display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Internet Connections for Rural America Act</short-title></quote>.</text></section><section id="H8F9432C09E7C4523A7FCDF4A12A76017"><enum>2.</enum><header>Innovative broadband advancement program</header><text display-inline="no-display-inline">Section 603(e) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb-2">7 U.S.C. 950bb-2(e)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7EE5C461838E4F0EAE51D891167A68CB" changed="added" reported-display-style="italic" committee-id="HAG00"><subsection id="H3FDE12BEAB524D61AA41FFB081E7C1A9"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="HD8206B8D080B4842B561F94CCD11EEE3"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary $300,000,000 for each of fiscal years 2022 through 2029, to remain available until expended, to carry out projects in States and territories selected by the Secretary to be diverse on the basis of geography, topography, and demographics.</text></paragraph><paragraph id="H8FFDD451FEF945E1BEC17FA8E8A82E85"><enum>(2)</enum><header>Limitation</header><text>Not more than $25,000,000 of the amounts made available under paragraph (1) for each fiscal year may be provided for a single project.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1C8FF169EA9E4F5D9A99D28C362FC7CF"><enum>3.</enum><header>Rural broadband program loans and grants</header><subsection id="HAB57A152C4A043EA9D1148C61A3BDACF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 601 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb">7 U.S.C. 950bb</external-xref>) is amended—</text><paragraph id="HAB77CCC7FDB2493393489805B3347384"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Access to broadband telecommunications services in rural areas</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Reconnect rural broadband program</header-in-text></quote>;</text></paragraph><paragraph id="H31055ABD584D483DB1F303812C8AE1C2" display-inline="no-display-inline"><enum>(2)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0936B545B6184354AF7465911375ACE9" changed="added" reported-display-style="italic" committee-id="HAG00"><subsection id="H9F342E4E268D495783AC66C6916F8DF7"><enum>(a)</enum><header>Establishment; purpose</header><text display-inline="yes-display-inline">The Secretary shall establish a program, which shall be known as the <quote>ReConnect Rural Broadband Program</quote>, to provide grants, loans, and loan guarantees to finance the costs of the construction, improvement, and acquisition of facilities and equipment for broadband service in rural areas.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H0AC1E2F666BF4A1D9FD8E81E8F996C66"><enum>(3)</enum><text>in subsection (c)(2), by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3BB10374AEA947558F5F078788BA3A36" changed="added" reported-display-style="italic" committee-id="HAG00"><subparagraph id="H2A26BBA3270948ACB1A97B0E2C8F996D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In making grants, making loans, and guaranteeing loans under paragraph (1), the Secretary shall give the highest priority to applications for projects to provide broadband service to unserved rural communities that do not have any residential broadband service of at least—</text><clause id="H6E7AC6424ACB4C8EBBF358494A490DDB"><enum>(i)</enum><text>a 10–Mbps downstream transmission capacity; and</text></clause><clause id="HB61DE601F79946AE828960CA024E2DBF"><enum>(ii)</enum><text>a 1–Mbps upstream transmission capacity.</text></clause></subparagraph><subparagraph id="HD21150A0F98941D6B97799C28FD7E7ED" display-inline="no-display-inline"><enum>(B)</enum><header>Other</header><text display-inline="yes-display-inline">After giving priority to the applications described in clauses (i) and (ii) of subparagraph (A), the Secretary shall then give priority to applications for projects to provide broadband service to rural communities—</text><clause id="H052BF919510B4A7585FCDC1151BD4769"><enum>(i)</enum><text>with a population of less than 10,000 inhabitants; or</text></clause><clause id="HF1CFFEE524BB45F288BBB94F0B07A5D8"><enum>(ii)</enum><text>with a high percentage of low income families or persons (as defined in section 501(b) of the Housing Act of 1949).