following bill; which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Environmental Policy Act of 1969 to impose time limits on the completion of certain required actions under the Act, and for other purposes.</official-title></form><legis-body id="H9E1747B4915345C3834EA83119FB8841" style="OLC"><section section-type="section-one" id="H1A06D9126CC44A3CB2FF8BF9ABCD9CA4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>NEPA Accountability and Enforcement Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H6CBB7B864C3C44C2B25A2F578B447687"><enum>2.</enum><header>National Environmental Policy Act timelines</header><text display-inline="no-display-inline">Title I of the National Environmental Policy Act of 1969 is amended—</text><paragraph id="H77F172D4748840C5ADC01C1E9CF02E3E"><enum>(1)</enum><text>by redesignating section 105 (<external-xref legal-doc="usc" parsable-cite="usc/42/4335">42 U.S.C. 4335</external-xref>) as section 106; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H48E49674044A481C8C8D15E8D6F6D929"><enum>(2)</enum><text>by inserting after section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/4334">42 U.S.C. 4334</external-xref>) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H426FB82BA9BC468AB71DFA2874699148"><section id="H996459652996410A8A159023A3B662E4"><enum>105.</enum><header>Applicable timelines</header><subsection id="H869D4B3939454655A1A4C3A924BEC5F3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HBC4FC3729609421EB457281202CD4FF9"><enum>(1)</enum><header>Environmental impact statement</header><text>The term <term>environmental impact statement</term> means a detailed statement required under section 102(2)(C). </text></paragraph><paragraph id="H37B5CC9DEB6C47F9AD8E50AB6A0D238A"><enum>(2)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> includes a State that has assumed responsibility under section 327 of title 23, United States Code.</text></paragraph><paragraph id="HC0053F3E37E44B9EA6878F99AF00C744"><enum>(3)</enum><header>Head of a Federal agency</header><text>The term <term>head of a Federal agency</term> includes the governor or head of an applicable State agency of a State that has assumed responsibility under section 327 of title 23, United States Code.</text></paragraph><paragraph id="HFED7966A9129427296716BD25706F481"><enum>(4)</enum><header>NEPA process</header><subparagraph id="H2064DE45C6134CCF967D536DBD961978"><enum>(A)</enum><header>In general</header><text>The term <term>NEPA process</term> means the entirety of every process, analysis, or other measure, including an environmental impact statement, required to be carried out by a Federal agency under this title before the agency undertakes a proposed action.</text></subparagraph><subparagraph id="H4783D3F97A2A4DD7842901C455FC11C9"><enum>(B)</enum><header>Period</header><text>For purposes of subparagraph (A), the NEPA process—</text><clause id="H5E2B4556D65548688EEC8C2DACC90CF1"><enum>(i)</enum><text>begins on the date on which the head of a Federal agency receives an application for a proposed action from a project sponsor; and</text></clause><clause id="H5F2DC1A83F3A459AB3D9F515735310A4"><enum>(ii)</enum><text>ends on the date on which the Federal agency issues, with respect to the proposed action—</text><subclause id="H4B60CC0FE06E4B2E8E829C2105BAD7A3"><enum>(I)</enum><text>a record of decision, including, if necessary, a revised record of decision;</text></subclause><subclause id="H3F628FA004A145DABBE8421A9B904A11"><enum>(II)</enum><text>a finding of no significant impact; or</text></subclause><subclause id="H2EBB676E125346F59A8B1A087F1B564A"><enum>(III)</enum><text>a categorical exclusion under this title. </text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4DF5453EFF048489F95FC1E00FAEC5D"><enum>(5)</enum><header display-inline="yes-display-inline">Project sponsor</header><text display-inline="yes-display-inline">The term <term>project sponsor</term> means a Federal agency or other entity, including a private or public-private entity, that seeks approval of a proposed action. </text></paragraph></subsection><subsection id="H9C4D3499F1D34E299694650E841E004F"><enum>(b)</enum><header>Applicable timelines</header><paragraph id="HF8310A7BA29A473B9242C7C3758F0585"><enum>(1)</enum><header>NEPA process</header><subparagraph id="HA6B72CB43DE74AD68A9E0A0631DE733F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The head of a Federal agency shall complete the NEPA process for a proposed action of the Federal agency, as described in subsection (a)(4)(B)(ii), shall not take longer than 2 years from notice of intent to record of decision, or not longer than when the agency first received the project to notice of intent, whichever comes first.