fees and costs in connection with consumer claim awards.</official-title></form><legis-body id="HD1FF6D7270734D32BC20E3EC3E072B70" style="OLC"><section section-type="section-one" id="HD1D589DB0D5A4B8C92FA00A4D568EBBE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Double Taxation of Successful Consumer Claims Act</short-title></quote>.</text></section><section id="H070DD5DCD98D457392AAC5C16B090BFE"><enum>2.</enum><header>Above-the-line deduction for attorney fees and costs in connection with consumer claim awards</header><subsection id="HC74EEA600B084DB49CD3C9B8D6A9C79E"><enum>(a)</enum><header>In general</header><text>The first sentence of paragraph (20) of <external-xref legal-doc="usc" parsable-cite="usc/26/62">section 62(a)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>or a claim of a consumer protection violation (as defined in subsection (f))</quote> after <quote>section 1862(b)(3)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)(3)(A)</external-xref>)</quote>.</text></subsection><subsection id="H5DA76A0CC7034CACA8635025594C1E93"><enum>(b)</enum><header>Consumer protection violation defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/62">Section 62</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H32B3022FF71144BF81C5AB33334746E2"><subsection id="HC02681FCCB18492B8FFD639044FD9EB5"><enum>(f)</enum><header>Consumer protection violation defined</header><text>For purposes of subsection (a)(20), the term <term>consumer protection violation</term> means an act that is unlawful under any of the following: </text><paragraph id="H4706202F3F89478A86DE760C2B8E9B47"><enum>(1)</enum><text>Section 987 of title 10, United States Code.</text></paragraph><paragraph id="H084661FC6BFD4618B0D114E73BD32E00"><enum>(2)</enum><text>Sections 6, 8, or 9 of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605</external-xref>, 2607, or 2608).</text></paragraph><paragraph id="H0E7877240E9A4734AEEC71BEC92D0222"><enum>(3)</enum><text>The Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4001">12 U.S.C. 4001 et seq.</external-xref>).</text></paragraph><paragraph id="H281CE2ACCB5043C9AADEA5C6A77B618C"><enum>(4)</enum><text>The Homeowners Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/12/4901">12 U.S.C. 4901 et seq.</external-xref>).</text></paragraph><paragraph id="H71AC14CB02834EBC8326D678A32F009E"><enum>(5)</enum><text>The Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et id="HEB6DACFBEC734453921B4A29C85E3B83"><enum>(9)</enum><text>The Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692">15 U.S.C. 1692 et Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/50/3901">50 U.S.C. 3901 et seq.</external-xref>).</text></paragraph><paragraph id="HA49722C8499241A58FAAEE1023A2BDB4"><enum>(15)</enum><text>Any provision of Federal law prohibiting unfair or deceptive trade or credit practices.</text></paragraph><paragraph id="HD4EB48336A8E4037A6A44D0C0F86BEBB"><enum>(16)</enum><text>Any provision of Federal, State, or local law, or common law claims permitted under Federal, State, or local law—</text><subparagraph id="H9808E3108C57473195E80E941AB36889"><enum>(A)</enum><text>providing for the enforcement of consumer protection, or</text></subparagraph><subparagraph id="H67EB6E6A7BA34E689B1046C516BE0495"><enum>(B)</enum><text>regulating any aspect of consumer transactions, including claims for unfair, deceptive, or abusive trade or credit practices, or for other actions that cause harm to an individual by a seller or provider of property, services, securities or other investments, money, or credit for personal, family, or household use.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5D47EDC92FE04F1FBF70C0C231A6EE37"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to attorney fees and court costs paid during taxable years ending after the date of the enactment of this Act with respect to any judgment or settlement occurring during such taxable years.</text></subsection></section></legis-body></bill>
