R. 4370</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210706">July 6, 2021</action-date><action-desc><sponsor name-id="P000048">Mr. Pfluger</sponsor> (for himself, <cosponsor name-id="N000189">Mr. Newhouse</cosponsor>, <cosponsor name-id="B001248">Mr. Burgess</cosponsor>, <cosponsor name-id="R000603">Mr. Rouzer</cosponsor>, <cosponsor name-id="H001084">Ms. Herrell</cosponsor>, <cosponsor name-id="M000871">Mr. Mann</cosponsor>, and <cosponsor name-id="C001109">Ms. Cheney</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require further consideration of economic cost in review of listing petitions under the Endangered Species Act of 1973, and for other purposes.</official-title></form><legis-body id="H1E16F4EA97B947F4B651172F6E1E95C5" style="OLC"><section id="HE3266F8DFE984B68BC194C345BF2FF1E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Listing Reform Act</short-title></quote>.</text></section><section id="H5F04117893974E31B224D02AE6F3928F"><enum>2.</enum><header>Consideration of economic cost in review of listing petitions under the Endangered Species Act of 1973</header><subsection id="HFFA91C5141E9421F8CC74E8B5563B8CC"><enum>(a)</enum><header>Consideration Of Significant, Cumulative Economic Effects Required</header><text display-inline="yes-display-inline">Section 4(b)(3) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(b)(3)</external-xref>) is amended—</text><paragraph id="HD0380264F1714A78B0219C7DF2FEFF13"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H1460E1AF410147258FC81B4B4A23E345"><enum>(A)</enum><text>by striking <quote>To the maximum extent practicable, within 90 days after</quote> and inserting <quote>(i) After</quote>; and</text></subparagraph><subparagraph id="H3DC76156B93E4CE18DFB84B12FC76F38"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="traditional" id="HA4A8450621864ED282BFDDA95E94FE1E" display-inline="no-display-inline"><clause id="H8D0FA37C647E42CF83B4964F81CE328F" indent="up2"><enum>(ii)</enum><text>The Secretary may prioritize the consideration of petitions under this subparagraph other than in the order in which the petitions are received, except the Secretary may not give general priority to petitions to add species to such a list over petitions to remove a species from such a list.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H55DC821A65684977BB961EB7A6724C20"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="H6C062DFA9B904559AF852FEAE0D04DF2"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>Within 12 months</quote> and inserting <quote>As expeditiously as practicable</quote>; and</text></subparagraph><subparagraph id="H62DC0DA7968E4E70BC478671F95BCF87"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="traditional" id="H125EECE304D2407B997CDCC2A5A80A6F" display-inline="no-display-inline"><clause id="HF2391ECC6E2A428E8ECD55D0EDEA8830" indent="up1"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF616897B1E8F4B07AC8B9D2051F060B2"><enum>(I)</enum><text display-inline="yes-display-inline">In the case of a petition to add a species to a list of threatened species, the petitioned action may be warranted but is precluded due to the likelihood of significant, cumulative economic effects that would result from listing or, to the extent it can be determined, from the likely resulting designation of critical habitat of the species. The Secretary may not reconsider such finding unless—</text><item id="H2FA02022670540BCABD18D548BC5709B" indent="up1"><enum>(aa)</enum><text>the Secretary determines there is endangerment of extinction of the species; or</text></item><item id="H301EDBC646774513B402120ABE62580A" indent="up1"><enum>(bb)</enum><text>the Secretary receives a new petition to add such species to such list that includes a written qualitative and quantitative analyses reexamining the incremental and significant, cumulative economic effects of likely actions to protect the petitioned species and its potential habitat upon each State and locality that is affected by the petitioned species listing and that, in the opinion of the Secretary, credibly concludes that alternative actions are possible other than those resulting in significant, cumulative economic effects.</text></item></subclause><subclause id="H8869203387564F05AB8FF0B6B2A5F84D" indent="up1"><enum>(II)</enum><text>In this clause the term <term>significant, cumulative economic effects</term> includes economic effects on—</text><item id="HA421743772654060A150BD4F89F08840"><enum>(aa)</enum><text display-inline="yes-display-inline">public land and, to the maximum extent practicable, private land and property values;</text></item><item id="H8520B2946C3D4317A1DE5DBC5A3F2D2F"><enum>(bb)</enum><text>the provision of water, power, or other public services;</text></item><item id="H38708DF2B7FB44049D832676AE2C994E"><enum>(cc)</enum><text>employment; and</text></item><item id="H9236AEC2098A42F694BEFC6D48B3228F"><enum>(dd)</enum><text>revenues available for State and local governments.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HB043C398272242D9855CE0D45EB0F2E2"><enum>(b)</enum><header>Conforming amendment</header><text>Section 4(b)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(b)(1)</external-xref>) is amended by inserting <quote>(except as provided in clause (iv) of paragraph (3)(B))</quote> after <quote>solely</quote>. </text></subsection></section></legis-body></bill>
