<section id="H1A13A9B1BA8D43EFBDF3F63C72552F25" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Jobs Act</short-title></quote>.</text></section> <section id="HC25C3B312B154861A945D8CABBE5A15C" display-inline="no-display-inline"><enum>2.</enum><header>Findings and sense of Congress</header> <subsection id="H1B1C91D36B004EC68C56FCB73A175317"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
<paragraph id="H0C67F44E0A8B4461B0ECF4024C2C55A0"><enum>(1)</enum><text display-inline="yes-display-inline">In the year 2018, funding for research and development in science and technology in the United States was $124.7 billion, or approximately 0.6 percent of the gross domestic product.</text></paragraph> <paragraph id="H41FC1E074FD34ACE8BEB970935F34655"><enum>(2)</enum><text display-inline="yes-display-inline">In the year 1964, the United States spent approximately 2 percent of gross domestic product on research and development in science and technology.</text></paragraph>
<paragraph id="H78371165E7C04502917609BEA49F6463"><enum>(3)</enum><text display-inline="yes-display-inline">Public funding for research and development in science and technology financed a majority of the innovations that powered growth in the United States after World War II, including digital computing and modern pharmaceutical science.</text></paragraph> <paragraph id="HB8CC6E7FC69E4E9FB7F95F35AC0D2580"><enum>(4)</enum><text display-inline="yes-display-inline">The United States currently ranks ninth in the world for total percentage of gross domestic product used for research and development in science and technology and twelfth in the world for public funding for research and development in science and technology.</text></paragraph>
<paragraph id="H999A5067AE8649E397C17E6033F757CE"><enum>(5)</enum><text>Funding for research and development in science and technology is concentrated in a small number of geographic regions in the United States.</text></paragraph> <paragraph id="H7DD773923C244249846FC6C19D7DA72D"><enum>(6)</enum><text display-inline="yes-display-inline">Established technology centers that promote research and development in science and technology are extremely crowded, have high real estate costs, and are in locations that require long commutes for many of the researchers at such centers.</text></paragraph>
<paragraph id="H5AB841AE07F04B569433446AA0859D1B"><enum>(7)</enum><text display-inline="yes-display-inline">The private sector has a limited ability or desire to invest outside of such centers, which limits the potential for growth in science and technology, including the availability of employment opportunities in such industries.</text></paragraph> <paragraph id="H9F3E2AF1C3E74A31B22D517A856C5C69"><enum>(8)</enum><text>Increasing public funding for research and development in science and technology to 1 percent of the gross domestic product would significantly increase the rank of the United States with respect to funding for such research and development among developed countries.</text></paragraph></subsection>
<subsection id="H95D68085AFDC484592EF856973D251BF"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of the Congress that amounts provided through this Act will be used—</text> <paragraph id="HAF2A847FE3424E9993315715112068BC"><enum>(1)</enum><text display-inline="yes-display-inline">in a manner that is similar to breakthrough-focused, project management models of the Defense Advanced Research Projects Agency of the Department of Defense; and</text></paragraph>
<paragraph id="HB1F54D5B36414DA2A9C8E3A7103CB173"><enum>(2)</enum><text>to supplement existing funding to Federal agencies.</text></paragraph></subsection></section> <section id="HC4FE60C4A1AE49C385B0DB163222EC7F"><enum>3.</enum><header>The Federal Institute of Technology</header> <subsection id="H9611175F47C542309D81E6BEFE9DEC20"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the executive branch of the Government an independent agency to be known as the <quote>Federal Institute of Technology</quote> (in this section referred to as the <quote>Institute</quote>).</text></subsection>
<subsection id="H3550C31B00D440B09370290DD38AFC52"><enum>(b)</enum><header>Headquarters</header><text display-inline="yes-display-inline">The Institute shall be headquartered in the District of Columbia.</text></subsection> <subsection id="H900D24ABABF8427AB17D570A206E9939"><enum>(c)</enum><header>Board of Directors</header> <paragraph id="H939F20307BF94B47BC053D520DAB9EF7"><enum>(1)</enum><header>In general</header><text>The Institute shall have a Board of Directors (in this section referred to as the <quote>Board</quote>).</text></paragraph>
<paragraph id="H1D2D05040FC54585A6D0E7A44B4C728E"><enum>(2)</enum><header>Duties of the Board</header><text display-inline="yes-display-inline">The duties of the Board shall include the following:</text> <subparagraph id="H82676480FFA8499EA44E2783F793CF57"><enum>(A)</enum><text>Not later than 2 years after the date of the enactment of this section, establish a minimum of 10 local boards in accordance with subsection (d), including—</text>
<clause id="H43F58BF26A7346B0AC68350BDC53306F"><enum>(i)</enum><text>appointing the members of each local board with consideration given to the recommendations provided pursuant to subsection (d)(1)(A)(iii);</text></clause> <clause id="H61227110343441118913FB0F0575EE9F"><enum>(ii)</enum><text>providing funding to local boards to support the local boards in achieving the duties under subsection (d)(3) and to carry out the comprehensive strategy under subsection (d)(2), including funds from amounts in the private endowment established under subsection (e); and</text></clause>
<clause id="H246A79DE17714D9CA617083A2EDD6A16"><enum>(iii)</enum><text>annually evaluate the effectiveness of each local board based on the requirements developed pursuant to subsection (d)(1)(D).</text></clause></subparagraph> <subparagraph id="HDF278CB7441E45ADB8056CDC1CD6A35C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Provide funds to Federal, State, and local agencies to support programs and research in the qualified subjects, including programs and research in certain technology sectors.</text></subparagraph></paragraph>
<paragraph id="H67A822D1730C453B9977C3A0ED8A3877"><enum>(3)</enum><header>Local board limitation</header><text display-inline="yes-display-inline">The Board may establish—</text> <subparagraph id="H02E4C7D5F07645E5BFE57E3B239C46BB"><enum>(A)</enum><text>not more than 30 local boards in the 10-year period after the date of the enactment of this Act; and</text></subparagraph>
<subparagraph id="H6372311F3EDA47778F93E1B81A78825C"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 3 local boards each fiscal year during such period.</text></subparagraph></paragraph> <paragraph id="HCDA36D067D1E45E79D17187696B6E59A"><enum>(4)</enum><header>New local board applications</header><text>The Board may consider new applications on an annual basis each fiscal year for the 10-year period after the date of the enactment of this Act, and every 3 years thereafter.</text></paragraph>
