<official-title display="yes">To help train individuals in effective and evidence-based de-escalation techniques to ensure that individuals at diverse levels of society have and retain greater skills to resolve conflicts, manage anger, and control implicit bias without the use of physical or other force, and for other purposes.</official-title>

<section id="H0FF0A17677994F3E8B5B824967842AF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Community Violence De-Escalation Training Act of 2021</short-title></quote>.</text></section> <section id="H8DCAC0DDBB924A5A99D04174A0BC71B9" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H51F52870EE044D909E697397A1D69FDC"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>Advisory Board</term> means the De-Escalation Advisory Board established pursuant to section 4.</text></paragraph> <paragraph id="H38355E3B3B6B4FEA9E0D4EC1DE9351C5"><enum>(2)</enum><text>The term <term>at-risk youth</term> means any individual who—</text>
<subparagraph id="H5BAE0009B13848ED884321D522CB13B2"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="HDDEB629499D2415BA1C3B5BAD9170E34"><enum>(i)</enum><text>has attained age 16 but not age 25;</text></clause> <clause id="H8ACA334C81E9498C88168A5927B9201F" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">has not regularly attended any secondary, technical, or postsecondary school during the preceding 6-month period;</text></clause>
<clause id="H6C2B8638900949AC8EB975AE54EB1C3D" indent="up1"><enum>(iii)</enum><text>has not been regularly employed during the preceding 6-month period; and</text></clause> <clause id="H2F7068E2CF5643CFA09C9494294AC3C4" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">is not readily employable by reason of lacking a sufficient number of basic skills; or</text></clause></subparagraph>
<subparagraph id="HDB6B6B8C43694241A5C4E29B7998396A"><enum>(B)</enum><text display-inline="yes-display-inline">has attained age 16 but not age 21 and was in foster care.</text></subparagraph></paragraph> <paragraph id="H9999105C03034B7DA1E3E53371B12B4A"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>de-escalation</term> means reduction of the intensity of a conflict or potentially violent situation.</text></paragraph>
<paragraph id="H689834001806483E9C18DFFC9EF0174D"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>implicit bias</term> means the attitudes or stereotypes that affect an individual’s understanding, actions, and decisions in an unconscious manner.</text></paragraph> <paragraph id="H0A05D89F62174A13A187C4E3F8016891"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>racial reconciliation</term> means a process of reconciliation that—</text>
<subparagraph id="H03DFD6B6BE5B4B02881778060AD09FE1"><enum>(A)</enum><text>recognizes that racism is both systemic and institutionalized with far-reaching effects on both political engagement and economic opportunities for minorities;</text></subparagraph> <subparagraph id="H0377C1065E62494E8034FD891C714EB5"><enum>(B)</enum><text>empowers local communities through relationship-building and truth-telling; and</text></subparagraph>
<subparagraph id="H57C64C9E14A14DB2B77D772D0BF09C01"><enum>(C)</enum><text>emphasizes restorative justice as an essential component.</text></subparagraph></paragraph> <paragraph id="HCEC514D21E0349F897517F1A60119F72"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Health and Human Services acting through Assistant Secretary for Mental Health and Substance Use.</text></paragraph></section>
<section id="HF693EE2E93894ECCAD40F11EC3CDFF7E"><enum>3.</enum><header>De-escalation training standards</header>
<subsection id="HAFA83C3E7F2D4EAEAB4FA4A4DFD7ACC4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall develop and issue training standards for the de-escalation training to be funded pursuant to section 5.</text></subsection> <subsection id="H42981659FE0B48539C93192D2B73C2F1"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The standards under subsection (a) shall, at a minimum, outline the types of de-escalation training that—</text>
