which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modernize the authority of the Commodity Futures Trading Commission to conduct research, development, demonstration, and information programs.</official-title></form><legis-body id="H0F2DE9953DA1436FB3C8D90715CFEB48" style="OLC"><section id="H23AA44650F2444259F853F49C394486D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commodity Futures Trading Commission Research and Development Modernization Act</short-title></quote>.</text></section><section id="H8A6F09A991A54F338E41688FD0CEDBB4"><enum>2.</enum><header>Modernization of authority of the Commission to conduct research, development, demonstration, and information programs</header><text display-inline="no-display-inline">Section 18 of the Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/22">7 U.S.C. 22</external-xref>) is amended to read as follows:</text><quoted-block id="H0E711737152E4D11B23476D0496511DC" style="OLC"><section id="HDE96B039B3224EB3BBD42339FF0DB5E6"><enum>18.</enum><header>Research and development programs</header><subsection id="HBE3B0227EA9A43F68B999FBA3FF446DE"><enum>(a)</enum><header>Programs</header><text>The Commission, as part of its ongoing operations, shall establish and maintain research, development, demonstration, and information programs that further the purposes of this Act, including programs that—</text><paragraph id="H9F1D79B0F35B41F59C2D2CF500D222DB"><enum>(1)</enum><text>facilitate the understanding by the Commission of—</text><subparagraph id="H8DD227A70D1144689EEC4932D282C4A3"><enum>(A)</enum><text>emerging technologies, technological advances, and innovations;</text></subparagraph><subparagraph id="HE1C31C8EF75F4F9D985CAF223DF5365A"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to those technologies, technological advances, and innovations, the potential application to, and effect on, the transactions and markets under the jurisdiction of the Commission;</text></subparagraph><subparagraph id="H810138D67BE245718886B21367E9D8F5"><enum>(C)</enum><text>associated implications for cybersecurity, data security, and systemic risk; and</text></subparagraph><subparagraph id="HAEB64368D6124666BA6DBA62BC7E6B60"><enum>(D)</enum><text display-inline="yes-display-inline">the economics of markets and market participants by the administration of this Act;</text></subparagraph></paragraph><paragraph id="HE080A00895DE4B8EAC96FCCA261F59B0"><enum>(2)</enum><text>provide an environment where emerging technologies, technological advances, and innovations may be explored by the Commission with developers and potential users to evaluate potential effects on the Commission and the markets under the jurisdiction of the Commission;</text></paragraph><paragraph id="HE24EF5B84FF64005B361B5F414B2E0D2"><enum>(3)</enum><text>identify areas where the Commission should adapt its administration of this Act in light of emerging technologies, technological advances, and innovations to benefit the markets under the jurisdiction of the Commission; and</text></paragraph><paragraph id="HE7327A38865144AB849BF2154628C575"><enum>(4)</enum><text>develop educational and other informational materials for dissemination and use among producers, market-users, and the general public regarding—</text><subparagraph id="H470AB56273E242AFB38AAC8279D7E0DA"><enum>(A)</enum><text display-inline="yes-display-inline">the activities, products, entities and markets regulated under this Act;</text></subparagraph><subparagraph id="H20D216F6F39E438FAA32E9D50E828F55"><enum>(B)</enum><text>emerging technologies, technological advances, and innovations in markets under the jurisdiction of the Commission; and</text></subparagraph><subparagraph id="HF1BCFC5A13DD4C6E84AD15C4C9DA566D"><enum>(C)</enum><text>applicable requirements of this Act and the regulations prescribed under this Act with regard to the subjects described in subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection><subsection id="HF1B9C83EAFFC43E8ACDB08B9466E57C5"><enum>(b)</enum><header>Research and development plan</header><paragraph id="H5D10D45E816547A0B4B2971C3D82E203"><enum>(1)</enum><header>In general</header><text>The Commission may, after notice and comment, adopt a research and development plan for a program established under subsection (a).</text></paragraph><paragraph id="H623A47B42D314C68A91B5DC7D69DD138"><enum>(2)</enum><header>Conditions</header><text>A research and development plan adopted pursuant to paragraph (1) shall identify—</text><subparagraph id="HD9BFD770C48B43D5ACEC0E2478953DA0"><enum>(A)</enum><text>specific areas of interest to the Commission;</text></subparagraph><subparagraph id="H7786D9AC3B6945558084D6D1B9CEDFF9"><enum>(B)</enum><text>potential activities the Commission will undertake to investigate an area of interest; and</text></subparagraph><subparagraph id="H190FBF1322E848CFA65998B8DFB50F12"><enum>(C)</enum><text display-inline="yes-display-inline">the means by which the authority described in subsection (c) will be used in the applicable program established under subsection (a).