<section id="HC7E3460703D04B00B25722F148182A47" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping America’s Farmers Act</short-title></quote>. </text></section> <section id="H331D5DF27AA647FA96598939C59DCC2D"><enum>2.</enum><header>Agricultural economic injury disaster loan</header> <subsection id="H1BC26E1205304440A183459713995700"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H905F9CACE86E4914892D358BCB23DB8E"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text> <subparagraph id="H4CFCA4F9ECF547638F667F9202CB4703"><enum>(A)</enum><text display-inline="yes-display-inline">a producer—</text>
<clause id="H0B434C53104F4046AC45BA33843DDAE7"><enum>(i)</enum><text>of horticulture, nursery crops, floriculture, non-specialty crops, wool, livestock, dairy, aquaculture, or specialty crops; or</text></clause> <clause id="HC243628717744032879C3D8B87057906"><enum>(ii)</enum><text>engaged in the production of food and fiber; or</text></clause></subparagraph>
<subparagraph id="H9D393751772E4DA5AA9175F4941912B9"><enum>(B)</enum><text>a farmer or rancher.</text></subparagraph></paragraph> <paragraph id="H842CCB48A714441ABDE0282F786AAC26"><enum>(2)</enum><header>Large eligible entity</header><text>The term <term>large eligible entity</term> means an eligible entity with an adjusted gross income of greater than $500,000.</text></paragraph>
<paragraph id="H3F58F3117D114542BC0644656A3B3D8A"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Administrator of the Farm Service Agency. </text></paragraph> <paragraph id="H901837AEC41B409D9054AD9EECB729BA"><enum>(4)</enum><header>Small eligible entity</header><text>The term <term>small eligible entity</term> means an eligible entity with an adjusted gross income of less than or equal to $500,000.</text></paragraph></subsection>
<subsection id="HAC0F489392464185AA7972600BEC80C4"><enum>(b)</enum><header>Agricultural economic injury disaster loan program</header>
<paragraph id="H18583D12FBCA47B58AFEE03E890CA0F4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to make loans under this subsection to small eligible entities for the purposes described in paragraph (3). </text></paragraph> <paragraph id="H2A2464950A3B452D84175EAAD67628C8"><enum>(2)</enum><header>Terms of loans</header> <subparagraph id="H04A4003BCE034ACB9E1F323495055557"><enum>(A)</enum><header>Amount of loan</header><text display-inline="yes-display-inline">In carrying out this subsection, the Secretary shall make loans to small eligible entities in an amount less than or equal to $2,000,000.</text></subparagraph>
<subparagraph id="H28E8448257A24C41978BB7FA0A8BFC2C"><enum>(B)</enum><header>Interest rate</header><text display-inline="yes-display-inline">A loan under subparagraph (A) shall have an interest rate equal to zero percent.</text></subparagraph> <subparagraph id="H24A98B9B88CC4ED89EC745A3F4B04389"><enum>(C)</enum><header>Repayment</header><text>The Secretary shall establish the repayment terms with respect to each loan to a small eligible entity under this subsection, except that such repayment may not—</text>
<clause id="H4045AC8FDAB245548CC1646DBD23BB6C"><enum>(i)</enum><text>begin before the date that is 1 year after the date on which such loan is made to such small eligible entity; and</text></clause> <clause id="H42493BF4E00A46319DFA04502BB03C5A"><enum>(ii)</enum><text>be for a period of less than 10 years or a period of greater than 15 years; and</text></clause></subparagraph>
<subparagraph id="HC4B115A1310444CAA41354C0089DEC0D"><enum>(D)</enum><header>Waiver of certain requirements</header><text>With respect to a loan made under this subsection in response to an economic disaster, the Secretary shall waive—</text> <clause id="HD1DA48C9DD8440598AEE04386CD13EE6"><enum>(i)</enum><text>any rules related the personal guarantee on advances and loans of not more than $200,000 for all applicants;</text></clause>
<clause id="HD23553384D5A40B89C178C51B7380465"><enum>(ii)</enum><text>any requirement that the small eligible entity exhaust other loan options before applying for a loan under this subsection; and</text></clause> <clause id="H0E48B13C977E40D981390B0EF4E92DC7"><enum>(iii)</enum><text>any requirement that an applicant needs to be in business for the 1-year period before the disaster, except that no waiver may be made for a business that was not in operation on January 31, 2020.</text></clause></subparagraph>
<subparagraph id="HA4F322959D7F4133AD5F40B5176E5478"><enum>(E)</enum><header>Priority</header><text>In making loans under this subsection the Secretary shall give priority to—</text> <clause id="H51514E48E0EB435CB4D94DEEE764EA82"><enum>(i)</enum><text>small eligible entities located in States most impacted by an economic disaster, as determined by the Secretary;</text></clause>