<paragraph id="H1B16D391A0A4430B996EA60110AA9A41" display-inline="no-display-inline"><enum>(5)</enum><header>Members; chair</header><text>The President shall—</text> <subparagraph id="H565973FBE02F42B889BCBD73466E3095"><enum>(A)</enum><text>appoint 5 members of the Board by and with the advice and consent of the Senate; and</text></subparagraph>
<subparagraph id="H585B2ED7088747049C714A0881047C0A"><enum>(B)</enum><text>designate a Chair from among the members.</text></subparagraph></paragraph> <paragraph id="H847DBFE6D29F4307A95326C20658B92C"><enum>(6)</enum><header>Terms</header> <subparagraph id="H2C96421D4503414FA9DFCC0D9E8BC8FF"><enum>(A)</enum><header>Length</header><text>Each Board member shall be appointed for a term of 5 years.</text></subparagraph>
<subparagraph id="H4C607D3F5F95423CB50A4C4902418DD4"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">Each Board member shall not serve more than 2 terms.</text></subparagraph></paragraph> <paragraph id="H2633BB3E822B454390C76FF8CE3E5186"><enum>(7)</enum><header>Vacancy</header><text display-inline="yes-display-inline">A vacancy on the Board shall be filled in the manner in which the original appointment was made.</text></paragraph>
<paragraph id="H56614A8C508B4B4097D3C85EDF9FECAA"><enum>(8)</enum><header>Basic pay</header><text display-inline="yes-display-inline">To the extent or in the amounts provided in advance in appropriation Acts, members shall each be paid at a rate not to exceed the rate of basic pay for level II of the Executive Schedule.</text></paragraph></subsection> <subsection id="HF4B274B59E6B47CE9BA4C8CD362B123E"><enum>(d)</enum><header>Local boards</header> <paragraph id="H3301714E62094B85951A56989B280524"><enum>(1)</enum><header>Applications</header> <subparagraph id="H2055F71B474F473ABBFDF20C1458B0D3"><enum>(A)</enum><header>In general</header><text>In establishing local boards pursuant to subsection (c)(1)(A), the Board shall consider applications on a competitive basis from State and local governments, which shall include the following:</text>
<clause id="HE36AE5718DB84627BE4A0D236A4AB65B"><enum>(i)</enum><text display-inline="yes-display-inline">The location of the local board, which must be in a covered region that—</text> <subclause id="H36AF484BA876431BB7A5DB0704544B6A"><enum>(I)</enum><text>possesses relevant assets for the development of technology; and</text></subclause>
<subclause id="HF105678CB95C4065BBEC3F8EAE96F3ED"><enum>(II)</enum><text>does not possess a leading technology center.</text></subclause></clause> <clause id="H1F9AB0E60FD047ADA71049B1A64EADDE" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">A comprehensive strategy described under paragraph (2).</text></clause>
<clause id="H45CACC237C3B4D7A937E26C1219B13CD"><enum>(iii)</enum><text display-inline="yes-display-inline">A recommendation of individuals to be appointed to the local board.</text></clause></subparagraph> <subparagraph id="HAE7117E907164217841CF6F3A7500938"><enum>(B)</enum><header>Duration period</header><text display-inline="yes-display-inline">Each grant under this section shall be made for a period of 10 years, provided that the local board that receives such grant meets the requirements developed pursuant to subparagraph (C).</text></subparagraph>
<subparagraph id="HACF13D3CB37D42FB84E62307491C447E"><enum>(C)</enum><header>Requirements</header><text>The Board shall develop requirements for each local board based on the comprehensive strategy of each such local board.</text></subparagraph></paragraph> <paragraph id="H86979D188CD34496A397ABB05852568C"><enum>(2)</enum><header>Comprehensive strategy</header><text>Each local board shall submit to the Board a comprehensive strategy that includes the following:</text>
<subparagraph id="H95FB38ADFEB1442E8DA297AE94F5BBF5"><enum>(A)</enum><text>A technology development plan, including the focus of the local board and existing advantages for the development of a hub in the covered region of the local board.</text></subparagraph> <subparagraph id="HAE0B29FE30E44EC987195DC894351F25"><enum>(B)</enum><text>A spending plan, including an outline of the use of funds based on the duties of the local board under paragraph (3).</text></subparagraph>
<subparagraph id="HD74F12D696A54A57A94755087229F365"><enum>(C)</enum><text>A plan to address infrastructure barriers to the development of a hub, including—</text> <clause id="H7B6B9A4418F64FF6BF8B250059C80375"><enum>(i)</enum><text>the development of data infrastructure;</text></clause>
<clause id="H2837D5D9098645E98370EE0DD0C55C8C"><enum>(ii)</enum><text display-inline="yes-display-inline">remediation of environmentally damaged sites;</text></clause> <clause id="H162EFE19C61D444B8DC3EE1A5912204D"><enum>(iii)</enum><text>the development of buildings, labs, roads, and bridges; and</text></clause>
<clause id="HE2E00AF4A14F4A139651A37E62CC789E"><enum>(iv)</enum><text>improvements to airports, train stations, and other forms of public transit.</text></clause></subparagraph> <subparagraph id="H3B4991EF842744EEB568673A5053EEEF"><enum>(D)</enum><text>A higher education improvement plan, including—</text>
<clause id="HD18BF2CE42024A6497CC75799360F9EB"><enum>(i)</enum><text>hiring faculty;</text></clause> <clause id="H9CAC05E0F61D4EC0AF1B96F1315B7C64"><enum>(ii)</enum><text>supporting students; and</text></clause>
<clause id="HFBAEBB171C1B4446846841BFB6C5A4F2"><enum>(iii)</enum><text>partnering with institutions of higher education.</text></clause></subparagraph> <subparagraph id="H003A59EFBCA34D76B0C281F0E8B3F1C9"><enum>(E)</enum><text>A primary and secondary education improvement plan, including—</text>
<clause id="HAE8236288AB84B8F9C70614EF7B820A0"><enum>(i)</enum><text display-inline="yes-display-inline">an outline with respect to educating students in science, technology, engineering, and mathematics through the use of Federal resources; and</text></clause> <clause id="HC10F8F7474B04EFB8A1A08BB9426B429"><enum>(ii)</enum><text display-inline="yes-display-inline">an evidence-based program to overcome existing barriers to student achievement in the covered region.</text></clause></subparagraph>
<subparagraph id="H3572052D0937442F8B1752CBA7A85731"><enum>(F)</enum><text>A career placement plan based on the duties of the local board under paragraph (3).</text></subparagraph> <subparagraph id="H855977F7C4DA4C21A38729F9C482B256"><enum>(G)</enum><text>A plan to improve access to capital for local businesses.</text></subparagraph>
<subparagraph id="H37E73AF5F5D04BCF9B1F6FA9FC7AE700"><enum>(H)</enum><text>A sustainable growth plan that—</text> <clause id="H262C30A0A03F4CCFA70F443A16917EE2"><enum>(i)</enum><text>ensures housing remains affordable in the covered region; and</text></clause>
