<section id="HB1DD4C33D19749CAB9524322E8583173"><enum>101.</enum><header>Cooperative federalism in oil and gas permitting on available Federal land</header>
<subsection id="H73F052B6C5764D49896D10A2F5090F33"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) is amended—</text> <paragraph id="H0B49428DADFA4BA28994AC41787A1C56"><enum>(1)</enum><text>by redesignating section 44 as section 47; and</text></paragraph>
<paragraph id="H08DAE5CF5C8343ADBDD6FE64EE0E2DB9"><enum>(2)</enum><text>by adding after section 43 the following new section:</text> <quoted-block display-inline="no-display-inline" id="H2D8AFEB1BCED4C78A27D8CFE26483DCA" style="OLC"> <section id="H1B80D4D3409846D99DB293ADD829B595"><enum>44.</enum><header>Cooperative federalism in oil and gas permitting on available Federal land</header> <subsection commented="no" id="H11FD530D615548B4A860E5CE0CA11A45"><enum>(a)</enum><header>Authorizations</header> <paragraph commented="no" id="H335D032B459A4D57B0EB58DB1B11C2DD"><enum>(1)</enum><header>In general</header><text>Upon receipt of an application under subsection (b), the Secretary may delegate to a State exclusive authority—</text>
<subparagraph commented="no" id="H19D3910271CF4B548FF2B1DDD83A69E6"><enum>(A)</enum><text display-inline="yes-display-inline">to issue an Application for Permit to Drill on available Federal land; or</text></subparagraph> <subparagraph commented="no" id="H0161CB657477421E929A55CD7B12049D"><enum>(B)</enum><text display-inline="yes-display-inline">to approve drilling plans on available Federal land.</text></subparagraph></paragraph>
<paragraph commented="no" id="H3C50C31B675C4E06B35A89E9E9674D41"><enum>(2)</enum><header>Sundry notices</header><text display-inline="yes-display-inline">Any authorization under paragraph (1) may, upon the request of the State, include authority to process sundry notices.</text></paragraph> <paragraph id="H90C4A65175B04CF881AB90842CEE4C4D"><enum>(3)</enum><header>Inspection and enforcement</header><text display-inline="yes-display-inline">Any authorization under paragraph (1) may, upon the request of the State, include authorization to inspect and enforce an Application for Permit to Drill or drilling plan, as applicable. An authorization under paragraph (1)(A) shall not affect the ability of the Secretary to collect inspection fees under section 108(d) of the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1718">30 U.S.C. 1718(d)</external-xref>).</text></paragraph></subsection>
<subsection id="H58932232E0A7465C8B3796A47B6542DA"><enum>(b)</enum><header>State application process</header>
<paragraph id="HF89D371AA42C4F54861B13E658CE5347"><enum>(1)</enum><header>Submission of application</header><text>A State may submit an application under subparagraph (A) or (B) of subsection (a)(1) to the Secretary at such time and in such manner as the Secretary may require.</text></paragraph> <paragraph id="H7669941DB412457C82879E0CB03C10EC"><enum>(2)</enum><header>Content of application</header><text>An application submitted under this subsection shall include—</text>
<subparagraph id="HE657B869743D476FA93E64EC9903502F"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the State program that the State proposes to administer under State law, including a State drilling plan; and</text></subparagraph> <subparagraph id="HDCA16E8BBC7049B0B3B155901E54DD16"><enum>(B)</enum><text display-inline="yes-display-inline">a statement from the Governor or attorney general of such State that the laws of such State provide adequate authority to carry out the State program.</text></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" id="HBF5BFE655C494006964BF736595902FD"><enum>(3)</enum><header>Deadline for approval or disapproval</header><text display-inline="yes-display-inline">Not later than 180 days after the date of receipt of an application under this subsection, the Secretary shall approve or disapprove such application.</text></paragraph> <paragraph id="H6C8782FCE98C4EF8BF9E4024FB3EED93"><enum>(4)</enum><header>Criteria for approval</header><text display-inline="yes-display-inline">The Secretary may approve an application received under this subsection only if the Secretary has—</text>
<subparagraph id="H2D40F28A0FF9426BA579AE2A3AD57091"><enum>(A)</enum><text display-inline="yes-display-inline">determined that the State applicant would be at least as effective as the Secretary in issuing Applications for Permit to Drill or in approving drilling plans, as applicable;</text></subparagraph> <subparagraph id="H28C809CA09A54C99A3E3291D459404D0"><enum>(B)</enum><text display-inline="yes-display-inline">determined that the State program of the State applicant—</text>
<clause id="H12FEB5B3A92E47509B6766A4D9D781B9"><enum>(i)</enum><text>complies with this Act; and</text></clause> <clause id="HA5EBB26EE96F490A96C3E6AE028EB802"><enum>(ii)</enum><text display-inline="yes-display-inline">provides for the termination or modification of an issued Application for Permit to Drill or approved drilling plan, as applicable, for cause, including for—</text>
<subclause id="H19FAACFA134341739ADF5C3D36DC13E8"><enum>(I)</enum><text display-inline="yes-display-inline">the violation of any condition of the issued Application for Permit to Drill or approved drilling plan;</text></subclause> <subclause id="H623024DD907F4BACAFF047926E7774F6"><enum>(II)</enum><text display-inline="yes-display-inline">obtaining the issued Application for Permit to Drill or approved drilling plan by misrepresentation; or</text></subclause>
<subclause id="H53C3A189A683481FBCFF76D0C46A8217"><enum>(III)</enum><text display-inline="yes-display-inline">failure to fully disclose in the application all relevant facts;</text></subclause></clause></subparagraph> <subparagraph id="H138DB53D16DD41D288C5D670BF60E685"><enum>(C)</enum><text>determined that the State applicant has sufficient administrative and technical personnel and sufficient funding to carry out the State program;</text></subparagraph>
<subparagraph id="H5D76C6FD0AF243F2BB07A722FE417654"><enum>(D)</enum><text display-inline="yes-display-inline">provided notice to the public, solicited public comment, and held a public hearing within such State;</text></subparagraph> <subparagraph id="HFC060FF000894C8CB35B46E807BADF28"><enum>(E)</enum><text>determined that approval of the application would not result in decreased royalty payments owed to the United States under section 35(a), except as provided in subsection (e) of that section; and</text></subparagraph>
<subparagraph id="HA2EBF7A1E354464E9A47A7F86116F82D"><enum>(F)</enum><text display-inline="yes-display-inline">in the case of a State applicant seeking authority under subsection (a)(3) to inspect and enforce Applications for Permit to Drill or drilling plans, as applicable, entered into a memorandum of understanding with such State applicant that delineates the Federal and State responsibilities with respect to such inspection and enforcement.</text></subparagraph></paragraph> <paragraph id="H073A5ABA19B248BB866AE2731EFD6F59"><enum>(5)</enum><header>Disapproval</header><text display-inline="yes-display-inline">If the Secretary disapproves an application submitted under this subsection, then the Secretary shall—</text>
<subparagraph id="H2E548077741C4C0A9344A4341BFE3D81"><enum>(A)</enum><text display-inline="yes-display-inline">notify, in writing, such State applicant of the reason for the disapproval and any revisions or modifications necessary to obtain approval; and</text></subparagraph> <subparagraph id="HE436C66DD63C4E63BB2CA4C063436361"><enum>(B)</enum><text>provide any additional information, data, or analysis upon which the disapproval is based.</text></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" id="H9EBE8FD94BE64896AFD059EB2833F72D"><enum>(6)</enum><header>Resubmittal of application</header><text display-inline="yes-display-inline">A State may resubmit an application under this subsection at any time.</text></paragraph> <paragraph id="H10D673B0D6A34E9DBDF938AFFEDDFAF4"><enum>(7)</enum><header>State Memorandum of Understanding</header><text display-inline="yes-display-inline">Before a State submits an application under this subsection, the Secretary may, at the request of such State, enter into a memorandum of understanding with such State regarding the proposed State program—</text>
<subparagraph id="H10CC2BD6F3AC4488BB45519C4747EBC8"><enum>(A)</enum><text display-inline="yes-display-inline">to delineate the Federal and State responsibilities for oil and gas regulations;</text></subparagraph> <subparagraph id="H8CE49E98CF9D435CB8D0AEBEC9D28520"><enum>(B)</enum><text>to provide technical assistance; and</text></subparagraph>
<subparagraph id="HAE5D628E81614B06B8BEFB58A8E0B580"><enum>(C)</enum><text>to share best management practices.</text></subparagraph></paragraph></subsection> <subsection commented="no" id="H6246CFDA25964F95A0DE2CAB28823C7C"><enum>(c)</enum><header>Administrative fees for Applications for Permit To Drill</header> <paragraph commented="no" id="H66CAEE68E67D4657A693BEC00A026474"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State for which authority has been delegated under subsection (a)(1)(A) may collect a fee for each application for an Application for Permit to Drill that is submitted to the State.</text></paragraph>
<paragraph id="HEF1AE863A5894564B8298E52549D608C"><enum>(2)</enum><header>No collection of fee by Secretary</header><text display-inline="yes-display-inline">The Secretary may not collect a fee from the applicant or from the State for an application for an Application for Permit to Drill that is submitted to a State for which authority has been delegated under subsection (a)(1)(A).</text></paragraph> <paragraph commented="no" id="H70B52FFE04BC494AAF521C634E86382B"><enum>(3)</enum><header>Fee amount</header><text display-inline="yes-display-inline">The fee collected under paragraph (1) shall be less than or equal to the amount of the fee described in section 35(d)(2).</text></paragraph>
<paragraph commented="no" id="H23D5ABBB82CF4E839E41BAB9045FC531"><enum>(4)</enum><header>Use</header><text>A State shall use 100 percent of the fees collected under this subsection for the administration of the approved State program of the State.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H365F6E7C01624E95860DCE2B45EF06F2"><enum>(d)</enum><header>Voluntary termination of authority</header><text display-inline="yes-display-inline">A State may voluntarily terminate any authority delegated to such State under subsection (a) upon providing written notice to the Secretary 60 days in advance of the date of termination. Upon expiration of such 60-day period, the Secretary shall resume any activities for which authority was delegated to the State under subsection (a).</text></subsection>
<subsection id="HB249DF35C6014A0EBAA2B87FDA6F2056"><enum>(e)</enum><header>Appeal of denial of application for Application for Permit To Drill or application for approval of drilling plan</header>
<paragraph id="HA5D7840008334095829B59AA999E0DCB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If a State for which the Secretary has delegated authority under subsection (a)(1) denies an application for an Application for Permit to Drill or an application for approval of a drilling plan, the applicant may appeal such decision to the Department of the Interior Office of Hearings and Appeals.</text></paragraph> <paragraph id="H5141409B355749BDB1DB6186BEFAC474"><enum>(2)</enum><header>Fee allowed</header><text>The Secretary may charge the applicant a fee for the appeal referred to in paragraph (1).</text></paragraph></subsection>
<subsection id="HFC56D98A85E94ED3B111460AF1AC4AB4"><enum>(f)</enum><header>Federal administration of State program</header>
<paragraph id="H74C3FE256B0F46DF9DABA635D697EC64"><enum>(1)</enum><header>Notification</header><text>If the Secretary has reason to believe that a State is not administering or enforcing an approved State program, the Secretary shall notify the relevant State regulatory authority of any possible deficiencies.</text></paragraph> <paragraph id="H8C7137A604FF44CB8AAF18267ACF9F00"><enum>(2)</enum><header>State response</header><text>Not later than 30 days after the date on which a State receives notification of a possible deficiency under paragraph (1), the State shall—</text>
<subparagraph id="H9D3D3D7291294B509A756484222CD490"><enum>(A)</enum><text>take appropriate action to correct the possible deficiency; and</text></subparagraph> <subparagraph id="H8D830A530CB1438E943DD5C4FE8FF898"><enum>(B)</enum><text>notify the Secretary of the action in writing.</text></subparagraph></paragraph>
<paragraph id="H2637D01AC79345A791A22FCFB5CDE982"><enum>(3)</enum><header>Determination</header>
<subparagraph id="H6B5E5A63AC2346B9824E099826B23A2A"><enum>(A)</enum><header>In general</header><text>On expiration of the 30-day period referred to in paragraph (2), if the Secretary determines that a violation of all or any part of an approved State program has resulted from a failure of the State to administer or enforce the approved State program of the State or that the State has not demonstrated its capability and intent to administer or enforce such a program, the Secretary shall issue public notice of such a determination.</text></subparagraph> <subparagraph id="H51E63DE6F8534C46A73B1CBF33BABE40"><enum>(B)</enum><header>Appeal</header><text display-inline="yes-display-inline">A State may appeal the determination of the Secretary under subparagraph (A) in the applicable United States district court. The Secretary may not resume activities under paragraph (4) pending the resolution of the appeal.</text></subparagraph></paragraph>
<paragraph id="H5899C0B149CA40F4935261B11D88DDF4"><enum>(4)</enum><header>Resumption by Secretary</header><text>Subject to paragraph (3)(B), 30 days after the date on which the Secretary issues the public notice described in paragraph (3)(A), the Secretary shall resume any activities for which authority was delegated to the State during the period—</text> <subparagraph id="HDB585FB221F3433A8C882780C9765613"><enum>(A)</enum><text>beginning on the date 30 days after the date on which the Secretary issues the public notice under paragraph (3)(A); and</text></subparagraph>
<subparagraph id="H0F02B1478C67429F8A3DBC77A2F234A3"><enum>(B)</enum><text>ending on the date on which the Secretary determines that the State will administer or enforce, as applicable, such State’s approved State program.</text></subparagraph></paragraph> <paragraph id="H1CE486F7F6294644AA229FC2A020B1D3" commented="no"><enum>(5)</enum><header>Standing</header><text>States with approved regulatory programs shall have standing to sue the Secretary for any action taken under this subsection.</text></paragraph></subsection>
<subsection id="H907957E633E1432B81E0876DBCAEE277"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H965C616216B54319B01FB52CF456A093" commented="no"><enum>(1)</enum><header>Application for Permit to Drill</header><text display-inline="yes-display-inline"> The term <term>Application for Permit to Drill</term> or <term>Applications for Permit to Drill</term> means a permit—</text>
<subparagraph id="HA97BBD84CFB64DFD8D2572D3C945D853" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">that grants authority to drill for oil and gas; and</text></subparagraph> <subparagraph id="H96D712E445804EEFB43D576E6A0B3309" commented="no"><enum>(B)</enum><text>for which an application has been received that contains—</text>
<clause id="HC71B38865F4D435AAF3F82AD77AE9A37" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a drilling plan;</text></clause> <clause id="HF4F9BC687BC94127AE12B8B7FBC0CC69" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a surface use plan of operations described under section 3162.3–1(f) of title 43, Code of Federal Regulations (or successor regulation);</text></clause>
<clause id="HFFCC65E9C292465FA40C7EF8CDBE9756" commented="no"><enum>(iii)</enum><text>evidence of bond coverage; and</text></clause> <clause id="H9AD7BEEE22674D298C4B267DA5EDCFB9" commented="no"><enum>(iv)</enum><text>such other information as may be required by applicable orders and notices.</text></clause></subparagraph></paragraph>
<paragraph id="H4709D1DF9739495CA9123D986EE04D53"><enum>(2)</enum><header>Available Federal land</header><text display-inline="yes-display-inline">The term <term>available Federal land</term> means any Federal land that—</text> <subparagraph id="H34162193F09E49079A771BB4DC88CCD7"><enum>(A)</enum><text display-inline="yes-display-inline">is located within the boundaries of a State;</text></subparagraph>
<subparagraph id="HE39D53EAA2594D7FAA62BB9BF4763BA9"><enum>(B)</enum><text display-inline="yes-display-inline">is not held by the United States in trust for the benefit of a federally recognized Indian Tribe or a member of such an Indian Tribe;</text></subparagraph> <subparagraph id="HE932A19AA9DE425EB935A12188C039A1"><enum>(C)</enum><text>is not a unit of the National Park System;</text></subparagraph>
<subparagraph id="HB346C5AE5729427A9712CBE6C28D8AE4"><enum>(D)</enum><text>is not a unit of the National Wildlife Refuge System, except for the portion of such unit for which oil and gas drilling is allowed under law;</text></subparagraph> <subparagraph id="H7517F2A374CD4B77A2A8120BAE2EE698"><enum>(E)</enum><text>is not a congressionally approved wilderness area under the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>); and</text></subparagraph>
<subparagraph id="HCED03B729F3445BB95D39F388F5EB4F7"><enum>(F)</enum><text>has been identified as land available for lease or has been leased for the exploration, development, and production of oil and gas—</text> <clause id="H8F5413BCC624424F9F0813D767A5E71C"><enum>(i)</enum><text>by the Bureau of Land Management under—</text>
<subclause id="H78BD79D5934F4D53B712207E0FAD9690"><enum>(I)</enum><text>a resource management plan under the process provided for in the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); or</text></subclause> <subclause id="HA480304DC6CF43DF896913F4B5A55402"><enum>(II)</enum><text>an integrated activity plan with respect to the National Petroleum Reserve in Alaska; or</text></subclause></clause>
<clause id="H93BA753E0AF74FA18F1CAEE249EEA601"><enum>(ii)</enum><text display-inline="yes-display-inline">by the Forest Service under a National Forest management plan under the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1600">16 U.S.C. 1600 et seq.</external-xref>).</text></clause></subparagraph></paragraph> <paragraph id="H690F654264DF455AA520A0CDAA47ED6E" commented="no"><enum>(3)</enum><header>Drilling plan</header><text display-inline="yes-display-inline">The term <term>drilling plan</term> means a plan described under section 3162.3–1(e) of title 43, Code of Federal Regulations (or successor regulation).</text></paragraph>
<paragraph id="H7B5143DF983048B7B5263995822B9BC9"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> <paragraph id="HAA588B19F8B048A98007E72F8749DA0A"><enum>(5)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States.</text></paragraph>