<clause id="H3F3C798D52994450BCE4460B752C3564"><enum>(ii)</enum><text display-inline="yes-display-inline">minority, veteran, and women farmers and ranchers; and</text></clause> <clause id="HA3237DFDED9944519F2DFDE590DBBF36"><enum>(iii)</enum><text>such other small eligible entities as the Secretary determines appropriate.</text></clause></subparagraph></paragraph>
<paragraph id="H928F0AA5E79B4DD385A72AD29CF00F95"><enum>(3)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A small eligible entity that receives a loan under this subsection shall use the loan funds to—</text> <subparagraph id="HB54CB95B143C48C99C705FA74486D0BC"><enum>(A)</enum><text>provide paid sick leave to employees unable to work due to the direct effect of an economic disaster; </text></subparagraph>
<subparagraph id="H0880D44EDA4D40DAA68D78F94E6CE988"><enum>(B)</enum><text>maintain payroll to retain employees during business disruptions or substantial slowdowns;</text></subparagraph> <subparagraph id="H79481780168C409DB63B4F2FBA49E77C"><enum>(C)</enum><text>meet increased costs to obtain materials unavailable from the applicant's original source due to interrupted supply chains; </text></subparagraph>
<subparagraph id="H0C1D353E0AB7488BABD98C021F677598"><enum>(D)</enum><text>make rent or mortgage payments;</text></subparagraph> <subparagraph id="H895351495B3546D19AEE3A99AF836C3B"><enum>(E)</enum><text>purchase personal protective equipment; and</text></subparagraph>
<subparagraph id="H8292936A548B4C0F99A307F3816AD2FD"><enum>(F)</enum><text>repay obligations that cannot be met due to revenue losses. </text></subparagraph></paragraph> <paragraph id="H8CA5112D03404C1E956DC7D455CC1B3D" commented="no"><enum>(4)</enum><header>Forgiveness</header><text>A small eligible entity shall be eligible for forgiveness of indebtedness on a loan under this subsection in an amount determined by the Secretary based on the losses of the small eligible entity—</text>
<subparagraph id="HD85A7678581C43C4975D9489CCE1B7E2" commented="no"><enum>(A)</enum><text>due to commodity price decreases during an economic disaster; or</text></subparagraph> <subparagraph id="HF9C8DECCDFAC4419B6D15A36431C7D96" commented="no"><enum>(B)</enum><text>revenue loss due to an economic disaster, including from—</text>
<clause id="HF56445B2FB7E4CB5908993E25A00A8A6" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">canceled purchasing contracts or agreements with schools, institutions, food hubs, and restaurants; </text></clause> <clause id="H4F7A31E7F47F49C490ED8B6AD2D97950" commented="no"><enum>(ii)</enum><text>loss of recurring deliveries of farm products to schools, institutions, food hubs, and restaurants; or</text></clause>
<clause id="H7B8EEF8BD109444094020D2C20CE23AF"><enum>(iii)</enum><text display-inline="yes-display-inline">any other unexpected source during such economic disaster.</text></clause></subparagraph></paragraph></subsection> <subsection id="HAE4426A1432D4111B12FD038ED802326"><enum>(c)</enum><header>Loan guarantees</header><text>The Secretary may guarantee a loan made by lenders approved by the Farm Service Agency to large eligible entities if—</text>
<paragraph id="H203A3CDC64AA4292BDAAF4987758D57D"><enum>(1)</enum><text>such loan—</text> <subparagraph id="H906E580B6E5E4499AA253AE3D6C434FC"><enum>(A)</enum><text>is for the purposes described in subsection (b)(3);</text></subparagraph>
<subparagraph id="H855FEEC48754451C95461097EF639392"><enum>(B)</enum><text>is in an amount greater than $2,000,000;</text></subparagraph> <subparagraph id="H8A18AA490B9042E5A071A50B936AEFEA"><enum>(C)</enum><text>has an interest rate equal to or less than 1 percent; and</text></subparagraph>
<subparagraph id="H53456624A44745F3A2BE120F62D77737"><enum>(D)</enum><text>has a repayment term that—</text> <clause id="HB6BCEAA909E64EBBAFD6D9090CF1F0F2" display-inline="no-display-inline"><enum>(i)</enum><text>begins after the date that is 1 year after the date on which such loan is made an eligible entity; and</text></clause>
<clause id="HDBAA233E91FB4F5C8FE97FB980F4A39F"><enum>(ii)</enum><text>is for a period of not less than 15 years and not greater than 20 years; and</text></clause></subparagraph></paragraph> <paragraph id="H033B4EFB3F5E466BAFA68455C5A5E87D"><enum>(2)</enum><text>the lender making such loan offers forgiveness of indebtedness on such loan under such terms as the Secretary determines are commensurate with the loan forgiveness under subsection (b)(4). </text></paragraph></subsection>
<subsection id="HE592ECDDAC2E45EC91F88A58763D695B"><enum>(d)</enum><header>Approval and Ability To Repay for Small Dollar Loans</header><text>With respect to a loan made under subsection (b) in response to an economic disaster, the Secretary may—</text> <paragraph id="H3793FF83404B4E7C905907E880B40165"><enum>(1)</enum><text>approve an applicant based solely on the credit score of the applicant and shall not require an applicant to submit a tax return or a tax return transcript for such approval; or </text></paragraph>