<clause id="H19E5A586BDF043BEBA016C264EEA646E"><enum>(ii)</enum><text>addresses environmentally damaged areas in the covered region.</text></clause></subparagraph></paragraph> <paragraph id="HE0DDD464F7E4446FB1D02A4D7458777C"><enum>(3)</enum><header>Duties of the local board</header><text display-inline="yes-display-inline">Each local board shall—</text>
<subparagraph id="H4DF1668F279E465895A0D0427FDD8DDA"><enum>(A)</enum><text display-inline="yes-display-inline">establish a hub and oversee the activities of such hub;</text></subparagraph> <subparagraph id="H81AFFAB8713E43EBB0775B3D7FBD81B4" commented="no"><enum>(B)</enum><text>make grants available for programs and research in the qualified subjects in covered regions, which may include grants to—</text>
<clause id="HB021721A35BC4251A3F31761E253F1D4"><enum>(i)</enum><text display-inline="yes-display-inline">promote the development of student skills at all levels, including—</text> <subclause id="HBC18D273D6A64101B5F67C33C8CE7FC7"><enum>(I)</enum><text>primary and secondary school improvements that support education in technology and the qualified subjects;</text></subclause>
<subclause id="HA1DB287832B74A9799295C6571EFA5FD"><enum>(II)</enum><text>fellowships for undergraduate students to support education in technology and the qualified subjects; and</text></subclause> <subclause id="H49C746C4C44B433890906B8CC6EA3669"><enum>(III)</enum><text display-inline="yes-display-inline">post-graduate fellowship programs to support such graduate students working in technology and the qualified subjects;</text></subclause></clause>
<clause id="H8730E5E6EC1940539935FAFF266068F3"><enum>(ii)</enum><text display-inline="yes-display-inline">improve the ability of local institutions of higher education to carry out leading-edge research in technology and the qualified subjects, including—</text> <subclause id="H95CF6D1986C548E89C2518A1B65CA532"><enum>(I)</enum><text display-inline="yes-display-inline">hiring faculty in the relevant areas;</text></subclause>
<subclause id="H477B33C29E474BEA92DACC4FA7E38719"><enum>(II)</enum><text display-inline="yes-display-inline">laboratory construction and development;</text></subclause> <subclause id="HE5570BDC3C89449B8797A51ECE0147D0"><enum>(III)</enum><text>developing and sponsoring programs to promote technological entrepreneurship among students (in partnership with leading firms in the covered region); and</text></subclause>
<subclause id="H3ABD5E5404514C229BBC94F5FA7F9144"><enum>(IV)</enum><text>developing partnerships with local businesses to facilitate the transition of students to the technology workforce; and</text></subclause></clause> <clause id="HF4CD962F0A3A44EF8028C1774FF8978C"><enum>(iii)</enum><text display-inline="yes-display-inline">develop effective pathways for career advancement in technology that creates and reduces the costs of—</text>
<subclause id="H2AD9A5F2E7EA4F4A916978D3D7BCEE6F"><enum>(I)</enum><text display-inline="yes-display-inline">training programs for work in technology jobs; and</text></subclause> <subclause id="H6C13DB41EF2942069D2D829C81D72A9F"><enum>(II)</enum><text display-inline="yes-display-inline">apprenticeship programs in technology jobs;</text></subclause></clause></subparagraph>
<subparagraph id="HC6DD88BBA0F04831B64A7DF1E37D2BA7"><enum>(C)</enum><text display-inline="yes-display-inline">develop effective infrastructure to promote the creation of a technology center as described in the plan under paragraph (2)(C); </text></subparagraph> <subparagraph id="H7CD8FF4A455C401DA82F841045528E43"><enum>(D)</enum><text>improve access to capital for businesses in the covered region, including—</text>
<clause id="H2D94B8E51D73485887A08FEB201FD0B1"><enum>(i)</enum><text>supporting partnerships with venture capitalists in regions with developed technology centers in the United States; and</text></clause> <clause id="H328DC364DA4242F6A4849CF42363E5D6"><enum>(ii)</enum><text>providing matching funds for Federal grants that support innovative businesses;</text></clause></subparagraph>
<subparagraph id="H2E601DBA30B74E9EBC17AC33DE601723"><enum>(E)</enum><text display-inline="yes-display-inline">develop and implement a plan for improving education in the qualified subjects;</text></subparagraph> <subparagraph id="H9D3E0A8EC9D842E1B0F81EB494128250"><enum>(F)</enum><text display-inline="yes-display-inline">develop and implement a plan for increasing employment opportunities in the covered region in which the local board is located, including—</text>
<clause id="HA19C867B368D46B98E5A062DF7A7FE76"><enum>(i)</enum><text>coordinating with the heads of businesses and institutions of higher education to support job placement in the covered region; and</text></clause> <clause id="H0CD9011AC76E4351AFE6B6BDBE3C5CBF"><enum>(ii)</enum><text display-inline="yes-display-inline">analyzing employment indicators with respect to high-wage job opportunities in the covered region of the local board to determine—</text>
<subclause id="H633502A4856B45FB9E8FE66AAEF50AF4"><enum>(I)</enum><text>areas that need development in such industries; and</text></subclause> <subclause id="H6D1759C25E6B439EBB623A768AC50B3D"><enum>(II)</enum><text>ways such industries would benefit from the advancement of technology;</text></subclause></clause></subparagraph>
<subparagraph id="H82D9EF0AA3CB46A2B104A90D0DCFE2C6"><enum>(G)</enum><text>analyze infrastructure in covered regions and provide policy recommendations to the Board with respect to inadequate infrastructure, including data infrastructure;</text></subparagraph> <subparagraph id="H5B29E4E201FD477AB969B52F0753E725"><enum>(H)</enum><text display-inline="yes-display-inline">analyze the cost of housing, zoning regulations, and laws related to housing in the covered region of the local board and provide policy recommendations to State and local governments to ensure the cost of housing remains affordable as the hub established pursuant to subparagraph (A) increases research activities in such covered region; and</text></subparagraph>
<subparagraph id="HC316D882D74E4724815B1DC0EA47EF21" display-inline="no-display-inline"><enum>(I)</enum><text>provide support for the development of technology, including establishing partnerships with institutions of higher education.</text></subparagraph></paragraph></subsection> <subsection id="H9008665D64C54D7DBCDC69C8D86D3869"><enum>(e)</enum><header>Gifts, bequests, and devises</header><text>Notwithstanding section 3302 of title 31, United States Code, and without further appropriation, the Board may accept, use, or dispose of gifts, bequests, or devises of services or property, both real and personal, for the purpose of aiding or facilitating the work of the Institute. Gifts, bequests, or devises of money and proceeds from sales of other property received as gifts, bequests, or devices shall be deposited in a private endowment for disbursement upon order of the Board.</text></subsection>