</text></clause></subparagraph><subparagraph id="HFE0914A29189410492F58C0B589664B4" display-inline="no-display-inline"><enum>(C)</enum><header>Ports in rural areas priority</header><clause id="H31A82D137AD34B02806B7B495CE9F514"><enum>(i)</enum><header>Definition of port</header><text display-inline="yes-display-inline">In this subparagraph, the term <quote>port</quote> means—</text><subclause id="H148B60A490294E2D96C23A5E9141587D"><enum>(I)</enum><text>any port on the navigable waters of the United States, including territories;</text></subclause><subclause id="H37293B3C88D64037B74B21FAD413DE5D"><enum>(II)</enum><text>any harbor, marine terminal, or other shore side facility used principally for the movement of goods on inland waters; and</text></subclause><subclause id="HF80A92801C044690B3C002BAF1DC994F"><enum>(III)</enum><text>any port formed in accordance with applicable State or territory law.</text></subclause></clause><clause id="H83BCECC802AF44DD949A2A649E62EB20"><enum>(ii)</enum><header>Priority</header><text>In addition to the priority given under subparagraph (B), the Secretary shall give equal priority to an application for a project that would increase the availability of broadband service in a port in a rural area.</text></clause></subparagraph><subparagraph id="HA2848137A5914B1DA51BAEDB39861E5A" display-inline="no-display-inline"><enum>(D)</enum><header>Additional considerations</header><text display-inline="yes-display-inline">In making grants, making loans, and guaranteeing loans under this subsection, the Secretary shall consider whether an application was developed with the participation of community stakeholders, and will receive a substantial portion of the funding for the project from community stakeholders or other non-Federal sources.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HBAC780B18F8C4848A3CE7CCE5DE903CE"><enum>(4)</enum><text>in subsection (c)(3)—</text><subparagraph id="HC47C75FA00164D0E82929CE1FCF6E13B"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="H61E0407DD95446D4A568A712BF06FC94"><enum>(i)</enum><text>by striking <quote>and</quote> at the end of clause (i);</text></clause><clause id="H60F5D8FFA0D44BB0A8C31A056A92D20D"><enum>(ii)</enum><text>by striking the period at the end of clause (ii) and inserting <quote>; and</quote>; and</text></clause><clause id="HE0FFD53E7DAC4167A59725F14747F00E"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HDD7FD54833984F1BA4ECCC76ECD3FD71" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HAG00"><clause id="H68EFF022757C40DE830B055ADB2DDBA2"><enum>(iii)</enum><text display-inline="yes-display-inline">shall be subject to a grant agreement of not less than ten years.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H621AE71FEBF2401B94FD8169D96C6B23"><enum>(B)</enum><text>in subparagraph (D)(i)—</text><clause id="HB7352C977EAD463AB069A136F73EA085"><enum>(i)</enum><text>in subclause (I), by striking <quote>(2)(A)(i)</quote> and inserting <quote>(2)(A)</quote>; and</text></clause><clause id="HB7960F839793478F861077645A058A37"><enum>(ii)</enum><text>in subclause (II), by striking <quote>any of subclauses (I) through (IV) of paragraph (2)(B)(i)</quote> and inserting <quote>clause (i) or (ii) of paragraph (2)(B)</quote>; and</text></clause></subparagraph><subparagraph id="HFD80809E1BA0461E9BFC4A902A2E9422"><enum>(C)</enum><text>by striking subparagraph (E) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H90557FC32E8D4CA4BA66FAB0659E8E0C" changed="added" reported-display-style="italic" committee-id="HAG00"><subparagraph id="H2E57EAC16D6748F69C5A90D48160E5F8"><enum>(E)</enum><header>Applications</header><clause id="H90385F118B3342348895397A47A4FB34"><enum>(i)</enum><header>Grant-only applications</header><text display-inline="yes-display-inline">The Secretary shall establish an application process that permits an application for a grant-only award.</text></clause><clause id="H377A2E775A2A442493F23D41FE78FCE5"><enum>(ii)</enum><header>Combined applications</header><text display-inline="yes-display-inline">The Secretary shall establish an application process that permits—</text><subclause id="HF7A4247DD8C54A5AAF50DDB0756017F7"><enum>(I)</enum><text>a single application for a grant and a loan under title I or II, or this title, that is associated with the grant; and</text></subclause><subclause id="HED23CBB873764EE988A84548032C956E"><enum>(II)</enum><text>provides a single decision to award the grant and the loan.