inline">Section 3004 of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6924">42 U.S.C. 6924</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H9DDE0FAD6B1442F0AABA232179D6E0A3" style="OLC"><subsection id="H86D093CDF961464791AC073D8505F8F6"><enum>(z)</enum><header>PFAS wastes</header><paragraph id="H04642A07589742419FCD3FC18C109166"><enum>(1)</enum><header>Firefighting foam</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this subsection, the Administrator shall promulgate regulations requiring that when materials containing perfluoroalkyl and polyfluoroalkyl substances or aqueous film forming foam are disposed—</text><subparagraph id="HCC074F9976FD42FF99C2251F17B2507A"><enum>(A)</enum><text display-inline="yes-display-inline">all incineration is conducted in a manner that eliminates perfluoroalkyl and polyfluoroalkyl substances, including eliminating perfluoroalkyl and polyfluoroalkyl substances emitted into the air; </text></subparagraph><subparagraph id="H98450580344648F18C3303A9D0AA2CFB"><enum>(B)</enum><text>all incineration is conducted in accordance with the requirements of the Clean Air Act, including controlling hydrogen fluoride; </text></subparagraph><subparagraph id="HA4F62A2C85CF4EF0A8D46DBFC3705698"><enum>(C)</enum><text display-inline="yes-display-inline">any materials containing perfluoroalkyl and polyfluoroalkyl substances that are designated for disposal are stored in accordance with the requirements under part 264 of title 40, Code of Federal Regulations; </text></subparagraph><subparagraph id="H32471D851B1142CEAE0F90DE27DE1BA4"><enum>(D)</enum><text>all incineration is conducted at a facility that has been permitted to receive waste regulated under this subtitle; and</text></subparagraph><subparagraph id="H72AC6271E9F04844AD2A141CABA8A56E"><enum>(E)</enum><text display-inline="yes-display-inline">incineration is prohibited in or near overburdened communities, as defined by the Administrator.</text></subparagraph></paragraph><paragraph id="H47E2F4455D3D4785899CCD2E6816C35B"><enum>(2)</enum><header>Penalties</header><text display-inline="yes-display-inline">For purposes of section 3008(d), a waste subject to a prohibition under this subsection shall be considered a hazardous waste identified or listed under this subtitle.</text></paragraph><paragraph id="HB93033149E2B4779ABFE02E6BE1A330F"><enum>(3)</enum><header>Interim prohibition on incineration</header><text display-inline="yes-display-inline">No person may incinerate for purposes of disposal any material containing perfluoroalkyl and polyfluoroalkyl substances or aqueous film forming foam until the effective date of the regulations promulgated under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