<subsection id="HEBFB674542914427A75D941115203C93"><enum>(f)</enum><header>Inspector General of the Federal Institute of Technology</header><text display-inline="yes-display-inline">Section 12 of the Inspector General Act of 1978 (<external-xref legal-doc="public-law" parsable-cite="pl/95/452">Public Law 95–452</external-xref>; 5 U.S.C. App.) is amended—</text> <paragraph id="H37AAFB167926474BB96E4B575F900EFF" display-inline="no-display-inline"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>the Board of Directors of the Federal Institute of Technology;</quote> after <quote>the Tennessee Valley Authority;</quote>; and</text></paragraph>
<paragraph id="HD65964B6D28A445699928C0AB75039A5"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>the Federal Institute of Technology,</quote> after the <quote>Tennessee Valley Authority,</quote>.</text></paragraph></subsection> <subsection id="H3B5A911325AE4DAC99EC83C41C2BC761"><enum>(g)</enum><header>Reports</header> <paragraph id="HFB0B764987E04F8DA18A747A2C732F9A" display-inline="no-display-inline"><enum>(1)</enum><header>Local board report</header><text>Not later than 1 year after the date of the enactment of this section, and annually thereafter, each local board shall submit to the Board a report containing recommendations based on the activities of each such local board, including recommendations for—</text>
<subparagraph id="H1C83B36C69B0460EA1220BC8A4B734FD"><enum>(A)</enum><text display-inline="yes-display-inline">legislation that—</text> <clause id="H2130C7F2AFD84F678697E39106159627"><enum>(i)</enum><text>supports research and education in the qualified subjects;</text></clause>
<clause id="H869F31723FAA4723A3357E8720F70D42"><enum>(ii)</enum><text>increases employment opportunities related to the qualified subjects;</text></clause> <clause id="H9E164D1E291642DB9572DE32D8E70083"><enum>(iii)</enum><text>addresses inadequate infrastructure in covered regions; and</text></clause>
<clause id="H92609B9B1ABC40AB97D6F338F7AD2819"><enum>(iv)</enum><text>ensures the cost of housing is affordable in covered regions;</text></clause></subparagraph> <subparagraph id="HB0DDC2FC6C884033ADE48B41EADD1DDF"><enum>(B)</enum><text display-inline="yes-display-inline">funding scientific development; and</text></subparagraph>
<subparagraph id="H458F175B6F6C45FCBE43BF2837A648AC"><enum>(C)</enum><text display-inline="yes-display-inline">policy priorities with respect to supporting scientific development.</text></subparagraph></paragraph> <paragraph id="H9CE00F35AC1248B7AF471774E91DEF4D"><enum>(2)</enum><header>Breakthrough science report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter, the Board shall submit to the President and Congress a report known as the <quote>Breakthrough Science Report</quote> containing recommendations for—</text>
<subparagraph id="HCECF0E69ED5D46F19690AE0A485978BC"><enum>(A)</enum><text>legislation based on the activities of the Institute; and</text></subparagraph> <subparagraph id="H9875AE51402449C088AEFD32E3DB8205"><enum>(B)</enum><text>policy priorities with respect to supporting scientific development, which shall take the funding priorities of the private sector into account.</text></subparagraph></paragraph>
<paragraph id="H8E8CD4510BB24752B0D14DC8B1EB6D56"><enum>(3)</enum><header>National Academy of Sciences report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter, the National Academy of Sciences shall submit to Congress a report on the activities of the local boards, including an analysis of research activities for areas that did not receive grants from such local boards.</text></paragraph> <paragraph id="H8824EA116EB949A983EE073FC0699C5A"><enum>(4)</enum><header>Authorization of appropriations; use of amounts</header> <subparagraph id="H48827FAAF0904311A1448106D54BADDC" display-inline="no-display-inline"><enum>(A)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated to the Board—</text>

<subclause id="HC85612EB5E5F431898CCAB59C913A65D"><enum>(II)</enum><text>Artificial intelligence.</text></subclause> <subclause id="HE79C7E3A35A74CCE8DB94307D2FD6F7F"><enum>(III)</enum><text>Biotechnology.</text></subclause>
<subclause id="H386C16A4546A4F0A96B231E6EBFF0286"><enum>(IV)</enum><text>Blockchain technology.</text></subclause> <subclause id="HB4AC2F926B5F45EA991EF781086CA60A"><enum>(V)</enum><text>Climate science.</text></subclause>

<clause id="H3ED6A0BDE102487296D02FAF05F43EDB"><enum>(ii)</enum><header>Covered region</header><text display-inline="yes-display-inline">The term <term>covered region</term> means a physical boundary identified by a local board and located near an institution of higher education. </text></clause> <clause id="HC3A8CAB4AB6D4BD48A1FAD921192570D"><enum>(iii)</enum><header>Hub</header><text display-inline="yes-display-inline">The term <term>hub</term> means a center for research in the qualified subjects.</text></clause>
<clause id="H336A05F09D964946A4294FAE611A561F"><enum>(iv)</enum><header>Qualified subjects</header><text display-inline="yes-display-inline">The term <term>qualified subjects</term> means mathematics and the physical, biological, engineering, social, and chemical sciences.</text></clause></subparagraph></paragraph></subsection></section> <section id="H5B05662738DE41FD80323A4918F88154" section-type="subsequent-section"><enum>4.</enum><header>Preference for software produced in rural areas and minority majority areas</header> <subsection id="HF768CF52D5EF4A6BAA73E19E3EB5E5C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">Chapter 33</external-xref> of title 41, United States Code, is amended by adding at the end the following:</text>

<section id="H7AA5F67AA2694F2B9DA3F70E2FF8D560"><enum>3313.</enum><header>Preference for software produced in rural areas and minority majority areas</header><text display-inline="no-display-inline">In awarding a contract for the procurement of software, an agency shall provide a contracting preference to an offeror who demonstrates in the bid or proposal of that offeror that at least 10 percent of the production or development of the software offered in that bid or proposal occurred in or will occur in—</text> <paragraph id="H47C5BA9FCE0443ADA97A66AF85210764"><enum>(1)</enum><text display-inline="yes-display-inline">a rural area, as that term is defined under section 343(a)(13) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)(13)</external-xref>); or</text></paragraph>
<paragraph id="H83853E9A400B480382D5ABBBEF8A2F08"><enum>(2)</enum><text display-inline="yes-display-inline">a ZIP Code in which over 50 percent of the residents of such ZIP Code are minorities, as that term is defined under section 365 of the Higher Education of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k</external-xref>). </text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HBAD6626F99B14ABBB0AA819934F00A9F"><enum>(b)</enum><header>Technical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">chapter 33</external-xref> of title 41, United States Code, is amended by inserting after the matter relating to section 3312 the following: </text>