<paragraph commented="no" id="H97F438C85E694296BADC589808C38107"><enum>(6)</enum><header>State applicant</header><text>The term <term>State applicant</term> means a State that has submitted an application under subsection (b).</text></paragraph> <paragraph id="HE996B478A466472DB824905920FFA5AC"><enum>(7)</enum><header>State program</header><text display-inline="yes-display-inline">The term <term>State program</term> means a program that provides for a State to—</text>
<subparagraph display-inline="no-display-inline" id="H006AED286ADC4708958F27741C6348ED"><enum>(A)</enum><text display-inline="yes-display-inline">issue Applications for Permit to Drill or approve drilling plans, as applicable, on available Federal land; and</text></subparagraph> <subparagraph id="H45135DB40B354EAD95CC105F2ADE3870"><enum>(B)</enum><text display-inline="yes-display-inline">impose sanctions for violations of State laws, regulations, or any condition of an issued Application for Permit to Drill or approved drilling plan, as applicable.</text></subparagraph></paragraph>
<paragraph id="H613D4A32CDBB443CB03E87E5C66C95EB"><enum>(8)</enum><header>Sundry notice</header><text display-inline="yes-display-inline">The term <term>sundry notice</term> means a written request—</text> <subparagraph id="H7F39C61500334830929ACB51ACC3F356"><enum>(A)</enum><text display-inline="yes-display-inline">to perform work not covered under an Application for Permit to Drill or drilling plan; or</text></subparagraph>
<subparagraph id="H2499E6CF3D5D405798C98BFF9733F3EC"><enum>(B)</enum><text display-inline="yes-display-inline">for a change to operations covered under an Application for Permit to Drill or drilling plan.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HEC4D114F07C5439898DF61D57C242131"><enum>(b)</enum><header>Inspection fees</header><text>Section 108 of the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1718">30 U.S.C. 1718</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H3BDA2B76B3634790A1F18A8993F6DFF9"><enum>(d)</enum><header>Inspection fees for certain States</header>
<paragraph id="H0CF929D0C6C847A78B2163740E9BFF83"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct inspections of operations under each oil and gas lease. The Secretary shall collect annual nonrefundable inspection fees in the amount specified in paragraph (2), from each designated operator under each oil and gas lease on Federal land that is subject to inspection under subsection (b) and that is located in a State for which the Secretary has delegated authority under section 44(a)(1)(A) of the Mineral Leasing Act.</text></paragraph> <paragraph id="HAF8854D14E0C476FAC07DA6C4407B671"><enum>(2)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount of the fees collected under paragraph (1) shall be—</text>
<subparagraph id="H3682C8CD76C541C898CC7ED1CD042C18"><enum>(A)</enum><text>$700 for each lease or unit or communitization agreement with no active or inactive wells, but with surface use, disturbance, or reclamation;</text></subparagraph> <subparagraph id="HEF6E24256FEF4EAB92F283D387B39973"><enum>(B)</enum><text>$1,225 for each lease or unit or communitization agreement with 1 to 10 wells, with any combination of active or inactive wells;</text></subparagraph>
<subparagraph id="HFAF4C04F5C48425FB4E6F27F7FCBF41B"><enum>(C)</enum><text>$4,900 for each lease or unit or communitization agreement with 11 to 50 wells, with any combination of active or inactive wells; and</text></subparagraph> <subparagraph id="H8D8EDF5DAE90440CBC388CB68EB7C683"><enum>(D)</enum><text>$9,800 for each lease or unit or communitization agreement with more than 50 wells, with any combination of active or inactive wells.</text></subparagraph></paragraph>
<paragraph id="H735F1BC1FB164D0DB4586F44ABF221C8"><enum>(3)</enum><header>Onshore energy safety fund</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the Onshore Energy Safety Fund (referred to in this subsection as the <quote>Fund</quote>), into which shall be deposited all amounts collected as fees under paragraph (1).</text></paragraph> <paragraph id="HF595DE6F8D41451CA3966A82FF8BF7FF"><enum>(4)</enum><header>Availability of fees</header><text>Notwithstanding section 3302 of title 31, United States Code, all amounts deposited in the Fund—</text>
<subparagraph id="H24A2072B0ED7418DA02BBCB01E2D7431"><enum>(A)</enum><text>shall be credited as offsetting collections;</text></subparagraph> <subparagraph id="HBC9E0930876241EBB7A50A34733823DE"><enum>(B)</enum><text>shall be available only to the extent provided for in advance in an appropriations Act; and</text></subparagraph>
<subparagraph id="H8C0E4C340042418E84882D6DF180E678"><enum>(C)</enum><text display-inline="yes-display-inline">shall only be available for expenditure for purposes of carrying out inspections of onshore oil and gas operations in those States for which the Secretary has delegated authority under section 44(a)(1)(A) of the Mineral Leasing Act.</text></subparagraph></paragraph> <paragraph id="HB50A997CE0DB4501894E5FB0CF779864"><enum>(5)</enum><header>Payment due date</header><text display-inline="yes-display-inline">The Secretary shall require payment of any fee assessed under this subsection not later than 30 days after the Secretary provides notice of the assessment of the fee after the completion of an inspection.</text></paragraph>
<paragraph commented="no" id="H514B5164994B4B36B10BDC187D221570"><enum>(6)</enum><header>Penalty</header><text display-inline="yes-display-inline">If a designated operator assessed a fee under this subsection fails to pay the full amount of the fee as prescribed in this subsection, the Secretary may, in addition to using any other applicable enforcement authority, assess civil penalties against the operator under section 109 in the same manner as if this section were a mineral leasing law.</text></paragraph> <paragraph id="H53EEB0FF41D34C5B8856CAC282E91748"><enum>(7)</enum><header>Notification to State of noncompliance</header><text display-inline="yes-display-inline">If, on the basis of any inspection under subsection (b), the Secretary determines that an operator is in noncompliance with the requirements of mineral leasing laws and this chapter, the Secretary shall notify the State of such noncompliance immediately.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section>
<section id="HE657BDBFED244990868FBB0DF870380B"><enum>102.</enum><header>Conveyance to certain States of property interest in State share of royalties and other payments</header>
<subsection id="H9EFB6A40AA244427BA3587BB37094235"><enum>(a)</enum><header>In general</header><text>Section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) is amended—</text> <paragraph id="HD78DB75584E7451BA603A74937013F6C"><enum>(1)</enum><text>in subsection (a), by striking <quote>shall be paid into the Treasury</quote> and inserting <quote>shall, except as provided in subsection (e), be paid into the Treasury</quote>;</text></paragraph>
<paragraph id="H5EEE9009127945DB976A43AA7A216909"><enum>(2)</enum><text>in subsection (c)(1), by inserting <quote>and except as provided in subsection (e)</quote> before <quote>, any rentals</quote>; and</text></paragraph> <paragraph id="H6DE1393ABBA743EE9FA67DD15A967607"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="H2DDC0B8174A549FCABBC5CF15C6092D5"><enum>(e)</enum><header>Conveyance to certain States of property interest in State share</header>
<paragraph commented="no" id="H69E9663338F5477CB82FDD4CED544B9A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, on request of a State and in lieu of any payments to the State under subsection (a), the Secretary of the Interior shall convey to the State all right, title, and interest in and to the percentage specified in that subsection for that State that would otherwise be required to be paid into the Treasury under that subsection.</text></paragraph> <paragraph id="HCAAFAEAB248D4E7E90037A49E0BB1DE8"><enum>(2)</enum><header>Amount</header><text>Notwithstanding any other provision of law, after a conveyance to a State under paragraph (1), any person shall pay directly to the State any amount owed by the person for which the right, title, and interest has been conveyed to the State under this subsection.</text></paragraph>
<paragraph id="H8EDD50577FA745E49A0579A3BD29364F"><enum>(3)</enum><header>Notice</header><text>The Secretary of the Interior shall promptly provide to each holder of a lease of public land to which subsection (a) applies that is located in a State to which right, title, and interest is conveyed under this subsection notice that—</text> <subparagraph id="H2C5D4D39350B4F63B6374CEF46A129AE"><enum>(A)</enum><text>the Secretary of the Interior has conveyed to the State all right, title, and interest in and to the amounts referred to in paragraph (1); and</text></subparagraph>
<subparagraph id="H11706343AC0C49C8AB06180CD1E61139"><enum>(B)</enum><text>the leaseholder is required to pay the amounts directly to the State.</text></subparagraph></paragraph> <paragraph id="HA73DB10B126F42EBBDBB10A5F3165452"><enum>(4)</enum><header>Report</header><text>A State that has received a conveyance under this subsection shall report monthly to the Office of Natural Resources Revenue of the Department of the Interior the amount paid to such State pursuant to this subsection.</text></paragraph>
<paragraph commented="no" id="H6D890530AC4F4619AC448B756A549B15"><enum>(5)</enum><header>Application with respect to Federal Oil and Gas Royalty Management Act</header><text display-inline="yes-display-inline">With respect to the interest conveyed to a State under this subsection from sales, bonuses, royalties (including interest charges), and rentals collected under the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1701">30 U.S.C. 1701 et seq.</external-xref>), this subsection shall only apply with respect to States for which the Secretary has delegated any authority under section 44(a)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection display-inline="no-display-inline" id="H7ECA617ED3C04B578900B1DD20A4C0B0"><enum>(b)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">Section 35(b) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191(b)</external-xref>) is amended by striking <quote>In determining</quote> and inserting <quote>Except with respect to States for which the Secretary has delegated any authority under section 44(a)(1), in determining</quote>.</text></subsection>
<subsection commented="no" id="H0B5F81D0E331496F9D05F2EA8061DA2B"><enum>(c)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 205(f) of the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1735">30 U.S.C. 1735(f)</external-xref>) is amended by striking <quote>All moneys</quote> and inserting <quote>Subject to subsection (e) of section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>), all moneys</quote>.</text></subsection></section> <section id="HE8AE708A59C8487C92A814EDC24216DC" section-type="subsequent-section"><enum>103.</enum><header>Access to Federal oil and gas from non-Federal surface estate</header><text display-inline="no-display-inline">Section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H3988DD7EBB394A4C8FA8B8261887F3A9" style="OLC">
<subsection id="H4EAC3430A6E94228B6B95540FEB05C7C"><enum>(q)</enum><header>No Federal permit required for oil and gas activities on certain land</header>
<paragraph id="H4F601C1773D348AE8077E0DFD1432426"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall not require an operator to obtain a Federal drilling permit for oil and gas exploration and production activities conducted on non-Federal surface estate, provided that—</text> <subparagraph id="HEEAACF24F9C04123A82C8AC682B24ED1"><enum>(A)</enum><text>the United States holds an ownership interest of less than 50 percent of the subsurface mineral estate to be accessed by the proposed action; and </text></subparagraph>
<subparagraph id="H726411C360FC4786B8CC368B684CC5D0"><enum>(B)</enum><text>the operator submits to the Secretary a State permit to conduct oil and gas exploration and production activities on the non-Federal surface estate.</text></subparagraph></paragraph> <paragraph id="H0E99780304B24BAAAB3801F4B76C41EA"><enum>(2)</enum><header>No Federal action</header><text display-inline="yes-display-inline">An oil and gas exploration and production activity carried out under paragraph (1)—</text>
<subparagraph id="H3959B557E07B45DEB4A7F91DFA33FA47"><enum>(A)</enum><text>shall require no additional Federal action;</text></subparagraph> <subparagraph id="H52115AB270AD473397B41861A3D8ACB7"><enum>(B)</enum><text>may commence 30 days after submission of the State permit to the Secretary;</text></subparagraph>
<subparagraph id="H254C4A59048748A089D4EA75EE3B8D91" commented="no"><enum>(C)</enum><text>shall be categorically excluded from any further analysis and documentation under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) if the activity is conducted pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) for the purpose of exploration or development of oil or gas; and</text></subparagraph> <subparagraph id="H1BEDEF9EE2464EF2A84A2CF8C85B88FC"><enum>(D)</enum><text>shall not be subject to—</text>
<clause id="H625F83564B394A27849CC9FA707E04AF"><enum>(i)</enum><text>section 306108 of title 54, United States Code (commonly known as the National Historic Preservation Act of 1966); and</text></clause> <clause id="HC289E43F8E264FB3A2E45ECB390CA2B7"><enum>(ii)</enum><text>section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>).</text></clause></subparagraph></paragraph>
<paragraph id="H0FE59BA223634C0AB373D63F442A9451"><enum>(3)</enum><header>Royalties and production accountability</header>
<subparagraph commented="no" display-inline="yes-display-inline" id="H99AA68C56FCC4AF3BD4D5F93E72AF87F"><enum>(A)</enum><text display-inline="yes-display-inline">Nothing in this subsection shall affect the amount of royalties due to the United States under this Act from the production of oil and gas, or alter the Secretary’s authority to conduct audits and collect civil penalties pursuant to the Federal Oil and Gas Royalty Management Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/30/1701">30 U.S.C. 1701 et seq.</external-xref>).</text></subparagraph> <subparagraph id="H4521F6FDD70A4AB3AC15D1786706A839" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary may conduct onsite reviews and inspections to ensure proper accountability, measurement, and reporting of production of Federal oil and gas, and payment of royalties.</text></subparagraph></paragraph>
<paragraph id="H5A797F9FD768477CBC3F6E518C6C2D35"><enum>(4)</enum><header>Exceptions</header><text display-inline="yes-display-inline">This subsection shall not apply to actions on Indian lands or resources managed in trust for the benefit of Indian Tribes.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HEF8DB4D255FA4028A66DC30734621AD4"><enum>104.</enum><header>Exemption of certain payments from sequestration</header> <subsection id="H51AA0C284EC948F0A6ABEF54656B8B3B" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by inserting after <quote>Payments to Social Security Trust Funds (28–0404–0–1–651).</quote> the following:</text>
<quoted-block style="OLC" id="HB571C67F8F684621AD16D819B11DF5EA" display-inline="no-display-inline"><list level="paragraph"><list-item>Payments to States pursuant to section 35 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) (014-5003-0-2-806).</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H522CFAE9DAE5488C8948DE28F4C3F0AC"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by this section shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>) on or after the date of enactment of this Act.</text></subsection></section> <section id="H344428B18EDA47E3A4C98DFCBED76650"><enum>105.</enum><header>State and Tribal authority for hydraulic fracturing regulation</header><text display-inline="no-display-inline">The Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) is amended by inserting after section 44 (as added by section 101) the following:</text>

<section id="HEC6D4949AD314A95AE81E8F754141374"><enum>45.</enum><header>State and Tribal authority for hydraulic fracturing regulation</header>
<subsection id="H033144F5145B4FB6926AE2DDE2BC8436"><enum>(a)</enum><header>In general</header><text>The Secretary of the Interior shall not enforce any Federal regulation, guidance, or permit requirement regarding hydraulic fracturing relating to oil, gas, or geothermal production activities on or under any land in any State that has regulations, guidance, or permit requirements for that activity.</text></subsection> <subsection id="HAB304CD1F1F141C69C5EBB6FFE48BF23"><enum>(b)</enum><header>State authority</header><text display-inline="yes-display-inline">The Secretary of the Interior shall defer to State regulations, guidance, and permit requirements for all activities regarding hydraulic fracturing relating to oil, gas, or geothermal production activities on Federal land.</text></subsection>
<subsection id="H32CC40BD4448481F8DACD14FE878CB50"><enum>(c)</enum><header>Transparency of State regulations</header>
<paragraph id="H361AA6A325194711A2808112BCE76006"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each State shall submit to the Bureau of Land Management a copy of the regulations of such State that apply to hydraulic fracturing operations on Federal land, including those that require disclosure of chemicals used in hydraulic fracturing operations.</text></paragraph> <paragraph id="H33DDBEE781B74915B4A2E96412202BE1"><enum>(2)</enum><header>Availability</header><text>The Secretary of the Interior shall make available to the public on the website of the Secretary the regulations submitted under paragraph (1).</text></paragraph></subsection>
<subsection id="HF07B33313AC34357908FF451DDFD2807"><enum>(d)</enum><header>Tribal authority on trust land</header><text display-inline="yes-display-inline">The Secretary of the Interior shall not enforce any Federal regulation, guidance, or permit requirement with respect to hydraulic fracturing on any land held in trust or restricted status for the benefit of a federally recognized Indian Tribe or a member of such an Indian Tribe, except with the express consent of the beneficiary on whose behalf such land is held in trust or restricted status.</text></subsection> <subsection id="HADD672856134450AA8D234D43AFC15BF"><enum>(e)</enum><header>Hydraulic fracturing defined</header><text display-inline="yes-display-inline">In this section, the term <term>hydraulic fracturing</term> means the process of creating small cracks, or fractures, in underground geological formations for well stimulation purposes of bringing hydrocarbons into the wellbore and to the surface for capture.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HE8855181B5574138A6ACA7D12BEBB899"><enum>106.</enum><header>Protested lease sales</header><text display-inline="no-display-inline">Section 17(b)(1)(A) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(b)(1)(A)</external-xref>) is amended by inserting <quote>The Secretary shall resolve any protest to a lease sale not later than 60 days after such payment.</quote> after <quote>annual rental for the first lease year.</quote>.</text></section> <section id="HE42595DD838E433187BE2D1BD5C6BE75"><enum>107.</enum><header>Clarification regarding liability under Migratory Bird Treaty Act</header><text display-inline="no-display-inline">Section 2 of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HF99E512311864F509F3F47BF5159958B"><enum>(c)</enum><header>Limitation on application to accidental or incidental take</header><text display-inline="yes-display-inline">This Act shall not apply to any activity described in subsection (a) that is accidental or incidental to the presence or operation of an otherwise lawful activity.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></section> <section id="H53E703662A464A5EB65A2877BD8ACF2C" section-type="subsequent-section"><enum>108.</enum><header>Amendments to the Energy Policy Act of 2005</header><text display-inline="no-display-inline">Section 390 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15942">42 U.S.C. 15942</external-xref>) is amended to read as follows:</text>

