R. 4438</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210716">July 16, 2021</action-date><action-desc><sponsor name-id="S001195">Mr. Smith of Missouri</sponsor> (for himself, <cosponsor name-id="M001180">Mr. McKinley</cosponsor>, <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>, and <cosponsor name-id="R000603">Mr. Rouzer</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XI of the Social Security Act to exclude from Federal health care programs health care providers performing certain acts forcing contraception with respect to individuals subject to a conservatorship.</official-title></form><legis-body id="H085D006C4466497A9875BAB196871614" style="OLC"><section id="HE81C2164531C44708F93A826D2821273" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conservatorships Immoral Relationship with Contraception in the United States Act</short-title></quote> or the <quote><short-title>CIRCUS Act</short-title></quote>. </text></section><section id="HE9D55A4CA793486587EADCDCC2D21912"><enum>2.</enum><header>Excluding from Federal health care programs health care providers performing certain acts forcing contraception with respect to individuals subject to a conservatorship</header><text display-inline="no-display-inline">Section 1128(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320a-7">42 U.S.C. 1320a–7(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HEADA758086D64F8F83DADFF6C9F1104D" display-inline="no-display-inline"><paragraph id="H9E4B00A609364772A6766DF7A8A8BF67"><enum>(5)</enum><header>Certain acts forcing contraception with respect to individuals subject to conservatorship</header><text display-inline="yes-display-inline">Any health care provider that on or after the date of the enactment of this paragraph—</text><subparagraph id="H4F0D5EB76F9F4E99BB8ED943E8FAC54E"><enum>(A)</enum><text display-inline="yes-display-inline">denies the removal of an intrauterine device or other contraceptive device from an individual who is subject to a conservatorship by reason of the conservator not approving of such removal; or </text></subparagraph><subparagraph id="H398078F42EFD4089B0CD63A079465B3F"><enum>(B)</enum><text display-inline="yes-display-inline">knowingly prescribes birth control medication (including any method of contraception approved or otherwise authorized by the Food and Drug Administration) to an individual subject to a conservatorship without the written consent of such individual. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