<section id="HABE70BA2C80F4656AC933855AB8AD6B9" commented="no"><enum>5.</enum><header>Equal Employment Opportunity Commission rules required for employers to report information regarding employees</header><text display-inline="no-display-inline">The Equal Employment Opportunity Commission shall—</text> <paragraph id="HA6E135BBCB5A43EEA450DD7CFC1F42A8"><enum>(1)</enum><text display-inline="yes-display-inline">initiate a rulemaking proceeding, including notice and opportunity for public comment, not later than 90 days after the date of the enactment of this section, and</text></paragraph>
<paragraph id="H7859B28E826D41FDB299FD340AD1B77B"><enum>(2)</enum><text>issue rules not later than 18 months after the date of the enactment of this section,</text></paragraph><continuation-text continuation-text-level="subsection">to require employers to specify in the periodic employer information reports submitted to the Commission by each such employer the number of individuals employed by the employer, the number of individuals performing services billed hourly by head count or by team for the employer, the countries in which such respective individuals reside, and all of the revenue generated by the employer in each such country. </continuation-text></section> <section id="H3890CE788A6C431B8510008516B9AB74"><enum>6.</enum><header>Amendment to the Elementary and Secondary Education Act</header> <subsection id="HC482D4EC32AF4A428BB2E1D4B635108B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1111(b)(1)(C) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(1)(C)</external-xref>) is amended by striking <quote>and science</quote> and inserting <quote>science, and computer science</quote>.</text></subsection>
<subsection id="H18C9A11E0C77419C986ADF440A773DD1"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Not later than 5 years after the date of the enactment of this section, the amendment made by subsection (a) shall take effect.</text></subsection> <subsection id="HB50A72231EB7428CB4A6B59181715DEE"><enum>(c)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this section, each State educational agency shall submit to the Secretary a report on preparations made by local educational agencies within the State to implement academic standards for computer science as required under section 1111(b)(1)(C) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(1)(C)</external-xref>), as amended by subsection (a).</text></subsection></section>
<section id="H905C896C0956430A896A6C9A0214D0EC"><enum>7.</enum><header>Computer Science Education Grants</header>
<subsection id="H34ADDFF8BDCD4FE98A8DDF9F6A978698"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary of Education (referred to in this section as the <quote>Secretary</quote>) shall carry out a program known as the <quote>Computer Science Education Grant Program</quote> (referred to in this section as the <quote>Program</quote>) to make grants on a competitive basis to eligible entities to pay the Federal share of the costs of training teachers and developing computer science curriculum (which includes data analytics) in accordance with subsection (c).</text></subsection> <subsection id="H0C291FEB78594F4B963D9C2AB0B0B701"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the Program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></subsection>
<subsection id="H7976801D13174566B7481C5C311EF515"><enum>(c)</enum><header>Requirement for uses of grant funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under the Program shall use grant funds to—</text> <paragraph id="H93D68D29F52D495F858682E02F4117CE"><enum>(1)</enum><text display-inline="yes-display-inline">create opportunities for licensed elementary school teachers to pursue and receive training in computer science for the purpose of incorporating computer science in the curriculum and educational material of such teacher;</text></paragraph>
<paragraph id="H1AB9E494557C45D8B632BEE31D74CEA8"><enum>(2)</enum><text display-inline="yes-display-inline"> create opportunities for licensed secondary school teachers to add computer science endorsements to the license of each such teacher and to provide computer science learning experiences that are age-appropriate;</text></paragraph> <paragraph id="H4BE514ACEEDE482786B9ED3F2E3768FC"><enum>(3)</enum><text>provide assistance to States that do not have computer science standards for teachers or students to develop such standards and provide licenses and endorsements with respect to such standards;</text></paragraph>
<paragraph id="H3119C12279A84696943D5879C4E9677D"><enum>(4)</enum><text>create opportunities for teacher candidates interested in computer science to complete a full-year residency program specialized in computer science;</text></paragraph> <paragraph id="H06283F06D31B47FB8681253E3FA3BD69"><enum>(5)</enum><text>expand access for teachers and students to high-quality learning materials, including computer equipment and high speed network infrastructure that supports the study of computer science;</text></paragraph>
<paragraph id="H8C3CDDA165F7487983235C377F79EE00"><enum>(6)</enum><text display-inline="yes-display-inline">expand computer science education programs—</text> <subparagraph id="H4433A2964E01482C86BF6A640339620B"><enum>(A)</enum><text>at public institutions of higher education; and</text></subparagraph>
<subparagraph id="HA0E05536B96F4C298C9B967BC83CEAE9"><enum>(B)</enum><text>for the education of teachers;</text></subparagraph></paragraph> <paragraph id="H3D5CFEB63DAF45F9A283A4BB41C716C7"><enum>(7)</enum><text>create and implement plans for expanding access to rigorous classes in science, technology, engineering, and math for underrepresented groups, including minorities, girls, and youth from low-income families; and</text></paragraph>
<paragraph id="HC826E9B1880D487C814C2747B9FDFC5D"><enum>(8)</enum><text>ensure support and resources for students, which may include mentoring for students traditionally underrepresented in fields related to science, technology, engineering, and math.</text></paragraph></subsection> <subsection id="H49C1393887D74EFE859BA40681C9E647"><enum>(d)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to applicants that demonstrate greater need as determined by the Secretary.</text></subsection>
<subsection id="HD9ADC78CBB914057BF55BAA001DDDE24"><enum>(e)</enum><header>Evaluation and report</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under the Program shall—</text> <paragraph id="H8E77917F3547436097827914219B81CB"><enum>(1)</enum><text>conduct an evaluation on the effects of the Program, including any increase in the ability of teachers to teach computer science; and</text></paragraph>