<section id="H9AA73B1F10E040B9882A6B3FA3A7F536"><enum>390.</enum><header>National Environmental Policy Act review</header>
<subsection id="H896EB6ACEC8B4F80AD8DC9EC05159A9C"><enum>(a)</enum><header>National Environmental Policy Act review</header><text display-inline="yes-display-inline">Action by the Secretary of the Interior, in managing the public lands, or the Secretary of Agriculture, in managing National Forest System lands, with respect to any of the activities described in subsection (d) shall be categorically excluded from any further analysis and documentation under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) if the activity is conducted pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) for the purpose of exploration or development of oil or gas.</text></subsection> <subsection id="HF893A1A1DBAD4AA5B1AA6BB8A56BDFFB"><enum>(b)</enum><header>Categorical exclusion</header><text display-inline="yes-display-inline">Use of a categorical exclusion created in this section—</text>
<paragraph id="HC2693BD7E7EA4D8FB70265EFAB757653"><enum>(1)</enum><text>shall not require a finding of no extraordinary circumstances; and</text></paragraph> <paragraph id="H941867CBE7AA4F7C9BA3D28FF424011C"><enum>(2)</enum><text>shall be effective for the full term of the authorized permit or approval.</text></paragraph></subsection>
<subsection id="H9D0CE03E9A9F414B8FDF511C0D08A8B2"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">This section shall not apply to an action of the Secretary of the Interior or the Secretary of Agriculture on Indian lands or resources managed in trust for the benefit of Indian Tribes.</text></subsection> <subsection id="H5C6AB7E5C4464C379A55D45F568D0157"><enum>(d)</enum><header>Activities described</header><text display-inline="yes-display-inline">The activities referred to in subsection (a) are as follows:</text>
<paragraph id="HE2C3A065B1AF4223BF8D716B3DA117AD"><enum>(1)</enum><text>Reinstating a lease pursuant to section 31 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/188">30 U.S.C. 188</external-xref>).</text></paragraph> <paragraph id="H5BF9F38115B74C05B508A4BE7183C3A5"><enum>(2)</enum><text display-inline="yes-display-inline">The following activities, provided that any new surface disturbance is contiguous with the footprint of the original authorization and does not exceed 20 acres or the acreage evaluated in a document previously prepared under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) with respect to such activity, whichever is greater:</text>
<subparagraph id="HC5DAD7EA53C74469B61528F048B2A6CE"><enum>(A)</enum><text>Drilling an oil or gas well at a well pad site at which drilling has occurred previously.</text></subparagraph> <subparagraph id="H269ABA1A854A4AE186CB16DEE3BAE4BA"><enum>(B)</enum><text>Expansion of an existing oil or gas well pad site to accommodate an additional well.</text></subparagraph>
<subparagraph id="H55FE6170C0D34AC28C62621CCBDD17DB"><enum>(C)</enum><text>Expansion or modification of an existing oil or gas well pad site, road, pipeline, facility, or utility submitted in a sundry notice.</text></subparagraph></paragraph> <paragraph id="H10995E359DA8421F996C1F6F59ED10EC"><enum>(3)</enum><text display-inline="yes-display-inline">Drilling of an oil or gas well at a new well pad site, provided that the new surface disturbance does not exceed 20 acres or the acreage evaluated in a document previously prepared under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) with respect to such activity, whichever is greater.</text></paragraph>
<paragraph id="H224C28678A4447778EA07951E5F4FA5E"><enum>(4)</enum><text>Construction or realignment of a road, pipeline, or utility within an existing right-of-way or within a right-of-way corridor established in a land use plan.</text></paragraph> <paragraph id="H7872042511D24FF1AB6B392DF0F8A422"><enum>(5)</enum><text>The following activities when conducted from non-Federal surface into federally owned minerals, provided that the operator submits to the Secretary concerned certification of a surface use agreement with the non-Federal landowner:</text>
<subparagraph id="H5A5B1759AF1E4389B2E368B8D7D6D467"><enum>(A)</enum><text>Drilling an oil or gas well at a well pad site at which drilling has occurred previously.</text></subparagraph> <subparagraph id="H23ACBDF0D1044CE4AA1FA7E2B9C0A45C"><enum>(B)</enum><text>Expansion of an existing oil or gas well pad site to accommodate an additional well.</text></subparagraph>
<subparagraph id="H9893ADADD45D4C359DD682420C87002E"><enum>(C)</enum><text>Expansion or modification of an existing oil or gas well pad site, road, pipeline, facility, or utility submitted in a sundry notice.</text></subparagraph></paragraph> <paragraph id="HE6736979CEFE40D9AB1BEF597D13B938"><enum>(6)</enum><text>Drilling of an oil or gas well from non-Federal surface and non-Federal subsurface into Federal mineral estate.</text></paragraph>
<paragraph id="HBA3EB62DB943493A8CF3685E62779CA5"><enum>(7)</enum><text>Construction of up to 1 mile of new road on Federal or non-Federal surface, not to exceed 2 miles in total.</text></paragraph> <paragraph id="HC737FEA820B44EB9BBF1F082408F8751"><enum>(8)</enum><text>Construction of up to 3 miles of individual pipelines or utilities, regardless of surface ownership.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HB7B8C68EDA924AD99284FBCF961E9E20" section-type="subsequent-section"><enum>109.</enum><header>Administrative protest process reform</header><text display-inline="no-display-inline">Section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>), as amended by section 103 of this Act, is further amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H3E5DBC8750C4457A8A25468C4796EAC4" style="OLC"> <subsection id="H5B61216FB3E24D588D951CE20110984F"><enum>(r)</enum><header>Protest filing fee</header> <paragraph display-inline="no-display-inline" id="H0F938EFD04C54A0BA36ACB7524389479"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before processing any protest filed under this section, the Secretary shall collect a filing fee in the amount described in paragraph (2) from the protestor to recover the cost for processing documents filed for each administrative protest.</text></paragraph>
<paragraph id="H8E471AA998114925AE128DFC20DDCD5F"><enum>(2)</enum><header>Amount</header><text display-inline="yes-display-inline">The amount described in this paragraph is calculated as follows:</text> <subparagraph id="H199146262B1B488EA3E36E6E275CD2D9"><enum>(A)</enum><text>For each protest filed in a submission not exceeding 10 pages in length, the base filing fee shall be $150.</text></subparagraph>
<subparagraph id="HF891263F927F4E888336F613D2491465"><enum>(B)</enum><text>For each submission exceeding 10 pages in length, in addition to the base filing fee, an assessment of $5 per page in excess of 10 pages shall apply.</text></subparagraph> <subparagraph id="H85E3CB133F6D4E228C1F594077439518"><enum>(C)</enum><text>For protests that include more than one oil and gas lease parcel, right-of-way, or application for permit to drill in a submission, an additional assessment of $10 per additional lease parcel, right-of-way, or application for permit to drill shall apply.</text></subparagraph></paragraph>
<paragraph id="H000BB081F83F42F88794C2048285B6BA"><enum>(3)</enum><header>Adjustment</header>
<subparagraph display-inline="no-display-inline" id="H26C62FEADA2F492C8D7A6ACE320AC245"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on January 1, 2022, and annually thereafter, the Secretary shall adjust the filing fees established in this subsection to whole dollar amounts to reflect changes in the Producer Price Index, as published by the Bureau of Labor Statistics, for the previous 12 months.</text></subparagraph> <subparagraph id="H2BDA3416855C40AE971646293A6B4306"><enum>(B)</enum><header>Publication of adjusted filing fees</header><text display-inline="yes-display-inline">At least 30 days before the filing fees as adjusted under this paragraph take effect, the Secretary shall publish notification of the adjustment of such fees in the Federal Register.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HE05CE132E82149F4AB965BF2D87C5D31"><enum>110.</enum><header>Notifications of permit to drill</header><text display-inline="no-display-inline">The Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>) is amended by inserting after section 45 (as added by section 104 of this Act) the following:</text> <quoted-block display-inline="no-display-inline" id="H8C0FEB51D2434CE9A0266C646BB29DFB" style="OLC"> <section id="H6C34B1CB19AE404696F1FE960108DA7F"><enum>46.</enum><header>Notifications of permit to drill</header> <subsection id="H5441FB1DAFA34440B2D90C588637AAA5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall establish procedures by which an operator may conduct drilling and production activities on available Federal land and non-Federal land that is located in a State to which the Secretary has not delegated exclusive authority under section 44(a)(1) after sending to the Secretary a notification of permit to drill under this section in lieu of obtaining an Application for Permit to Drill.</text></subsection>
<subsection id="H3574BAEFFDDA4BAF8001A226FE4A4457"><enum>(b)</enum><header>Content of notification</header><text display-inline="yes-display-inline">To be considered a complete notification of permit to drill under this section, an operator shall include in the notification of permit to drill submitted under this section—</text> <paragraph id="H1CF4EFCD6F5947ABAF7BB51C4733FD6F"><enum>(1)</enum><text display-inline="yes-display-inline">a notification of permit to drill form;</text></paragraph>
<paragraph id="H89997338D85C4E51AAA9A71D89F5550F"><enum>(2)</enum><text>a surface use plan of operations;</text></paragraph> <paragraph id="HC437B59BC0B548C58C77B5F060F3C937"><enum>(3)</enum><text>a drilling plan;</text></paragraph>
<paragraph id="H5D06779B95E9442CA4EBAE1E19D5E34E"><enum>(4)</enum><text>a well plat certified by a registered surveyor;</text></paragraph> <paragraph id="HE52847361AC4429680B1999727F7C37A"><enum>(5)</enum><text>an operator certification;</text></paragraph>
<paragraph id="H320AE0C75B924AFABDF91B9BBF3C1775"><enum>(6)</enum><text>evidence of bond coverage; and</text></paragraph> <paragraph id="H0ED04B40095C431D82F99ACFC2373CEB"><enum>(7)</enum><text display-inline="yes-display-inline">a notification of permit to drill fee in an amount to be determined by the Secretary.</text></paragraph></subsection>
<subsection id="HD6A4C778F7D544C496078336A280BF9A"><enum>(c)</enum><header>Justifications for objection</header>
<paragraph id="H0681133F6D0B417E983296185DAC6F55"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this subsection, the Secretary may not object to a notification of permit to drill under this section if the notification—</text> <subparagraph id="HA6C8469FFB7C46CAA50E352149D320A8"><enum>(A)</enum><text display-inline="yes-display-inline">demonstrates that the drilling operations described in the notification of permit to drill will be located in—</text>
<clause id="H7D1A3A0680FD40F4BC98A82BC97EEBBC"><enum>(i)</enum><text display-inline="yes-display-inline">a developed field, where there are existing oil and gas wells within a 5-mile radius and for which an approved land use plan or environmental review was prepared within the last 10 years under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) that analyzed such drilling operations as a reasonably foreseeable activity;</text></clause> <clause id="H2A3041564C13423B9B845BB02004A951"><enum>(ii)</enum><text>a location or well pad site at which drilling has occurred within 10 years before the date of spudding the well and the proposed operations do not increase the surface disturbance on the location or well pad site;</text></clause>
<clause id="HF46A1E55265D4C21B071D7CA7808028B"><enum>(iii)</enum><text display-inline="yes-display-inline">an area consisting of individual surface disturbances of less than 10 acres and the total surface disturbance on the lease is not greater than 150 acres and for which an approved land use plan or environmental review was prepared within the last 10 years under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) that analyzed such drilling operations as a reasonably foreseeable activity;</text></clause> <clause id="H4BC8EB70D6D5410D827BB5E5A8EAAF94"><enum>(iv)</enum><text>an area consisting of Federal mineral interests that is located within the boundaries of a communitization agreement or unit agreement which contains minerals leased by a State or private mineral owner for which a drilling permit has been approved by a State regulatory agency; or</text></clause>
<clause id="H6DDE351B8DEB445FA851DE33B15437AB"><enum>(v)</enum><text display-inline="yes-display-inline">an area in which a categorical exclusion under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) applies for oil and gas drilling or reentry activities; or</text></clause></subparagraph> <subparagraph id="H3C7513FAF1E54CFDB973DDA0394A9732"><enum>(B)</enum><text>includes—</text>
<clause id="HF2366814B0984E1A8A0DAF87FC730D05"><enum>(i)</enum><text display-inline="yes-display-inline">an environmental review that concludes that actions described in the notification of permit to drill pose no significant effects on the human environment or threatened or endangered species; and</text></clause> <clause id="H27C5C9E8D4D74E31B73DA0013D007DA5"><enum>(ii)</enum><text display-inline="yes-display-inline">an archaeological review that concludes that actions described in the notification of permit to drill pose no significant effects on cultural or historic properties or resources.</text></clause></subparagraph></paragraph>
<paragraph id="HB58379E54E454F57A24246F1F0391277"><enum>(2)</enum><header>Endangered species protection</header>
<subparagraph id="H24B935B0D7A94604B4105A14844933CD"><enum>(A)</enum><header>In general</header><text>Notwithstanding paragraph (1), the Secretary shall object to a notification of permit to drill if the activity described in such notification of permit to drill is likely to jeopardize the continued existence of a species that is a threatened species or endangered species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or result in the destruction or adverse modification of critical habitat of such species.</text></subparagraph> <subparagraph id="H90399F76111648BD8F0E7248DBFA37B2"><enum>(B)</enum><header>Withdrawal of objection</header><text display-inline="yes-display-inline">The Secretary may withdraw an objection under subparagraph (A) if the operator consults with the Secretary on such objection and places conditions on the notification of permit to drill sufficient to comply with the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph></paragraph>
<paragraph id="HF135F3BE549746DCBE46EF5EE2C59AEE"><enum>(3)</enum><header>National Historic Preservation</header>
<subparagraph id="H1A5E1B219A7C45E6938D3DACE1D30918"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), the Secretary shall object to a notification of permit to drill if the activity described in such notification of permit to drill is likely to affect properties listed, or eligible for listing, in the National Register of Historic Places under section 306108 of title 54, United States Code (commonly known as the National Historic Preservation Act of 1966).</text></subparagraph> <subparagraph id="H50BD496B07E1427886E633D14D4D4487"><enum>(B)</enum><header>Withdrawal of objection</header><text display-inline="yes-display-inline">The Secretary may withdraw an objection under subparagraph (A) if the operator consults with the Secretary on such objection and places conditions on the notification of permit to drill sufficient to comply with section 306108 of title 54, United States Code (commonly known as the National Historic Preservation Act of 1966).</text></subparagraph></paragraph></subsection>
<subsection id="HD6DDECF8CD7D4D72B216A80F5244ADAD"><enum>(d)</enum><header>Objection or no action</header>
<paragraph id="H5A28F033FBD748EFBBA6D0E23348AE15"><enum>(1)</enum><header>Notification of incomplete notification</header><text display-inline="yes-display-inline">Not later than 15 days after receipt of a notification of permit to drill or a revised notification of permit to drill from an operator under this section, the Secretary shall notify the operator in writing if the notification of permit to drill is not complete.</text></paragraph> <paragraph id="HF6B2247E196C41D5BD93F5320E214452"><enum>(2)</enum><header>Notification of objections</header><text display-inline="yes-display-inline">The Secretary shall notify an operator of any objections to the notification of permit to drill not later than 45 days after receipt of a complete notification of permit to drill from an operator under this section.</text></paragraph>
<paragraph id="HA5BF3286A9C84F04BB99CCE52FA0D02A"><enum>(3)</enum><header>No action required</header><text display-inline="yes-display-inline">If the Secretary has not notified an operator under either paragraph (1) or paragraph (2) within 45 days after receipt of a notification of permit to drill from the operator under this section, the operator may, without further action from the Secretary, conduct the drilling and production activities for which the notification of permit to drill was submitted.</text></paragraph> <paragraph id="H2E2FF42B481E40A6B628A908DC7B4A48"><enum>(4)</enum><header>Opportunity to resubmit notification</header><text display-inline="yes-display-inline">If the Secretary notifies an operator under paragraph (1) of an incomplete notification or paragraph (2) of an objection, the Secretary shall allow the operator to address such incomplete notification or objection and revise and resubmit the notification of permit to drill.</text></paragraph>
