R. 4407</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210713">July 13, 2021</action-date><action-desc><sponsor name-id="B001303">Ms. Blunt Rochester</sponsor> (for herself, <cosponsor name-id="L000585">Mr. LaHood</cosponsor>, and <cosponsor name-id="D000619">Mr. Rodney Davis of Illinois</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide a waiver of the cap on annual payments for nursing and allied health education payments.</official-title></form><legis-body id="HCF6FBB695D4F49A0B229D3DDF70284F0" style="OLC"><section id="H723A9C6E3355464884447023C673F726" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Technical Reset to Advance the Instruction of Nurses Act</short-title></quote> or the <quote><short-title>TRAIN Act</short-title></quote>.</text></section><section id="H6283D0D82A2443189F19045FE74E3026"><enum>2.</enum><header>Waiver of cap on annual payments for nursing and allied health education payments</header><subsection id="H03BF3557D2734A96AF5AD6FC0381F2E6"><enum>(a)</enum><header>In general</header><text>Section 1886(l)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(l)(2)(B)</external-xref>) is amended—</text><paragraph id="H944B6D31DE4E42739B4EAF346C79DE03"><enum>(1)</enum><text>by striking <quote><header-in-text style="OLC" level="subparagraph">payments</header-in-text>.—Such ratio</quote> and inserting “<header-in-text level="subparagraph" style="OLC">payments</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="H820B0312795F4BAB8F051127B3D9352E"><clause id="HA05E834EA12248F88902F8F6AF8E4A78"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), such ratio</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HD35BF88D5F1847468309A54E4AB9D9ED"><enum>(2)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H77611FAC97504E8C81E080BCCD2BE7CF"><clause id="H8704E9701E4745E2B24254C580AD306D"><enum>(ii)</enum><header>Exception to annual limitation for each of 2010 through 2019</header><text>For each of 2010 through 2019, the limitation under clause (i) on the total amount of additional payments for nursing and allied health education to be distributed to hospitals under this subsection for portions of cost reporting periods occurring in the year shall not apply to such payments made in such year.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H85F60A8394CB49D7870D460BA0165603"><enum>(b)</enum><header>No affect on payments for direct graduate medical education</header><text>Section 1886(h)(3)(D)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(h)(3)(D)(iii)</external-xref>) is amended by adding at the end the following sentence: <quote>In applying the preceding sentence for each of 2010 through 2019, the Secretary shall not take into account any increase in the total amount of such additional payment amounts for such nursing and allied health education for portions of cost reporting periods occurring in the year pursuant to the application of paragraph (2)(B)(ii) of such subsection.</quote>.</text></subsection><subsection id="H3E80EB7296154319B7210F9D221063C9"><enum>(c)</enum><header>Retroactive application</header><text>The amendments made by this section shall apply to payments made for portions of cost reporting periods occurring in 2010 and subsequent years.</text></subsection></section></legis-body></bill>
