which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Director of the Centers for Disease Control and Prevention to track and report on suicides and other issues among public safety telecommunicators, to require the Federal Emergency Management Agency to award grants to advance public safety telecommunicator health and well-being, and for other purposes.</official-title></form><legis-body id="HCF91C12BF6074512AE92CA6E92D09BD1" style="OLC"><section id="H4781B45E68A24D658761A397BD453B6B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Resources and Occupational Training for Emotional Crisis and Trauma in 911 Act</short-title></quote> or the <quote><short-title>PROTECT 911 Act</short-title></quote>.</text></section><section id="HF247C1D90A8E40639BCAF01E73C0BE58"><enum>2.</enum><header>Data system To capture public safety telecommunicator suicide rates</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 317 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-23">42 U.S.C. 247b–23</external-xref>) the following:</text><quoted-block id="H539D07AA5DED46998426A6AA7A68DD13" style="OLC"><section id="H32180058630A48E291E2F542F97A5995"><enum>317V.</enum><header>Data system To capture public safety telecommunicator suicide rates</header><subsection id="HA306A07FF0E24D12BFC2970E496895C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director, in coordination with the National Highway Traffic Safety Administration and the heads of other Federal agencies as determined appropriate by the Director—</text><paragraph id="H1CECB8B576AE4443ACEDFAB319480CF6"><enum>(1)</enum><text>shall develop and maintain a data system, to be known as the Public Safety Telecommunicator Suicide Reporting System, for the purposes of—</text><subparagraph id="H018AE46F29294FB28C84A9D1ED357F6B"><enum>(A)</enum><text>collecting data on the suicide rate among public safety telecommunicators; and</text></subparagraph><subparagraph id="HB92ABC02FB4846CCA3117BBFDAB5A82A"><enum>(B)</enum><text>facilitating the study of successful interventions to reduce suicide among public safety telecommunicators; and</text></subparagraph></paragraph><paragraph id="HC626DB7FF0EB4175BF08DDBDEF23084D"><enum>(2)</enum><text>may integrate such system with the National Violent Death Reporting System, if such integration is consistent with the purposes specified in paragraph (1).</text></paragraph></subsection><subsection id="H8EC0DB9F6979431CAEDCBE4D0F821434"><enum>(b)</enum><header>Data collection</header><text display-inline="yes-display-inline">In collecting data for the Public Safety Telecommunicator Suicide Reporting System, the Director shall, at a minimum, collect the following information:</text><paragraph id="HEFB87E168B494E819C39AE5826F51D4D"><enum>(1)</enum><text>The total number of suicides in the United States among public safety telecommunicators each calendar year.</text></paragraph><paragraph id="H44700BC86102445AB190877776EE1127"><enum>(2)</enum><text>Suicide rates for public safety telecommunicators each calendar year, disaggregated by—</text><subparagraph id="H827804252A8E4197AB73681501D8C779"><enum>(A)</enum><text>age and gender of the individual;</text></subparagraph><subparagraph id="H9174CEDF79CC4BC09A9892B37A9D4475"><enum>(B)</enum><text>State;</text></subparagraph><subparagraph id="H2AD9E5C01B4848DDA782732F62E99F77"><enum>(C)</enum><text>occupation, including both the individual’s role and their primary occupation in the case of a part-time public safety telecommunicator;</text></subparagraph><subparagraph id="H656C48BE7FBD4CACA1E8BDC8D7B42A50"><enum>(D)</enum><text>the number of public safety telecommunicators employed at the individual’s primary work location;</text></subparagraph><subparagraph id="H831160820D1F4CA39A65C1F927613CE2"><enum>(E)</enum><text>the status of the public safety telecommunicator as hourly, part-time, or full-time;</text></subparagraph><subparagraph id="HA5187B61C93D4D3DBF1EE8D7E3F4DC55"><enum>(F)</enum><text>the status of the public safety telecommunicator as active or retired; and</text></subparagraph><subparagraph id="H7BBA786A0EA142E68A5BE2289E0D77AB"><enum>(G)</enum><text>the method of suicide used.