<paragraph id="H61157D5F5D5849AF9A4A8A0139EF4E4B"><enum>(1)</enum><text>have been determined by the Secretary to be effective; and</text></paragraph> <paragraph id="H049AAAFDD5844EDB81805B6536EFFA84"><enum>(2)</enum><text>are eligible to be funded pursuant to section 5.</text></paragraph></subsection>
<subsection id="H548E76B28B7345D3AF06CE2706764DD5"><enum>(c)</enum><header>Process</header>
<paragraph id="H820F3588A0CF4FC1B23FA468D515B863"><enum>(1)</enum><header>Seeking input</header>
<subparagraph id="H0EDDCFB8F71F44809057ECD17C8300C8"><enum>(A)</enum><header>In general</header><text>In developing and issuing standards under this section and any related regulations or guidance, the Secretary shall seek input from community stakeholders, health care and wellness professionals, law enforcement agencies, Tribes, and nonprofit organizations involved in de-escalation at the local level, and others knowledgeable about the need for and importance of de-escalation, including through holding public meetings throughout the Nation and through other media, including webinars.</text></subparagraph> <subparagraph id="H649E2987035B437EA8CB1F59C414F903"><enum>(B)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>community stakeholders</term> includes—</text>
<clause id="H10FA9C914EF94A40AE37B16A7D2E3F1C"><enum>(i)</enum><text>members of minority communities, those with disabilities, persons of color, immigrants, noncitizens, Native Americans, youth, and formerly incarcerated persons; and</text></clause> <clause id="HAEC4AE337F664F8A96F137DBBF7DCC30"><enum>(ii)</enum><text>nonprofit organizations with longstanding experience, in communities with high rates of violence, conducting de-escalation and conflict prevention work targeting the categories of individuals described in clause (i).</text></clause></subparagraph></paragraph>
<paragraph id="H1989B7E8EE944FEDBCE8BD8E3B7F460F"><enum>(2)</enum><header>Negotiated rulemaking</header><text display-inline="yes-display-inline">In developing and issuing standards under this section, the Secretary shall consider the use of negotiated rulemaking.</text></paragraph></subsection></section> <section id="H8B4E29E0510C4FB791AEFB6753BE3CC4"><enum>4.</enum><header>Advisory Board</header> <subsection id="HB8D99713CA164066A633348E1459B408"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">To assist in carrying out this Act, the Secretary shall establish an advisory board to be known as the De-Escalation Advisory Board.</text></subsection>
<subsection id="HB7D47BE752814BEDAADE49E639516488"><enum>(b)</enum><header>Composition</header>
<paragraph id="H004401C816E24EBD9ECC2FBB67A4FE47"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Advisory Board shall be composed of—</text> <subparagraph id="H9CB4D22285D046998111B8AB9CEBBAB5"><enum>(A)</enum><text>up to 25 members appointed by the Secretary in accordance with paragraph (2) (in this subsection referred to as the <quote>appointed members</quote>), who shall be voting members; and</text></subparagraph>
<subparagraph id="H964F7FA0F59E460EBCD4D4F8183003C9"><enum>(B)</enum><text>the ex officio members under paragraph (3), who shall be nonvoting members.</text></subparagraph></paragraph> <paragraph id="HD08E913CAFCC413182EEFFB7B2FB4722"><enum>(2)</enum><header>Appointed members</header> <subparagraph id="H4CDAB2E4EC5F4AD8B5E1AB6ACFB581B9"><enum>(A)</enum><header>Selection</header><text display-inline="yes-display-inline">The appointed members of the Advisory Board shall be appointed (or reappointed, as applicable) by the Secretary after soliciting and reviewing nominations for such appointments from nonprofit organizations, individuals, State and local officials, and others stakeholders.</text></subparagraph>
<subparagraph id="H5CCD244DADC04B13AFD68291A6156BB3"><enum>(B)</enum><header>Representatives</header><text>The appointed members of the Advisory Board shall include representatives of each the following:</text> <clause id="HFE3C6458F84A4A48B2A73F97ABE227E1"><enum>(i)</enum><text>Law enforcement.</text></clause>
