which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program to map optimal locations for electric vehicle charging stations and the derived demand for electricity, and for other purposes.</official-title></form><legis-body id="H203582DC38CA4E2788B2D792C7321E64" style="OLC"><section section-type="section-one" id="HA5CACD57C46641E2A06B39191E9026F8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electric Vehicle Mobility Area Planning Act</short-title></quote> or the <quote><short-title>EV MAP Act</short-title></quote>.</text></section><section id="H4DBFBF99A9434676A1164B8A70541D94"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HD19B794BA0A142E8BA55F32D499996E9"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="HF9B99855D85A4DCD84561594FCBD94D6"><enum>(A)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph id="HEB2E27E2C9184821BBFACBDD2F108EE3"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph><subparagraph id="H3022A5C5CE4942B8B6D38CF4FC9A03C4"><enum>(C)</enum><text>the Committee on Appropriations of the House of Representatives; and </text></subparagraph><subparagraph id="H8888EC18B8DB4C158EA6E79E26D9003D"><enum>(D)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H31ED71BBE9704E2CAC6A182E0D091AD6"><enum>(2)</enum><header>Direct current fast charging equipment</header><text>The term <term>direct current fast charging equipment</term> means electric vehicle supply equipment that provides a direct current power source at a minimum of 50 kilowatts. </text></paragraph><paragraph commented="no" id="H7D703BB9E2DB4F2CA294C554768818C3"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" id="H60F865DC9E8D4F6C9E14D52E871DF527"><enum>(A)</enum><text>a college or university;</text></subparagraph><subparagraph commented="no" id="HC612986346E34318BBB792411142A23C"><enum>(B)</enum><text>a nonprofit entity;</text></subparagraph><subparagraph commented="no" id="H52AD089445EB4E27A106F581E6B6C1E5"><enum>(C)</enum><text>an electric cooperative;</text></subparagraph><subparagraph commented="no" id="H84C7169AA20347E3879C02957E986F72"><enum>(D)</enum><text>a political subdivision of a State;</text></subparagraph><subparagraph commented="no" id="H0798C29261854BD48E1B3613E89CEB56"><enum>(E)</enum><text>any agency, authority, corporation, or instrumentality of—</text><clause commented="no" id="H7B37081B297A4E9AA12A31763931B502"><enum>(i)</enum><text>a State;</text></clause><clause commented="no" id="H4C71E00B7A244B22A9B4311FB46F53EE"><enum>(ii)</enum><text>a political subdivision of a State; or</text></clause><clause commented="no" id="HFC1FA74CBDCC440CA79AC3D449D5A830"><enum>(iii)</enum><text>an Indian Tribe;</text></clause></subparagraph><subparagraph commented="no" id="HCE4136E0CC444B9799BA035CD642BF2F"><enum>(F)</enum><text>a municipally owned electric utility; </text></subparagraph><subparagraph id="H44FE35598A07437180F9A3E7CB55851C"><enum>(G)</enum><text display-inline="yes-display-inline">a Tribally owned electric utility;</text></subparagraph><subparagraph commented="no" id="HB3985BE7DA3C4A52AD0C6B7FE6B66C50"><enum>(H)</enum><text>an investor-owned electric utility;</text></subparagraph><subparagraph commented="no" id="H78FF19CAD1CA49EFA1440D9140579998"><enum>(I)</enum><text>a private entity; and</text></subparagraph><subparagraph commented="no" id="H974CB4B291BD4ED692577A322D26380E"><enum>(J)</enum><text>a partnership of 2 or more entities described in any of subparagraphs (A) through (I).</text></subparagraph></paragraph><paragraph id="HC5C7AAB9E35D46BB9CDE06012CE7C57D"><enum>(4)</enum><header>Electric vehicle</header><text>The term <term>electric vehicle</term> means a light-, medium-, or heavy-duty vehicle that is powered primarily by an electric motor drawing current from rechargeable batteries, including— </text><subparagraph id="H1B1D884B48A74637AFFE4B1C3A070632"><enum>(A)</enum><text>a battery electric vehicle; and </text></subparagraph><subparagraph id="H0753D57ED801439CB073143D61925301"><enum>(B)</enum><text>a plug-in hybrid vehicle.</text></subparagraph></paragraph><paragraph id="HAE0CC35FC761470EB7DFB28D8C970A0A"><enum>(5)</enum><header>Electric vehicle charging station</header><text>The term <term>electric vehicle charging station</term> means electric vehicle supply equipment that provides electric current to recharge electric vehicles, including, as applicable, alternating current or direct current charging capabilities, at—</text><subparagraph id="H049C5F19CD2A473FBA199FD0F576FB8D"><enum>(A)</enum><text>a multi-unit housing structure;</text></subparagraph><subparagraph id="H161D9C910397466D957ECB71541FED31"><enum>(B)</enum><text>a workplace;</text></subparagraph><subparagraph id="HB1FA9ABAA3B842278D6C54C2EF36F272"><enum>(C)</enum><text>a commercial location; or</text></subparagraph><subparagraph id="H603A9AF9898A4E3AB4A0E677F64B1989"><enum>(D)</enum><text>any location that is open to the public.