which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to provide for certain accommodations for breastfeeding in the workplace, and for other purposes.</official-title></form><legis-body id="H2566C6DDB2D74F218997B7749A9C0BBD" style="OLC"><section id="H30FDC315363D40B782CA86C1569C55E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Working Mothers Act</short-title></quote>.</text></section><section id="H71C5F338131B4F5CBC3B881C0AE829E0"><enum>2.</enum><header>Breastfeeding accommodations in the workplace</header><text display-inline="no-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended as follows:</text><paragraph id="HDB9034E7CD0E422B8BDFA81123906E59"><enum>(1)</enum><text>In section 7, by striking subsection (r).</text></paragraph><paragraph id="H8D614AA0936F4367A1567AD690D05CA8"><enum>(2)</enum><text>By inserting after section 18C the following:</text><quoted-block id="H22F865D6B6A14D41835203318193CA1E" style="OLC"><section id="HE1DFAC8165364EDAA3062038EFB2DE8F"><enum>18D.</enum><header>Breastfeeding accommodations in the workplace</header><subsection id="H95F4F5E61B304099B6B09455C6DE6C8F"><enum>(a)</enum><text>An employer shall provide—</text><paragraph id="H9AE10397BEC04105954F28CE89D3008D"><enum>(1)</enum><text>a reasonable break time for an employee to express breast milk for such employee’s nursing child for 1 year after the child’s birth each time such employee has need to express the milk; and</text></paragraph><paragraph id="H51E6F83B7E714391B4CD8D5E1A434C7D"><enum>(2)</enum><text>a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public, which may be used by an employee to express breast milk.</text></paragraph></subsection><subsection id="H4F24AEA6B38B46F4B33E166F759921F3"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HB680D85A67E44561B730B0AD251D38E1"><enum>(1)</enum><text>Subject to paragraph (2), an employer shall not be required to compensate an employee receiving break time under subsection (a)(1) for any time spent during the workday for such purpose.</text></paragraph><paragraph id="H4353E6E60EC848428E78A5C000EEE9B0" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Break time provided under subsection (a)(1) shall be considered hours worked if the employer requires the employee to engage actively in work activities during that time, and then only to the extent of the time spent on such activities.</text></paragraph></subsection><subsection id="H93C172A9721045D1B3D94E7EE97EC472"><enum>(c)</enum><text>An employer that employs less than 50 employees shall not be subject to the requirements of this section, if such requirements would impose an undue hardship by causing the employer significant difficulty or expense when considered in relation to the size, financial resources, nature, or structure of the employer’s business.</text></subsection><subsection id="HFC58926BA6F842E1906A6B8A10BE7F9A"><enum>(d)</enum><text>Nothing in this section shall preempt a State law or municipal ordinance that provides greater protections to employees than the protections provided for under this section.</text></subsection><subsection id="HF261EC2145104FD584CB4EB4465EE3AD"><enum>(e)</enum><text>In the case that an employer receives notice that the employer is not in compliance with subsection (a), the employer shall be deemed not to have violated such subsection if the employer rectifies such violation not later than 30 days after the date on which the employer receives such notice. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H28840564D4094974845FFB810F953344" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">In section 13—</text><subparagraph id="HA1CA01FAB3C04CB0A56704D6A1F5F58C" commented="no"><enum>(A)</enum><text>in subsection (a)—</text><clause id="H003120B2664D4EAB9DB90933E3A9A364"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>of sections 6 (except</quote> and all that follows through <quote>and 7 shall</quote> and insert <quote>of sections 6, 7, and 18D (except sections 6(d) and 18D in the case of paragraph (1) of this subsection) shall</quote>; and</text></clause><clause id="HDD24D4A95BD545C0ABB6D66E2BBAA8A8" commented="no"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>and 7</quote> and inserting <quote>7, and 18D</quote>;</text></clause></subparagraph><subparagraph id="H976D0FC372264515A008184A1B6BC317" commented="no"><enum>(B)</enum><text>in subsection (b), by striking <quote>section 7</quote> and inserting <quote>sections 7 and 