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H62B2F2D36D844DDBAF1DC0C66E9008B3"><enum>(5)</enum><text>in subsection (d)(2)—</text><subparagraph id="HEE6EA170832D41D58AD2B17D4FA10A42"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="H824D2E25774842EF90276E267F33C13B"><enum>(i)</enum><text>by striking <quote>subparagraphs (B) and (C)</quote> and inserting <quote>subparagraph (B)</quote>;</text></clause><clause id="H8E0C65DD26B74B2BAE7EF1C33867C7E8"><enum>(ii)</enum><text>by striking <quote>is submitted—</quote> and all that follows through <quote>(i) not less</quote> and inserting <quote>is submitted not less</quote> ; and</text></clause><clause id="HFCDF1DA195BE4AA9B78A619A55C1BAED"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking <quote>(e); and</quote> and all that follows and inserting <quote>(e).</quote>;</text></clause></subparagraph><subparagraph id="HDD2940E517B84F7FA2CD264478413B41"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>Subparagraph (A)(i)</quote> and inserting <quote>Subparagraph (A)</quote>; and</text></subparagraph><subparagraph id="HCD6AE6AF33E343E1A2B3C099C41967C7"><enum>(C)</enum><text>by striking subparagraph (C);</text></subparagraph></paragraph><paragraph id="H2FF1789B3832472D93B5CE5DD0E79CCD"><enum>(6)</enum><text>in subsection (d), by striking paragraph (5);</text></paragraph><paragraph id="H23B29F92AAAD4E4E84041C5DBD571582"><enum>(7)</enum><text>by striking subsection (j) and inserting the following:</text><quoted-block style="OLC" id="H5A4512507B1C4F6B90684964C8F953D7" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HAG00"><subsection id="H821B9462AD264D4CA4F5328AC6AE5494"><enum>(j)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $4,500,000,000 for each of fiscal years 2022 through 2029, to remain available for 5 fiscal years after the fiscal year for which appropriated. </text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5F4C8EF0C661491FBB13D828AA16BE34"><enum>(8)</enum><text>in subsection (k), by striking <quote>2023</quote> and inserting <quote>2029</quote>.</text></paragraph></subsection><subsection id="HF71E58790EFC454BA028672E5083DBBC"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Agriculture shall promulgate rules to carry out the amendments made by subsection (a) of this section, and complete the biennial review process required by section 601(e)(2) of the Rural Electrification Act of 1936.</text></subsection><subsection id="H32378F514F5048D0B4DE3D4721B80FA7"><enum>(c)</enum><header>Sunset</header><text display-inline="yes-display-inline">The authorities provided by section 779 of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) shall have no force or effect after June 30, 2022.</text></subsection><subsection id="H1CEA382F190D4878A65FC0091013B1B8"><enum>(d)</enum><header>Transition rules</header><paragraph id="HED9B0488529543229233813B627A4DD7"><enum>(1)</enum><header>Availability of funds for administrative costs</header><text display-inline="yes-display-inline">Not more than 1 percent of the unobligated balances of amounts made available as of June 1, 2021, to carry out the pilot program described in section 779 of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) may be used for the costs of transitioning from the pilot program to the program under section 601 of the Rural Electrification Act of 1936, as amended by this Act.</text></paragraph><paragraph id="H57777F8E6700494FBE1FB053D42BF1C1"><enum>(2)</enum><header>Consolidation of funds</header><subparagraph id="HA5B9E1CF89C74F0DA948E9A8BA7E5FCB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The unobligated balances of all amounts made available on or before June 30, 2022, to carry out the pilot program described in section 779 of the Consolidated Appropriations Act, 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/141">Public Law 115–141</external-xref>) that are in excess of the amount described in subparagraph (B) of this paragraph are hereby transferred to and merged with amounts made available to carry out the program authorized under section 601 of the Rural Electrification Act of 1936.