<clause id="HE577A2696B3346D3BCA063AA4DB51657"><enum>(ii)</enum><text>Tribes.</text></clause> <clause id="H1F87AD2DD0844A0988D71BB5CF760828"><enum>(iii)</enum><text display-inline="yes-display-inline">Health care and wellness professionals.</text></clause>
<clause id="H00D4A47916404BD59863DA1046CF71DA"><enum>(iv)</enum><text display-inline="yes-display-inline">Disability and behavioral health organizations.</text></clause> <clause id="H103190C9EEE34AAEBB3B0100DDF1C902"><enum>(v)</enum><text display-inline="yes-display-inline">State and local public health agencies.</text></clause>
<clause id="H78003D0F908341B6B133F1F3423AAC32"><enum>(vi)</enum><text>Faith institutions.</text></clause> <clause id="H46C5E698E6AB46C6A50E90BCC2931319"><enum>(vii)</enum><text>Other entities dedicated to encouraging de-escalation and nonviolence and resisting implicit bias and racial reconciliation, with a preference for nonprofit organizations that demonstrate strong experience—</text>
<subclause id="H867832FC14AE45B09D4A083D809CBCE3"><enum>(I)</enum><text>addressing these issues at the local and community level; and</text></subclause> <subclause id="HC78B7A72A2994DF9A159FE4A809D9FBF"><enum>(II)</enum><text>working with the targeted individuals, especially at-risk youth.</text></subclause></clause></subparagraph></paragraph>
<paragraph id="H9133ACD44CDC4430803765C7E3244108"><enum>(3)</enum><header>Ex officio members</header><text>The Advisory Board shall include the following ex officio members:</text> <subparagraph id="H0EABC8F6AD664EE2BC455AF7B01FF6F6"><enum>(A)</enum><text>The Secretary of Health and Human Services (or the Secretary’s designee).</text></subparagraph>
<subparagraph id="HD880913F3CCD42F8A9C9B5C96D6005C0"><enum>(B)</enum><text>The Secretary of Education (or the Secretary’s designee).</text></subparagraph> <subparagraph id="H55AD370EDB5B4547BA73E34D7D188BD2"><enum>(C)</enum><text>The Attorney General of the United States (or the Attorney General’s designee).</text></subparagraph>
<subparagraph id="HB0A0D665782744CB8C3CB8AEABB848AF"><enum>(D)</enum><text>The heads of such other Federal departments and agencies as the Secretary determines appropriate (or their designees).</text></subparagraph></paragraph> <paragraph id="H65A643B24D344558877E7D086688A5B9"><enum>(4)</enum><header>Terms</header> <subparagraph id="HC84341FE5DFC4262A2C5E37B92A8A2E0"><enum>(A)</enum><header>Duration</header><text>The appointed members of the Advisory Board shall each be appointed for a term of 3 years.</text></subparagraph>
<subparagraph id="H07F070F10C7640019730FB3D6DEC49B8"><enum>(B)</enum><header>Initial appointments</header><text display-inline="yes-display-inline">Not later than 4 months after the date of enactment of this Act, the Secretary shall appoint all of the initial appointed members of the Advisory Board.</text></subparagraph></paragraph> <paragraph id="HA4410CF68F904A9090A2D70D50B6682D"><enum>(5)</enum><header>Officers</header><text display-inline="yes-display-inline">At the first meeting of the Advisory Board, and every other year thereafter, the members of the Advisory Board shall elect from among such members a chairperson and vice chairperson of the Advisory Board. Federal officials are not eligible for election as chairperson or vice chairperson.</text></paragraph></subsection>
<subsection id="H4FBF51DE480C4F0899B6BA68A78A6479"><enum>(c)</enum><header>Duties</header><text>The Advisory Board shall—</text> <paragraph id="HFDE11781A2C343B2A2DB7E966C7DCED0"><enum>(1)</enum><text display-inline="yes-display-inline">make recommendations to the Secretary regarding—</text>
<subparagraph id="H99A08309C8E74C3A96E49491F1179DDA"><enum>(A)</enum><text>the training standards under section 3 as may be beneficial to fulfilling the mission and purposes of the grant program under section 5; and</text></subparagraph> <subparagraph id="H315BBD618A5546698ED7F713783A5550"><enum>(B)</enum><text>implementation of the grant program under section 5;</text></subparagraph></paragraph>