<paragraph id="HAD71FF73B54E4257943625012910F013"><enum>(2)</enum><text>use alternative appropriate methods to determine an applicant's ability to repay. </text></paragraph></subsection> <subsection id="H55808790902543C4927426A497A8CFB1"><enum>(e)</enum><header>Emergency grant</header> <paragraph id="HB49279BBA8334519AFF7EE109A8AD26D"><enum>(1)</enum><header>In general</header><text>An eligible entity that applies for a loan under subsection (b) or a loan guarantee under subsection (c) in response to an economic disaster may request that the Secretary provide an advance that is, subject to paragraph (3), in the amount requested by such applicant to such applicant within 3 days after the Secretary receives an application from such applicant.</text></paragraph>
<paragraph id="H2FCEEC7486BF46DBB3F6F149392589E4"><enum>(2)</enum><header>Verification</header><text>Before disbursing amounts under this subsection, the Secretary shall verify that the applicant is an eligible entity by accepting a self-certification from the applicant under penalty of perjury pursuant to section 1746 of title 28 United States Code. </text></paragraph> <paragraph id="HFCB3619932E74A0B8F1E12166338F8A7"><enum>(3)</enum><header>Amount</header><text>The amount of an advance provided under this subsection shall be not less than $20,000.</text></paragraph>
<paragraph id="H8985330E80B047559BD48CB2D57BA076"><enum>(4)</enum><header>Use of funds</header><text>An advance provided under this subsection may be used to address any allowable purpose for a loan made under subsection (b) or a loan guarantee made under subsection (c).</text></paragraph> <paragraph id="HD2D5E502337440CCAF573EE219E6CCBF"><enum>(5)</enum><header>Repayment</header><text>An applicant shall not be required to repay any amounts of an advance provided under this subsection, even if subsequently denied a loan under subsection (b) or a loan guarantee under subsection (c).</text></paragraph></subsection>
<subsection id="H728A9210B1A34BBC8FD475658BB7444B"><enum>(f)</enum><header>Other benefits</header><text>Receipt of a grant, loan, or loan guarantee under this section shall not be construed as to prohibit receipt of any Federal grant, loan, or other aid.</text></subsection> <subsection id="HEA93FE8A95A14367998B3E8DDE8ACA22" commented="no"><enum>(g)</enum><header>Taxability</header><text display-inline="yes-display-inline">For purposes of the Internal Revenue Code of 1986—</text>
<paragraph id="H75CF0C28868B4D05A87E912ED82EB8EA"><enum>(1)</enum><text>any amount which would be includible in gross income of the eligible entity by reason of forgiveness described in this paragraph shall be excluded from gross income; and</text></paragraph> <paragraph id="H53C459D63A9E49C089655D5875ADAC95"><enum>(2)</enum><text>any amount received under this section shall be excluded from gross income. </text></paragraph></subsection>
<subsection id="HE9BECC283292410B9FC1B4E44A860C15"><enum>(h)</enum><header>Funding</header><text display-inline="yes-display-inline">There is hereby appropriated, out of any amounts in the Treasury not otherwise appropriated—</text> <paragraph id="H68C7C93C93FB4EC8B1C556F1ACB16DEC"><enum>(1)</enum><text>$6,000,000,000, to remain available until September 30, 2021, to make loans to small eligible entities under this section;</text></paragraph>
<paragraph id="H6E2FF21C975A41BC9C77F773A82D25AB"><enum>(2)</enum><text display-inline="yes-display-inline">$6,000,000,000, to remain available until September 30, 2021, to make loan guarantees to large eligible entities under this section;</text></paragraph> <paragraph id="HC316F5DB788A4E9D88C3B71F2BA6DE1D"><enum>(3)</enum><text display-inline="yes-display-inline">$4,000,000,000, to remain available until September 30, 2021, to make grants under subsection (e) to small eligible entities; and</text></paragraph>
<paragraph id="H3AF736C488BA4559BAF2854C58DE337B"><enum>(4)</enum><text display-inline="yes-display-inline">$4,000,000,000, to remain available until September 30, 2021, to make grants under subsection (e) to large eligible entities. </text></paragraph></subsection></section> <section id="H6566A0FB51B64EECBB584040AC123833"><enum>3.</enum><header>Training for loan servicers</header><text display-inline="no-display-inline">There is hereby appropriated, out of any amounts in the Treasury not otherwise appropriated, $300,000,000, to the Secretary of Agriculture to carry out a training program to provide Farm Service Agency staff with appropriate training relating to economic injury loan processing and servicing under section 2. </text></section>