</text></subparagraph></paragraph></subsection><subsection id="H847C4E24126F4C1EA04BEE7299F4C7A8"><enum>(c)</enum><header>Consultation during development</header><text display-inline="yes-display-inline">In developing the Public Safety Telecommunicator Suicide Reporting System, the Director shall consult with Federal and non-Federal experts to determine the best means to collect data regarding suicide rates in a safe, sensitive, anonymous, and effective manner. Such non-Federal experts shall include the following:</text><paragraph id="HF5EF51FCD59D4EDB9D79C9B9D209EF01"><enum>(1)</enum><text>Public health experts with experience in developing and maintaining suicide registries.</text></paragraph><paragraph id="HEA536A2105D54A61A135E3B28024A737"><enum>(2)</enum><text>Organizations that track suicide among public safety telecommunicators or conduct awareness training specialized to public safety telecommunicators.</text></paragraph><paragraph id="H59557F24EC8B4383A7C43BFBCBB2B9BE"><enum>(3)</enum><text>Mental health experts with experience in studying suicide and other profession-related traumatic stress.</text></paragraph><paragraph id="HC86AA90F88574CD4A7DD744D3CA3987B"><enum>(4)</enum><text>Clinicians with experience in diagnosing and treating mental health issues.</text></paragraph><paragraph id="H78715A85B2B44B0C82C1ED8669BB3625"><enum>(5)</enum><text>Current and retired public safety telecommunicators, including those trained to provide mental health or peer support.</text></paragraph><paragraph id="H38AC4AF70B8E4295965660C3C1303C6D"><enum>(6)</enum><text>Relevant public safety telecommunicator organizations.</text></paragraph></subsection><subsection id="H19961967517A490489A70063DD3E1810"><enum>(d)</enum><header>Data privacy and security</header><text display-inline="yes-display-inline">In developing and maintaining the Public Safety Telecommunicator Suicide Reporting System, the Director shall ensure that all applicable Federal and State privacy and security protections are followed to ensure that—</text><paragraph id="H1D2424797AD0492BAE7CA3CDFF3FE6B1"><enum>(1)</enum><text>the confidentiality and anonymity of suicide victims and their families are protected, including so as to ensure that data cannot be used to deny benefits or cause reputational or professional harm; and</text></paragraph><paragraph id="H4C4B702164EE4A91B44D4C8DB4B98054"><enum>(2)</enum><text>data is sufficiently secure to prevent unauthorized access.</text></paragraph></subsection><subsection id="H5557B7EB39D44F3ABCE1123136FFA273"><enum>(e)</enum><header>Best practices</header><paragraph id="HEE0E9C22CEA14E15A835704717BB840F"><enum>(1)</enum><header>In general</header><text>The Director shall—</text><subparagraph id="HFF55CA6A45DE46838FCB9F5FD0E30F91"><enum>(A)</enum><text>develop evidence-based best practices to identify, prevent, and treat posttraumatic stress disorder and co-occurring disorders in public safety telecommunicators; and</text></subparagraph><subparagraph id="HF507BA6243664346BA92320368D28DCE"><enum>(B)</enum><text>periodically reassess and update, as the Director determines necessary, such best practices, including based on the options for interventions to reduce suicide among public safety telecommunicators identified in the annual reports under subsection (f).</text></subparagraph></paragraph><paragraph id="H276C3186CA0448A093ABE0C3C27A3F87" display-inline="no-display-inline"><enum>(2)</enum><header>Consultation</header><text>In developing, reassessing, and updating the best practices under paragraph (1), the Director shall consult with, at a minimum, the following:</text><subparagraph id="H67C18AD00E3447A0A213BAB9C344827B" commented="no"><enum>(A)</enum><text>Public health experts.</text></subparagraph><subparagraph id="HCA96386C14C84A0EBF8BD8DE313E65FA" commented="no"><enum>(B)</enum><text>Mental health experts with experience in studying suicide and other profession-related traumatic stress.