<paragraph id="HEBDC41E00598449DB941B9BB542BA43E"><enum>(2)</enum><text>monitor the implementation of such grant program and provide technical assistance and support to grantees under such grant program;</text></paragraph> <paragraph id="HDD50FF7B3FE24395A4A432ADA649E8CB"><enum>(3)</enum><text display-inline="yes-display-inline">determine—</text>
<subparagraph id="H49776B4C50E04D57AB9B2B46DD31D011"><enum>(A)</enum><text>the extent to which such grantees face challenges to implementing such grant program; and</text></subparagraph> <subparagraph id="HFDECAA09B8094C74A75D44457ADFCB17"><enum>(B)</enum><text>the effectiveness of the Department of Health and Human Services in addressing such challenges;</text></subparagraph></paragraph>
<paragraph id="H577F98C6A4614CFBB8CB42E8F0273086"><enum>(4)</enum><text display-inline="yes-display-inline">continually identify new advances and innovative practices in effective ways to conduct de-escalation training to incorporate such advances and innovative practices into the standards under section 3 and implementation of such grant program; and</text></paragraph> <paragraph id="HF42CA7B908F84B47835C77E740FAF6B6"><enum>(5)</enum><text display-inline="yes-display-inline">provide—</text>
<subparagraph id="HC94C8D14ECDB45289CCD13BBD80646E7"><enum>(A)</enum><text>on a biennial basis, reports to the Secretary regarding the Advisory Board’s activities and the effectiveness of such grant program; and</text></subparagraph> <subparagraph id="H2B4F53E40B0B4528BE71880BC1441F47"><enum>(B)</enum><text>not later than 2 years after the award of the first grant under section 5, and every 5 years thereafter, a report to the Congress on the Advisory Board’s activities, challenges to the programs and activities under this Act, and the effectiveness of such programs and activities.</text></subparagraph></paragraph></subsection>
<subsection id="H60DD249E834C414DBA7C914DA87FC239"><enum>(d)</enum><header>Evaluation of HHS proposals</header><text display-inline="yes-display-inline">Not later than 90 days after the Secretary proposes standards under section 3 or rules or guidance for implementing the grant program under section 5, and prior to the Secretary finalizing such standards, rules, and guidance, respectively, the Advisory Board shall evaluate—</text> <paragraph id="H2AA57F23AF0940929D4B3FC8F57F56EE"><enum>(1)</enum><text display-inline="yes-display-inline">whether the training to be funded pursuant to section 5 can be applied practically in everyday scenarios that have the potential for violence that are regularly faced by law enforcement officers, educators, public transit operators including bus drivers, health care and wellness professionals, youth, faith leaders, and other categories of persons for whom such training could help to reduce tensions and avoid conflict;</text></paragraph>
<paragraph id="H6C71A071573D4F2F9189609AA192339A"><enum>(2)</enum><text display-inline="yes-display-inline">whether the principles of such training can effectively work with other types of professional training such as mental health training that employs evidence-based de-escalation techniques;</text></paragraph> <paragraph id="HA25BEDD52FB541418AD446BD2835AD5D"><enum>(3)</enum><text display-inline="yes-display-inline">the extent to which the proposed standards under section 3 adequately address and effectively take into consideration the role of implicit bias, cultural competency, and the intersection of race and policing;</text></paragraph>
<paragraph id="HABD236E33CA54CD69379610876F6C0BB"><enum>(4)</enum><text display-inline="yes-display-inline">whether the standards and guidance under sections 3 and section 5 effectively promote alternatives to the use of lethal and nonlethal force;</text></paragraph> <paragraph id="H8C35CB935C314DB68751D74590EEFF27"><enum>(5)</enum><text display-inline="yes-display-inline">the extent to which Federal training standards and guidelines promote or support de-escalation techniques to help effectively, safely, and respectfully interact with people with disabilities and behavioral health issues;</text></paragraph>