<paragraph id="H847FBCCDFD184ED2A4447E701FA88D6C"><enum>(2)</enum><text>submit to the Secretary a report on such evaluation.</text></paragraph></subsection> <subsection id="H98970105F3B04FFBB21A7BA1A8D4F9FB"><enum>(f)</enum><header>Limitation on use of grant funds</header><text>An eligible entity that receives a grant under the Program may not use more than 20 percent of the grant funds to purchase computer equipment and network infrastructure.</text></subsection>
<subsection id="HEC8B63BC79CB44CFAA0E0816D25A92A6" display-inline="no-display-inline"><enum>(g)</enum><header>Grant duration and amount</header>
<paragraph id="H41F8DA5F597F4BC8A1D69F1C0807E8F6"><enum>(1)</enum><header>Duration</header><text>Each grant under this section shall be made for a period of 5 years.</text></paragraph> <paragraph id="H597FBF944F9A4202827807B86AB21080"><enum>(2)</enum><header>Amount</header><text>The Secretary shall determine the maximum amount of each grant under this section.</text></paragraph></subsection>
<subsection id="HE218290E55ED486E93F35DA2BBFDA52F" display-inline="no-display-inline"><enum>(h)</enum><header>Federal share</header><text display-inline="yes-display-inline">The Federal share of a grant under the Program shall not exceed 90 percent of the costs of carrying out the activities described in subsection (c).</text></subsection> <subsection id="HFC85797031E14798B1E49CEBD78C3290"><enum>(i)</enum><header>Supplement, not supplant</header><text display-inline="yes-display-inline">An eligible entity shall use a grant received under the Program only to supplement funds that would, in the absence of such grant, be made available from other Federal, State, or local sources for activities supported by the grant, not to supplant such funds.</text></subsection>
<subsection id="H5327A21E340B4FBEBA99FF228A7B93C6" commented="no"><enum>(j)</enum><header>Eligible entity defined</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text> <paragraph id="HF6CDC9AF6A5147F89E7447024BA8481F" display-inline="no-display-inline"><enum>(1)</enum><text>a State educational agency;</text></paragraph>
<paragraph id="H0A4DB0F6DF5949DCAB0276113216E5E5"><enum>(2)</enum><text display-inline="yes-display-inline">an institution of higher education; and</text></paragraph> <paragraph id="H7CA07B38F5CC42A18D6119D6D80BF67F"><enum>(3)</enum><text>a local educational agency.</text></paragraph></subsection>
<subsection id="H6411AF9258814A0491C5811114A95F9C"><enum>(k)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $8,000,000,000 for fiscal year 2021.</text></subsection></section> <section id="H19DB36AEA7C7460B88DBE1034DD1FDF9"><enum>8.</enum><header>Smart Students Everywhere Grants</header> <subsection id="H4B296E7B32944CC5BC89242DB922E406"><enum>(a)</enum><header>Eligible participants</header> <paragraph id="HF6B2BC0D8B83498A981E9084AB9C5956"><enum>(1)</enum><header>In general</header><text>Section 401A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-1">20 U.S.C. 1070a–1</external-xref>) is amended—</text>
<subparagraph id="HA3D889A0E9E448BF927DBBF4FDBA862F"><enum>(A)</enum><text>in subsection (a), by inserting <quote>or graduate</quote> before <quote>education</quote>;</text></subparagraph> <subparagraph id="H5800138989F7427194BB1FD4665630C8"><enum>(B)</enum><text>in subsection (b)—</text>
<clause id="H05A816E5495045D3858D45A6535FDAC4"><enum>(i)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></clause> <clause id="H87529D2F3DE342D1A51445081AA72784"><enum>(ii)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause>
<clause id="HA0B4A60D921A4A3AA6566757C722B8DC"><enum>(iii)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="H935E23FBACC34EA29B0B789068BD8DFC" display-inline="no-display-inline"> <paragraph id="H0AD5B51F52514221BDCAD392EA3AC116"><enum>(3)</enum><text display-inline="yes-display-inline">for the first through fourth year in a graduate program in science, technology, engineering, or mathematics shall be known as a <quote>SMART Students Everywhere Grant</quote>.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="HD467868D72894D5C932009D7CB3232F1"><enum>(C)</enum><text>by amending subsection (c) to read as follows: </text> <quoted-block style="OLC" id="H11DD8A3801504E9E8E1B5530201339FC" display-inline="no-display-inline"> <subsection id="H8004C39FC2514F91826C43FBEB37E680"><enum>(c)</enum><header>Definition of eligible student</header><text display-inline="yes-display-inline">In this section, the term <term>eligible student</term> means a student who—</text>
<paragraph id="H9CF64D42F2BF4426BAD4353EC62220A6"><enum>(1)</enum><text>either—</text> <subparagraph id="H267E908A769B4F5F939A2D0F0D19D6CD" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">received a high school diploma from a high school located in a county that has a college graduation rate that is below the national average; or</text></subparagraph>
<subparagraph id="H298B0D10225F45B19DFE241CBE7DCCE9" commented="no"><enum>(B)</enum><text>is a minority student; and</text></subparagraph></paragraph> <paragraph id="HF2212D32F9CD4A50B97C0B525AE572FD"><enum>(2)</enum><text>for the award year for which the determination of eligibility is made for a grant under this section—</text>
<subparagraph id="H01E0A6E3C1F545699D8AC92BB95D87EB"><enum>(A)</enum><text>except with respect to a student described in clause (C)(vi), is eligible for a Federal Pell Grant; </text></subparagraph> <subparagraph id="H3B0AEB864CF44F6EA742CB04DA050531"><enum>(B)</enum><text>is enrolled or accepted for enrollment in an institution of higher education on not less than a half-time basis; and</text></subparagraph>
<subparagraph id="HC0F1225AE55D48DFAF6E92233B6A57AE"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a student enrolled or accepted for enrollment in—</text> <clause id="H39F29669A7234A93BDC9DD4160F7DC8E"><enum>(i)</enum><text>the first year of a program of undergraduate education at an institution of higher education (including a program of not less than one year for which the institution awards a certificate)—</text>
<subclause id="H7AD02BC4BD174EECB0C38590714F66C1"><enum>(I)</enum><text>has not been previously enrolled in a program of undergraduate education, except as part of a secondary school program of study; and</text></subclause> <subclause id="H4877D15B00274A99BDD6A888120B5701"><enum>(II)</enum><text>is certified by the institution of higher education as pursuing a major in the physical, life, or computer sciences, mathematics, technology, or engineering (as determined by the Secretary pursuant to regulations); or</text></subclause></clause>
