R. 4320</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210701">July 1, 2021</action-date><action-desc><sponsor name-id="K000394">Mr. Kim of New Jersey</sponsor> (for himself, <cosponsor name-id="S001201">Mr. Suozzi</cosponsor>, and <cosponsor name-id="G000597">Mr. Garbarino</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to reduce the base erosion minimum tax rate for taxable years ending in 2020.</official-title></form><legis-body id="H4B2F17A471D7416ABADE0579B3825E56" style="OLC"><section id="HF8AB2535CE824D1DB79A3A5E8DEFEB6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help Our Businesses Recover Act of 2021</short-title></quote>. </text></section><section id="HACF84DAE72C94013A5D5986B5D55DD58"><enum>2.</enum><header>Base erosion minimum tax relief for 2020</header><subsection id="H22EF786ABECB461696B85AA3024F0BD8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/59A">Section 59A(b)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H2C88A4B59D904150A973ACB2425CA59E"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and (3)</quote> and inserting <quote>, (3), and (5)</quote>, and </text></paragraph><paragraph id="H8A7976CACC8840C285F2D56E71A187ED"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H7C7F868F176545559FE1988505B04907" display-inline="no-display-inline"><paragraph id="H0F695FFF9812483E8CDCA56C918C9916"><enum>(5)</enum><header>Modification for taxable years ending in 2020</header><subparagraph id="HC1125BD397E8485583CCB39D5DEC2AF7"><enum>(A)</enum><header>In general</header><text>In the case of any taxable year ending in 2020, paragraph (1) shall be applied by substituting <quote>0 percent</quote> for <quote>10 percent</quote> in subparagraph (A) of such paragraph.</text></subparagraph><subparagraph id="H88DF6F4AF5A5464B9C62F0280BD937F7"><enum>(B)</enum><header>Coordination with section 15</header><text display-inline="yes-display-inline">Section 15 shall not apply to any of the changes in rates of tax by reason of subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE754F12079584426948FB7F07D4E9B39"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2019.</text></subsection></section></legis-body></bill>