<paragraph id="H84D23B1A65B54F0F949F4642433E4CFF"><enum>(6)</enum><text display-inline="yes-display-inline">whether the proposed standards under section 3 adequately address the need for training in interpersonal communication on de-escalation for those working with at-risk youth, including methods that use time, tone, distance, cover, and concealment to avoid escalation situations;</text></paragraph> <paragraph id="H4198C50AC4714C3C841DC125C1FAEF45"><enum>(7)</enum><text display-inline="yes-display-inline">the time required to properly conduct the training to be funded under section 5 and the methods for delivering such training (either online or in person); and</text></paragraph>
<paragraph id="H06B02D13745249C4B73B9C12462B2ADE"><enum>(8)</enum><text display-inline="yes-display-inline">whether the proposed requirements and standards under section 3 reflect the latest evidence-based de-escalation practices and techniques.</text></paragraph></subsection> <subsection id="H820A830123694141964E92B3C5A5C543"><enum>(e)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary—</text>
<paragraph id="HE39E086F8588475EB570C367BF7425A9"><enum>(1)</enum><text display-inline="yes-display-inline">shall not finalize any standard under section 3 or rule or guidance for implementing the grant program under section 5 before the date that is 30 days after the Secretary receives the recommendations of the Advisory Board on the respective standard, rule, or guidance; and</text></paragraph> <paragraph id="H15955A692374405F9C9441C93452A470"><enum>(2)</enum><text>shall respond to the Advisory Board in writing on each recommendation of the Advisory Board that the Department of Health and Human Resources will not implement and include a detailed explanation of the reasons therefor.</text></paragraph></subsection>
<subsection id="HA63F71ECC2664246AE8AA303701DCD3C"><enum>(f)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out this section, the Advisory Board shall—</text> <paragraph id="H8C150BA6527344CE8FE900DA61370364"><enum>(1)</enum><text>consult with any appropriate Federal departments and agencies; and</text></paragraph>
<paragraph id="H60899E8E7610449EA145E9E98C8DBC5D"><enum>(2)</enum><text>solicit opinions and recommendations from the public and persons with relevant expertise.</text></paragraph></subsection> <subsection id="H22E796724EE84910970F8459D8ABF9F3"><enum>(g)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">On request of the Advisory Board, the head of a Federal department or agency may provide technical assistance to the Advisory Board, but no Federal employee may be detailed to the Advisory Board.</text></subsection>
<subsection id="H7DED4169132842E0AED148848DD023ED"><enum>(h)</enum><header>Pay and reimbursement</header><text display-inline="yes-display-inline">Members of the Advisory Board may not receive pay, allowances, or benefits by reason of their service on the Advisory Board, but members of the Advisory Board shall receive travel expenses, including per diem in lieu of subsistence under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection> <subsection id="H0B06087413554D5DB58CAF3DF0BBABF3"><enum>(i)</enum><header>Federal Advisory Committee Act</header><text display-inline="yes-display-inline">The Advisory Board is deemed to have filed a charter for the purpose of <external-xref legal-doc="usc-act" parsable-cite="usc-act/Federal Advisory Committee Act /9">section 9(c)</external-xref> of the Federal Advisory Committee Act (5 U.S.C. App.). Notwithstanding section 14 of the Federal Advisory Committee Act, the Advisory Board shall continue in effect until terminated by an Act of Congress.</text></subsection>