<paragraph id="H7C441BA9479E4A88A0E40DB1F0EECDA6"><enum>(5)</enum><header>Opportunity to resubmit notification as Application for Permit to Drill</header><text display-inline="yes-display-inline">If the Secretary notifies an operator under paragraph (2) of an objection, the Secretary shall allow the operator to resubmit such information in the form of an Application for Permit to Drill.</text></paragraph></subsection> <subsection display-inline="no-display-inline" id="H99DCDA3040DD4CE685CDCEAB17F8B409"><enum>(e)</enum><header>Notification fee</header><text display-inline="yes-display-inline">The Secretary may not charge an operator under this section a fee for submitting a notification of permit to drill greater than the fee the Secretary charges an applicant for an Application for Permit to Drill.</text></subsection>
<subsection id="H9F9A09A3819A4A31985BA25EE6250066"><enum>(f)</enum><header>Environmental review</header>
<paragraph id="H8C4295F0CA6648168322692F84E57722"><enum>(1)</enum><header>In general</header><text>An environmental review or archaeological review described in subsection (c)(1)(B) may be completed by a third-party contractor approved by the Secretary or pursuant to a memorandum of understanding between the operator and the Secretary.</text></paragraph> <paragraph id="H42CBC3894F3F47B38C09ACEA6DC44058"><enum>(2)</enum><header>Field work authorization</header><text display-inline="yes-display-inline">The Secretary shall issue a field work authorization to a third-party contractor for the purposes of paragraph (1) within a reasonable time.</text></paragraph>
<paragraph commented="no" id="H9A5F901F15C040A48315CEB9BC748B98"><enum>(3)</enum><header>Request for concurrence</header><text display-inline="yes-display-inline">The Secretary shall allow a third-party contractor to submit a request to the State Historic Preservation Office on behalf of the Secretary.</text></paragraph></subsection> <subsection display-inline="no-display-inline" id="H7175EC1D38F143EC858B23BAF87B7D2C"><enum>(g)</enum><header>Additional surface use permits</header><text display-inline="yes-display-inline">The Secretary may not require an operator that has submitted a notification of permit to drill for which the Secretary did not object to obtain a surface use permit for an action included in the notification of permit to drill.</text></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD83BB0D058C54ABB80F41CD572109E05"><enum>(h)</enum><header>Site inspection</header><text display-inline="yes-display-inline">The Secretary may not require an operator that has submitted a notification of permit to drill for which the Secretary did not object to submit to a site inspection before commencement of the activities described in the notification of permit to drill.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H8ACCEAAB7A7F4A4BB5590E45E2C42FCE"><enum>(i)</enum><header>Federal enforcement</header><text display-inline="yes-display-inline">The Secretary may conduct inspections of and evaluate activities described in a notification of permit to drill for purposes of bringing an enforcement action. The Secretary may suspend enforcement proceedings if the operator modifies its activities to comply with the notification of permit to drill or obtains an Application for Permit to Drill for such activities.</text></subsection>
<subsection id="HC169F835EB5B4F8BA43B480DCC57EB17"><enum>(j)</enum><header>Application of the National Environmental Policy Act</header>
<paragraph id="H595CC2E75E184C469CEB53073BD54CC3"><enum>(1)</enum><header>No action by Secretary</header><text>The decision by the Secretary to take no action under subsection (c)(1)(B)(2) shall not constitute a major Federal action for the purposes of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></paragraph> <paragraph id="H5190E683AA33466A95946659C4AB64C4"><enum>(2)</enum><header>Development of regulations</header><text display-inline="yes-display-inline">The development of any regulation pursuant to this section shall constitute a major Federal action for the purposes of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H1A6504F587F84CFF8ABC354E4E6EC613"><enum>(k)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H2F33737A8DB14AC5A4D956C562EE66E1"><enum>(1)</enum><header>In general</header><text>The terms <term>Application for Permit to Drill</term>, <term>Applications for Permit to Drill</term>, <term>available Federal land</term>, and <term>drilling plan</term> have the meaning given those terms in section 44.</text></paragraph>
<paragraph id="H91FE3916D03643568F30797FBEAD484D"><enum>(2)</enum><header>Surface use plan of operation</header><text display-inline="yes-display-inline">The term <term>surface use plan of operation</term> means a plan containing—</text> <subparagraph id="HD91DDA56929A4BF8919C204A860AC426"><enum>(A)</enum><text>the road and drill pad location;</text></subparagraph>
<subparagraph id="HE8A1AA9D63854348A9ADF41D3EF14AFC"><enum>(B)</enum><text>details of pad construction;</text></subparagraph> <subparagraph id="H95C0B47F4C7742F29AE87E979A4E8C4B"><enum>(C)</enum><text>methods for containment and disposal of waste material;</text></subparagraph>
<subparagraph id="H6701C54F19634BE0A2369B675FCCF993"><enum>(D)</enum><text>plans for reclamation of the surface;</text></subparagraph> <subparagraph id="H416C6BB73A5749D79D2EE2D84EC8201E"><enum>(E)</enum><text>any other information specified in applicable orders or notices; and</text></subparagraph>
<subparagraph id="H92C48798CC9D46AC9130EBDB7FF7370F"><enum>(F)</enum><text>any other pertinent data as the Secretary may require.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title> <title id="HF17CFDC148274DA2BA83B7D2C76EFE82"><enum>II</enum><header>Offshore Oil and Gas</header> <section id="H7D31FB4CF2E849149E2A7545A3FBBF47" commented="no"><enum>201.</enum><header>Limitation of authority of the President to withdraw areas of the Outer Continental Shelf from oil and gas leasing</header> <subsection id="H17D69969A0844E83A2184F2399C9A07C" commented="no"><enum>(a)</enum><header>Reservations</header><text>Section 12(a) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1341">43 U.S.C. 1341(a)</external-xref>) is amended to read as follows:</text>

<paragraph id="H09C04F557729413DBB7C95E4740432A5" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, no submerged lands of the Outer Continental Shelf may be withdrawn from disposition except by an Act of Congress.</text></paragraph> <paragraph id="HCF8ED9F9816B423299FCEE3D1F56E000" commented="no"><enum>(2)</enum><header>National marine sanctuaries</header><text>The President may withdraw from disposition any of the unleased submerged lands of the Outer Continental Shelf that are located in a national marine sanctuary designated—</text>
<subparagraph id="H41111F04A61B458282E53F2EF1170F0E"><enum>(A)</enum><text>in accordance with the National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431 et seq.</external-xref>); or</text></subparagraph> <subparagraph id="H75A0879AE81E44B7B72F9BB3A963FCB3"><enum>(B)</enum><text>by an Act of Congress.</text></subparagraph></paragraph>
<paragraph id="H90A2E448866645099FB88B655936D58D" commented="no"><enum>(3)</enum><header>Existing withdrawals</header>
<subparagraph id="H463EA19817BF474B8A62B49DB46341D2" commented="no"><enum>(A)</enum><header>In general</header><text>Except for the withdrawals described in subparagraph (B), any withdrawal from disposition of submerged lands of the Outer Continental Shelf before the date of the enactment of this subsection shall have no force or effect.</text></subparagraph> <subparagraph id="H14391A66DEEA4CDD89F2839A9CABB1C3" commented="no"><enum>(B)</enum><header>Exceptions</header><text>Subparagraph (A) shall not apply to the following withdrawals:</text>
<clause id="HB7F61151471D4E1EAC2BBEFCB04E6153" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">Any withdrawal from disposition of submerged lands of the Outer Continental Shelf that are located in a national marine sanctuary designated in accordance with the National Marine Sanctuaries Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1431">16 U.S.C. 1431 et seq.</external-xref>).</text></clause> <clause id="H180950019FB44A2DA83441F2F881D336" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">Any withdrawal from disposition of submerged lands of the Outer Continental Shelf that are located in the boundary of a national monument declared under section 320301 of title 54, United States Code.</text></clause>
<clause commented="no" id="H522DEE500FD64962B14E30B092B8F93E"><enum>(iii)</enum><text display-inline="yes-display-inline">Any withdrawal from disposition of the North Aleutian Basin planning area, including Bristol Bay (as such planning area is depicted in the document titled <quote>2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program</quote>, dated November 2016, or a subsequent oil and gas leasing program developed under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>)).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H3AB9290EDDB14D92AC4BE173B9EDB385" commented="no"><enum>(b)</enum><header>Termination of authority To establish marine national monuments</header><text display-inline="yes-display-inline">Section 320301 of title 54, United States Code, is amended—</text>

<clause id="H51F89A686064465E821C644BBBE00551"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), the term <term>covered planning area</term> means each of the following planning areas (as such planning areas are depicted in the document titled <quote>2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program</quote>, dated November 2016, or a subsequent oil and gas leasing program developed under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>)):</text> <subclause id="H3EBEA7DFF4494A58B4503363E4ECE609"><enum>(I)</enum><text>The Mid-Atlantic planning area.</text></subclause>

<clause id="H3774337E710F46D69708E63B100E73EF"><enum>(ii)</enum><header>Exclusions</header><text>The term <term>covered planning area</term> does not include any area in the Atlantic Ocean—</text> <subclause id="HF66764E029F64368AEFEF6CDC1B0BE7D"><enum>(I)</enum><text>north of the southernmost lateral seaward administrative boundary of the State of Maryland; or</text></subclause>
<subclause id="H4176E91CACE042ADA6FB9BA65AE087F9"><enum>(II)</enum><text>south of the northernmost lateral seaward administrative boundary of the State of Florida.</text></subclause></clause></subparagraph> <subparagraph id="HB1E422B6A85B4AE1BBEE3BA93D2C7446"><enum>(B)</enum><header>Producing State</header> <clause id="H01FD86693A0242FEA368CF2F782177B1"><enum>(i)</enum><header>In general</header><text>The term <term>producing State</term> means each of the following States:</text>
<subclause id="HC3D4ADA5C3F74A7D99F07E53DF9D1BC4"><enum>(I)</enum><text>Virginia.</text></subclause> <subclause id="HBBEE7C8526D647B695B9ADAFDEC81D94"><enum>(II)</enum><text>North Carolina.</text></subclause>
<subclause id="HA906F6BBA573445297B68DD138909004"><enum>(III)</enum><text>South Carolina.</text></subclause> <subclause id="H790923BB8CA4409C9E4A5700A63F2E96"><enum>(IV)</enum><text>Georgia.</text></subclause>
<subclause id="H9DBFC54706DB49DA971B1AAA8791BD9B"><enum>(V)</enum><text>Alaska.</text></subclause></clause> <clause id="H80A767EA133641778EB39FB2B9FE8E9B"><enum>(ii)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>producing State</term> does not include any State the coastal seaward boundary of which is further than 200 nautical miles from the geographic center of any leased tract of the Outer Continental Shelf.</text></clause></subparagraph>
<subparagraph id="H83AFE4044623405A8BDB8E58110FBCB8"><enum>(C)</enum><header>Qualified revenue</header>
<clause id="HEB60111E787C4D48940626292EAF2C69"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>qualified revenue</term> means any revenue derived from rentals, royalties, bonus bids, and other sums due and payable to the United States under an oil and gas lease with respect to a covered planning area entered into on or after the date of the enactment of this subsection.</text></clause> <clause id="HB0B634936B254EB288E566A41F604611"><enum>(ii)</enum><header>Exclusions</header><text display-inline="yes-display-inline">The term <term>qualified revenue</term> does not include—</text>
<subclause id="H9ABADC2EA1644888BC5873C976044B24"><enum>(I)</enum><text>revenue from the forfeiture of a bond or other surety securing obligations other than royalties, civil penalties, or royalties taken by the Secretary in kind and not sold;</text></subclause> <subclause id="H39F5F10BD74142EA895377940876672A"><enum>(II)</enum><text>revenue generated from a lease subject to section 8(g); and</text></subclause>
<subclause id="HB84376A580F54278B95638E9D741954A" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">the portion of the rental revenue in excess of the amount of rental revenue that would have been collected at the rates in effect before August 5, 1993.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H737176E8026D43A59F1F9C8658A5A7A7"><enum>(2)</enum><header>Deposit of qualified revenue</header> <subparagraph id="HFBAC6FDEC00A45ABA0850A412A170057"><enum>(A)</enum><header>Phase I</header><text display-inline="yes-display-inline">With respect to qualified revenue from leases awarded under the first leasing program approved under section 18(a) that takes effect after the date of the enactment of this subsection, the Secretary of the Treasury shall deposit or allocate, as applicable—</text>
<clause id="HE291E6AAC942403AAA22BA380D8F548F"><enum>(i)</enum><text display-inline="yes-display-inline">87.5 percent of such qualified revenue into the general fund of the Treasury; and</text></clause> <clause id="H962673B2FF234F8BB6A65D4EC6686CF1"><enum>(ii)</enum><text display-inline="yes-display-inline">12.5 percent of such qualified revenue to producing States in accordance with paragraph (3).</text></clause></subparagraph>
<subparagraph id="H1CF272098ED446B0AF15470EA03F201A"><enum>(B)</enum><header>Phase II</header><text display-inline="yes-display-inline">With respect to qualified revenue from leases awarded under the second leasing program approved under section 18(a) that takes effect after the date of the enactment of this subsection, the Secretary of the Treasury shall deposit or allocate, as applicable—</text> <clause id="H766FAAEDFEC14967A3FCDE305E5B3299"><enum>(i)</enum><text display-inline="yes-display-inline">75 percent of such qualified revenue into the general fund of the Treasury; and</text></clause>
<clause id="H2B89AC06037846DFAB6C8432DD51DD7F"><enum>(ii)</enum><text display-inline="yes-display-inline">25 percent of such qualified revenue to producing States in accordance with paragraph (3).</text></clause></subparagraph> <subparagraph id="H6C1CE72129FB460CAF41BF8A95E6A29C"><enum>(C)</enum><header>Phase III</header><text>With respect to qualified revenue from leases awarded under the third leasing program approved under section 18(a) that takes effect after the date of the enactment of this subsection, and under any subsequent such leasing program, the Secretary of the Treasury shall deposit or allocate, as applicable—</text>
<clause id="HCB4EBA326536489B9B9F668A3C25AF46"><enum>(i)</enum><text display-inline="yes-display-inline">50 percent of such qualified revenue into the general fund of the Treasury; and</text></clause> <clause id="H2925E4C6FAD940F9BD541E3B05D34F8E"><enum>(ii)</enum><text display-inline="yes-display-inline">50 percent of such qualified revenue into a special account in the Treasury from which the Secretary of the Treasury shall disburse—</text>
<subclause display-inline="no-display-inline" id="HBA8B7E69737A4F0D8CEA23A6E474CFFD"><enum>(I)</enum><text display-inline="yes-display-inline">75 percent to States in accordance with paragraph (3); and</text></subclause> <subclause id="H070F8BFF20EB40E2A1B2239F41CA7180"><enum>(II)</enum><text display-inline="yes-display-inline">25 percent to the Secretary of the Interior for units of the National Park System.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="H7D95818CB981491BAC9CF5306B64476C" display-inline="no-display-inline"><enum>(3)</enum><header>Allocation to producing States</header>
<subparagraph commented="no" id="H9973937C2C4B4C18BB13824D2F8C4179"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with subparagraphs (B) and (C), the Secretary of the Treasury shall annually allocate the amounts made available under subparagraphs (A)(ii), (B)(ii), and (C)(ii)(I) of paragraph (2) to each producing State in an amount (based on a formula established by the Secretary by regulation) that—</text> <clause id="HD85E3BE250004766A50998AB7870CB07" commented="no"><enum>(i)</enum><text>is inversely proportional to the respective distances between—</text>
<subclause commented="no" id="HE7A284564F044AA29AD6135F0C97C57D"><enum>(I)</enum><text display-inline="yes-display-inline">the point on the coastline of the producing State that is closest to the geographical center of the applicable leased tract; and</text></subclause> <subclause commented="no" id="HB4C976A2613D453F9FB44A07A06821A0"><enum>(II)</enum><text>the geographical center of that leased tract; and</text></subclause></clause>
<clause commented="no" id="H8AC077E81BB44741895203F75BA2A327"><enum>(ii)</enum><text>is not less than 10 percent of the qualified revenue for a given leasing program.</text></clause></subparagraph> <subparagraph id="HEFEE99F71CB94B86ADF2AC5AEAA90BF7"><enum>(B)</enum><header>Allocation to noncontiguous coastal States</header> <clause id="H4551D02EBF144DF0B1C8B626649FBB6A"><enum>(i)</enum><header>In general</header><text>With respect to each producing State that is a noncontiguous coastal State, the Secretary of the Treasury shall allocate 20 percent of the allocable share of such State determined under this paragraph to the coastal political subdivisions of such State.</text></clause>
<clause id="H6C067AF6FE97438FAE48C4E7B6B0BE54"><enum>(ii)</enum><header>Allocation</header><text display-inline="yes-display-inline">The amount allocated by the Secretary of the Treasury to coastal political subdivisions under this subparagraph shall be allocated to each such coastal political subdivision in accordance with subparagraphs (B) and (E) of section 31(b)(4).</text></clause> <clause id="H9E26788DBC9743AD95480052D688BE65"><enum>(iii)</enum><header>Definition of coastal political subdivision</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>coastal political subdivision</term> means—</text>
<subclause id="HEAFE1A5538354100B762359E7E848C6A"><enum>(I)</enum><text display-inline="yes-display-inline">a county-equivalent subdivision of a State for which—</text> <item id="HB869CB481A464C8BA132689AC9FAB3A2"><enum>(aa)</enum><text>all or part of such subdivision lies within the coastal zone of the State (as defined in section 304 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref>)); and</text></item>
<item id="H18AD4FE9FD76414AB5D2ADE1406B3F79"><enum>(bb)</enum><text>the closest coastal point of such subdivision is not more than 200 nautical miles from the geographical center of any leased tract on the Outer Continental Shelf; or</text></item></subclause> <subclause id="HC389E3E919B24215B51C3FF1EC9C7C5D"><enum>(II)</enum><text>a municipal subdivision of a State—</text>