<clause id="H16AEE127B83C4F18B61D20ADD64E09E3"><enum>(ii)</enum><text>the second year of a program of undergraduate education at a two- or four-year degree-granting institution of higher education (including a program of not less than two years for which the institution awards a certificate), is certified by the institution of higher education as pursuing a major in a subject described in clause (i)(II);</text></clause> <clause id="HCD72DE98F2B14BFFBED5273DF50340C2"><enum>(iii)</enum><text display-inline="yes-display-inline">the third or fourth year of a program of undergraduate education at a four-year degree-granting institution of higher education, is certified by the institution of higher education to be pursuing a major in a subject described in clause (i)(II);</text></clause>
<clause id="HD72F06A46FA24C489680E1AE7B403869"><enum>(iv)</enum><text>the third or fourth year of a program of undergraduate education at an institution of higher education (as defined in section 101(a)), if such institution of higher education demonstrates, to the satisfaction of the Secretary, that—</text> <subclause id="H66C313F93900480AB875A45627475C6F"><enum>(I)</enum><text>such institution of higher education offers a single liberal arts curriculum leading to a baccalaureate degree, under which students are not permitted by the institution to declare a major in a particular subject area, and the student—</text>
<item id="HB16CD1B2106E4ADE8228CF3F2459CCDB"><enum>(aa)</enum><text display-inline="yes-display-inline">studies, in such years, a subject described in clause (i)(II) that is at least equal to the requirements for an academic major at an institution of higher education that offers a baccalaureate degree in such subject, as certified by an appropriate official from such institution; or </text></item> <item id="HD8A84BCF04594681BEB842C07363D645" commented="no"><enum>(bb)</enum><text>is required, as part of the student's degree program, to undertake a course of study in a subject described in clause (i)(II) which consists of at least—</text>
<subitem id="H0980C9917BFE4C3E8782F4D9BCBE8B6B" commented="no"><enum>(AA)</enum><text>4 years of study in mathematics; and</text></subitem> <subitem id="H2D018CBEDB8946879E004EB539B2CA93" commented="no"><enum>(BB)</enum><text>3 years of study in the sciences, with a laboratory component in each of those years; and </text></subitem></item></subclause>
<subclause id="H5EA5F163282A4E1ABC8A37B99E1179CE"><enum>(II)</enum><text>such institution offered such curriculum prior to February 8, 2006; </text></subclause></clause> <clause id="HD72BA3BA6A904AD4986D055128BDFEB9"><enum>(v)</enum><text display-inline="yes-display-inline">the fifth year of a program of undergraduate education that requires 5 full years of coursework, as certified by the appropriate official of the degree-granting institution of higher education, for which a baccalaureate degree is awarded by a degree-granting institution of higher education, is certified by such institution of higher education to be pursuing a major in a subject described in clause (i)(II); or</text></clause>
<clause id="HA0EB5EC56A5E4036817A4F943C771162"><enum>(vi)</enum><text display-inline="yes-display-inline">the first through fourth year of a graduate program at an institution of higher education, is certified by such institution of higher education to be pursuing a graduate degree (including a program of not less than two years for which the institution awards a certificate) in a subject described in clause (i)(II).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HD22D350D2EFB4A458E00E10E3193E6B9"><enum>(D)</enum><text>in subsection (d)—</text>
<clause id="HEF90ED40C20E4780881575ACA2507071"><enum>(i)</enum><text>in paragraph (1)—</text> <subclause id="H96957AED5F504457905236EEB1A95522"><enum>(I)</enum><text>by amending subparagraph (A) to read as follows: </text>
<quoted-block style="OLC" id="H40718CA5723A4202A066E71FAF2C73C7" display-inline="no-display-inline">
<subparagraph id="H31CB5907C8C24B2CABB92433C14B3699"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall award a grant under this section in the amount of—</text> <clause id="H44C4B70EAECC4A138FA247DAED2B129E"><enum>(i)</enum><text>$10,000 for an eligible student under clause (i) through (v) of subsection (c)(2)(C); and</text></clause>
<clause id="H855FD2608522498EB97A044C00E447B5"><enum>(ii)</enum><text>$20,000 for an eligible student under clause (vi) of subsection (c)(2)(C).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause> <subclause id="H1020A194F7874804BB9C8EFE5FE38568"><enum>(II)</enum><text>in subparagraph (B)(i), by striking <quote>a student</quote> and inserting <quote>an undergraduate student</quote> ; and</text></subclause>
<subclause id="H553BF6182F1B4CC0AFEC1355537ECFEC"><enum>(III)</enum><text>by adding at the end the following: </text> <quoted-block style="OLC" id="H81EFFC9A417A49F1958CF67EF78988F4" display-inline="no-display-inline"> <subparagraph id="HC138BF8219F24D699AF0A5E60AD49AFE"><enum>(C)</enum><header>Reduction for less than full-time graduate students</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), in any case in which a graduate that attends an institution of higher education on less than a full-time basis, the amount of the grant that such a student may receive shall be reduced in proportion to the degree to which such student is not so attending on a full-time basis. </text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause>
<clause id="H8491843E2709424482C7D6FAA7A72AAE"><enum>(ii)</enum><text>in paragraph (2)—</text> <subclause id="HADC1D04E80F1477C90F68B6E3F7C0A04"><enum>(I)</enum><text>in subparagraph (A), by inserting <quote>or graduate</quote> after <quote>undergraduate</quote>; and </text></subclause>
<subclause id="H3372C2FD820544829D87B3B75DC49E96"><enum>(II)</enum><text>in subparagraph (B), by striking <quote>subsection (c)(3)</quote> and inserting <quote>subsection (c)(2)(C)</quote>; and</text></subclause></clause> <clause id="H33F0DCEABBFD4E43BBF9138673E82415"><enum>(iii)</enum><text>in paragraph (3), by inserting <quote>to an undergraduate student</quote> before <quote>in the same manner</quote>; and</text></clause></subparagraph>
<subparagraph id="H95B613D3C06843F588D2E4AD54193933"><enum>(E)</enum><text>by striking subsections (e), (f), and (g) and inserting the following:</text> <quoted-block style="OLC" id="HE079B5661251479093EED4E86FED8023" display-inline="no-display-inline"> <subsection id="H47B5A7188C9C42E2AE7A63D5A7C6ACC6"><enum>(e)</enum><header>Report to Secretary</header><text display-inline="yes-display-inline">An institution of higher education shall submit to the Secretary a report on the students who receive a grant under this section, including data disaggregated with respect to the degree being pursued by such students and (if applicable) the earnings of such students.</text></subsection>
<subsection id="H055F6058D5974F2296D5EB48B3DD4A23"><enum>(f)</enum><header>Funding</header>
