R. 4405</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210709">July 9, 2021</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to waive or reduce the amount of over-the-counter monograph fees applicable to small businesses, and for other purposes.</official-title></form><legis-body id="H3A26CD9F6DD04785B6B795D40825B763" style="OLC"><section id="H13BF3701E5F44B719466E56EE5BD29A7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business FDA User Fee Adjustment Act of 2021</short-title></quote>.</text></section><section id="H0690798593BB45C583A69B26CD61CF11"><enum>2.</enum><header>Waiver and reduction of OTC monograph fees for small businesses</header><subsection id="H3209887250264D7097539BF87FE0E70C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 744M of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379j-72">21 U.S.C. 379j–72</external-xref>) is amended—</text><paragraph id="H7E69B272120844F290B4724B80D06418"><enum>(1)</enum><text>by redesignating subsections (d) through (h) as subsections (e) through (i), respectively; and</text></paragraph><paragraph id="H1319917873164EC1A3CFEA65071687AE"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" id="H479CC5E29FD3498C84B2AF5D1E7FEA8B" display-inline="no-display-inline"><subsection id="HF368E8D338614C3687208AAEEB6C7AE8"><enum>(d)</enum><header>Fee waiver and reduction for small businesses</header><paragraph id="H25E5FC7CF1A94A6BAEFB1892196321CA"><enum>(1)</enum><header>In general</header><text>Beginning with respect to fiscal year 2022:</text><subparagraph id="H6ECC9921E28D4EDFBB1724D29D14DD97"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary shall waive the fee under subsection (a)(2) with respect to the first OTC monograph order request that a small business submits to the Secretary for review. </text></subparagraph><subparagraph id="H6026DE5AFBBE47CC9C6819990045306D"><enum>(B)</enum><text>The Secretary shall reduce the fees that are applicable to a small business under subsections (a)(1) (facility fees) and (a)(2) (OTC monograph order request fees), and not waived under subparagraph (A), to 25 percent of the amount otherwise owed.</text></subparagraph></paragraph><paragraph id="HE0EB12461A7B4EB1854963B4B30EC2B1"><enum>(2)</enum><header>Certification</header><text display-inline="yes-display-inline">The Secretary shall require any person who applies for a waiver or reduction of fees under paragraph (1) to certify their qualification for the waiver or reduction. The Secretary shall periodically publish in the Federal Register a list of persons making such certifications.</text></paragraph><paragraph id="H9672C6C923154FE09261A36AD89AF8A4"><enum>(3)</enum><header>Small business defined</header><text>In this subsection, the term <term>small business</term> means an entity that has fewer than 500 employees, including employees of affiliates</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE88EE22F1CF54A56AD579F31DBA45DB3"><enum>(b)</enum><header>Conforming change to fee revenue amounts</header><text display-inline="yes-display-inline">Section 744M(b)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379j-72">21 U.S.C. 379j–72(b)(2)</external-xref>) is amended by striking <quote>For each of the fiscal years 2022 through 2025</quote> and inserting <quote>Subject to subsection (d), for each of the fiscal years 2022 through 2025</quote>. </text></subsection></section></legis-body></bill>