<item id="H8E8F0CEB4340409DB03347E04C2427E7"><enum>(aa)</enum><text>for which the closest point of such subdivision is not more than 200 nautical miles from the geographical center of a leased tract on the Outer Continental Shelf; and</text></item> <item id="H1F12E688578646479D0A88ECD8A94669"><enum>(bb)</enum><text>that the State determines is a significant staging area for oil and gas servicing, supply vessels, operations, suppliers, or workers.</text></item></subclause></clause></subparagraph>
<subparagraph id="HA4FE4F3765AA40B6981CF080C09B7889"><enum>(C)</enum><header>Allocation to contiguous coastal States</header>
<clause id="H43D517F7B1C94400B62736D9067995DE"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to each producing State that is a contiguous coastal State, the Secretary of the Treasury shall allocate—</text> <subclause id="H9864C4FF9B3B494FA3CA1F81869DDAE9"><enum>(I)</enum><text display-inline="yes-display-inline">50 percent of the allocable share of such State determined under this paragraph to the State treasury to be used by the State in accordance with clause (ii);</text></subclause>
<subclause id="HA22B188729FF4F38A04B468A0A1B051A"><enum>(II)</enum><text display-inline="yes-display-inline">25 percent of the allocable share of such State determined under this paragraph to coastal towns; and</text></subclause> <subclause id="HFBD371C80F4244AB81F6093867B3D0CF"><enum>(III)</enum><text display-inline="yes-display-inline">25 percent of the allocable share of such State determined under this paragraph to coastal counties.</text></subclause></clause>
<clause id="HA48A79D7BEFC4C9DA1381CEAC5D5B2E5"><enum>(ii)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds allocated to a producing State under clause (i)(I) shall be used by such State—</text> <subclause id="H252EA01CB49D4BF1822CCE69DE98EE92"><enum>(I)</enum><text display-inline="yes-display-inline">to enhance State land and water conservation efforts, particularly in inlets, waterways, and beaches;</text></subclause>
<subclause id="H6C16F00FD88F42C4A35C4A8A84817E4F"><enum>(II)</enum><text>for the purposes of beach nourishment and coastline enhancements;</text></subclause> <subclause id="H90F1609A7A3B47DFB8643A2211A14034"><enum>(III)</enum><text>for the protection of coastal wildlife;</text></subclause>
<subclause id="H242BCE228CAF40C0A6809963453818A1"><enum>(IV)</enum><text>to support estuary health and aquaculture management;</text></subclause> <subclause id="H632898DB7A6D47B8A7FE5853E1C5D872"><enum>(V)</enum><text display-inline="yes-display-inline">for dredging and port infrastructure development;</text></subclause>
<subclause id="H787D5BA99C1249E38F0625D501045CBC"><enum>(VI)</enum><text display-inline="yes-display-inline">to provide grants to support the geological and geophysical sciences or petroleum engineering programs or departments at institutions of higher education (as such term is defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that—</text> <item id="HF5A9EAB372BA4904A3EF1643B7662202"><enum>(aa)</enum><text>are accredited by the Accreditation Board for Engineering and Technology; and</text></item>
<item id="H5EEB3193C81A4417962CBAFD98B98458"><enum>(bb)</enum><text>are located within the producing State; or</text></item></subclause> <subclause id="H7C4DB4190E3D4F36B73F8101F04C3D24"><enum>(VII)</enum><text display-inline="yes-display-inline">for any other purpose that enhances coastal communities, as determined by the Governor of the producing State.</text></subclause></clause>
<clause id="H9FBDAC05D8A34F10951C24596B5DACC2"><enum>(iii)</enum><header>Definition of coastal town</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>coastal town</term> means an economic and residential center that is not more than 20 miles from the coast of the producing State.</text></clause></subparagraph></paragraph> <paragraph id="H0BC48436BAA745558F9E28F203D019BC" commented="no"><enum>(4)</enum><header>Administration</header><text display-inline="yes-display-inline">Amounts made available under paragraph (2)(B) shall—</text>

<paragraph id="H9CC28AB14EB74283B08E9615C6BC7CCF"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by this subsection shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>) on or after the date of enactment of this Act.</text></paragraph></subsection></section> <section id="H1929D24B5C3E42639C4E7DB29FA59B2D" section-type="subsequent-section"><enum>204.</enum><header>Addressing permits for taking of marine mammals</header><text display-inline="no-display-inline">Section 101(a)(5)(D) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1371">16 U.S.C. 1371(a)(5)(D)</external-xref>) is amended as follows:</text>

<quoted-block-continuation-text quoted-block-continuation-text-level="section">Any condition imposed pursuant to subclause (I), (II), or (III) may not result in more than a minor change to the specified activity and may not alter the basic design, location, scope, duration, or timing of the specified activity.</quoted-block-continuation-text><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph>

<paragraph id="H52E0BA0719A44C27900C338D09E330B5"><enum>(5)</enum><text>By adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HD32A9F201BF9448CB63DFDA8106E1A35" style="OLC"> <clause id="H0E6D439128F64EAEA6BC9F15A0A1117F" indent="up1"><enum>(viii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H02CE1F0C49DE468D8FD088506B37D910"><enum>(I)</enum><text display-inline="yes-display-inline">The Secretary shall—</text>
<item id="H2127041A00A142DDAFDC43E9A86C1BFA" indent="up1"><enum>(aa)</enum><text>accept as complete a written request for authorization under this subparagraph for incidental taking described in clause (i), by not later than 45 days after the date of submission of the request; or</text></item> <item id="HF3400B65185B455186CC45E247687B7B" indent="up1"><enum>(bb)</enum><text>provide to the requester, by not later than 15 days after the date of submission of the request, a written notice describing any additional information required to complete the request.</text></item></subclause>
<subclause id="H105DA7431C2E45E88F8918E5BA860972" indent="up1"><enum>(II)</enum><text>If the Secretary provides notice under subclause (I)(bb), the Secretary shall, by not later than 30 days after the date of submission of the additional information described in the notice—</text> <item id="H596B596C193C472CA5A339A1E6843B1B"><enum>(aa)</enum><text display-inline="yes-display-inline">accept the written request for authorization under this subparagraph for incidental taking described in clause (i); or</text></item>
<item id="H79BCB6B01EB7448B945513A147A5211F"><enum>(bb)</enum><text>deny the request and provide the requester a written explanation of the reasons for the denial.</text></item></subclause> <subclause id="HED18E222137C472AAB852069A577E8D1" indent="up1"><enum>(III)</enum><text>The Secretary may not make a second request for information, request that the requester withdraw and resubmit the request, or otherwise delay a decision on the request.</text></subclause>
<subclause id="H3FEE739A29D34971A877C63E65D8363C" indent="up1"><enum>(IV)</enum><text>If the Secretary fails to respond to a request for authorization under this subparagraph in the manner provided in subclause (I) or (II), the request shall be considered to be complete.</text></subclause></clause> <clause id="HD1102DB9C5B54415BF22428EE0CC12E8" indent="up1"><enum>(ix)</enum> <subclause commented="no" display-inline="yes-display-inline" id="H1DFBF78A0EFE42E5B78B640154BCCC09"><enum>(I)</enum><text>At least 90 days before the expiration of any authorization issued under this subparagraph, the holder of such authorization may apply for a one-year extension of such authorization. The Secretary shall grant such extension not later than 14 days after the date of such request on the same terms and without further review if there has been no substantial change in the activity carried out under such authorization nor in the status of the marine mammal species or stock, as applicable, as reported in the final annual stock assessment reports for such species or stock.</text></subclause>
<subclause id="H24BFACFC0FCC4A169B6BCC446223F587" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">In subclause (I), the term <term>substantial change</term> means a change that prevents the Secretary from making the required findings to issue an authorization under clause (i) with respect to such species or stock.</text></subclause> <subclause id="HC2D72C8F743D4CDB8F6D01BEABD2B8FB" indent="up1"><enum>(III)</enum><text>The Secretary shall notify the applicant of such substantial changes with specificity and in writing not later than 14 days after the applicant’s submittal of the extension request.</text></subclause></clause>
<clause commented="no" id="H85130C476B7C4A18AA947DB902D10BBE" indent="up1"><enum>(x)</enum><text display-inline="yes-display-inline">If the Secretary fails to make the required findings and, as appropriate, issue the authorization not later than 120 days after the application is accepted or required to be considered complete under subclause (I)(aa), (II)(aa), or (III) of clause (viii), as applicable, the authorization is deemed to have been issued on the terms stated in the application and without further process or restrictions under this Act.</text></clause> <clause id="HAA44CB96B31949A28577BDAC3EB22755" indent="up1"><enum>(xi)</enum><text>Any taking of a marine mammal in compliance with an authorization under this subparagraph is exempt from the prohibition on taking in section 9 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538</external-xref>). Any Federal agency authorizing, funding, or carrying out an action that results in such taking, and any agency action authorizing such taking, is exempt from the requirement to consult regarding potential impacts to marine mammal species or designated critical habitat under section 7(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H853A0FC54AA3430F9803D11D8BFB0CE0"><enum>205.</enum><header>Energy development in the Eastern Gulf of Mexico</header>
<subsection id="H304AC66AD54F4E3DA807ECFE946A61B3"><enum>(a)</enum><header>Compatibility between military mission and oil and gas operations</header>
<paragraph id="H438605315AD141C0AA906C9F31376264" commented="no"><enum>(1)</enum><header>Updating memorandum of agreement</header><text>Not later than 270 days after the date of the enactment of this Act, the Secretary of the Interior and the Secretary of Defense shall update the memorandum of agreement entitled <quote>Memorandum of Agreement Between the Department of Defense and the Department of the Interior on Mutual Concerns on the Outer Continental Shelf</quote> to ensure compatibility between the military mission and oil and gas operations in the Eastern Gulf of Mexico.</text></paragraph> <paragraph id="H35BF6D716F9742C7920EAC23044665EF"><enum>(2)</enum><header>Reservations</header><text>Nothing in this section affects section 12 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1341">43 U.S.C. 1341</external-xref>).</text></paragraph>
<paragraph id="HABE43471C74A4E96A838AF8CB8803423"><enum>(3)</enum><header>Existing leases</header><text>The stipulations and restrictions developed under this subsection shall not apply to existing leases in the Eastern Planning Area.</text></paragraph></subsection> <subsection id="H53DF04649F114277AF346F7B3F914B28"><enum>(b)</enum><header>Directed lease sales</header> <paragraph id="H9809311CD007482593480D33FABB9008"><enum>(1)</enum><header>In general</header><text>Notwithstanding the omission of any of these areas from the Outer Continental Shelf oil and gas leasing program approved by the Secretary of the Interior under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>), as in effect at the time of the lease sale, but subject to paragraph (2) of this subsection, the Secretary shall offer the following areas for oil and gas leasing under such Act:</text>
<subparagraph id="H9D0B0506361A468CACE91059D7B819AD"><enum>(A)</enum><text>All acreage of the Eastern Planning Area that is not subject to section 104(a) of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note), as in effect on the date of the enactment of this Act, by holding at least two lease sales before December 31, 2021.</text></subparagraph> <subparagraph id="HDA2137CD6D0D48EBB82033A4FB107A8B"><enum>(B)</enum><text>All acreage of the Eastern Planning Area by holding at least one additional sale after June 30, 2022, and before December 31, 2022, and at least two additional sales each subsequent year.</text></subparagraph></paragraph>
<paragraph id="H18D8F42362F84AC3B2CE4590EF9EBEC2"><enum>(2)</enum><header>National Environmental Policy Act requirements</header><text>The Secretary and all other Federal officials shall complete all actions required by section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) with respect to such lease sales by not later than 1 year before the final lease sale conducted under paragraph (1).</text></paragraph> <paragraph id="H8A0DC8F922CF4E6A9B31302E786EEF35"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the term <term>Eastern Planning Area</term> means the Eastern Gulf of Mexico Planning Area of the Outer Continental Shelf, as such planning area is depicted in the document titled <quote>2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program</quote>, dated November 2016, or a subsequent oil and gas leasing program developed under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>).</text></paragraph></subsection>
<subsection id="H8F1ECAF432BE4C2F8CDF0946D450C138"><enum>(c)</enum><header>Lease terms</header>
<paragraph id="HB4960FDBBF9C4ECB8009E14D621B64E8"><enum>(1)</enum><header>In general</header><text>Section 8(b)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(b)(2)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H2E39BD39A50646B4AFCA7FCC0BC34E99" display-inline="no-display-inline"> <paragraph id="H451C541CC1DD4CF58B3B40743358AF13"><enum>(2)</enum><text display-inline="yes-display-inline">be for an initial period of not more than—</text>
<subparagraph id="HD703C282AEDA47819FE11386FBB7F989"><enum>(A)</enum><text>5 years;</text></subparagraph> <subparagraph id="HC3BAED887CF24B3BA2B80A81D268923D"><enum>(B)</enum><text display-inline="yes-display-inline">10 years if the Secretary finds that a longer period is necessary to encourage exploration and development in areas with unusually deep water or other unusually adverse conditions; or</text></subparagraph>
<subparagraph id="H1E03D786DE5D42458568FE46164C95A5"><enum>(C)</enum><text display-inline="yes-display-inline">15 years for leases located in water depths of more than 1,500 meters and as long as—</text> <clause id="H67418E0686F34228BA281E45DAB13674"><enum>(i)</enum><text>oil or gas is produced from the area in paying quantities; or</text></clause>
<clause id="H54BF17330647400CA8E7EDD578E84DC5"><enum>(ii)</enum><text>drilling or well reworking operations approved by the Secretary are conducted;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="HC0BED19BACE84CBB8C8781DBAEF69F2C" commented="no"><enum>(2)</enum><header>Extension of existing leases</header> <subparagraph id="H3A1889808098415B9BB7105AAA6940A2" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of the Interior shall issue regulations under which the Secretary may extend by 5 years the term of an oil and gas lease under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>) for a tract located in water depths of more than 1,500 meters.</text></subparagraph>
<subparagraph id="H15A5789FED294EB3B184F511B7E9D975" commented="no"><enum>(B)</enum><header>Application; payment</header><text>Regulations issued under this paragraph shall require—</text> <clause id="H77A846DB961244618E167FFA7EDADC0A" commented="no"><enum>(i)</enum><text>submission of an application for such extension; and</text></clause>
<clause id="H64526E1BE0DE4C64882A77ED7DD224FD" commented="no"><enum>(ii)</enum><text>payment of a minimum bid amount.</text></clause></subparagraph> <subparagraph id="H8258050BB0DF4B18AC2D4BF1EB19D05D" commented="no"><enum>(C)</enum><header>Limitation</header><text>The Secretary may not extend the term of a lease under this paragraph more than once.</text></subparagraph></paragraph></subsection>
<subsection id="H07AEDFB4544847D1863103F23EB2E0D7"><enum>(d)</enum><header>Report</header>
<paragraph id="HFC84B573856646668AC787AC8FE8A244"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Interior shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report regarding options for sharing the revenue collected from oil and gas leasing in the Eastern Gulf of Mexico Planning Area with the Gulf States consistent with section 105 of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note), as amended by section 203 of this Act.</text></paragraph> <paragraph id="HBBB3B4CFE76A4E5F8BD29073DAC9A4FE"><enum>(2)</enum><header>Inclusion</header><text>The report shall include analysis of potential economic benefits to the Gulf States and recommendations for authorizing the use of the revenue for coastal restoration, recovering endangered species, coral restoration, and mitigation of harmful algal blooms.</text></paragraph></subsection></section>
<section section-type="subsequent-section" id="H7BD1645DFE5E47369A5E263BB4AB4514"><enum>206.</enum><header>Annual lease sales in Gulf of Mexico region</header><text display-inline="no-display-inline">Section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H310A3BFDF05C41D18CA3D320325E078A"> <subsection id="H9CC4B3A5AF19440D8070046F0D6EDDB6"><enum>(i)</enum><header>Annual lease sales in Gulf of Mexico Region</header> <paragraph id="HED0E9A03E5AB4C53BC099E94A5904B5B"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text>
<subparagraph id="H9120428442FA4ED989D6C5389C3CDE55"><enum>(A)</enum><header>Central Gulf of Mexico Planning Area</header><text>The term <term>Central Gulf of Mexico Planning Area</term> has the meaning given the term <term>Central Planning Area</term> in section 102 of the Gulf of Mexico Energy Security Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/432">Public Law 109–432</external-xref>).</text></subparagraph> <subparagraph id="HC35B20CDBEE04B22BC408C42926E66B0"><enum>(B)</enum><header>Western Gulf of Mexico Planning Area</header><text>The term <term>Western Gulf of Mexico Planning Area</term> means the Western Gulf of Mexico Planning Area of the Outer Continental Shelf, as designated in the document entitled <quote>Draft Proposed Program Outer Continental Shelf Oil and Gas Leasing Program 2007–2012</quote> and dated February 2006.</text></subparagraph></paragraph>
<paragraph id="H61AE390BB65C4F828033829C7F98BB85"><enum>(2)</enum><header>Annual lease sales</header><text>Notwithstanding any other provision of law, beginning in fiscal year 2022, the Secretary shall hold a minimum of 2 regionwide lease sales annually in the Gulf of Mexico pursuant to this Act, each of which shall include areas in—</text> <subparagraph id="H2C576B1B62924FD5A18B84F7E9D7B5D7"><enum>(A)</enum><text>the Central Gulf of Mexico Planning Area; and </text></subparagraph>