</text></subparagraph><subparagraph id="HBAA1420195694703B141251915B8C3B0"><enum>(B)</enum><header>Environmental documents</header><text>Within the period described in subparagraph (A), not later than 1 year after the date described in subsection (a)(4)(B)(i), the head of the Federal agency shall, with respect to the proposed action—</text><clause id="HB03ED847439745F3BC90F8E392C40B36"><enum>(i)</enum><text>issue—</text><subclause id="H8B173BFDF0CF49B5A252F0809608ECF6"><enum>(I)</enum><text>a finding that a categorical exclusion applies to the proposed action; or</text></subclause><subclause id="H1B79E7E92216421296349071F0EBE8F1"><enum>(II)</enum><text>a finding of no significant impact; or</text></subclause></clause><clause id="H4A9E03772E8F4536B7F08BAC4B69D776"><enum>(ii)</enum><text>publish a notice of intent to prepare an environmental impact statement in the Federal Register.</text></clause></subparagraph><subparagraph id="HA4C845C04B50435D86D7FE9122D24FCF"><enum>(C)</enum><header>Environmental impact statement</header><text>If the head of a Federal agency publishes a notice of intent described in subparagraph (B)(ii), within the period described in subparagraph (A) and not later than 2 years after the date on which the head of the Federal agency publishes the notice of intent, the head of the Federal agency shall complete the environmental impact statement and, if necessary, any supplemental environmental impact statement for the proposed action.</text></subparagraph><subparagraph id="H886514BE787241CDB442EBF89E9CEFC9"><enum>(D)</enum><header>Penalties</header><clause id="HE8C79CFCB449462CAD6565876BDBDFD7"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text><subclause id="H81286EE87C4448CBA0709750CE5331E6"><enum>(I)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></subclause><subclause id="H05ADEA4250F740A2918229556E1DCC19"><enum>(II)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> does not include a State.</text></subclause><subclause id="H7388D1B25F1B433FB64DF8C3302ADF11"><enum>(III)</enum><header>Final NEPA compliance date</header><text>The term <term>final NEPA compliance date</term>, with respect to a proposed action, means the date by which the head of a Federal agency is required to complete the NEPA process under subparagraph (A).</text></subclause><subclause id="H8BE3F02904F04A309302F546FDD15C50"><enum>(IV)</enum><header>Head of a Federal agency</header><text>The term <term>head of a Federal agency</term> does not include the governor or head of a State agency of a State.</text></subclause><subclause id="HF64C8124475C4913AC0F05FB57E5C740"><enum>(V)</enum><header>Initial EIS compliance date</header><text>The term <term>initial EIS compliance date</term>, with respect to a proposed action for which a Federal agency published a notice of intent described in subparagraph (B)(ii), means the date by which an environmental impact statement for that proposed action is required to be completed under subparagraph (C).</text></subclause><subclause id="HE4E179ECC56E46FC91E615F07CC9839C"><enum>(VI)</enum><header>Initial NEPA compliance date</header><text>The term <term>initial NEPA compliance date</term>, with respect to a proposed action, means the date by which the head of a Federal agency is required to issue or publish a document described in subparagraph (B) for that proposed action under that subparagraph.</text></subclause><subclause id="HC670C00D48AA4AE3BD09A2FB79A2EB39"><enum>(VII)</enum><header>Initial noncompliance determination</header><text>The term <term>initial noncompliance determination</term> means a determination under clause (ii)(I)(bb) that the head of a Federal agency has not complied with the requirements of subparagraph (A), (B), or (C).