R. 435</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="V000081">Ms. Velázquez</sponsor> (for herself, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="W000788">Ms. Williams of Georgia</cosponsor>, <cosponsor name-id="S000510">Mr. Smith of Washington</cosponsor>, <cosponsor name-id="J000298">Ms. Jayapal</cosponsor>, <cosponsor name-id="M001137">Mr. Meeks</cosponsor>, <cosponsor name-id="W000800">Mr. Welch</cosponsor>, <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>, <cosponsor name-id="K000009">Ms. Kaptur</cosponsor>, <cosponsor name-id="T000481">Ms. Tlaib</cosponsor>, <cosponsor name-id="W000826">Ms. Wild</cosponsor>, <cosponsor name-id="N000192">Ms. Newman</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, <cosponsor name-id="M001188">Ms. Meng</cosponsor>, and <cosponsor name-id="N000002">Mr. Nadler</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To exclude from tax certain payments of Federal pandemic unemployment compensation, and for other purposes.</official-title></form><legis-body id="H78D27337B76645009191D2821F9FB2C6" style="OLC"><section id="HDC822223DABB4CD2B8C2ADCB15070F40" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Excluding Pandemic Unemployment Compensation from Income Act</short-title></quote>. </text></section><section id="H3AE46DF8188741FDBF32ECF1D341C030"><enum>2.</enum><header>Certain payments of Federal pandemic unemployment compensation not includible in gross income or taken into account in determining certain means-tested benefits</header><subsection id="H1799872D1AEE4608A6196D7AB3EFCEF0"><enum>(a)</enum><header>Exclusion from gross income</header><text display-inline="yes-display-inline">For purposes of the Internal Revenue Code of 1986, gross income shall not include the amount specified in section 2104(b)(3) of the CARES Act to the extent such amount is received by the taxpayer pursuant to section 2102, 2104, or 2107 of such Act.</text></subsection><subsection id="HA2B196D98E6C4AB7996E815E01FE78FC"><enum>(b)</enum><header>Disregarded in the administration of Federal programs and federally assisted programs</header><text display-inline="yes-display-inline">For purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/6409">section 6409</external-xref> of the Internal Revenue Code of 1986, any amount excluded from gross income under subsection (a) shall be treated in the same manner as a refund under such Code.</text></subsection><subsection id="HD56F73B552504B3AA9400BCB0E025C72"><enum>(c)</enum><header>Effective dates</header><paragraph id="HB523481565C74C1D882AC40ADC6FAF1D"><enum>(1)</enum><header>Exclusion</header><text display-inline="yes-display-inline">Subsection (a) shall apply to taxable years ending after the date of the enactment of the CARES Act.</text></paragraph><paragraph id="HF24AB91637DD4FCAA454E2E61279C098"><enum>(2)</enum><header>Disregard</header><text>Subsection (b) shall apply to amounts received after the date of the enactment of the CARES Act.</text></paragraph></subsection></section></legis-body></bill>
