R. 430</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210121">January 21, 2021</action-date><action-desc><sponsor name-id="S001214">Mr. Steube</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Veterans Affairs from denying a veteran benefits administered by the Secretary by reason of the veteran participating in a State-approved marijuana program, and for other purposes.</official-title></form><legis-body id="H057AC25156F94D02BBAD364BBC3E16BF" style="OLC"><section id="HF1F7A8D686D34D0EB23F8DE8CD4F9335" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Cannabis Use for Safe Healing Act</short-title></quote>.</text></section><section id="HBCFA42960E654918A17E84C73428AF95"><enum>2.</enum><header>Veteran participation in State-approved marijuana programs</header><subsection id="HC98167FD4CBE40B7944987AE38546707"><enum>(a)</enum><header>Provision of benefits</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Veterans Affairs may not deny a veteran any benefit under the laws administered by the Secretary by reason of the veteran participating in a State-approved marijuana program.</text></subsection><subsection commented="no" id="HC6E1DCA49A5E474F840CC9E7D3E1C829"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">With respect to a veteran who is enrolled in the system of patient enrollment under section 1705 of title 38, United States Code, and participates in a State-approved marijuana program, the Secretary shall ensure that physicians and other health care providers of the Veterans Health Administration—</text><paragraph commented="no" id="H6B6E75BE6E2541EAB7A8D345EE7B5CD8"><enum>(1)</enum><text>discuss marijuana use with the veteran and adjust medical treatment plans accordingly; and</text></paragraph><paragraph commented="no" id="H842D37FC0A114FB0A8B7A75FE57276DE"><enum>(2)</enum><text display-inline="yes-display-inline">record such use in the medical records of the veteran.</text></paragraph></subsection><subsection commented="no" id="HBD2C7001679F400490DAFC0D7687F141"><enum>(c)</enum><header>Provision of information</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary shall authorize physicians and other health care providers of the Veterans Health Administration of the Department of Veterans Affairs to provide recommendations and opinions to veterans who are residents of States with State-approved marijuana programs regarding the participation of veterans in such programs.</text></subsection><subsection id="HD2B64A7E77DE43339A99B9B7F2BDC5B6"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H515F45515ADC415DA04AFE122B1C88F4"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>marijuana</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>).</text></paragraph><paragraph id="H08ACD7AEA0034C388FFDF80358869712"><enum>(2)</enum><text>The term <term>State</term> has the meaning given that term in section 101 of title 38, United States Code.</text></paragraph></subsection></section></legis-body></bill>