</text></subparagraph><subparagraph id="H8D2766E394C44B91842DB50477A5944C"><enum>(B)</enum><header>Unfunded approvals</header><text display-inline="yes-display-inline">The amount described in this subparagraph is the amount required to fully fund each project approved as of June 30, 2022, under the pilot program described in such section 779 for which amounts were not obligated or partially obligated as of such date.</text></subparagraph></paragraph></subsection></section><section id="H8742DDD415D142B5B3427036FB3332C4"><enum>4.</enum><header>Community Connect grants</header><text display-inline="no-display-inline">Section 604(g) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb-3">7 U.S.C. 950bb-3(g)</external-xref>) is amended by striking <quote>$50,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$150,000,000 for each of fiscal years 2022 through 2029, to remain available for 2 fiscal years after the fiscal year for which appropriated</quote>.</text></section><section id="HABFFF319EAF449F29B72C9493AD0BA68"><enum>5.</enum><header>Distance learning and telemedicine loans and grants</header><text display-inline="no-display-inline">Section 2335A of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/950aaa-5">7 U.S.C. 950aaa–5</external-xref>) is amended by striking <quote>$82,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$150,000,000 for each of fiscal years 2022 through 2029, to remain available for 2 fiscal years after the fiscal year for which appropriated</quote>.</text></section><section id="H66A5866CD38D44F5A17FF904533F45AD"><enum>6.</enum><header>Expansion of middle mile infrastructure into rural areas</header><text display-inline="no-display-inline">Section 602(g) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950bb-1">7 U.S.C. 950bb-1(g)</external-xref>) is amended by striking <quote>$10,000,000 for each of fiscal years 2018 through 2023</quote> and inserting <quote>$300,000,000 for each of fiscal years 2022 through 2029, to remain available for 2 fiscal years after the fiscal year for which appropriated</quote>.</text></section><section id="H016461C8D12F4D08AD5BBD3CE1865A03"><enum>7.</enum><header>Broadband Connectors Program</header><subsection id="H5CE29A3F462B4C6281DD801E797D3AEA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall establish a system for the dissemination of information and technical assistance on the broadband programs of the Department of Agriculture, which shall be for the use of entities eligible, such as Indian tribes and tribal organizations, to receive funds under title II or VI of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/901">7 U.S.C. 901 et seq.</external-xref>) or chapter 1 of subtitle D of title XXIII of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/950aaa">7 U.S.C. 950aaa et seq.</external-xref>).</text></subsection><subsection id="HECFBA1F33A4D41C2AD33BE171145F814"><enum>(b)</enum><header>Limitations on authorization of appropriations</header><text>To carry out subsection (a), there are authorized to be appropriated to the Secretary of Agriculture not more than $25,000,000 for each of fiscal years 2022 through 2029, which are authorized to remain available through fiscal year 2029.</text></subsection></section><section id="HB67D76AAAA1D4346BFF6B98E61860F6F" section-type="subsequent-section" display-inline="no-display-inline"><enum>8.</enum><header>Community broadband mapping</header><text display-inline="no-display-inline">Section 701 of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950cc">7 U.S.C. 950cc</external-xref>) is amended by redesignating subsection (e) as subsection (f) and inserting after subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9EB35A9F51534E3C9B5FDDC1720B4C9C" changed="added" reported-display-style="italic" committee-id="HAG00"><subsection id="H7CB98F43E9F145AD9B77743B8880070B"><enum>(e)</enum><header>Community broadband mapping program</header><paragraph id="H7C2507BE32B84C0AA18C3064D6E99460"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may make grants to eligible entities for the purpose of collecting broadband service data to assist the Secretary in—</text><subparagraph id="H2C96B1349A3D4F60AEE08FDA166393A8"><enum>(A)</enum><text>establishing the availability of broadband service or middle mile infrastructure in a rural area;</text></subparagraph><subparagraph id="H6CC4AE2B0190450796AAD862A8EBCDD1"><enum>(B)</enum><text>determining the eligibility of a community for assistance under any broadband program administered by the Secretary; or</text></subparagraph><subparagraph id="HAC0099C29C994444A39EF0576420EBF5"><enum>(C)</enum><text>undertaking a service area assessment under this section.