<subsection id="H31F3F022514D417C9E57524461075CF1"><enum>(j)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Advisory Board shall meet on a regular basis and no less than twice a year to carry out the duties of the Advisory Board under this section.</text></subsection> <subsection id="HD3C36C66C3FC4ABFA3D204D1F5455FEB"><enum>(k)</enum><header>Funding</header><text display-inline="yes-display-inline">Out of the amounts made available to the Secretary each fiscal year for general departmental management, not more than $500,000 are authorized to be used by the Advisory Board to carry out this section.</text></subsection></section>
<section id="H72DCC6F15AD5452185B87113F98183C7"><enum>5.</enum><header>De-escalation grants</header>
<subsection id="HB88BC6FAC6D14994870386702F5E7084"><enum>(a)</enum><header>Grants</header>
<paragraph id="H0B0D721478534387A582E7573E43FDA1"><enum>(1)</enum><header>Training grants</header><text>The Secretary shall award grants to eligible entities to provide training, in accordance with the standards issued under section 3, on de-escalation of violence to enhance community safety.</text></paragraph> <paragraph id="H1CF3CEA0A90F4C9C8B1149B07BD94C2E"><enum>(2)</enum><header>Community outreach, evaluation, and social media grants</header><text display-inline="yes-display-inline">The Secretary shall award grants to eligible entities to support—</text>
<subparagraph id="H660D543673D24457A35CFA502F6735B1"><enum>(A)</enum><text>the dissemination to targeted populations of information about de-escalation training provided through grants under paragraph (1) to encourage such populations to participate in the training;</text></subparagraph> <subparagraph id="HB707CF8706DB443FA5A218A6740068BC"><enum>(B)</enum><text>the development of social media and online training tools to educate the larger public about the methods and goals of such de-escalation training; and</text></subparagraph>
<subparagraph id="HBF6F6F726AD540C59238781CB1C45879"><enum>(C)</enum><text display-inline="yes-display-inline">the conduct of evaluations of the impact and effectiveness of such de-escalation training, include consideration of community stakeholders and those who have received such training.</text></subparagraph></paragraph></subsection> <subsection id="H195A36C5BC564C60A802223F5A3D5669"><enum>(b)</enum><header>Training described</header><text>Training provided through a grant under subsection (a)(1)—</text>
<paragraph id="HCC7DE6AF146946C0BC47E368C7A79076"><enum>(1)</enum><text display-inline="yes-display-inline">shall include training on—</text> <subparagraph id="HCF2E7B022F0A424881B03DF760B1D2AA"><enum>(A)</enum><text>techniques to de-escalate situations to avoid violence;</text></subparagraph>
<subparagraph id="H832F4067CAC847958E8BFA36B22AE5FF"><enum>(B)</enum><text display-inline="yes-display-inline">understanding implicit bias and how it contributes to violence;</text></subparagraph> <subparagraph id="H93416101C592415285BD1EBA1B7B62D1"><enum>(C)</enum><text display-inline="yes-display-inline">understanding how to promote racial reconciliation in communities affected by racial division that leads to violence and conflict;</text></subparagraph>
<subparagraph id="HD0B3431CAA9E49768036A1A7AB2E09DD"><enum>(D)</enum><text display-inline="yes-display-inline">verbal and physical tactics to minimize the need for the use of force, with an emphasis on communication, negotiation, and techniques that help to provide the time needed to resolve the incident safely for everyone;</text></subparagraph> <subparagraph id="H564905464BE8468F90F7366B4649084D"><enum>(E)</enum><text display-inline="yes-display-inline">awareness and recognition of mental health and substance abuse issues and crisis intervention strategies to appropriately identify and respond to individuals suffering from mental health or substance abuse issues, with an emphasis on de-escalation tactics and promoting effective communication with such individuals;</text></subparagraph>