</text></subclause></clause><clause id="HE1D5377937BC429DBB61F4B5A336BAE1"><enum>(ii)</enum><header>Initial noncompliance</header><subclause id="H81CB2D0FF6274AEFA772B9118C7BDAEC"><enum>(I)</enum><header>Determination</header><item id="H930C533C1F7B4DE6BC1DB475FE6455EC"><enum>(aa)</enum><header>Notification</header><text>As soon as practicable after the date described in subsection (a)(4)(B)(i) for a proposed action of a Federal agency, the head of the Federal agency shall notify the Director that the head of the Federal agency is beginning the NEPA process for that proposed action.</text></item><item id="H8E550614E6064DEFA0C46AEA81AA5A2A"><enum>(bb)</enum><header>Determinations of compliance</header><subitem id="H71D01FE0EC484E74BD9B46CB7E2E97F8"><enum>(AA)</enum><header>Initial determination</header><text>As soon as practicable after the initial NEPA compliance date for a proposed action, the Director shall determine whether, as of the initial NEPA compliance date, the head of the Federal agency has complied with subparagraph (B) for that proposed action.</text></subitem><subitem id="HE3AACFC69BE943D5AF64D7FC7A4F052F"><enum>(BB)</enum><header>Environmental impact statement</header><text>With respect to a proposed action of a Federal agency in which the head of the Federal agency publishes a notice of intent described in subparagraph (B)(ii), as soon as practicable after the initial EIS compliance date for a proposed action, the Director shall determine whether, as of the initial EIS compliance date, the head of the Federal agency has complied with subparagraph (C) for that proposed action.</text></subitem><subitem id="H31F93B62838246A798E495DD000B4C49"><enum>(CC)</enum><header>Completion of NEPA process</header><text>As soon as practicable after the final NEPA compliance date for a proposed action, the Director shall determine whether, as of the final NEPA compliance date, the head of the Federal agency has complied with subparagraph (A) for that proposed action.</text></subitem></item></subclause><subclause id="H551A4C28F65941A8A01F08335002B7A1"><enum>(II)</enum><header>Identification; penalty; notification</header><text>If the Director makes an initial noncompliance determination for a proposed action—</text><item id="H39F5F25E1CEE43B68430222DD63B5657"><enum>(aa)</enum><text>the Director shall identify the account for the salaries and expenses of the office of the head of the Federal agency, or an equivalent account;</text></item><item id="H58893EF60925464D95FF88090C16A694"><enum>(bb)</enum><text>beginning on the day after the date on which the Director makes the initial noncompliance determination, the amount that the head of the Federal agency may obligate from the account identified under item (aa) for the fiscal year during which the determination is made shall be reduced by 0.5 percent from the amount initially made available for the account for that fiscal year; and</text></item><item commented="no" id="H770373CEDCDB474C86634B2B92BACD6C"><enum>(cc)</enum><text>the Director shall notify the head of the Federal agency of—</text><subitem commented="no" id="H53B1A473D3E04FBB9BCBE1596B41B59D"><enum>(AA)</enum><text>the initial noncompliance determination;</text></subitem><subitem commented="no" id="HA49F42AF18264449A48C75C684A3F4A2"><enum>(BB)</enum><text>the account identified under item (aa); and</text></subitem><subitem commented="no" id="HC5B024EF9BCF41268BE58A60097B0F5E"><enum>(CC)</enum><text>the reduction under item (bb).</text></subitem></item></subclause></clause><clause id="HF82C64BED8D842DB93DAEB492E0E5995"><enum>(iii)</enum><header>Continued noncompliance</header><subclause id="H1BAED2D11B4249E29080451F2B478D5F"><enum>(I)</enum><header>Determination</header><text>Every 90 days after the date of an initial noncompliance determination, the Director shall determine whether the head of the Federal agency has complied with the applicable requirements of subparagraphs (A) through (C) for the proposed action, until the date on which the Director determines that the head of the Federal agency has completed the NEPA process for the proposed action.