</text></subparagraph></paragraph></subsection><subsection id="H302F5F056E064393AFCCC84E5760F670"><enum>(c)</enum><header>Other transaction authority</header><paragraph id="H76ECA74FB7784BC58EB9240CCA1A966C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding the full and open competition requirements under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">chapter 33</external-xref> of title 41, United States Code, the Commission may enter into and perform a transaction (other than a standard contract) for the purpose of aiding or facilitating the programs and activities under subsection (a).</text></paragraph><paragraph id="HB2BB2B80A6BD46E597C62CE11AC8FD9B"><enum>(2)</enum><header>Conditions</header><text>The Commission may enter into a transaction under this subsection only if—</text><subparagraph id="H51CAB1C6D1BC429695110F1CFA1098D3"><enum>(A)</enum><text>the transaction is used only in furtherance of a research and development plan established under subsection (b);</text></subparagraph><subparagraph id="H485C8B6FF3FA4385A7ACC4E73D3E5C99"><enum>(B)</enum><text>the Commission endeavors to use a competitive process, where appropriate, when determining the parties to the transaction; and</text></subparagraph><subparagraph id="H8CFE83640F344FEF8D465E84A5D02F07"><enum>(C)</enum><text>using a standard contract to do so is either not feasible or not appropriate.</text></subparagraph></paragraph><paragraph id="H12FA8D52BCC044A9B629F0FC9F481A9E"><enum>(3)</enum><header>Policies</header><text>The Commission shall, after notice and comment, establish and publish written policies setting forth the manner and criteria for utilizing the authority provided by this subsection.</text></paragraph></subsection><subsection id="HE79E9329080D47B9BC6D93EBBA56E8EF"><enum>(d)</enum><header>Acceptance of nonmonetary contributions for research and development programs, projects, and activities</header><paragraph id="H9051161BE82B4E6285F6C076BE61FC4D"><enum>(1)</enum><header>Definition of covered nonmonetary contribution</header><text display-inline="yes-display-inline">In this subsection, the term <quote>covered nonmonetary contribution</quote> means a nonmonetary contribution of provision of access, use of facilities, personal property, or services, that is related to—</text><subparagraph id="HBA1C4EC34139496E8D765A3EB6E6DCBB"><enum>(A)</enum><text>sharing of research, data, or other information;</text></subparagraph><subparagraph id="HD8E5A301E44446A0881A082128C43CD1"><enum>(B)</enum><text>public presentations; or</text></subparagraph><subparagraph id="HFEC06D03AA7F4942AC3CB6E5ACEED96D"><enum>(C)</enum><text>non-commercially available services or systems.</text></subparagraph></paragraph><paragraph id="H29EEFA93652A4634BB2FD2DF1ACE48F0"><enum>(2)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Commission may accept and use, on behalf of the United States and in accordance with this subsection, any covered nonmonetary contribution.</text></paragraph><paragraph id="H79DD1A42A3DF425488DDB2EA7A57D2F5"><enum>(3)</enum><header>Conditions</header><subparagraph id="H6D6729B3AF8145B9936C218AC298E42D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A covered nonmonetary contribution may be accepted pursuant to this subsection only if the covered nonmonetary contribution is in furtherance of a research and development plan established under subsection (b).</text></subparagraph><subparagraph id="H313F9CEFE3ED425899DBFCE52289C548"><enum>(B)</enum><header>Limitations</header><text display-inline="yes-display-inline">The Commission may not accept a covered nonmonetary contribution if—</text><clause id="HA55785DBC0B64942BBDB40789291D333"><enum>(i)</enum><text display-inline="yes-display-inline">conditions inconsistent with applicable laws or regulations apply to the covered nonmonetary contribution;</text></clause><clause id="H348C5A31B33E4A9FA025AE294DC69CDD"><enum>(ii)</enum><text display-inline="yes-display-inline">the covered nonmonetary contribution is conditioned on, or will require, the expenditure of appropriated funds not available to the Commission;</text></clause><clause id="H08838C0BB2ED4D36B5033629F862CA7C"><enum>(iii)</enum><text display-inline="yes-display-inline">using a standard contract or other transaction authority under subsection (c) to acquire the covered nonmonetary contribution is either feasible or appropriate; or</text></clause><clause id="HEEEFF7D5786C4BA19AD01110DE0AF06D"><enum>(iv)</enum><text display-inline="yes-display-inline">acceptance of the covered nonmonetary contribution would—</text><subclause id="H64D746C658CC41A194A64FA140E44F18"><enum>(I)</enum><text>reflect unfavorably on the ability of the Commission to carry out its responsibilities or official duties in a fair and objective manner;</text></subclause><subclause id="HA48AE3A7AC8A46B293FC5CD922285C10"><enum>(II)</enum><text>compromise the integrity or the appearance of the integrity of its programs or any official involved in its programs; or</text></subclause><subclause id="H7C8135B7F79D4A6C9774D1D02BA6B179"><enum>(III)</enum><text>give the endorsement or the appearance of the endorsement by the Commission or Commission staff of the products, services, activities, or policies of the donor.