</text></subparagraph></paragraph><paragraph id="HB9E204B59ACE482588A2B8B731B506FA"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">To apply for a grant under this section, an entity shall submit an application therefor which identifies—</text><subparagraph id="H2C1F8031A9434FADA5F459AE5CD5F933"><enum>(A)</enum><text>the data collection area;</text></subparagraph><subparagraph id="H2FC91C0816064D81AF3768D7B16330BE"><enum>(B)</enum><text>the purpose of the data collection;</text></subparagraph><subparagraph id="H8441FD31A61E48BCBCF89FF92A644281"><enum>(C)</enum><text>the types of broadband service data to be collected;</text></subparagraph><subparagraph id="HE6AC6408E3B34912BADDC9DD5B6F5CC1"><enum>(D)</enum><text>the survey and data collection methods to be utilized; and</text></subparagraph><subparagraph id="H31F193A927B147FE8E71828D8B9B6700"><enum>(E)</enum><text>any other information the Secretary determines necessary to promote the integrity of broadband service data collected under this section.</text></subparagraph></paragraph><paragraph id="H7E598AB03A4748338D65B78D9161C9BC" display-inline="no-display-inline"><enum>(3)</enum><header>Limitation on grant amount</header><text>The amount of a grant made under this subsection shall not exceed $50,000.</text></paragraph><paragraph id="H467A7AC7B0D546B085AAA30DFB0D7F43"><enum>(4)</enum><header>Broadband service data usage</header><text display-inline="yes-display-inline">The Secretary shall ensure that any broadband service data collected under this section is—</text><subparagraph id="H3B79E0190F1B4F339128C5C38DE2782D"><enum>(A)</enum><text display-inline="yes-display-inline">measured or assessed in accordance with such standards as the Secretary may establish;</text></subparagraph><subparagraph id="HBC3DD2E5464541FA8E150A858E0CFA83"><enum>(B)</enum><text>accurate and verifiable in accordance with such standards as the Secretary may establish;</text></subparagraph><subparagraph id="HE20E31BFABBA4DFDBAA7EEED7BB6D33B"><enum>(C)</enum><text>included in any broadband maps or data sets maintained by the Secretary; and</text></subparagraph><subparagraph id="H1273DF2F3D48404EA87D5C2928F1485B"><enum>(D)</enum><text>made available to the Chair of the Federal Communications Commission and the Administrator of the National Telecommunications and Information Administration for inclusion in any broadband maps or data sets either may maintain.</text></subparagraph></paragraph><paragraph id="H2E5F95B6BFDD44099A397D2DB8525BF1"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H56ECCDAD80B64FDE9C4C4C2CA3DF6784"><enum>(A)</enum><header>Broadband service</header><text>The term <quote>broadband service</quote> has the meaning given the term in section 601.</text></subparagraph><subparagraph id="H1AF9E5CE1F4242C08F3AF08E9633C105"><enum>(B)</enum><header>Broadband service data</header><clause id="HAC333E716C1C4664B330CBF37C650741"><enum>(i)</enum><header>In general</header><text>The term <quote>broadband service data</quote> means information related to—</text><subclause id="H6037FB4DA52E4DC486EB4AEF381ACE6E"><enum>(I)</enum><text>the location and type of broadband service;</text></subclause><subclause id="H7EE2C6189D644C68B9AA73B8FCB335AD"><enum>(II)</enum><text>the location and type of broadband infrastructure;</text></subclause><subclause id="HFAF3F212301A4D38A90D3DBA1333AB15"><enum>(III)</enum><text>the advertised, maximum, and average speed of broadband service;</text></subclause><subclause id="HE9422B80FFDB4586B97061A7FE1EB0DA"><enum>(IV)</enum><text>the average price of the most subscribed tier of broadband service;</text></subclause><subclause id="H25E0ECE4E84F4CA886B96E7364F96538"><enum>(V)</enum><text display-inline="yes-display-inline">the speed tiers of broadband service available in the area; or</text></subclause><subclause id="HC8E5F169A2C1443BBB38A9EA46E4BB99"><enum>(VI)</enum><text>any additional metric the Secretary deems appropriate.