which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Nutrition Act of 1966 to extend certain certification periods for the special supplemental nutrition program for women, infants, and children, and for other purposes.</official-title></form><legis-body id="H032AA06B61A14648A6C0805A923B671A" style="OLC"><section id="H38B47C3AC6B8470989D0FCB73ECEA991" section-type="section-one"><enum>1.</enum><header>Extension of certain WIC certification periods</header><subsection id="H53C8D032D4E34C44B56DBB004AEF3329"><enum>(a)</enum><header>Expansion of adjunctive eligibility</header><text display-inline="yes-display-inline">Section 17(d)(2)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(2)(A)</external-xref>) is amended—</text><paragraph id="HAC71139D8AAB4B8E8621F2C33070CBF5"><enum>(1)</enum><text>in clause (ii)—</text><subparagraph id="H0D0F3171C1AF45C8AD39A0CA309D4691"><enum>(A)</enum><text>in subclause (I), by inserting <quote>resides in a household (as such term is defined in section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>)) that</quote> before <quote>receives</quote>; and</text></subparagraph><subparagraph id="HC832D82D26F44FD7818C24654AEAF2C4"><enum>(B)</enum><text>in subclause (II), by striking <quote>; or</quote> and inserting a semicolon; </text></subparagraph></paragraph><paragraph id="H9D953C96272843CCB99E43AEA589B740"><enum>(2)</enum><text>by amending clause (iii) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HE02ECDEB1C314C0FA9E7284B4BF0E7F2"><clause id="H4E6107F9427B4B32B9826F8333CE43FE"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H65A0590878244E6CB1E2E6FFAB5A0F93"><enum>(I)</enum><text display-inline="yes-display-inline">is enrolled in medical assistance under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) or child health assistance under title XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>); or</text></subclause><subclause id="H1919238D6B40452D9C4DE4753F3F926E" indent="up1"><enum>(II)</enum><text>is a member of a family in which a pregnant woman, postpartum woman, infant, or child receives such assistance;</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2F61F72B3670466282DD0F7CD49F80E7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB9B7CC688FE8457BBFA85A8B51FAA536"><clause id="H011367EA1978447383567F8B9324DED0" indent="up2"><enum>(iv)</enum><text display-inline="yes-display-inline">is enrolled as a participant in a program authorized under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>) or resides in a household in which one or more children is enrolled as a participant in such a Head Start program;</text></clause><clause id="H12957D6150914E928DC5BE8BAB6CEE3B" indent="up2"><enum>(v)</enum><text>resides in a household that receives assistance under the food distribution program on Indian reservations established under section 4(b) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(b)</external-xref>); or</text></clause><clause id="H43C64F697B1D4E76B0987EB5B7A09096" indent="up2" commented="no"><enum>(vi)</enum><text>resides in a household that receives assistance from a nutrition assistance program funded by the consolidated block grants for Puerto Rico and the American Samoa established under section 19 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2028">7 U.S.C. 2028</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6D6A72EB8C5D458AAFE145A1EDDD3E60"><enum>(b)</enum><header>Certification within one household family; certification of infants</header><text display-inline="yes-display-inline">Section 17(d)(3)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>)(d)(3)(A)) is amended—</text><paragraph id="H6DB5BE71BA814511956C662CB99F765C"><enum>(1)</enum><text>in clause (i), by striking <quote>clause (ii)</quote> and inserting <quote>clauses (ii) and (v)</quote>; and </text></paragraph><paragraph id="H569A533833564280B26C227ED03C004B"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDC099B09A22A4BED8EBD2DB5827EB5C5"><clause id="H5121FE7949544B1F8AB8B25A76F046D5" commented="no"><enum>(iv)</enum><header>Certification within one household family</header><text display-inline="yes-display-inline">In the case of an individual who is a member of a household participating in the program pursuant to clauses (i), (ii), or (iii) of paragraph (2)(A) and is certified for purposes of such clauses under subparagraph (D) or (E), a local agency may extend or establish, if such an extension or establishment would promote alignment between such family members, a certification period for family members of such individual who—</text><subclause id="H844A487D91C543CFAD51E79794BAEDDB" commented="no"><enum>(I)</enum><text>reside in the same household; and</text></subclause><subclause id="HCBA287FC35314986AF592C8359D4FC73" commented="no"><enum>(II)</enum><text>are—</text><item id="H99FA22E83E3547FD8B3902DF2864C9A2"><enum>(aa)</enum><text>participants in the program; or</text></item><item id="HA819CB099D6A4D4C92F8037E7D9BC264"><enum>(bb)</enum><text>eligible to participate in the program.</text></item></subclause></clause><clause id="HAD3E51DE7BF74C16A5A4A6F13C7D4B63"><enum>(v)</enum><header>Certification of infants</header><text>A State shall certify for participation, without further application, an infant born to a pregnant individual who is participating in the program pursuant to clause (iii) of paragraph (2)(A).</text></clause><clause id="H946A10BFB9A84100A42C401BC52A12F6"><enum>(vi)</enum><header>Recertification</header><text>Before requesting new income documentation for purposes of recertifying an individual under the program, a State shall—</text><subclause id="H0B19D4571A7248888747451FFD6D9B30"><enum>(I)</enum><text>determine whether such individual is eligible for recertification under subparagraph (E); and</text></subclause><subclause id="HD0E5EED4C95B4143AA5F7FD534C05A23"><enum>(II)</enum><text>if such individual is so eligible—</text><item id="H6D46DF3221374E8DBD831D4920519EAF"><enum>(aa)</enum><text>recertify such individual; and</text></item><item id="H44D08E0B5C274B608E53049BDB7BBFBA"><enum>(bb)</enum><text>notify such individual of such recertification.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB585F47BD1F340CABC763EB3CBEA967A"><enum>(c)</enum><header>Extension of child certification periods</header><text display-inline="yes-display-inline">Section 17(d)(3)(A)(iii) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)(iii)</external-xref>) is amended by striking <quote>1 year</quote> and inserting <quote>2 years</quote>.</text></subsection><subsection id="H61A91962301F4EBD9518E15C0F9707D8"><enum>(d)</enum><header>Automatic eligibility for children in kinship families</header><text display-inline="yes-display-inline">Section 17(f)(1)(C)(ix) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(f)(1)(C)(ix)</external-xref>) is amended by inserting <quote>a kinship family,</quote> after <quote>under the care of</quote>. </text></subsection></section></legis-body></bill>