</text></subparagraph></paragraph><paragraph id="H2F6F0515474B472A9EF7EF065E827308"><enum>(6)</enum><header>Evaluation period</header><text>The term <term>evaluation period</term> means the 5-year period beginning on the date on which an eligible entity receives a grant under the program.</text></paragraph><paragraph id="HE24C6EADF10C4DCEB1BAC88DB89059AE"><enum>(7)</enum><header>Grant date</header><text>The term <term>grant date</term> means the date on which an eligible entity receives a grant under the program.</text></paragraph><paragraph id="H4F0177A9C9DE49609866EDC09A45F74D"><enum>(8)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H8F31AA4DCBD540529C470D060983252E" commented="no"><enum>(9)</enum><header>Level 2 charging equipment</header><text>The term <term>level 2 charging equipment</term> means electric vehicle supply equipment that provides an alternating current power source at a minimum of 240 volts.</text></paragraph><paragraph id="HB8F141C0D4204406B2A08E377AB63458"><enum>(10)</enum><header>Program</header><text>The term <term>program</term> means the program established under section 3(a).</text></paragraph><paragraph id="HDEA50274AA9042E28B17CA9832658394"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></section><section id="H00366DFA1543490B9DFFF87A3188E4C7"><enum>3.</enum><header>Electric vehicle charging station mapping program</header><subsection commented="no" id="H1FAA411109BA49FA923FE9A235B38697"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide grants to, or enter into cooperative agreements with, eligible entities to carry out activities described in subsection (c)—</text><paragraph commented="no" id="HB3E1E2C01148463997D73D31E2EAF662"><enum>(1)</enum><text display-inline="yes-display-inline">to determine the locations in which electric vehicle charging stations will be needed to meet the needs of electric vehicle drivers during the evaluation period; and </text></paragraph><paragraph commented="no" id="H6468D363C28C4EEBAA74BA5BC3516CB6"><enum>(2)</enum><text display-inline="yes-display-inline">to help guide future investments for electric vehicle charging stations.</text></paragraph></subsection><subsection id="H0697D813FEDE43D39BB1528B02FB0934"><enum>(b)</enum><header>Application; consideration</header><paragraph id="HDFE3CAA540E24711B4EC2DF6EE5D8D92"><enum>(1)</enum><header>Application</header><text>To be eligible to receive a grant under the program, an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph><paragraph id="H680BF8DE9A274203A0C824A02E799C67"><enum>(2)</enum><header>Consideration</header><text display-inline="yes-display-inline">In awarding grants under the program, the Secretary may take into consideration and give priority to an eligible entity that will carry out activities using grant funds with respect to—</text><subparagraph id="HDCBAFFA0448E42BBA335A13A574772D1"><enum>(A)</enum><text>a rural area; or</text></subparagraph><subparagraph id="HFC168DFD7170492C9110DCD3B915B546"><enum>(B)</enum><text>an area where, as of the date of enactment of this Act, there is a low concentration of electric vehicle charging stations at locations open to the public.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HDFCEA1AF81304F239A355E56EB77A867"><enum>(c)</enum><header>Use of grant</header><text display-inline="yes-display-inline">An eligible entity may use a grant received under the program— </text><paragraph commented="no" id="HA9293148CE5A490F81FB22C44E7FC84C"><enum>(1)</enum><text display-inline="yes-display-inline">to evaluate, in an area in the United States designated by the eligible entity—</text><subparagraph commented="no" id="HE7F9334314CB4773968A00D555D6987F"><enum>(A)</enum><text display-inline="yes-display-inline">the locations of electric vehicle owners on the grant date; and</text></subparagraph><subparagraph commented="no" id="H758F73421905417FABB435557842C3FB"><enum>(B)</enum><text>the potential locations of electric vehicle owners during the evaluation period, based on data such as commuting and travel patterns;</text></subparagraph></paragraph><paragraph commented="no" id="H9DC48A2AE05846ACB94E5250464456FD"><enum>(2)</enum><text>to evaluate, in the area designated by the eligible entity, estimated commuting and travel patterns of electric vehicles—</text><subparagraph commented="no" id="HFBB19AA6C8DD47ACB936800870F4F01E"><enum>(A)</enum><text>on the grant