</text></subclause></clause><clause id="HF6F6C5D520B74D9081A96D25678EFBA6"><enum>(ii)</enum><header>Further definition</header><text>The Secretary shall further define the term <quote>broadband service data</quote> to ensure that data is measured and collected in a manner consistent with the reporting requirements under this section, and any broadband coordination or data- sharing obligations.</text></clause></subparagraph><subparagraph id="HB40FEA20A4B24A4388781958353AF431"><enum>(C)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text><clause id="HA60B9919A14340418D1D7A005710EEC5"><enum>(i)</enum><text display-inline="yes-display-inline">a unit of local government in a rural area;</text></clause><clause id="H75D3387E974A4AF399D89B0A2D3501B3"><enum>(ii)</enum><text>a tribal government or unit of tribal government;</text></clause><clause id="H869931C006184CCC85E97D65D98CD90A"><enum>(iii)</enum><text>an economic development or other community organization;</text></clause><clause id="HC9F9DE9EFB3D40259E55BBAD983EBF2F"><enum>(iv)</enum><text>an eligible entity under title I or II that serves persons in rural areas;</text></clause><clause id="H933A4218DD574ED3B3653672CC83748D"><enum>(v)</enum><text>an internet service provider that has not more than 100,000 subscribers; or</text></clause><clause id="H6B63EE4FC0E84FA9A86CC101E139F0B4"><enum>(vi)</enum><text>any other entity eligible under a title VI program that is not an internet service provider.</text></clause></subparagraph><subparagraph id="HE5149D4069A147849672E84C61239F82"><enum>(D)</enum><header>Middle mile infrastructure</header><text>The term <quote>middle mile infrastructure</quote> has the meaning given the term in section 602.</text></subparagraph><subparagraph id="H8A4EF797DE8A467F9D921A9BDB375FC0"><enum>(E)</enum><header>Rural area</header><text>The term <quote>rural area</quote> has the meaning given the term in section 601.</text></subparagraph></paragraph><paragraph id="HA26D6280995A4A0A96C5663218332D23"><enum>(6)</enum><header>Limitation on amount made available for grants</header><text display-inline="yes-display-inline">The Secretary may not expend more than 1 percent of the amounts made available under subsection (f) for each of fiscal years 2022 through 2029 to carry out this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HB9ECA000176140648EDDD3679BEF8E94"><enum>9.</enum><header>Limitations on reservation of funds</header><text display-inline="no-display-inline">Section 701(f) of the Rural Electrification Act of 1936 (<external-xref legal-doc="usc" parsable-cite="usc/7/950cc">7 U.S.C. 950cc(f)</external-xref>), as so redesignated by section 8 of this Act, is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H258F24C223984A7A954C245BCC2B913A" changed="added" reported-display-style="italic" committee-id="HAG00"><subsection id="HE3E622325E83401E804F541709058781"><enum>(f)</enum><header>Limitations on reservation of funds</header><text display-inline="yes-display-inline">Not less than 3 but not more than 7 percent of the amounts appropriated to carry out title VI shall be set aside to be used—</text><paragraph id="H9A34CF6B272A4050AD3611A6F6CD1E5C"><enum>(1)</enum><text>for administrative costs to carry out programs under title VI;</text></paragraph><paragraph id="H3A89B8D9532C48DDA2AC692DD713B5B6"><enum>(2)</enum><text>for technical assistance and pre-development planning activities to support the most rural communities;</text></paragraph><paragraph id="HD71955E596084A8CAB1608508018570B"><enum>(3)</enum><text>to conduct oversight under title VI;</text></paragraph><paragraph id="H5B654A00D7CD49BC9372FDD5F48E5279"><enum>(4)</enum><text>to implement accountability measures and related activities authorized under title VI; and</text></paragraph><paragraph id="HD1991F08DD5441259EBBE64AF4FE5266"><enum>(5)</enum><text>to carry out this