</text></subclause></clause></subparagraph><subparagraph id="H1EF2795C77994C6188128DDE7288FB17"><enum>(C)</enum><header>Solicitation prohibition</header><clause id="HF66D15368CEF49E39B11F2BA799F551E"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), a covered nonmonetary contribution may not be solicited by any Commissioner, employee of, or contractor at the Commission.</text></clause><clause id="H77D0CA9BD63F490585A1DD80A12AC97E"><enum>(ii)</enum><header>Exception</header><text display-inline="yes-display-inline">A Commissioner or employee of the Commission may solicit only a covered nonmonetary contribution described in paragraph (1)(B).</text></clause></subparagraph><subparagraph id="HCC1DA9C72A554117BD34A8A3B63C554E"><enum>(D)</enum><header>Duration</header><text display-inline="yes-display-inline">To the extent applicable, the Commission shall return any covered nonmonetary contribution accepted pursuant to this subsection within 90 days after accepting the covered nonmonetary contribution.</text></subparagraph><subparagraph id="HA5CD723A40EA482293DF8D117E77A347"><enum>(E)</enum><header>Rules</header><text display-inline="yes-display-inline">The Commission shall, after notice and comment, establish and publish written rules setting forth the manner and criteria to be used in determining whether a covered nonmonetary contribution meets the conditions of this paragraph.</text></subparagraph></paragraph><paragraph id="H329CCDEF45554FCEA86360512473AEA6"><enum>(4)</enum><header>Disclosure</header><text display-inline="yes-display-inline">Within 30 days after accepting a covered nonmonetary contribution pursuant to this subsection, the Commission shall publish in the Federal Register a notice detailing—</text><subparagraph id="H931BDF262A494F98B3B7B746DC4DF08B"><enum>(A)</enum><text display-inline="yes-display-inline">the source of the covered nonmonetary contribution;</text></subparagraph><subparagraph id="H44CAD82D5F9F4C5A838B5A2482E8BBB9"><enum>(B)</enum><text display-inline="yes-display-inline">the nature of the covered nonmonetary contribution;</text></subparagraph><subparagraph id="H059C892DAFAF4E6FB165DE5FC93091D3"><enum>(C)</enum><text display-inline="yes-display-inline">whether the covered nonmonetary contribution was solicited pursuant to paragraph (3)(C)(ii), and if so, by whom; and</text></subparagraph><subparagraph id="H9218B845DD3E484B8D86ED1AF8DCD4DA"><enum>(D)</enum><text display-inline="yes-display-inline">the means by which the covered nonmonetary contribution meets the conditions set forth in paragraph (3).</text></subparagraph></paragraph><paragraph id="H771E83A5C1AE48569D1C29526B87828A"><enum>(5)</enum><header>Sunset</header><text>The authority provided in this subsection may not be exercised on or after October 1, 2025.</text></paragraph></subsection><subsection id="HD16ABA316C8C4478AA39F454CB7EB786"><enum>(e)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than 60 days after the end of each fiscal year, the Commission shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report on all transactions entered into under subsection (c) and all covered nonmonetary contributions accepted under subsection (d) in the fiscal year, which shall include the following:</text><paragraph id="HF2F21D7AF87A4B4F8603E9EF907F7831"><enum>(1)</enum><text display-inline="yes-display-inline">A brief description of the subject of each such transaction or covered nonmonetary contribution, with an explanation of—</text><subparagraph id="H0EF676EACF9D4943B1EE21F31B9C31B4"><enum>(A)</enum><text display-inline="yes-display-inline">the potential utility of the transaction or covered nonmonetary contribution to the Commission or the markets regulated by the Commission;</text></subparagraph><subparagraph id="H1BC8CD5B003B4109B9C83A5AC2B42C02"><enum>(B)</enum><text display-inline="yes-display-inline">the means by which the transaction or covered nonmonetary contribution fulfills the goals and objectives of the research and development plan established under subsection (b); and</text></subparagraph><subparagraph id="HF87F405DE17B4A6E8FA536E6BCCAB248"><enum>(C)</enum><text>the status of all related projects.</text></subparagraph></paragraph><paragraph id="H0A3C50D532B948B2BF905C316A1E9BC4"><enum>(2)</enum><text>The information required to be published pursuant to subsection (d)(4).</text></paragraph><paragraph id="H7513D59921064A27B995AED3A8006EB9"><enum>(3)</enum><text display-inline="yes-display-inline">A description of all sums expended by the Commission in connection with a transaction entered into under subsection (c), and, if readily ascertainable, the value of any covered nonmonetary contribution accepted under subsection (d).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