</text></subparagraph><subparagraph id="H83814424A3EB4A94AB33E791C9DB72DA" commented="no"><enum>(C)</enum><text>Clinicians with experience in diagnosing and treating mental health issues.</text></subparagraph><subparagraph id="HB1BB95165FEE405D8D6155A6C7864C6D" commented="no"><enum>(D)</enum><text>Relevant national nonprofit associations of public safety telecommunicators.</text></subparagraph></paragraph></subsection><subsection id="HF9CF988345734AACB444E13772069A8F"><enum>(f)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of the <short-title>PROTECT 911 Act</short-title>, and annually thereafter, the Director shall submit a report to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the suicide rate among public safety telecommunicators. Each such report shall—</text><paragraph id="H17F1C23128D14E389738288B8B444C8B"><enum>(1)</enum><text>include such suicide rate;</text></paragraph><paragraph id="HD6ECEFD3F2C94E0BACCA66F5320FBF86"><enum>(2)</enum><text>identify risk factors for suicide among public safety telecommunicators;</text></paragraph><paragraph id="HB94BB23F52B947C9BC3CE633E9C11770"><enum>(3)</enum><text>disaggregate such suicide rate by—</text><subparagraph id="H0470EBCCD6CA48C79823BA50F3553A12"><enum>(A)</enum><text>age and gender;</text></subparagraph><subparagraph id="H1BEDEE39067445E284BBB0700133E1FD"><enum>(B)</enum><text>locality and State;</text></subparagraph><subparagraph id="H71E954E4BA05448E982DDA6F1954FCAA"><enum>(C)</enum><text>occupation, including both the individual’s role and primary occupation in case of a part-time public safety telecommunicator;</text></subparagraph><subparagraph id="HC68B644040234E62BAF8BAC7D9B162D9"><enum>(D)</enum><text>the number of public safety telecommunicators employed at the individual’s location;</text></subparagraph><subparagraph id="H93D49BFED57F4866A64A7448CFCB7A34"><enum>(E)</enum><text>the status of public safety telecommunicator as hourly, part-time or full time; and</text></subparagraph><subparagraph id="HC4641224BB124150AA4433BFCF25F22D"><enum>(F)</enum><text>the status of public safety telecommunicator as active or retired;</text></subparagraph></paragraph><paragraph id="HD9A2997DC6B84C4C8C80580A5766A138"><enum>(4)</enum><text>specify in detail, if found, any obstacles in collecting data;</text></paragraph><paragraph id="H53A9250AACED4DE4915CA6D77C33258F"><enum>(5)</enum><text>identify options for interventions to reduce suicide among public safety telecommunicators;</text></paragraph><paragraph id="HB4A128FCA01F49B2B319D9A8BF7C1278"><enum>(6)</enum><text>differentiate suicide rates based on the adoption of various legacy and new emergency communication technologies;</text></paragraph><paragraph id="H0FE638A579AF441EB0D993BCD40C5DF6"><enum>(7)</enum><text> include the best practices developed and updated pursuant to subsection (e); and</text></paragraph><paragraph id="H0684B517B8404CEDB42C489DA3B61418"><enum>(8)</enum><text>ensure the confidentiality and anonymity of suicide victims and their families, as described in subsection (d)(1).</text></paragraph></subsection><subsection id="HF83FB9399FEC4DFFA505DAB2535DE885"><enum>(g)</enum><header>Prohibited use of information</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if an individual is identified as deceased based on information contained in the Public Safety Telecommunicator Suicide Reporting System, such information may not be used to deny, modify, or rescind life insurance payments or other benefits to a survivor of the deceased individual.</text></subsection><subsection id="H7FE5A630F0414991963BD72E296BBC96"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HC195B4743CAD46B09C4CA368C6EA9015"><enum>(1)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Centers for Disease Control and Prevention.</text></paragraph><paragraph id="H70B865395141468A8F86539C7FD95012"><enum>(2)</enum><header>Emergency communication technologies</header><text>The term <term>emergency communication technologies</term> means any publicly available telecommunications technology used to contact or communicate with an emergency communications center.