<subparagraph id="H937B734183AE48D19D3C2C7EC14A3DEC"><enum>(B)</enum><text>the Western Gulf of Mexico Planning Area.</text></subparagraph></paragraph> <paragraph id="H40355D80F80149CC8AD928FC64EB772E"><enum>(3)</enum><header>Requirements</header> <subparagraph id="HBD3DED6DD3A045798809F4F427AC8559"><enum>(A)</enum><header>In general</header><text>In carrying out the lease sales under paragraph (2), the Secretary shall issue leases to the highest responsible qualified bidder or bidders. </text></subparagraph>
<subparagraph id="HDF362141B84F464FBE7D60C9BAEC4CAB"><enum>(B)</enum><header>Areas included in lease sales</header><text>In carrying out the lease sales under paragraph (2), the Secretary shall include in each lease sale all unleased areas that are not subject to restrictions as of the date of the lease sale.</text></subparagraph></paragraph> <paragraph id="HCFFB777CE84D4CD28704A37776F9F0BB"><enum>(4)</enum><header>Environmental review</header> <subparagraph id="H1699EF2807324C2BA7786ADA26168FCC"><enum>(A)</enum><header>In general</header><text>With respect to each lease sale required under paragraph (2), the Secretary shall conduct any environmental reviews required by the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph>
<subparagraph id="H47AAC995A57D441E8FFFA4E9E957CDFF"><enum>(B)</enum><header>Deadline</header>
<clause id="H68ECAA43983F487799397F14A69DE16B"><enum>(i)</enum><header>Individual review</header><text>If the Secretary conducts environmental reviews with respect to a lease sale under subparagraph (A) for each individual lease included in the lease sale, the Secretary shall complete all environmental reviews for the lease sale, including by issuing a finding of no significant impact or a record of decision, if applicable, in less than 365 calendar days.</text></clause> <clause id="H2AE43BEA74FF4CBCA2A121723BC7F86B"><enum>(ii)</enum><header>Programmatic review</header><text>If the Secretary conducts a programmatic environmental review with respect to a lease sale under subparagraph (A) for all leases under the lease sale, the Secretary shall complete the programmatic environmental review, including by issuing a finding of no significant impact or a record of decision, if applicable, in less than 180 calendar days.</text></clause></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H855301EDAC9449C1AFE4B468CF040D30"><enum>(j)</enum><header>Permitting</header>
<paragraph commented="no" display-inline="no-display-inline" id="HFD0DDCBA3DFF436295469D8A6B15F470"><enum>(1)</enum><header>In general</header><text>Pursuant to sovereign contracting rights and obligations, the Secretary shall review and grant or deny in accordance with paragraph (2) any application for a permit or other approval for offshore oil and natural gas exploration, development, and production activities under a lease issued pursuant to this Act by not later than the earlier of—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H0221EEF67F4C4D66B841EFD7871A14DC"><enum>(A)</enum><text>75 calendar days after the date on which the application is received by the Bureau of Ocean Energy Management or the Bureau of Safety and Environmental Enforcement; or</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H68121A63D6CA49199396324241EAFE72"><enum>(B)</enum><text>any other applicable deadline required by law.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H24E996284A924A97B6BEE755C46FA907"><enum>(2)</enum><header>Approval or denial</header> <subparagraph commented="no" display-inline="no-display-inline" id="H2265F45175F64C03943042E7ED1EB815"><enum>(A)</enum><header>In general</header><text>Absent clear grounds for denial of an application for a permit or other approval described in paragraph (1), the Secretary shall grant the permit or approval.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H47CF0F639E564873924BAC5E55DA8F05"><enum>(B)</enum><header>Requirement</header><text>If the Secretary denies an application for a permit or other approval under subparagraph (A), the Secretary shall provide to the applicant written notice explaining the grounds for the denial.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title> <title id="H4E8FE6D4FC214E81B6510636A846C23F"><enum>III</enum><header>Alternative Energy</header> <section id="H5FC54AF61B9F45E687F4A7CD3C2DA5C9"><enum>301.</enum><header>Geothermal, solar, and wind leasing priority areas</header> <subsection id="H10F09A8D410242D8A61AEB157FCD6B14"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following terms apply:</text>
<paragraph id="HB524F9AE46F94B649ABE4451D0713159"><enum>(1)</enum><header>Covered land</header><text display-inline="yes-display-inline">The term <term>covered land</term> means land that is—</text> <subparagraph id="H3E5188012EEB4F799337DD16ADD18C76"><enum>(A)</enum><text>Federal land; and</text></subparagraph>
<subparagraph id="H4F92E891315D4E78BF63643312885FB5"><enum>(B)</enum><text>not excluded from the development of geothermal energy under—</text> <clause id="H6C607507030944CD8ED9E98F5740E2BA"><enum>(i)</enum><text>a land use plan established under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>); or</text></clause>
<clause id="H286B337ADFB940A896B65ED20CD09135"><enum>(ii)</enum><text>any other Federal law.</text></clause></subparagraph></paragraph> <paragraph id="H52020E79578D428B926BBD373D795F60"><enum>(2)</enum><header>Priority area</header><text display-inline="yes-display-inline">The term <term>priority area</term> means covered land identified by the land use planning process of the Bureau of Land Management as being a preferred location for a renewable energy project for solar, wind, or geothermal energy.</text></paragraph>
<paragraph id="HFCE4F2A548A7438CB1B4D5E32C95C254"><enum>(3)</enum><header>Solar designated leasing area</header><text display-inline="yes-display-inline">The term <term>solar designated leasing area</term> means covered land identified by the land use planning process of the Bureau of Land Management as being a preferred location for a solar energy project, including the solar energy zones established by the 2012 Western Solar Plan of the Bureau of Land Management, and any subsequent land use plan amendments.</text></paragraph></subsection> <subsection id="HEB101AA1EDBE40F7AD7FCA52735260A3"><enum>(b)</enum><header>Designation of geothermal, solar, and wind leasing priority areas</header> <paragraph id="HEC10CA7BDCC64607A218B796DF34E08B"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Secretary of Energy, shall establish priority areas on covered land for geothermal, solar, and wind energy projects.</text></paragraph>
<paragraph id="HDDADE674FBFC471A9962C25DE9568110"><enum>(2)</enum><header>Deadline</header>
<subparagraph id="H24858E63E2A849D1B70D58903FE30B05"><enum>(A)</enum><header>Geothermal and wind energy</header><text display-inline="yes-display-inline">With respect to geothermal and wind energy, the Secretary shall establish priority areas as soon as practicable, but not later than 5 years after the date of enactment of this Act.</text></subparagraph> <subparagraph id="H91EECEE5E4144A96890CA96DAF38DBAA"><enum>(B)</enum><header>Solar energy</header><text display-inline="yes-display-inline">Solar designated leasing areas shall be considered to be priority areas for solar energy leases. The Secretary shall establish additional priority areas for solar energy as soon as practicable, but not later than 3 years after the date of enactment of this Act. </text></subparagraph></paragraph></subsection>
<subsection id="HCEEE08FA42FE44BB813085E7A1137F4E"><enum>(c)</enum><header>Criteria for selection</header><text display-inline="yes-display-inline">In determining which covered land to designate as a priority area for geothermal, solar, or wind leasing under subsection (b), the Secretary, in consultation with the Secretary of Energy, shall consider if—</text> <paragraph id="HFDF113224B1743239AC8FCB56F759E8A"><enum>(1)</enum><text display-inline="yes-display-inline">the covered land is preferable for geothermal, solar, or wind leasing;</text></paragraph>
<paragraph id="H6AFA86D313F6451FA6CC7E965ABDEEE7"><enum>(2)</enum><text display-inline="yes-display-inline">production of geothermal, solar, or wind energy on such land is economically viable, including if such land has access to methods of energy transmission; and</text></paragraph> <paragraph id="H3D0A880464A949C39A8C702729E46D8C"><enum>(3)</enum><text>the designation would be in compliance with section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>), including subsection (c)(9) of that section.</text></paragraph></subsection>
<subsection id="HED7CA309F73E44C8A7010262AE70FBD7"><enum>(d)</enum><header>Review and modification</header><text display-inline="yes-display-inline">Not less frequently than once every 5 years, the Secretary shall—</text> <paragraph id="H38117B27BC0846A79342E4B54BF6B7AA"><enum>(1)</enum><text display-inline="yes-display-inline">review covered land and, if appropriate, make additional designations of priority areas for geothermal, solar, or wind leasing; and</text></paragraph>
<paragraph id="H7F8A58CC2A094C1C92F50293494F2F27"><enum>(2)</enum><text display-inline="yes-display-inline">review each area designated as a priority area for geothermal, solar, or wind energy leasing under this section and, if appropriate, remove such designation.</text></paragraph></subsection> <subsection id="H95AD326A91A640EEAA755CF7DA13AD77"><enum>(e)</enum><header>Compliance with the National Environmental Policy Act</header><text display-inline="yes-display-inline">For the purposes of this section, compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) shall be accomplished—</text>
<paragraph id="H2AD18382BFB24B9C94B4590070BAE2D8"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to geothermal energy, by supplementing the October 2008 final programmatic environmental impact statement for geothermal leasing in the Western United States and incorporating any additional regional analyses that have been completed by Federal agencies since such programmatic environmental impact statement was finalized;</text></paragraph> <paragraph id="H40EF21EBE3134C3E93FB265D1F23A285"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to solar energy, by supplementing the July 2012 final programmatic environmental impact statement for solar energy development and incorporating any additional regional analyses that have been completed by Federal agencies since such programmatic environmental impact statement was finalized; and</text></paragraph>
<paragraph id="HB2F144C2C3A54F07896A6C43EDB73408"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to wind energy, by supplementing the July 2005 final programmatic environmental impact statement for wind energy development and incorporating any additional regional analyses that have been completed by Federal agencies since such programmatic environmental impact statement was finalized.</text></paragraph></subsection> <subsection id="H4340FEFBFE4D4EF2AF2D26FF0FD4CD29"><enum>(f)</enum><header>Additional environmental review</header><text display-inline="yes-display-inline">If the Secretary determines that additional environmental review under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) is necessary for a proposed renewable energy project, the Secretary shall—</text>
<paragraph id="H5DFFBE7165EC4626B899433F8802864A"><enum>(1)</enum><text display-inline="yes-display-inline">rely on the analysis in the programmatic environmental impact statement conducted under subsection (e), to the maximum extent practicable when analyzing the potential impacts of the project;</text></paragraph> <paragraph id="HCDC856D6E48E4F5CA719C273C9BA4A74"><enum>(2)</enum><text>complete any such environmental review document by not later than 364 days; and</text></paragraph>
<paragraph id="H4B552F9B3A7D4284A790C8AAD47C9150"><enum>(3)</enum><text>limit any such review documents to 150 pages in length.</text></paragraph></subsection></section> <section id="HCA72DF95A2F54C68BECAE095F98FD626"><enum>302.</enum><header>Geothermal production on Federal lands</header><text display-inline="no-display-inline">The Geothermal Steam Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/30/1001">30 U.S.C. 1001 et seq.</external-xref>) is amended by adding at the end the following:</text>
<quoted-block display-inline="no-display-inline" id="H0FF4ED1ADD8D40A28AB5947C2DA858CD" style="OLC">
<section id="H4D86C346F0E64A1188AA55B4D874F34C"><enum>30.</enum><header>Geothermal exploration test projects</header>
<subsection display-inline="no-display-inline" id="HFBD2F19DBF1E4B9AB4AA451FC93471BD"><enum>(a)</enum><header>Definition of geothermal exploration test project</header><text display-inline="yes-display-inline">In this section, the term <term>geothermal exploration test project</term> means the drilling of a well to test or explore for geothermal resources on lands for which the Secretary has issued a lease under this Act, that—</text> <paragraph id="H311F13A492E749E7AE878F85EBBBEBB8"><enum>(1)</enum><text>is carried out by the holder of the lease;</text></paragraph>
<paragraph id="H1AFF8339676A4D32A3D0A781CBEF8C40"><enum>(2)</enum><text>causes—</text> <subparagraph id="HD38C7E3B9AB74760A53D8271EDA15855"><enum>(A)</enum><text> less than 5 acres of soil or vegetation disruption at the location of each geothermal exploration well; and</text></subparagraph>
<subparagraph id="H594043D907CA4A3CA2F74FC8174CDABB"><enum>(B)</enum><text>not more than an additional 5 acres of soil or vegetation disruption during access or egress to the test site;</text></subparagraph></paragraph> <paragraph id="H911CA3A0884349F296A1D6E5BAD44CCF"><enum>(3) </enum><text display-inline="yes-display-inline">is developed—</text>
<subparagraph id="HF413D5A080344967927CE2E0C5255376"><enum>(A)</enum><text>with a bore well measuring less than 9 inches in diameter;</text></subparagraph> <subparagraph id="H5CC654E684484BC78B8A23C3BC207F4A"><enum>(B)</enum><text>in a manner that does not require off-road motorized access other than to and from the well site along an identified off-road route;</text></subparagraph>
<subparagraph id="H7B4390CEDBB148DAA6C7789F5BD0CD9C"><enum>(C)</enum><text>without construction of new roads other than upgrading of existing drainage crossings for safety purposes;</text></subparagraph> <subparagraph id="H4358056189364776B82F67FBD7FA4A77"><enum>(D)</enum><text>with the use of rubber-tired digging or drilling equipment vehicles; and</text></subparagraph>
<subparagraph id="H82E87EE0ACAA4D44BEFF05B6802E8730"><enum>(E)</enum><text>without the use of high-pressure well stimulation;</text></subparagraph></paragraph> <paragraph display-inline="no-display-inline" id="H0316E91BCD50470C91EE08555DA6C363"><enum>(4)</enum><text>is completed in less than 90 days, including the removal of any surface infrastructure from the site; and</text></paragraph>
<paragraph id="HCB238DDA03B44AC7855C7F442EEB6012"><enum>(5)</enum><text display-inline="yes-display-inline">requires the restoration of the project site not later than 3 years after the date of first exploration drilling to approximately the condition that existed at the time the project began, unless the site is subsequently used as part of energy development under the lease.</text></paragraph></subsection> <subsection display-inline="no-display-inline" id="HA93A2DB76FF9410C9CF144354FBAB19C" commented="no"><enum>(b)</enum><header>Categorical exclusion</header> <paragraph id="HF8BEDFC69E964626AC9D319ED70D344D"><enum>(1)</enum><header>In general</header><text>Unless extraordinary circumstances exist, a project that the Secretary determines under subsection (c) is a geothermal exploration test project shall be categorically excluded from the requirements for an environmental assessment or an environmental impact statement under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or section 1508.4 of title 40, Code of Federal Regulations (or a successor regulation).</text></paragraph>
<paragraph id="H7F2AB89A42024968933E8D05DC5E579D"><enum>(2)</enum><header>Extraordinary circumstances</header><text display-inline="yes-display-inline">The term <term>extraordinary circumstances</term> has the meaning give that term in the Department of the Interior Departmental Manual, 516 DM 2.3A(3) and 516 DM 2, 3 Appendix 2 (or successor provisions).</text></paragraph></subsection> <subsection id="HD3433D7B27444F6D99D1474779FF96F8"><enum>(c)</enum><header>Process</header> <paragraph id="H28747492D047429BBB2311201DDE4964"><enum>(1)</enum><header>Requirement to provide notice</header><text display-inline="yes-display-inline">A leaseholder shall provide notice to the Secretary of the leaseholder’s intent to carry out a geothermal exploration test project at least 30 days before the date on which drilling under the project will begin.</text></paragraph>
<paragraph id="HCF2CD575BB7540CA9F07684FDF0CA1A3"><enum>(2)</enum><header>Review and determination</header><text display-inline="yes-display-inline">Not later than 10 days after receipt of a notice of intent under paragraph (1), the Secretary shall, with respect to the project described in the notice of intent—</text> <subparagraph id="H4F32668996BE4944A65E1B301D15271A"><enum>(A)</enum><text display-inline="yes-display-inline">determine if the project qualifies for a categorical exclusion under subsection (b); and</text></subparagraph>
<subparagraph id="HDEA8C682EBFD451D9F8F213441CFBB81"><enum>(B)</enum><text display-inline="yes-display-inline">notify the leaseholder of such determination.</text></subparagraph></paragraph> <paragraph commented="no" id="H55024CD5FE1E44CFB06C98E07E2C2F81"><enum>(3)</enum><header>Opportunity to remedy</header><text display-inline="yes-display-inline">If the Secretary determines under paragraph (2)(A) that the project does not qualify for a categorical exclusion under subsection (b), the Secretary shall—</text>
<subparagraph id="H3018EADFEC65444E8B53B4264080F104"><enum>(A)</enum><text>include in such notice clear and detailed findings on any deficiencies in the project that resulted in such determination; and</text></subparagraph> <subparagraph id="HEA5B85633F3E4947874470BFEBB46A34"><enum>(B)</enum><text display-inline="yes-display-inline">allow the leaseholder to remedy any such deficiencies and resubmit the notice of intent under paragraph (1).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HEEB679E9DE1D42A1B6448B674D5D0692"><enum>303.</enum><header>Application of Outer Continental Shelf Lands Act with respect to territories of the United States</header>
<subsection id="H1BCE34E5C37C4985BA5E0E453D472A11"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>) is amended—</text> <paragraph id="HABE397941E694180B2B91B9D128B5E27"><enum>(1)</enum><text>in subsection (a), by inserting before the semicolon the following: <quote>or lying within the exclusive economic zone of the United States and the Outer Continental Shelf adjacent to any territory or possession of the United States, except that such term shall not include any area conveyed by Congress to a territorial government for administration</quote>;</text></paragraph>