</text></subclause><subclause id="HE34C5249A03D4975B62FAF81F3DA3D3B"><enum>(II)</enum><header>Penalty; notification</header><text>For each determination made by the Director under subclause (I) that the head of a Federal agency has not complied with a requirement of subparagraph (A), (B), or (C) for a proposed action—</text><item id="H71022ADD242D423195378368F23EC345"><enum>(aa)</enum><text>the amount that the head of the Federal agency may obligate from the account identified under clause (ii)(II)(aa) for the fiscal year during which the most recent determination under subclause (I) is made shall be reduced by 0.5 percent from the amount initially made available for the account for that fiscal year; and</text></item><item commented="no" id="HEF5C176364B04007A24594BEE906B6D7"><enum>(bb)</enum><text>the Director shall notify the head of the Federal agency of—</text><subitem commented="no" id="H4555A7EA49694D3EBB74F13D874CAB0F"><enum>(AA)</enum><text>the determination under subclause (I); and</text></subitem><subitem commented="no" id="HFCF188F21565440894314887C3890D13"><enum>(BB)</enum><text>the reduction under item (aa).</text></subitem></item></subclause></clause><clause id="H1BDD63EA137042D1AF7CFA8012357AD5"><enum>(iv)</enum><header>Requirements</header><subclause id="H7DCEDCFD69ED47B0A9F7EF01D207D887"><enum>(I)</enum><header>Amounts not restored</header><text>A reduction in the amount that the head of a Federal agency may obligate under clause (ii)(II)(bb) or (iii)(II)(aa) during a fiscal year shall not be restored for that fiscal year, without regard to whether the head of a Federal agency completes the NEPA process for the proposed action with respect to which the Director made an initial noncompliance determination or a determination under clause (iii)(I).</text></subclause><subclause id="H31763AEFF26C453CB415F63FD53EF585"><enum>(II)</enum><header>Required timelines</header><text>The violation of subparagraph (B) or (C), and any action carried out to remediate or otherwise address the violation, shall not affect any other applicable compliance date under subparagraph (A), (B), or (C).</text></subclause></clause></subparagraph></paragraph><paragraph id="H629E68C7B9414D0E95141C5C8FAC56B6"><enum>(2)</enum><header>Authorizations and permits</header><subparagraph id="H0B29B538FF95465FB6472CDC6E161A79"><enum>(A)</enum><header>In general</header><text>Not later than 90 days after the date described in subsection (a)(4)(B)(ii), the head of a Federal agency shall issue—</text><clause id="HEEB3F9ADC71E4C2383806227E30EF7DF"><enum>(i)</enum><text>any necessary permit or authorization to carry out the proposed action; or</text></clause><clause id="H7FD6A0B7E4C44C87A02310D2CBA9992D"><enum>(ii)</enum><text>a denial of the permit or authorization necessary to carry out the proposed action.</text></clause></subparagraph><subparagraph id="H70BD79A58C0547A6A22BAE465FEA1E63"><enum>(B)</enum><header>Effect of failure to issue authorization or permit</header><text>If a permit or authorization described in subparagraph (A) is not issued or denied within the period described in that subparagraph, the permit or authorization shall be considered to be approved.</text></subparagraph><subparagraph id="HC7ACE3CE4737472ABD656193B9539297"><enum>(C)</enum><header>Denial of permit or authorization</header><clause id="H4B7458BBBD3946E98944C815ED2C7855"><enum>(i)</enum><header>In general</header><text>If a permit or authorization described in subparagraph (A) is denied, the head of the Federal agency shall describe to the project sponsor—</text><subclause id="H15D63CF4818F425690707FD1C948919C"><enum>(I)</enum><text>the basis of the denial; and</text></subclause><subclause id="H75137564F72E430CBE3FD027E80A2E30"><enum>(II)</enum><text>recommendations for the project sponsor with respect to how to address the reasons for the denial.</text></subclause></clause><clause id="H27530069FEBF4AFDB01678CAA1D18697"><enum>(ii)</enum><header>Recommended changes</header><text>If the project sponsor carries out the recommendations of the head of the Federal agency under clause (i)(II) and notifies the head of the Federal agency that the recommendations have been carried out, the head of the Federal agency—</text><subclause id="HC725C224F67247B99CBBE588ACC81A7E"><enum>(I)</enum><text>shall decide whether to issue the permit or authorization described in subparagraph (A) not later than 90 days after date on which the project sponsor submitted the notification; and</text></subclause><subclause id="H421981BF497847AFA2B93FF0F968EE6C"><enum>(II)</enum><text>shall not carry out the NEPA process with respect to the proposed action again.</text></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
