<section id="H5740855EA07D47BD8A2F5B8FC5340D1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Put Our Neighbors to Work Act of 2021</short-title></quote>.</text></section> <section id="H3219E801FBB34E73B9AB75100C191B4D"><enum>2.</enum><header>Supervision of military construction projects</header><text display-inline="no-display-inline">Section 2851 of title 10, United States Code, is amended—</text>
<paragraph id="HF4077DCFD7ED40E6BA760D44A7372B6E"><enum>(1)</enum><text>in subsection (c)(1)—</text> <subparagraph id="HAFD73483156B4BA3A7CC39CDA3FC5239"><enum>(A)</enum><text>by inserting <quote>or appropriated</quote> after <quote>funds authorized</quote> each place such term appears; and</text></subparagraph>
<subparagraph id="H3278FC6BF0E440668DBCE39E8062DB66"><enum>(B)</enum><text>in subparagraph (E), by inserting <quote>, Facilities Sustainment, Restoration, and Modernization (FSRM) project,</quote> after <quote>military construction project</quote>; </text></subparagraph></paragraph> <paragraph id="H64DCEC7A2550453A8F18D42BB5018224"><enum>(2)</enum><text>in subsection (c)(2)—</text>
<subparagraph id="H1E841A88847A4804B1EFB8CB4F800385"><enum>(A)</enum><text>by inserting <quote>, deadline for bid submissions,</quote> after <quote>solicitation date</quote>;</text></subparagraph> <subparagraph id="H853259B474D44D67BBEA8A15AE2A86D3"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>(including the address of such recipient)</quote> after <quote>contract recipient</quote>; and</text></subparagraph>
<subparagraph id="HCBC4F22267B7467F8584D5B171F84D0A"><enum>(C)</enum><text>by adding at the end the following new subparagraphs:</text> <quoted-block style="OLC" id="HFEFF9CD65AA445469EA1C2E667CEBFDD" display-inline="no-display-inline"> <subparagraph id="HEAFF942C8409413EB68961BB6D6DB7B3" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">Any subcontracting plan required under paragraph (4) or (5) of section 8(d) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)</external-xref>) for the project submitted by the contract recipient to the Secretary of Defense.</text></subparagraph>
<subparagraph id="H235F8D8D9D3A44958A27B601E4A1449F" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">A detailed written statement describing and justifying any exception applied or waiver granted under—</text> <clause id="H78DB357159E0459A9825886978C5DD97"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41;</text></clause>
<clause id="HDEE75EF09EA7484D8E20EDC134DE20AD"><enum>(ii)</enum><text>section 2533a of this title; or</text></clause> <clause id="HA9020E62A66B40BB98F30E857388B019"><enum>(iii)</enum><text>section 2533b of this title.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H61AF37B39C8F46EEA35C4E49772DD356"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="H4EF73710895549DDA3245EF50AE47FBF" display-inline="no-display-inline"> <paragraph id="HD179B988CBF34347B4299E48B705B298" indent="up1" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The information required to be published on the Internet website under subsection (c) shall constitute a record for the purposes of Chapter 21, 29, 31, and 33 of title 44.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H176C8784A1D34B5E9D594CC5E1DB9DD6"><enum>3.</enum><header>Requirements relating to the award of covered military construction contracts</header>
<subsection id="HE5617B2FEF334FE19648030936EFF9A7"><enum>(a)</enum><header>Requirements for covered military construction contracts</header>
<paragraph id="H15A2EEE6938A4FE4B0A49C72A9ED83B0"><enum>(1)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/169">chapter 169</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/2851a">section 2851a</external-xref> the following new section:</text> <quoted-block id="H48C2F1F8579442DB85AEB562FBC9CA98" style="USC"> <section id="HD28F8544357B43798BB29004BCADC45F" section-type="subsequent-section"><enum>2851b.</enum><header>Requirements relating to the award of covered military construction contracts</header> <subsection id="H9672C9BEE7B34A0FB0C9B1E21795E7B4"><enum>(a)</enum><header>Publication of certain information relating to covered military construction contracts</header> <paragraph id="H3B3D467104B9424FAD9851A53AD309DA"><enum>(1)</enum><header>Contractor requirements</header><text display-inline="yes-display-inline">A contractor that has been awarded a covered military construction contract shall—</text>
<subparagraph id="H5DF22ABC4107486A83537A4AEB4A951E"><enum>(A)</enum><text display-inline="yes-display-inline">make publicly available on a website of the General Services Administration or the Small Business Administration, as applicable, any solicitation under that covered military construction contract for a subcontract of an estimated value of $250,000 or more; and</text></subparagraph> <subparagraph id="HEA26F447CD6E455190DB26142B8C005F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">submit written notification of the award of the covered military construction contract, and of any subcontract awarded under the covered military construction contract, to the relevant agency of a covered State that enforces workers’ compensation or minimum wage laws in such covered State.</text></subparagraph></paragraph>
<paragraph id="H150A9C861E114D23A3A8D338C0776CF6"><enum>(2)</enum><header>Notice</header><text display-inline="yes-display-inline">Upon award of a covered military construction contract with an estimated value greater than or equal to $2,000,000, the Secretary concerned shall notify any applicable Member of Congress representing the covered State in which that covered military construction contract is to be performed of such award in a timely manner.</text></paragraph> <paragraph id="H856229B00ED34242AEF8A18A6464D379"><enum>(3)</enum><header>Federal Procurement Data System</header><text display-inline="yes-display-inline">The Secretary of Defense shall ensure that there is a clear and unique indication of any covered military construction contract with subcontracting work of an estimated value of $250,000 or more in the Federal Procurement Data System established pursuant to section 1122(a)(4) of title 41 (or any successor system).</text></paragraph></subsection>
<subsection id="HF503A88C317541588447575C9E96BC06"><enum>(b)</enum><header>Local hire requirements</header>