</text></paragraph><paragraph id="HAF1EF18579504AEFA63130988CE979D7"><enum>(3)</enum><header>Public safety telecommunicator</header><text>The term <term>public safety telecommunicator</term> means a public safety telecommunicator as designated in detailed occupation 43–5031 in the Standard Occupational Classification Manual of the Office of Management and Budget (2018), or any successor designation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1F4E604540C1404A97C86CD34BFADB2A"><enum>3.</enum><header>Grants for behavioral health and wellness programs within emergency communications centers</header><subsection id="H684FB0AB46E2495C96E90CD7B209F9C5"><enum>(a)</enum><header>Homeland Security Grant Programs</header><text>Section 2002(a) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/603">6 U.S.C. 603(a)</external-xref>) is amended to read as follows:</text><quoted-block id="H0D1BAEE148C74F20BD206229B2106AF2" style="OLC"><subsection id="H1EE0F00808484E07B860E33D948E26FE"><enum>(a)</enum><header>Grants authorized</header><text display-inline="yes-display-inline">The Secretary, through the Administrator, and in consultation with the heads of such other Federal agencies as the Administrator determines appropriate, may award grants under sections 2003, 2004, 2009, and 2010 of this title to—</text><paragraph id="HEC775AC156784AA991039293702A94D2"><enum>(1)</enum><text>State, local, and tribal governments; and</text></paragraph><paragraph id="H9347790A2DE14C95BB6E2B38DC17696E"><enum>(2)</enum><text>other eligible entities (as such term is defined in section 2010) through the State in which such other eligible entities are located.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8C5FF351B6A84C67B2C49CAD56ECDD8F"><enum>(b)</enum><header>Behavioral health and wellness</header><text>Title XX of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/601">6 U.S.C. 601 et seq.</external-xref>) is amended by inserting after section 2009 the following:</text><quoted-block id="H7E89C24AB2BA4DDFA742438B70E0A5D2" style="OLC"><section id="H3DBCD8FE9E2940DFA468CD31D2536F2D"><enum>2010.</enum><header>Grants for behavioral health and wellness programs within emergency communications centers</header><subsection id="H9A0D6FC7D82144F89F09FD1B2BC1DCB7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator, and in consultation with the heads of such other Federal agencies as the Administrator determines appropriate, shall award grants to State, local, and multi-local emergency communications centers and other eligible entities, through the State in which such other eligible entities are located, for the purpose of establishing or enhancing behavioral health and wellness programs.</text></subsection><subsection id="H38196061B344468D9041DFF815172B83"><enum>(b)</enum><header>Program description</header><text>A behavioral health and wellness program funded under this section shall—</text><paragraph id="H162BC23C28544D54BC843F9BE42F6E57"><enum>(1)</enum><text>establish evidence-based behavioral health and wellness programs for emergency communications centers to support public safety telecommunicators, including programs dedicated to raising awareness of, preventing, and mitigating job-related mental health issues;</text></paragraph><paragraph id="H2C12FD72E2284C79846E8A8DEBB0D8F5"><enum>(2)</enum><text>establish or enhance peer-support behavioral health and wellness programs;</text></paragraph><paragraph id="HE00609160A12461FBBE330CBB97BD26D"><enum>(3)</enum><text>purchase materials to provide such training; and</text></paragraph><paragraph id="H62E80CEDE4B84DA2A456940ED5D60E63"><enum>(4)</enum><text>disseminate such information and materials as are necessary to carry out the program.