<paragraph id="HEBBF30F85AC442B2A0BD657EF36C5B99"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary of Education to carry out this section $5,000,000,000 for fiscal year 2020 and each fiscal year thereafter.</text></paragraph> <paragraph id="H647F267C390341CE82D030B98BFF888E"><enum>(2)</enum><header>Availability of funds</header><text display-inline="yes-display-inline">The amounts made available by paragraph (1) for any fiscal year shall be available from October 1 of that fiscal year and remain available through September 30 of the succeeding fiscal year.</text></paragraph>
<paragraph id="H9A3D135778DF46B38E08200C36B049F6"><enum>(3)</enum><header>Technical assistance</header>
<subparagraph id="H658368F3F6C54933B117CE014966A037"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Of the amounts appropriated for a fiscal year under paragraph (1), the Secretary may use 1 percent to carry out technical assistance in such fiscal year to institutions of higher education to assist such institutions of higher education in carrying out SMART Students Everywhere Grants.</text></subparagraph> <subparagraph id="H442F91A5BD2E4578B6B0F4712A935B4E"><enum>(B)</enum><header>Application</header><text display-inline="yes-display-inline">This paragraph shall only apply to the first 3 years after the date of the enactment of this paragraph in which—</text>
<clause id="HA56F5549F40240CB9F00152A845331F4"><enum>(i)</enum><text>amounts are appropriated under paragraph (1); and</text></clause> <clause id="H0B36535C0C9745BA941EDE949CE313E3"><enum>(ii)</enum><text>SMART Students Everywhere Grants are awarded under this section.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HD7F8F6015B274F0CBCA5E557CE5C2018"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date that is 1 year after the date of the enactment of this section.</text></paragraph></subsection> <subsection id="HD85E9748FF734534BD3A4A89AB6369D1"><enum>(b)</enum><header>Tax credit for first-Year wages of qualified recipients of a SMART grant</header> <paragraph id="H21037404F601458A8636A98E0308BBA5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of subparagraph (I), by striking the period at the end of subparagraph (J) and inserting a comma, and by adding at the end the following new subparagraph: </text>

<subparagraph id="H6C2D94C4993A4724B552E75103AB1504"><enum>(K)</enum><text display-inline="yes-display-inline">a qualified recipient of a SMART grant.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H5249C89531CF44A6ACD1FF22311C674E"><enum>(2)</enum><header>Definitions and special rules</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<paragraph id="H76F091637FE74BC2AF6641D71B90D623"><enum>(16)</enum><header>Qualified recipient of a SMART grant</header>
<subparagraph id="HFFD86CE060664B7C835D4EF8B1800F4E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualified recipient of a SMART grant</term> means any individual who is certified by the designated local agency as a recipient of a SMART Students Everywhere Grant pursuant to Section 401A of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a-1">20 U.S.C. 1070a–1</external-xref>) during the 1-year period ending on the hiring date.</text></subparagraph> <subparagraph id="H7BD8AC25A3574D0C883CEBAF6ACB8118"><enum>(B)</enum><header>Special rules for determining amount of credit</header><text display-inline="yes-display-inline">For purposes of applying this subpart to any qualified recipient of a SMART grant—</text>
<clause id="HE72B9D7A52D44ACC9DC8A0A40A0FB014" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">subsection (a) shall be applied by substituting <quote>5 percent (10 percent in the case of any specified recipient of a SMART grant)</quote> for <quote>40 percent</quote>, and</text></clause> <clause id="H1A72FE0D69FA4060BCC7D0F59F1353F5"><enum>(ii)</enum><text>subsection (b)(3) shall be applied by substituting <quote>$50,000</quote> for <quote>$6,000</quote> and all that follows in such subsection.</text></clause></subparagraph>
<subparagraph id="H4A403998D5D24F4C87931CBCF3AEB79A"><enum>(C)</enum><header>Aggregate credit dollar limitation per employer</header>
<clause id="H7A47902BD2474ACE8AE85EA64B030DD5"><enum>(i)</enum><header>Limitation with respect to qualified recipients of a SMART grant</header><text display-inline="yes-display-inline">The aggregate credit determined under subsection (a) with respect to qualified recipients of a SMART grant (other than specified recipients of a SMART grant) shall not exceed $10,000 for any taxable year of the taxpayer.</text></clause> <clause id="HDB5CF30143094AD784089F8864A8EA98" display-inline="no-display-inline"><enum>(ii)</enum><header>Limitation with respect to specified recipients of a SMART grant</header><text display-inline="yes-display-inline">The aggregate credit determined under subsection (a) with respect to specified recipients of a SMART grant shall not exceed $20,000 for any taxable year of the taxpayer.</text></clause></subparagraph>
<subparagraph id="H3CC86F5D23AD4A9B94ABEEF71E46DE67"><enum>(D)</enum><header>Specified recipient of a SMART grant</header><text>For purposes of this paragraph—</text> <clause id="H30736800190C4D1EA920946157F4FFC8"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>specified recipient of a SMART grant</term> means any qualified recipient of a SMART grant who is certified by the designated local agency as a veteran (as defined in paragraph (3)(B)), a minority, or employed in a designated county.</text></clause>
<clause id="H39AF9FE1D8E64D3D892960A7C30E713D"><enum>(ii)</enum><header>Designated county</header><text display-inline="yes-display-inline">In this paragraph, the term <term>designated county</term> means a county that has a college graduation rate that is below the national average.</text></clause> <clause id="H7856D90F2335475B8D9A1F88EBF6A9E5"><enum>(iii)</enum><header>Minority</header><text display-inline="yes-display-inline">In this paragraph, the term <term>minority</term> has the meaning given the term under section 365 of the Higher Education of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H7470B9B4026442B9BD419769D2D4FB38"><enum>(3)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this subsection shall apply to individuals who begin work for the employer after the date of the enactment of this section.</text></paragraph></subsection></section> <section id="HCED8D6E952284B5196E7F68F2DD0D4F2"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="HA0FE754F700C4F8FB1AC31E789CB302D"><enum>(1)</enum><header>Elementary and Secondary Education Act terms</header><text display-inline="yes-display-inline">The terms <term>institution of higher education</term>, <quote>local educational agency</quote>, and <quote>State educational agency</quote> have the meaning given the terms under section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph> <paragraph id="H8BD7B695A4604ED1AFF3E4BE021B0EA5"><enum>(2)</enum><header>Secondary and elementary school</header><text>The terms <term>secondary school</term> and <term>elementary school</term> have the meanings given the terms under section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></section>