<paragraph id="H51E9CC9F4497447996771C648187C333" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To the extent practicable, in awarding a covered military construction contract, the Secretary concerned shall give preference to those firms and individuals who certify that at least 51 percent of the total number of employees hired to perform the contract (including any employees hired by a subcontractor at any tier) shall reside in the same covered State as, or within a 60-mile radius of, the location of the work to be performed pursuant to the contract. </text></paragraph> <paragraph id="HB39BD72E25434D40A7045B0CE9D6645A"><enum>(2)</enum><header>Justification required</header><text display-inline="yes-display-inline">The Secretary concerned shall prepare a written justification, and make such justification available on the Internet site required under section 2851 of this title, for the award of any covered military construction contract to a firm or individual that is not described under paragraph (1).</text></paragraph></subsection>
<subsection id="HBEC96D1FA86D4848AC735CD00A760276"><enum>(c)</enum><header>Licensing</header><text display-inline="yes-display-inline">A contractor and any subcontractors performing a covered military construction contract shall be licensed to perform the work under such contract in the covered State in which the work will be performed.</text></subsection> <subsection id="H63EB5FDA077945819662A68815B493CC" commented="no"><enum>(d)</enum><header>Monthly report</header><text display-inline="yes-display-inline">Not later than 10 days after the end of each month, the Secretary of Defense shall submit to the congressional defense committees a report identifying for that month the following:</text>
<paragraph id="H1C413D94736349239C1F2708AE00E5EF" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Each covered military construction contract and each subcontract of a covered military construction contract described in subsection (a)(1)(A) awarded during that month.</text></paragraph> <paragraph id="HC46BFFA1432048A48D9F12D9770754D1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The location of the work to be performed pursuant to each covered military construction contract and subcontract identified pursuant to paragraph (1).</text></paragraph>
<paragraph id="HC2EA16F002744E1685092A1523542E44" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">The prime contractor and any subcontractor performing each covered military construction contract and subcontract identified pursuant to paragraph (1).</text></paragraph> <paragraph id="H6257414DB62040138811387E902E8390" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">The estimated value of each covered military construction contract and subcontract identified pursuant to paragraph (1).</text></paragraph></subsection>
<subsection id="H88C6CCD00A7C439F9AE3BC93B9603DFD"><enum>(e)</enum><header>Exclusion of classified projects</header><text display-inline="yes-display-inline">This section does not apply to a classified covered military construction project.</text></subsection> <subsection id="H186E6494D80B44FE821D4471E957664B"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
<paragraph id="H41D0F69826664B36AC289FDF8F84892D"><enum>(1)</enum><header>Covered military construction contract</header><text display-inline="yes-display-inline">The term <term>covered military construction contract</term> means a contract for work on a military construction project, military family housing project, or Facilities Sustainment, Restoration, and Modernization (FSRM) project carried out in a covered State.</text></paragraph> <paragraph id="H30F7CBD1855A40E59C6D9D920B7285F0"><enum>(2)</enum><header>Covered State</header><text>The term <term>covered State</term> means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, or the Commonwealth of the Northern Mariana Islands.</text></paragraph>
<paragraph id="HE26A9D82AC4B40E694FA22D88AA6596E"><enum>(3)</enum><header>Member of Congress</header><text>The term <term>Member of Congress</term> has the meaning given in section 2106 of title 5.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H38EBFCBC74A349CFB5AD024FAC8A26D5"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/169">chapter 169</external-xref> of title 10, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/10/2851a">section 2851a</external-xref> the following new item:</text>

<toc-entry level="section">2851b. Requirements relating to the award of covered military construction contracts.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H3767DDDE3332428E9D4328F9037E629A" commented="no"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Section 2851b of title 10, United States Code, as added by subsection (a), shall apply with respect to a covered military construction contract, as defined in such section, entered into on or after the date of the enactment of this Act.</text></subsection></section> <section id="HA46D11F973F74434ABBA373492B2E92E"><enum>4.</enum><header>Small business credit for local businesses</header><text display-inline="no-display-inline">Section 15 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref>) is amended by adding at the end the following new subsection—</text>

<subsection id="HDAF4F3C97E7D4F6ABFEBD12AF861E9E6"><enum>(y)</enum><header>Small business credit for local businesses</header>
<paragraph id="H8AC64AC9CDC24809B10F2AA1F9EC7363"><enum>(1)</enum><header>Credit for meeting subcontracting goals</header><text display-inline="yes-display-inline">If a prime contractor awards a subcontract (at any tier) to a small business concern that has its principal office located in the same State as, or within a 60-mile radius of, the location of the work to be performed pursuant to the contract of the prime contractor, the value of the subcontract shall be doubled for purposes of determining compliance with the goals for procurement contracts under subsection (g)(1)(A) during such period.</text></paragraph> <paragraph id="HA76D1CC40C4E419389C17926FB193412"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Along with the report required under subsection (h)(1), the head of each Federal agency shall submit to the Administrator, and make publicly available on the scorecard described in section 868(b) of the National Defense Authorization Act for Fiscal Year 2016 (<external-xref legal-doc="public-law" parsable-cite="pl/114/92">Public Law 114–92</external-xref>; 129 Stat. 933; <external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644</external-xref> note), an analysis of the number and dollar amount of subcontracts awarded pursuant to paragraph (1) for each fiscal year of the period described in such paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