<paragraph id="HA9510A44AC634E68A9B0EE5A55C2CD2C"><enum>(2)</enum><text>in subsection (p), by striking <quote>and</quote> after the semicolon at the end;</text></paragraph> <paragraph id="HEF522808B8A74ECABA3AB5D051B5ED41"><enum>(3)</enum><text>in subsection (q), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>
<paragraph id="H566B36C824714C85A5845C1F3FA2E9BE" commented="no"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block id="H525A23F084FA4908B41494DAF423B796" style="OLC"> <subsection id="H3A13D2C1AC8B49BEA8288889420279DD" commented="no"><enum>(r)</enum><text display-inline="yes-display-inline">The term <term>State</term> means the several States, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H1ACB0C8796594E30B5208020423F325E"><enum>(b)</enum><header>Exclusions</header><text>Section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>), as amended by section 206 of this Act, is further amended by adding at the end the following:</text> <quoted-block id="H74644A89C859448AA3912AD550F95B15" style="OLC"> <subsection id="H6693FB43970741D4B5EBBE669DDF18DA"><enum>(k)</enum><header>Exclusions</header><text>This section shall not apply to the scheduling of lease sales in the Outer Continental Shelf adjacent to the territories and possessions of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HD9012600FC9B40348771EA3CFCBC961C"><enum>304.</enum><header>Disposition of revenues with respect to territories of the United States</header><text display-inline="no-display-inline">Section 9 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1338">43 U.S.C. 1338</external-xref>) is amended—</text> <paragraph id="HF8D019FC6CA4444D8856ED22ACBED075"><enum>(1)</enum><text>by striking <quote>All rentals</quote> and inserting the following:</text>

<subsection id="H0E12A8BEC5B9450EB8FD3CC1529C4BBF"><enum>(a)</enum><header>In general</header><text>Except as otherwise provided in law, all rentals</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H75B12AEB56294E7A9B486C8CD0A42698"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block id="H7856502FD8D843CAB4E0F73C61880666" style="OLC">
<subsection id="H2FE4C1031EB7402695B4A393F1B3C6D8"><enum>(b)</enum><header>Disposition of revenues to territories of the united states</header><text>Of the bonuses, rentals, royalties, and other sums paid to the Secretary under this Act from a lease for an area of land on the Outer Continental Shelf adjacent to a territory and lying within the exclusive economic zone of the United States pertaining to such territory, and not otherwise obligated or appropriated—</text> <paragraph id="HCACCF1B3D76548B090BF098D77E1205B"><enum>(1)</enum><text>50 percent shall be deposited in the Treasury and credited to miscellaneous receipts;</text></paragraph>
<paragraph id="HAF397FCC94334C9D805AD47BA76421E6"><enum>(2)</enum><text>12.5 percent shall be deposited in the Coral Reef Conservation Fund established under section 211 of the Coral Reef Conservation Act of 2000; and</text></paragraph> <paragraph id="H66FC5DDCE0914F51B6E7552A4E52FB15"><enum>(3)</enum><text>37.5 percent shall be disbursed to territories of the United States in an amount for each territory (based on a formula established by the Secretary by regulation) that is inversely proportional to the respective distance between the point on the coastline of the territory that is closest to the geographic center of the applicable leased tract and the geographic center of the leased tract.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H6EEAEDBA17624A37B486DAF808AA06D2"><enum>305.</enum><header>Wind lease sales for areas of Outer Continental Shelf</header>
<subsection id="H8038FF6C27D943189FACB515F8D8D33B"><enum>(a)</enum><header>Conditional wind lease sales in territories of the United States</header><text>The Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H22436C380E644C159E6E15059DB9E9CA" style="OLC"> <section id="HE7FF5368CCAF4EF28F15D94A395E8961"><enum>33.</enum><header>Wind lease sales for areas of Outer Continental Shelf</header> <subsection id="H2431FC924437488692D73C6AF541C769"><enum>(a)</enum><header>Authorization</header><text>The Secretary may conduct wind lease sales on the Outer Continental Shelf.</text></subsection>
<subsection id="HAD05144BB06C44A995FE9343CF0AC036"><enum>(b)</enum><header>Wind lease sale procedure</header><text>Any wind lease sale conducted under this section shall be considered a lease under section 8(p).</text></subsection> <subsection id="H8A7902F53BF34D97B07CF0988D42B9AF"><enum>(c)</enum><header>Wind lease sales off coasts of territories of the United States</header> <paragraph id="HE4D2D32699DD4BA2829D8B6A5EC8C62C"><enum>(1)</enum><header>Study on feasibility of conducting wind lease sales</header> <subparagraph id="H6C07DC5AA03843B5B3F861E49D7873F5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall conduct a study on the feasibility, including the technological and long-term economic feasibility, of conducting wind lease sales on an area of the Outer Continental Shelf within the territorial jurisdiction of American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the United States Virgin Islands.</text></subparagraph>
<subparagraph id="H880C9CC552974E1AA6562EB16B5C5D96"><enum>(B)</enum><header>Consultation</header><text>In conducting the study required in paragraph (A), the Secretary shall consult—</text> <clause id="HBBF5AA735A03447CA1AE56151FD228B0"><enum>(i)</enum><text display-inline="yes-display-inline">the National Laboratories, as that term is defined in section 2(3) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801(3)</external-xref>);</text></clause>
<clause id="H95205C8E3CD041EFA601D1EEDD5CCBE7"><enum>(ii)</enum><text display-inline="yes-display-inline">the Governor of each of American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the United States Virgin Islands; and</text></clause> <clause id="H0FCB663309A9485F8FAC3554208D6C30"><enum>(iii)</enum><text display-inline="yes-display-inline">the National Oceanic and Atmospheric Administration, including the Office of National Marine Sanctuaries and the National Marine Fisheries Service.</text></clause></subparagraph>
<subparagraph id="H8F01164E711841FB8E9A7BED709C46FE"><enum>(C)</enum><header>Publication</header><text display-inline="yes-display-inline">The findings and determinations of the study required in subparagraph (A) shall be published in the Federal Register and open for public comment for not fewer than 60 days.</text></subparagraph> <subparagraph id="HE8BB57DFBBCA4DD8BC0050A79904005A"><enum>(D)</enum><header>Submission of results</header><text>Not later than 18 months after the date of enactment of this section, the Secretary shall submit the results of the study conducted under subparagraph (A) to—</text>
<clause id="HD6B5BA37B28B47568EB49387C89EB3E5"><enum>(i)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></clause> <clause id="H6AF8849B92FF4D2FB66C8984AAAE2CBB"><enum>(ii)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></clause>
<clause id="H34D80914EA7347B5AA4F4F444C37633E"><enum>(iii)</enum><text display-inline="yes-display-inline">each of the delegates or resident commissioner to the House of Representatives from American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, the Commonwealth of Puerto Rico, and the United States Virgin Islands, respectively.</text></clause></subparagraph> <subparagraph id="H51D826E5615849C3B218C9F442E5D847"><enum>(E)</enum><header>Public availability</header><text>The findings and determinations of the study published under subparagraph (C) shall be made readily available on a public website.</text></subparagraph></paragraph>
<paragraph id="HCEFBB16A2A4D48A4A9959276CC151147"><enum>(2)</enum><header>Call for information and nominations</header><text display-inline="yes-display-inline">The Secretary shall issue a call for information and nominations for proposed wind lease sales for areas determined to be feasible under the study conducted under paragraph (1).</text></paragraph> <paragraph display-inline="no-display-inline" id="H08378D893F13453FAC44715C6AECD111"><enum>(3)</enum><header>Conditional wind lease sales</header> <subparagraph id="HDCE2EBF34BB54F45B77EA6239096AF97"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For each territory specified in paragraph (1), the Secretary shall conduct not less than one wind lease sale on an area of the Outer Continental Shelf within the territorial jurisdiction of each such territory that meets each of the following criteria:</text>
<clause id="H8A8CF783F61A49569C11F9701FD3192D"><enum>(i)</enum><text>The study required under paragraph (1) concluded that a wind lease sale on the area is feasible.</text></clause> <clause id="H07FC81746BBF4E4E8560B33FC5317916"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary has determined that the call for information has generated sufficient interest for the area.</text></clause>
<clause id="H810BDEA45FB14014838367DB61BA7CF0"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary has consulted with the Secretary of Defense regarding such a sale.</text></clause></subparagraph> <subparagraph id="HCFA4EC727A9D410B89C3274C852186CE"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">If no area of the Outer Continental Shelf within the territorial jurisdiction of a territory meets each of the criteria in clauses (i) through (iii) of subparagraph (A), the requirement under subparagraph (A) shall not apply to such territory.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HDF1403CCD475493F8F8578D38E233C95"><enum>306.</enum><header>Establishment of Coral Reef Conservation Fund</header>
<subsection id="H08991FC860884A7293F27486AFC25415"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6401">16 U.S.C. 6401 et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="HD478DC042DF14315819F5EADBEF4EBE7" style="OLC"> <section id="H29C532C1529A44B8BD9B280ECC39A267"><enum>211.</enum><header>Coral Reef Conservation Fund</header> <subsection id="HB8094569F2324A28A508F6FE4B97BE17"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury the Coral Reef Conservation Fund, (in this section referred to as the <quote>Fund</quote>).</text></subsection>
<subsection id="HCDC5EABF8DE444C1B81E40287F47A339"><enum>(b)</enum><header>Deposits</header><text display-inline="yes-display-inline">For each fiscal year, there shall be deposited in the Fund the portion of such revenues due and payable to the United States under subsection (b)(2) of section 9 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1338">43 U.S.C. 1338</external-xref>).</text></subsection> <subsection id="H91E4961EC59141F8877A02BB1ACDA0A1"><enum>(c)</enum><header>Uses</header><text display-inline="yes-display-inline">Amounts deposited in the Fund under this section and appropriated to the Secretary of Commerce under subsection (f) shall be used by the Secretary of Commerce to carry out this Act, with priority given to carrying out sections 204 and 206.</text></subsection>
<subsection id="H9559C42AB15C45CBBF0F769F462E8358"><enum>(d)</enum><header>Availability</header><text>Amounts deposited in the Fund shall remain in the Fund until appropriated by Congress.</text></subsection> <subsection id="H39265601F0744121BAE17A74258BF722" commented="no"><enum>(e)</enum><header>Reporting</header><text display-inline="yes-display-inline">The President shall include with the proposed budget for the United States Government submitted to Congress for a fiscal year a comprehensive statement of deposits into the Fund during the previous fiscal year and estimated requirements during the following fiscal year for appropriations from the Fund.<italic></italic></text></subsection>
<subsection id="H19F8916D83A94E48976A47A6AF521681"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated from the Fund to the Secretary of Commerce, an amount equal to the amount deposited in the Fund in the previous fiscal year.</text></subsection> <subsection id="HCD9BCAB2E6E24ECDAEF489EB716BDCD1"><enum>(g)</enum><header>No limitation</header><text>Appropriations from the Fund pursuant to this section may be made without fiscal year limitation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H42C11BFA2131474F9AB0B91AFF86A312"><enum>(b)</enum><header>Renaming of existing fund</header><text display-inline="yes-display-inline">Section 205 of the Coral Reef Conservation Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/16/6404">16 U.S.C. 6404</external-xref>) is amended—</text> <paragraph id="HB73C82609D4F49B0BEE0E553E278EFAF"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="section" style="OLC">Coral reef conservation fund</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Coral Reef Public-Private Partnership</header-in-text></quote>;</text></paragraph>

<clause id="HC6DEF88175BA449EBDE7DA709D2DAD6E"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text> <subclause id="H75183F2BE0B6407192485D033D94A826"><enum>(I)</enum><header>Covered offshore wind project</header><text>The term <quote>covered offshore wind project</quote> means a wind powered electric generation project in a wind energy area on the outer Continental Shelf that is not wholly or partially located within an area subject to subparagraph (B).</text></subclause>
<subclause id="H73C669BD057A42059B7C1DBA7E5CF318"><enum>(II)</enum><header>Eligible state</header><text>The term <quote>eligible State</quote> means a State a point on the coastline of which is located within 75 miles of the geographic center of the covered offshore wind project.</text></subclause></clause> <clause id="H8D8D608578494904B213A13110637E5A"><enum>(ii)</enum><header>Requirement</header> <subclause id="H61683A7901CD40DE984446261580E5D5"><enum>(I)</enum><header>In general</header><text>Of the operating fees, rentals, bonuses, royalties, and other payments that are paid to the Secretary under subparagraph (A) from covered offshore wind projects—</text>
<item id="H0C25026922F248BAAB7B93033E3AFE38"><enum>(aa)</enum><text>12.5 percent shall be deposited in the Treasury and credited to miscellaneous receipts;</text></item> <item id="HB9AC901C0AF5408CBFB60C4EAD0CB231"><enum>(bb)</enum><text>37.5 percent shall be deposited in the North American Wetlands Conservation Fund;</text></item>
<item id="HE930BCEB98C443F7981BFBC20471C86E"><enum>(cc)</enum><text display-inline="yes-display-inline">50 percent shall be deposited in a special account in the Treasury, from which the Secretary, subject to subclause (II), shall disburse to each eligible State an amount (based on a formula established by the Secretary of the Interior by rulemaking not later than 180 days after the date of enactment of the American Energy First Act) that is inversely proportional to the respective distances between—</text> <subitem id="H575D161C16F44BE9AEBC5E8D16B116FB"><enum>(AA)</enum><text>the point on the coastline of each eligible State that is closest to the geographic center of the applicable leased tract; and</text></subitem>
<subitem id="H520DC0BEC42642AA81CE4FB03FB04951"><enum>(BB)</enum><text>the geographic center of the leased tract.</text></subitem></item></subclause> <subclause id="HF0E84C6D944A41B190479CC51A987E3B"><enum>(II)</enum><header>Wind revenue sharing allocations</header> <item id="HFD534A8D75D1447898A39FEE121F4723"><enum>(aa)</enum><header>Minimum Allocation</header><text>The amount allocated to an eligible State each fiscal year under item (cc) of subclause (I) shall be at least 10 percent of the amounts available under that item. </text></item>
<item id="HFE2DA2857E2743A68AAF36E2559772A2"><enum>(bb)</enum><header>Payments to Coastal Political Subdivisions</header>
<subitem id="H169CF99B77584450A1648DC62B0AE169"><enum>(AA)</enum><header>In general</header><text>The Secretary shall pay 20 percent of the allocable share of each Gulf producing State, as determined under paragraphs (1) and (2) of section 105(b) of the Gulf of Mexico Energy Security Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref> note), to the coastal political subdivisions of the Gulf producing State. </text></subitem> <subitem id="HF5CBB5FBAAAF4597AEEFEF0BC0FAB04F"><enum>(BB)</enum><header>Allocation</header><text>The amount paid by the Secretary to coastal political subdivisions shall be allocated to each coastal political subdivision in accordance with subparagraphs (B), (C), and (E) of section 31(b)(4) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1356a">43 U.S.C. 1356a(b)(4)</external-xref>).</text></subitem></item></subclause></clause>
<clause id="HB994459A885540DD9A29B8F347ECEA83"><enum>(iii)</enum><header>Timing</header><text>The amounts required to be deposited under item (cc) of clause (ii)(I) for the applicable fiscal year shall be made available in accordance with that item during the fiscal year immediately following the applicable fiscal year.</text></clause> <clause id="H3EB0C2C7DBE84DE9AA25DB4913FEC972"><enum>(iv)</enum><header>Authorized uses</header> <subclause id="H8317950EBB7847D69380ABA1A555576C"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II), each State shall use all amounts received under clause (ii)(I)(cc) in accordance with all applicable Federal and State laws, only for 1 or more of the following purposes:</text>
<item id="H1FF7DBA8EB574DCEA4E008234BAC63CB"><enum>(aa)</enum><text>Projects and activities for the purposes of coastal protection, including conservation, coastal restoration, hurricane protection, and infrastructure directly affected by coastal wetland losses.</text></item> <item id="H3AC926D4F0F04F6593B768B8966D5675"><enum>(bb)</enum><text>Mitigation of damage to fish, wildlife, or natural resources, including through fisheries science and research.</text></item>
<item id="HBCA3F7B08E83427EB9375FBB65CEA905"><enum>(cc)</enum><text>Implementation of a federally approved marine, coastal, or comprehensive conservation management plan.</text></item> <item id="HF6C362BDE5A24C06AB5429B91CFD9F8D"><enum>(dd)</enum><text>Mitigation of the impact of outer Continental Shelf activities through the funding of onshore infrastructure projects.</text></item>
<item id="H9B924D4BF04044518878726523054E35"><enum>(ee)</enum><text>Planning assistance and the administrative costs of complying with this section.</text></item></subclause> <subclause id="HAD8FD1AA3D274B2B91948611505FB370"><enum>(II)</enum><header>Limitation</header><text>Of the amounts received by a State under clause (ii)(I)(cc), not more than 3 percent shall be used for the purposes described in subclause (I)(ee).</text></subclause></clause>
<clause id="H5480E06F126B4D65BA1036D7A13A5279"><enum>(v)</enum><header>Administration</header><text display-inline="yes-display-inline">Subject to clause (vi)(III), amounts made available under clauses (ii)(I)(aa) and (ii)(I)(cc) shall—</text> <subclause id="H1D8F4054BA8747EEA8DE01920ADF7858"><enum>(I)</enum><text>be made available, without further appropriation, in accordance with this paragraph;</text></subclause>
<subclause id="H2AEABAF89F504EDBAA80CF260697D41A"><enum>(II)</enum><text>remain available until expended; and</text></subclause> <subclause id="H9870FFB4B17D4F8D82D3A1616F767DDE"><enum>(III)</enum><text>be in addition to any amount appropriated under any other Act.</text></subclause></clause>