</text></paragraph></subsection><subsection id="HEBCE383C69704261B0522B25B097F851"><enum>(c)</enum><header>Development of resources for educating mental health professionals about treating public safety telecommunicators</header><paragraph id="H1472242D48534428A6C41E4E23E1CEEE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall develop and make publicly available resources that may be used by the Federal Government and other entities to educate mental health professionals about—</text><subparagraph id="HEEED45514E5D41B096703DCFC27169E6"><enum>(A)</enum><text display-inline="yes-display-inline">the culture of emergency communications centers;</text></subparagraph><subparagraph id="H6828AA0EEAB2405B871C4416B29304DE"><enum>(B)</enum><text display-inline="yes-display-inline">the different stressors experienced by public safety telecommunicators;</text></subparagraph><subparagraph id="H50AF62A93E1A48C6AF0CDBEEA0380F72"><enum>(C)</enum><text display-inline="yes-display-inline">challenges encountered by retired public safety telecommunicators; and</text></subparagraph><subparagraph id="H49F3CD05600943B4A9BD9B0E73879C9A"><enum>(D)</enum><text display-inline="yes-display-inline">evidence-based therapies for mental health issues common to public safety telecommunicators.</text></subparagraph></paragraph><paragraph id="H91C4CF5F08C346CABCB0AB272C3FC35F"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing resources under paragraph (1), the Administrator shall consult with national nonprofit associations of public safety telecommunicators.</text></paragraph></subsection><subsection id="H4B0948CD742D44059C3B8CFD898E61C5"><enum>(d)</enum><header>Definitions</header><paragraph id="H65E386E71C7444F3A363BAC9C23CD7B2"><enum>(1)</enum><header>Emergency communications center</header><text>The term <term>emergency communications center</term> means a facility that is designated to receive a 9–1–1 request for emergency assistance and perform one or more of the following functions:</text><subparagraph id="H044D1713EBBA4B2C860B51149F6FA328"><enum>(A)</enum><text>Process and analyze 9–1–1 requests for emergency assistance and other gathered information.</text></subparagraph><subparagraph id="HA322A5AB0019419A967BA984E1CFD06A"><enum>(B)</enum><text>Dispatch appropriate emergency response providers.</text></subparagraph><subparagraph id="H9EE3B83616F3486D832CF3B6BD4D75E3"><enum>(C)</enum><text>Transfer or exchange 9–1–1 requests for emergency assistance and other gathered information with other emergency communications centers and emergency response providers.</text></subparagraph><subparagraph id="H32455049AA1B4DE6B551D6871B7CC855"><enum>(D)</enum><text>Analyze any communications received from emergency response providers.</text></subparagraph><subparagraph id="HE7A8AC4F64F5418191C6F73817D05BC2"><enum>(E)</enum><text>Support incident command functions.</text></subparagraph></paragraph><paragraph id="HEE986324FBE945799D9D476C8F041B6C"><enum>(2)</enum><header>Other eligible entity</header><text>The term <term>other eligible entity</term> means a nonprofit organization with expertise and experience with respect to the health and wellness of public safety telecommunicators, including State, local, and multi-local 9–1–1 authorities and State, regional, and national public safety communications associations.</text></paragraph><paragraph id="HF7BA4254CF7B42A3A9BAE9D38D2E6BB8"><enum>(3)</enum><header>Peer-support behavioral health and wellness program</header><text>The term <term>peer-support behavioral health and wellness program</term> means programs that use public safety telecommunicators to serve as peer counselors or provide training to public safety telecommunicators to serve as such peer counselors.</text></paragraph><paragraph id="H4795389FC16647BBA503673D52806D4B"><enum>(4)</enum><header>Public safety telecommunicator</header><text>The term <term>public safety telecommunicator</term> means a public safety telecommunicator as designated in detailed occupation 43–5031 in the Standard Occupational Classification Manual of the Office of Management and Budget (2018), or any successor designation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