date; and</text></subparagraph><subparagraph commented="no" id="H5554154AC8F742D2AD45CB0A032DFF71"><enum>(B)</enum><text display-inline="yes-display-inline">during the evaluation period; </text></subparagraph></paragraph><paragraph commented="no" id="H0E0DC06644894EAA8E42E0F7867594C5"><enum>(3)</enum><text>to estimate, for the area designated by the eligible entity, the quantity of electricity required to serve electric vehicle charging stations—</text><subparagraph id="H5F3778359FCE41CB8B4260C65F7036FE" commented="no"><enum>(A)</enum><text>on the grant date; and</text></subparagraph><subparagraph commented="no" id="H0231A85D0E354209900C0232049815C5"><enum>(B)</enum><text>during the evaluation period;</text></subparagraph></paragraph><paragraph commented="no" id="H613048808A1E4B30AC01B2866BEC2B58"><enum>(4)</enum><text display-inline="yes-display-inline">to develop a map identifying concentrations of electric vehicle charging stations to meet the needs of current and future electric vehicle drivers in the area designated by the eligible entity, based on data such as commuting and travel patterns;</text></paragraph><paragraph commented="no" id="HEC4BC41C3E454EC3BBE99EA88D7A58E5"><enum>(5)</enum><text>to estimate future needs for electric vehicle charging stations in the area designated by the eligible entity to support the adoption and use of electric vehicles in shared mobility solutions, such as micro-transit and transportation network companies; or</text></paragraph><paragraph commented="no" id="H301D596DBDBB4AE78B598BADBC5C1F29"><enum>(6)</enum><text>to develop an analytical model to allow a city, county, or other political subdivision of a State or a local agency to compare and evaluate different adoption and use scenarios for electric vehicles and electric vehicle charging stations, with the ability to adjust factors to account for locally and regionally specific characteristics.</text></paragraph></subsection><subsection id="HF79E7D13641A403BB3235DFE606C85A6"><enum>(d)</enum><header>Electric vehicle charging station database</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall establish and maintain a fully searchable database, which shall be accessible on the website of the Department of Energy, that contains, at a minimum—</text><paragraph id="HC1E149061FCB40489A1B724EC1268BEF"><enum>(1)</enum><text>information maintained by the Office of Energy Efficiency and Renewable Energy of the Department of Energy with respect to the locations of electric vehicle charging stations;</text></paragraph><paragraph id="HF15FD9AECB3F42339638C9C606614275"><enum>(2)</enum><text>potential locations for electric vehicle charging stations identified by eligible entities through the program; and</text></paragraph><paragraph id="H81301C6447144DFDBF887D59F36E8AC9"><enum>(3)</enum><text>the ability for a user of the database to sort generated electric vehicle charging station results by various characteristics with respect to those electric vehicle charging stations, including—</text><subparagraph id="H496C5E35F70B4436A0B11F42720D3AF1"><enum>(A)</enum><text>location, in terms of the State, city, or other area specified by the user;</text></subparagraph><subparagraph id="HA70BEB4D66EE42A7A7E5050DF6C7A897"><enum>(B)</enum><text>accessibility, in terms whether the station is public or private;</text></subparagraph><subparagraph id="H8E7F148C23E6453384AC2FEBE2FE184F"><enum>(C)</enum><text>status, in terms of whether the station is available, planned, or a potential location identified by an eligible entity under the program; and</text></subparagraph><subparagraph id="H83E7F0CD538B474694DB77A7CA8B5324"><enum>(D)</enum><text>charging type, in terms of—</text><clause id="H7C10A02FB7C34142903C1871DB034042"><enum>(i)</enum><text>level 2 charging equipment; or</text></clause><clause id="H31582E72E9214DB1B5B816EF096A80BF"><enum>(ii)</enum><text>direct current fast charging equipment.</text></clause></subparagraph></paragraph></subsection><subsection id="HA1BCA1AB07334535BB0A3CC9316DB10E"><enum>(e)</enum><header>Reports</header><paragraph id="H6B579DE262284499908DC223B64D0975"><enum>(1)</enum><header>Reports to Congress</header><text>Not later than 18 months after the date of enactment of this Act, and annually thereafter during for duration of the program, the Secretary shall submit to the appropriate committees of Congress a report on the outcomes of the program, including—</text><subparagraph id="HFED31123F6E64511A649015ED8A3828A"><enum>(A)</enum><text>the concentrations and, to the maximum extent practicable, number of locations of electric vehicle charging stations identified by eligible entities