<subparagraph id="H85456D5ECE14481EBD4EE2DC60561FB0"><enum>(F)</enum><text display-inline="yes-display-inline">the critical decision making model and other evidence-based approaches that are found by the Secretary to be appropriate to enhance de-escalation skills and tactics;</text></subparagraph> <subparagraph id="HDB5915ABA70B468FB41CABAE7C455AA3"><enum>(G)</enum><text display-inline="yes-display-inline">techniques that can be used by a wide range of audiences, including those with disabilities and or behavioral health issues; and</text></subparagraph>
<subparagraph id="HCEA56135FBB34E7387FD825221479A2F"><enum>(H)</enum><text display-inline="yes-display-inline">first aid, including mental health first aid techniques and training to identify, understand, and respond to signs of mental illnesses and substance use disorders;</text></subparagraph></paragraph> <paragraph id="HF8A1988AEFAD492A8863FADE294C8875"><enum>(2)</enum><text display-inline="yes-display-inline">shall include scenario-based training that applies evidence-based de-escalation techniques to practical on-the-job scenarios that are regularly faced by law enforcement officers, educators, public transit operators including bus drivers, health care and wellness professionals in emergency rooms, youth in neighborhoods, faith leaders at faith institutions, and other situations that regularly encounter potentially violent situations;</text></paragraph>
<paragraph id="HADB6B2DFB90C46B8A921A1AFC51F20E9"><enum>(3)</enum><text display-inline="yes-display-inline">shall appropriately incorporate cultural competency to reach a range of audiences;</text></paragraph> <paragraph id="H119E577BDA624D2BA63E833B5BB3EF11"><enum>(4)</enum><text display-inline="yes-display-inline">may consist of—</text>
<subparagraph id="HC65DDA0E16D64DEBBA9B50ACBD031B44"><enum>(A)</enum><text>initial training; or</text></subparagraph> <subparagraph id="H7547B7783EB1433AAFA9AAF33C3C7143"><enum>(B)</enum><text>subsequent or periodic training to renew, reinforce, and update knowledge and skills, including updates on new legal requirements and new de-escalation techniques and strategies; and</text></subparagraph></paragraph>
<paragraph id="H428342420C904EC5AB9E818705A347B4"><enum>(5)</enum><text display-inline="yes-display-inline">shall emphasize training for law enforcement officials, teachers and educators, school administrators, school service employees, public transit operators including bus drivers, citizens returning from prison, faith leaders, recreational professionals (such as recreation facility staff and youth sport coaches), health care and wellness professionals, youth, staff of nonprofit organizations dedicated to violence prevention, security guards, ex-gang members, and performing artists.</text></paragraph></subsection> <subsection id="H7EE3C7AAC1D543D19458ABF740DE65A9"><enum>(c)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (a)(1), an entity shall be a State or local government, nonprofit organization, faith institutions, institutions of higher education including community colleges, other schools, professional teacher associations, and small businesses (including minority- and women-owned small businesses).</text></subsection>
<subsection id="HCD113301157D4E629A4210B11B7DC270"><enum>(d)</enum><header>Preference</header><text>In selecting among nonprofit organizations applying for a grant under subsection (a)(1), subject to subsection (e), the Secretary shall give preference to those organizations that—</text> <paragraph id="HD07472269620476FAA2A3E755CB5549A"><enum>(1)</enum><text>interact with youth, including at-risk youth;</text></paragraph>
<paragraph id="H85B3C1D91ABD428FB627F9D25E28E5E4"><enum>(2)</enum><text display-inline="yes-display-inline">have a sound track record of de-escalation work in a local community; or</text></paragraph> <paragraph id="HD461B2D783874296B8F6AB8A20541A53"><enum>(3)</enum><text display-inline="yes-display-inline">employ individuals who reside in the geographic area to be served under the grant or which offices or facilities in that area.</text></paragraph></subsection>
<subsection id="HDA2097962E524AC4893E054258F39AF1"><enum>(e)</enum><header>Equity in distribution</header>