<clause id="H52011AC46FDB48A79D85F6FA901709FC"><enum>(vi)</enum><header>Reporting requirement</header>
<subclause id="H342EABF4C82544448A6D81A37E0DDE3F"><enum>(I)</enum><header>In general</header><text>Not later than 180 days after the end of each fiscal year, the Governor of each eligible State that receives amounts under clause (ii)(I)(cc) for the applicable fiscal year shall submit to the Secretary a report that describes the use of the amounts by the eligible State during the period covered by the report.</text></subclause> <subclause id="HAA5548FBB9314B96AEB624FED9A847A6"><enum>(II)</enum><header>Public availability</header><text>On receipt of a report under subclause (I), the Secretary shall make the report available to the public on the website of the Department of the Interior.</text></subclause>
<subclause id="H74E59FC3A78048A48C0847ED3CA59889"><enum>(III)</enum><header>Limitation</header><text display-inline="yes-display-inline">If the Governor of an eligible State that receives amounts under clause (ii)(I)(cc) for the applicable fiscal year fails to submit the report required under subclause (I) by the deadline specified in that subclause, any amounts that would otherwise be provided to the eligible State under clause (ii)(I)(cc) for the succeeding fiscal year shall be deposited in the Treasury and credited to miscellaneous receipts.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H8318E0C42CE644BDA4BBF1C18D89DDA7"><enum>(b)</enum><header>Exemption of certain payments from sequestration</header> <paragraph id="HD23D61EB3EBA4C34BC0A447087213C25"><enum>(1)</enum><header>In general</header><text>Section 255(g)(1)(A) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/905">2 U.S.C. 905(g)(1)(A)</external-xref>) is amended by inserting after <quote>Payments to Social Security Trust Funds (28–0404–0–1–651).</quote> the following: </text>
<quoted-block style="OLC" id="HF227984CEF0943E0B882B3AD11D91341" display-inline="no-display-inline"><list level="paragraph"><list-item>Payments to States pursuant to subparagraph (C)(ii)(I)(cc) of section 8(p)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(2)</external-xref>).</list-item></list><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H90956052F358493FA8411501A46E96CB"><enum>(2)</enum><header>Applicability</header><text>The amendment made by this subsection shall apply to any sequestration order issued under the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900 et seq.</external-xref>) on or after the date of enactment of this Act.</text></paragraph></subsection></section> <section id="H6627B7FCAD8C487C85DD35AAEAA2830E"><enum>308.</enum><header>Energy and environmental remediation demonstration project for biochar</header> <subsection id="H6EA5AFCC4CA54DF087978D41955F4695"><enum>(a)</enum><header>Demonstration projects</header> <paragraph id="H4E2F476C966847A6A47C806F6567596E"><enum>(1)</enum><header>Establishment</header> <subparagraph id="HFD24C69DCFC9442DB943EFA4622FE346"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this section, the Secretary shall establish a program to enter into partnerships with eligible entities to carry out demonstration projects to support the development and commercialization of biochar in accordance with this subsection.</text></subparagraph>
<subparagraph id="HE3BE88ABD9364D148EAA07709F9CD70B"><enum>(B)</enum><header>Location of demonstration projects</header><text>The Secretary shall, to the maximum extent practicable, establish biochar demonstration projects in geographically diverse regions.</text></subparagraph></paragraph> <paragraph id="H8444EB114FFF4BE09A6617FCF727DB1C"><enum>(2)</enum><header>Proposals</header><text>To be eligible to enter into a partnership to carry out a biochar demonstration project under paragraph (1)(A), an eligible entity shall submit to the Secretary a proposal at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph>
<paragraph id="H635348C301674498BC2ACB5926D79A2A"><enum>(3)</enum><header>Priority</header><text>In selecting proposals under paragraph (2), the Secretary shall give priority to partnering with eligible entities that submit proposals to carry out biochar demonstration projects that—</text> <subparagraph id="H33487BBE5FAD4BD29628F213993ECD94"><enum>(A)</enum><text>have the most carbon sequestration potential;</text></subparagraph>
<subparagraph id="HD9D34EFACF37463E96FA03B6D76F6522"><enum>(B)</enum><text>will create new jobs and contribute to local economies, particularly in rural areas;</text></subparagraph> <subparagraph id="HDCD9FFA48DB7477D9533E282375B3E97"><enum>(C)</enum><text>will demonstrate—</text>
<clause id="HF4157CC5AFB74F4DB2099FFE861573DB"><enum>(i)</enum><text>new and innovative uses of biochar;</text></clause> <clause id="HAD3CEDC9C8354C0EBEDEED0B1BE3EE51"><enum>(ii)</enum><text>viable markets for cost-effective biochar-based products;</text></clause>
<clause id="H683F0AE0CE2143F4B2F038D690E5A007"><enum>(iii)</enum><text>the ecosystem services of biochar; or</text></clause> <clause id="HAF7FB8161D2C427CA0838D6864E94151"><enum>(iv)</enum><text>any combination of purposes specified in clauses (i) through (iii);</text></clause></subparagraph>
<subparagraph id="HE5CAF2266AB54A79A727733CF6B22E5B"><enum>(D)</enum><text>are located in local markets that have the greatest need for the biochar production units due to—</text> <clause id="H4ADFA1E186844D51830A40ED04BFE5FB"><enum>(i)</enum><text>availability of sufficient quantities of feedstocks; or</text></clause>
<clause id="H05298DF823CE49CC9764F0DDC10510A8"><enum>(ii)</enum><text>a high level of demand for biochar or other commercial byproducts of biochar; or</text></clause></subparagraph> <subparagraph id="HA115B48129CC4588B56C7A616DFFE51E"><enum>(E)</enum><text>meet any combination of criteria specified in subparagraphs (A) through (D).</text></subparagraph></paragraph>
<paragraph id="HBBD320E40A7B40398151A8F4C23FC42F"><enum>(4)</enum><header>Use of funds</header><text>In carrying out the program established under paragraph (1)(A), the Secretary may enter into partnerships and provide funding to carry out demonstration projects that—</text> <subparagraph id="HB9C5FF56E6374D84B00BCA44F98ABD03"><enum>(A)</enum><text>acquire and test various feedstocks and their efficacy;</text></subparagraph>
<subparagraph id="H5F328766972D4418AB00B23A4C28A643"><enum>(B)</enum><text>develop and optimize commercially and technologically viable biochar production units, including mobile and permanent units;</text></subparagraph> <subparagraph id="H8CC1C1EAF996419D90C7F2E2C63372DC"><enum>(C)</enum><text>build, expand, or establish biochar facilities;</text></subparagraph>
<subparagraph id="H9981A456CC7E45F4B0E89897D2A224C0"><enum>(D)</enum><text>conduct research on new and innovative uses of biochar or demonstrate cost-effective market opportunities for biochar and biochar-based products;</text></subparagraph> <subparagraph id="HCED6F178E8FE42CAB5463C5FFDA2542C"><enum>(E)</enum><text>carry out any other activities the Secretary determines appropriate; or</text></subparagraph>
<subparagraph id="H95EDC168217B4A9B9512C457146713FC"><enum>(F)</enum><text>meet any combination of the criteria specified in subparagraphs (A) through (E).</text></subparagraph></paragraph> <paragraph id="HD05D5349C37A44659B161949782982FF"><enum>(5)</enum><header>Review of biochar demonstration</header> <subparagraph id="H69A1D022E3614D8AAF770EFAA2AFCA7E"><enum>(A)</enum><header>In general</header><text>The Secretary shall conduct regionally specific research, including economic analyses and life-cycle assessments, on the biochar produced from the demonstration projects under this subsection, including—</text>
<clause id="H6B808C9DD85748E59255D85E5F376B59"><enum>(i)</enum><text>the effects of such biochar on—</text> <subclause id="H97423A75753B4F90BD36D3CEA6BCDE5D"><enum>(I)</enum><text>carbon capture and sequestration, including increasing soil carbon in the short term and long term;</text></subclause>
<subclause id="H4BB3C0AC1011430A8C8EBB3216A1913A"><enum>(II)</enum><text>environmental remediation activities, including abandoned mine land remediation; and</text></subclause> <subclause id="HA8CA7CB20F814A07B31FF77BA7521168"><enum>(III)</enum><text>other ecosystem services of biochar;</text></subclause></clause>
<clause id="HC42A3A895D4342FA903ADBCA8E467948"><enum>(ii)</enum><text>the efficacy of biochar as a coproduct of biofuels or in biochemicals; and</text></clause> <clause id="H629C1414CB02483693C6F7708D94D75B"><enum>(iii)</enum><text>whether biochar can effectively be used to produce any other technologically and commercially viable outcome.</text></clause></subparagraph>
<subparagraph id="H9F6DF788C93B4782A526468C88D0B55C"><enum>(B)</enum><header>Coordination</header><text>The Secretary shall, to the maximum extent practicable, provide data, analysis, and other relevant information collected under subparagraph (A) to eligible institutions conducting research and development activities on biochar.</text></subparagraph></paragraph> <paragraph id="H0E83EA53E2284B30AE18B407D0B04664"><enum>(6)</enum><header>Limitation on funding for establishing biochar facilities</header><text>In the case of an eligible entity that enters into a partnership to carry out a biochar demonstration project under this subsection and seeks to establish a biochar facility under such demonstration project, the Secretary may not provide funding to such eligible entity in an amount greater than 35 percent of the capital cost of establishing such biochar facility.</text></paragraph></subsection>
<subsection id="HE2A5381CEE5C44B69E5984D09F58D498"><enum>(b)</enum><header>Reports</header>
<paragraph id="H659CEAC153044CAA967EC0CA8CA9C7D1"><enum>(1)</enum><header>Report to congress</header><text>Not later than 2 years after the date of the enactment of this section, the Secretary shall submit a report to Congress that—</text> <subparagraph id="H781834B4ADB54BE682D92DE17200A862"><enum>(A)</enum><text>includes policy and program recommendations to improve the widespread use of biochar;</text></subparagraph>
<subparagraph id="H775FE0AE7AD9428B96DF32D907FF84FF"><enum>(B)</enum><text>identifies the areas of research needed to advance biochar commercialization and opportunities to expand markets for biochar and create jobs, particularly in rural areas;</text></subparagraph> <subparagraph id="H5438A3AEDBE540DD813F44D70599D2AA"><enum>(C)</enum><text>identifies barriers to further biochar commercialization, including permitting and siting considerations; and</text></subparagraph>
<subparagraph id="H37B21693A0974C49A590292BFBD46B41"><enum>(D)</enum><text>identifies best management practices of biochar and biochar-based products to maximize—</text> <clause id="HB12898CCDAF44981B4EC7F64CE02D023"><enum>(i)</enum><text>carbon sequestration benefits;</text></clause>
<clause id="H811F673C190946E89FE097E1D7FAF7DD"><enum>(ii)</enum><text>applications in environmental remediation, including abandoned mine land remediation; and</text></clause> <clause id="H2E3D215017094E889294FE589C5365EC"><enum>(iii)</enum><text>applications as a coproduct of biofuels or in biochemicals.</text></clause></subparagraph></paragraph>
<paragraph id="H9AEE3160BE384F6681D501A39E36B6CE"><enum>(2)</enum><header>President’s annual budget request</header><text>Beginning 2 years after the date of the enactment of this section and annually until the date described in subsection (c), the Secretary shall include in the budget materials submitted to Congress in support of the President’s annual budget request (submitted to Congress pursuant to section 1105 of title 31, United States Code) for each fiscal year a report on the status of the demonstration projects carried out under subsection (a).</text></paragraph></subsection> <subsection id="H46E6F878FE014432BAC4E9D4E5FD47B0"><enum>(c)</enum><header>Sunset</header><text>The authority to carry out this section shall terminate on the date that is 10 years after the date of the enactment of this section.</text></subsection>
<subsection id="H68D17D16F0B14534AFA1876FD43FA1F8"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="HF2C6F8A65D6345468524484253F9C050"><enum>(1)</enum><header>Biochar</header><text>The term <term>biochar</term> means carbonized biomass produced by converting feedstock through reductive thermal processing for nonfuel uses.</text></paragraph>
<paragraph id="HAAC33A83731B4466970649BA7029A18C"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H03F46B8F451E473FB61B92BE6B0843B6"><enum>(A)</enum><text>State, local, and Tribal governments;</text></subparagraph>
<subparagraph id="HF93CC752EC1A4530918C502AE3D10F19"><enum>(B)</enum><text>eligible institutions; and</text></subparagraph> <subparagraph id="H5EFF14B60B844370AF29E6BB4CC543BB"><enum>(C)</enum><text>private, nonprivate, or cooperative entities.</text></subparagraph></paragraph>
<paragraph id="HDB5389AD224B4434B9763565C03AC6C9"><enum>(3)</enum><header>Eligible institution</header><text>The term <term>eligible institution</term> means land-grant colleges and universities, including institutions eligible for funding under the—</text> <subparagraph id="H704EC5E4684D41D8BDCC9FDB8817DDEE"><enum>(A)</enum><text>Act of July 2, 1862;</text></subparagraph>
<subparagraph id="H437EF40F771445E886EC81EAD3887F50"><enum>(B)</enum><text>Act of August 30, 1890, including Tuskegee University;</text></subparagraph> <subparagraph id="H49E6F5989F294B2092DE5C93E4A48BE2"><enum>(C)</enum><text>Public Law 87–788 (commonly known as the McIntire-Stennis Act of 1962); or</text></subparagraph>
<subparagraph id="HE2342AAFB8564577AC3394574BECD549"><enum>(D)</enum><text>Equity in Educational Land-Grant Status Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/301">7 U.S.C. 301</external-xref> note).</text></subparagraph></paragraph> <paragraph id="H99C9869715094E3CB75641422A32E640"><enum>(4)</enum><header>Feedstock</header><text>The term <term>feedstock</term> means excess biomass in the form of plant matter or materials that serves as the raw material for the production of biochar.</text></paragraph>
<paragraph id="H0400FA1A61D04CCC945837D149474FF6"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></subsection></section></title> <title id="HA6A08777D19147B6A39C4EDDD35E2ED9"><enum>IV</enum><header>Limitations on Leasing Moratoriums</header> <section id="H275CFA141481405B9D4C969DDEA58228"><enum>401.</enum><header>Coal leases</header><text display-inline="no-display-inline">Section 2(a)(1) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/201">30 U.S.C. 201(a)(1)</external-xref>) is amended by striking <quote>in his discretion, upon the request of any qualified applicant or on his own motion from time to time</quote> and inserting <quote>at the Secretary’s discretion or upon the request of any qualified applicant</quote>.</text></section>
<section id="HFC3F1AFDA55546B7B8077647AB25CAC9"><enum>402.</enum><header>Congressional authority requirement</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary of the Interior may not declare a moratorium on the leasing of Federal lands, including on the Outer Continental Shelf, for the drilling, mining, or collection of oil, gas, or coal, or related activities unless such moratorium is authorized by an Act of Congress.</text></section> <section id="H3C1AB204835741EABE99C2941D089560"><enum>403.</enum><header>Prohibition on moratoria of new energy leases on certain Federal land and on withdrawal of Federal land from energy development</header> <subsection id="HFACCCA71E48D41A8B48326F0CC772FAF"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="H583644C3CA0645E5AA83C9AAEC8A724F"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>critical mineral</term> means any mineral included on the list of critical minerals published in the notice of the Secretary of the Interior entitled <quote>Final List of Critical Minerals 2018</quote> (83 Fed. Reg. 23295 (May 18, 2018)); </text></paragraph> <paragraph id="H2B8594FBAA1243A58F297EE68AF64EF8"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Federal land</term>—</text>
<subparagraph id="H84A6B487DFC548F9B02545EF2EFF0689"><enum>(A)</enum><text>means—</text> <clause id="H131197EAD2054319A9977CFCE9DB7971"><enum>(i)</enum><text>National Forest System land;</text></clause>
<clause id="H9716B4CDB2E54FC18EDDBEE85164F906"><enum>(ii)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>));</text></clause> <clause id="H095F6BA02BC543239BC329A17362E326"><enum>(iii)</enum><text>the Outer Continental Shelf (as defined in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>)); and</text></clause>
<clause id="H19D5307B11A24C0DAF2A68EE662EAA8B"><enum>(iv)</enum><text>land managed by the Secretary of Energy; and</text></clause></subparagraph> <subparagraph id="H757F972453524D07AB0F74D5D87178E9"><enum>(B)</enum><text>includes land described in clauses (i) through (iv) of subparagraph (A) for which the rights to the surface estate or subsurface estate are owned by a non-Federal entity; and</text></subparagraph></paragraph>
<paragraph id="H4F927E033FD14CE0B228F29CDADBD034"><enum>(3)</enum><text>the term <term>President</term> means the President or any designee, including—</text> <subparagraph id="H667B49609CF54BAAB9F3C9E54013A3BE"><enum>(A)</enum><text>the Secretary of Agriculture;</text></subparagraph>
<subparagraph id="H4350D5C4FE6E4F978312B117FE0E8AE6"><enum>(B)</enum><text>the Secretary of Energy; and</text></subparagraph> <subparagraph id="H27FA4895E80342F49C8E0014286E7A09"><enum>(C)</enum><text>the Secretary of the Interior.</text></subparagraph></paragraph></subsection>
<subsection id="H38B7DC4870224BAAB97B63BC7CD3C51D"><enum>(b)</enum><header>Prohibitions</header>
<paragraph id="H7FE47B9BEF594CF8A6842F2D44B14ACA"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, the President may not carry out any action that would prohibit or substantially delay the issuance of any of the following on Federal land, unless such an action has been authorized by an Act of Congress:</text> <subparagraph id="H514C639A51D2427D9E0D435808C08768"><enum>(A)</enum><text>New oil and gas leases, drill permits, approvals, or authorizations.</text></subparagraph>
<subparagraph id="HDFFC89D1E70B4037A2AE0A8BC146CBC3"><enum>(B)</enum><text>New coal leases, permits, approvals, or authorizations.</text></subparagraph> <subparagraph id="H6E7FDAF6AC8E4B73ACBA6711629F20BD"><enum>(C)</enum><text>New hard rock leases, permits, approvals, or authorizations.</text></subparagraph>
<subparagraph id="HD24B0879767C4D9E8BF5671086E34FEF"><enum>(D)</enum><text>New critical minerals leases, permits, approvals, or authorizations.</text></subparagraph></paragraph> <paragraph id="H0D0481B892C941F9989A256DCC1DB5B6"><enum>(2)</enum><header>Prohibition on withdrawal</header><text>Notwithstanding any other provision of law, the President may not withdraw any Federal land from forms of entry, appropriation, or disposal under the public land laws, location, entry, and patent under the mining laws, or disposition under laws pertaining to mineral and geothermal leasing or mineral materials unless the withdrawal has been authorized by an Act of Congress.</text></paragraph></subsection></section></title>