in—</text><clause id="H39273EB540244E25B8A206303EFA3117"><enum>(i)</enum><text>rural areas; </text></clause><clause id="H032905E1317444DF8AA23F3343C4DC36"><enum>(ii)</enum><text>urban areas; or </text></clause><clause id="HFC71B9CAD02147178DBCE2AD68C5F8A6"><enum>(iii)</enum><text>other areas with a combination of rural and urban areas;</text></clause></subparagraph><subparagraph id="H4ECD5684928348D1858D5EF7C1DCD88B"><enum>(B)</enum><text>an analysis, based on the concentrations or number of locations of electric vehicle charging stations identified by eligible entities, of—</text><clause id="H9C8069E8C30B4C20AD4D38BC49AC0083"><enum>(i)</enum><text>the potential of electric vehicle charging stations to reasonably support travel patterns of various distances for operators of electric vehicles; and</text></clause><clause id="H7EE3D527F74244C2A344AFCA094EA584"><enum>(ii)</enum><text>any relevant variables with respect to the quantity of electricity required to serve, or that may impact the efficacy of, electric vehicle charging stations in—</text><subclause id="H507C551249364A42BC4FCF91A5529AB9"><enum>(I)</enum><text>rural areas; </text></subclause><subclause id="HBB0C2E35AFAA405BBE0F141E40DF465F"><enum>(II)</enum><text>urban areas; or </text></subclause><subclause id="HA986765DF69741BF8444561F94BA3356" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>other areas with a combination of rural and urban areas; </text></subclause></clause></subparagraph><subparagraph id="H505B66B2C785413EBF9B69F098940177"><enum>(C)</enum><text>a summary of characteristics, trends, or lessons learned by eligible entities in identifying concentrations or locations of electric vehicle charging stations in—</text><clause id="H178FCDD2447243278191B4CD7B1557ED"><enum>(i)</enum><text>rural areas; </text></clause><clause id="H6BAA595C00764668992E8409CC0ACD28"><enum>(ii)</enum><text>urban areas; or </text></clause><clause id="HD5D4856A523A4CA096D9D95E9D2BECE6" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>other areas with a combination of rural and urban areas; and</text></clause></subparagraph><subparagraph id="H061302F020C4470987E77CD4727C37B7"><enum>(D)</enum><text>such other information as the Secretary determines to be appropriate. </text></subparagraph></paragraph><paragraph id="H3221225AEB65460B883EFF31AD7B31B9"><enum>(2)</enum><header>Reports to the Secretary</header><subparagraph id="HD6CCAC92FCCC4C34B5C64C16AE7F16DC"><enum>(A)</enum><header>In general</header><text>To facilitate the preparation of each report described in paragraph (1), each eligible entity receiving a grant under the program shall submit to the Secretary 1 or more reports containing, as applicable, the preliminary or complete findings, data, and results of each activity carried out by the eligible entity using the grant.</text></subparagraph><subparagraph id="H0ED6A5ED31DE4DE68699C2438608ED68"><enum>(B)</enum><header>Timing</header><clause id="H4DAEA8BF35C44E09877E8E6A2C2FE481"><enum>(i)</enum><header>First report</header><text>The first report submitted under subparagraph (A) shall be submitted on the earlier of—</text><subclause id="H94B1D47F67AC415086576AE46ED98E6C"><enum>(I)</enum><text>the date on which the findings, data, and results described in that subparagraph are available; and</text></subclause><subclause id="H4334F15FFEDD4E349AA0A9751CB31FEB"><enum>(II)</enum><text>the date that is 1 year after the grant date. </text></subclause></clause><clause id="HF9A6B863E4A840B0B04A3D84810B8487" commented="no"><enum>(ii)</enum><header>Subsequent reports</header><text>If the first report submitted by an eligible entity under this paragraph does not contain the complete findings, data, and results of each activity carried out by the eligible entity using the applicable grant, a subsequent report shall be submitted as soon as practicable after the date on which those complete findings, data, and results are available.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" id="H19798273CDA74AD9847C2C6E170C6CAF"><enum>4.</enum><header>Authorization of appropriations</header><subsection commented="no" id="H08DD7C239B334D9AADE87BFB8C7E6286"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act $2,000,000 for each of fiscal years 2022 through 2027.</text></subsection><subsection commented="no" id="H3794611C99234709A7A893E92C851A4C"><enum>(b)</enum><header>Administrative costs</header><text>Of the amounts made available to the Secretary under subsection (a) each fiscal year, the Secretary may use not more than 5 percent for administrative expenses necessary to carry out this Act.</text></subsection></section></legis-body></bill>