<paragraph id="H0CC1256EABC34064B5AD929731C9C7E7"><enum>(1)</enum><header>In general</header><text>In any fiscal year in which insufficient funds are appropriated to fund a grant under subsection (a)(1) for an eligible entity in each State, the Secretary shall limit the award of grants under subsection (a)(1) to eligible entities in States for which no eligible entity received funds through a grant under subsection (a)(1) for the prior fiscal year.</text></paragraph> <paragraph id="H65E5392DB4974D5EB3DECD36686D777E"><enum>(2)</enum><header>Tribal organizations</header><text>In applying paragraph (1), the Secretary shall not—</text>
<subparagraph id="H50FBFA60C47A47C8990EF59E89A914B6"><enum>(A)</enum><text>consider any grant recipient that is a tribal organization in determining whether grant funds were made available to an eligible entity in any State for the prior fiscal year; or</text></subparagraph> <subparagraph id="H262C25357D364F08BFFD8EEA92128AEA"><enum>(B)</enum><text>limit the award of grants to tribal organizations pursuant to the reservation of funds for grants to tribal organizations under subsection (g)(1).</text></subparagraph></paragraph></subsection>
<subsection id="H944C1CCBD5E448A782220DAEB55C5660"><enum>(f)</enum><header>Duration of grants</header><text display-inline="yes-display-inline">The period of a grant under this section may not exceed 3 years. </text></subsection> <subsection id="HBB99905993A74BE5AB65A315466831F6"><enum>(g)</enum><header>Authorization of appropriations</header> <paragraph id="H1A21C7540B0C412287A518AA99CF8CBA"><enum>(1)</enum><header>Training grants</header><text>For grants under subsection (a)(1), there is authorized to be appropriated $100,000,000 for each of fiscal years 2022 through 2027, of which $10,000,000 for each of such fiscal years shall be for grants under subsection (a)(1) to tribal organizations (as defined in section 4 of the Indian Self-Determination and Education Assistance Act).</text></paragraph>
<paragraph id="H136C6E0B0CA84149BA2B0A963A1423E5"><enum>(2)</enum><header>Community evaluation, and social media grants</header><text display-inline="yes-display-inline">For grants under subsection (a)(2), there is authorized to be appropriated $10,000,000 for each of fiscal years 2022 through 2027.</text></paragraph></subsection></section> <section id="H54BB11F226DB4F5392350D007D6377DF"><enum>6.</enum><header>Reauthorization of mental health first aid training grants</header><text display-inline="no-display-inline">Section 520J(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-41">42 U.S.C. 290bb–41(b)</external-xref>) is amended—</text>
<paragraph id="H382CB08C420548388EB3AADE96581A01"><enum>(1)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">Mental health awareness training grants</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Mental Health First Aid Training Grants</header-in-text></quote>;</text></paragraph> <paragraph id="H9D0886F7AA864FADBF5519BC2E799041"><enum>(2)</enum><text>in paragraph (1)—</text>
<subparagraph id="H55F5AA0D8ED94B4B8DBEEE10DDC7177E"><enum>(A)</enum><text>by inserting <quote>(including training on how to safely de-escalate crisis situations involving such individuals)</quote> after <quote>disorders</quote>; and</text></subparagraph> <subparagraph id="H6375ADF22D2647CEBCE10BD66ECE76B4"><enum>(B)</enum><text>by inserting <quote>(including training on how to safely de-escalate crisis situations involving such individuals)</quote> after <quote>to identify and appropriately respond to persons with a mental illness</quote>;</text></subparagraph></paragraph>
<paragraph id="HA61DB7B384864419B0BD45056CC011EB"><enum>(3)</enum><text>in paragraph (5)(B)—</text> <subparagraph id="H68858377DE424AC4B5C324237039ED77"><enum>(A)</enum><text>in clause (i), by striking <quote>or</quote> at the end;</text></subparagraph>
<subparagraph id="HBDBFDB90B1BD4D2286F8ED12844B45A0"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; or</quote>; </text></subparagraph> <subparagraph id="HB53CB6D6185044D58B47677511E31885"><enum>(C)</enum><text>by adding at the end the following:</text>