18D</quote>;</text></subparagraph><subparagraph id="HD66629B078D84CFEA5B8B025ECCD7207" commented="no"><enum>(C)</enum><text>in subsection (d), by inserting <quote>18D</quote> after <quote>7,</quote>;</text></subparagraph><subparagraph id="H66A430EF104C4F9D97C0D8400673C6B1" commented="no"><enum>(D)</enum><text>in subsection (e), by striking <quote>section 7</quote> and inserting <quote>sections 7 and 18D</quote>;</text></subparagraph><subparagraph id="H68C129A5FFB94DBEABB25C013442F2A9" commented="no"><enum>(E)</enum><text>in subsection (f), by inserting <quote>18D</quote> after <quote>7,</quote>;</text></subparagraph><subparagraph id="HC518CCE17AF243B587A8967421A52032" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">in subsection (h)—</text><clause id="HA9292A6486C848778C72A1DD322EA165" commented="no"><enum>(i)</enum><text> in the matter preceding paragraph (1), by striking <quote>section 7</quote> and inserting <quote>sections 7 and 18D</quote>; and</text></clause><clause id="H8F307D42DC604C19BDDA4984F3A63BE9" commented="no"><enum>(ii)</enum><text>in the matter following paragraph (2), by striking <quote>or section 7</quote> and inserting <quote>, section 7, or section 18D</quote>;</text></clause></subparagraph><subparagraph id="HDFE8DA7A0B8449F3A7C514CFD9F84183" commented="no"><enum>(G)</enum><text>in subsection (i), by striking <quote>section 7</quote> and inserting <quote>sections 7 and 18D</quote>; and</text></subparagraph><subparagraph id="H758D5AC06D3D4E2D82D26337ADF78159" commented="no"><enum>(H)</enum><text display-inline="yes-display-inline">in subsection (j), by striking <quote>section 7</quote> and inserting <quote>sections 7 and 18D</quote>. </text></subparagraph></paragraph><paragraph id="H8F36CB92814E4ABAA8D347594D5ACABA" display-inline="no-display-inline"><enum>(4)</enum><text>In section 15(a)—</text><subparagraph id="HF56758526C9049CFAC6BD93320EDB00D"><enum>(A)</enum><text>by striking the period at the end of paragraph (5) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H80062721969A4E1EA1EAF0F1B9D08FEA"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="HDA7235CC93BC43AFA398C88181EF5D67" style="OLC"><paragraph id="H247C46FD92464A3F9199A176C6D1486E"><enum>(6)</enum><text>to violate any of the provisions of section 18D.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAF64090D0A1049508B014457D0D230F4" display-inline="no-display-inline"><enum>(5)</enum><text>In section 16—</text><subparagraph id="HF2F5AACDEFFC402CB7A408D77C965168"><enum>(A)</enum><text>by striking <quote>section 6 or section 7</quote> in each place it appears and inserting <quote>sections 6, 7, or 18D</quote>;</text></subparagraph><subparagraph id="HA9E1BAD6D952446FA9C9943A1D8117BE"><enum>(B)</enum><text>by striking <quote>6 or 7</quote> in each place it appears and inserting <quote>6, 7, or 18D</quote>; and</text></subparagraph><subparagraph id="H2B86D476E339417F978F09C82819C4CF"><enum>(C)</enum><text>by striking <quote>6 and 7</quote> in each place it appears and inserting <quote>6, 7, and 18D</quote>. </text></subparagraph></paragraph></section><section id="H5EF67E9176024217ACA1943B6284DB48"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made under this Act shall take effect on the date that is 120 days after the date of enactment of this Act.</text></section><section id="H739CA3E87F664A3B9530D414EC9D68AB"><enum>4.</enum><header>GAO report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment, the Government Accountability Office shall issue a report to Congress evaluating the implementation and expansion of workplace accommodations for nursing mothers under this Act, with a focus on assessing—</text><paragraph id="H7F1E441DB2B24B828C0CAB79C61964D9"><enum>(1)</enum><text>the number of working mothers, both before and after the Act’s implementation, with access to nursing accommodations;</text></paragraph><paragraph id="H262E929B7F8E435C9C2BB7EDC6F73AEB"><enum>(2)</enum><text>the types of nursing accommodations covered employers have implemented;</text></paragraph><paragraph id="H50A3BD8AC1C542A4B3F407D14A3D080C"><enum>(3)</enum><text>the factors employers consider when making decisions on the expansion of nursing accommodations and the industries that face the most significant challenges in providing them; and</text></paragraph><paragraph id="H711FC67661734ECA9CA24CAB14D1AA25"><enum>(4)</enum><text>actions taken by the Secretary of Labor to enforce the provisions of this Act.</text></paragraph></section></legis-body></bill>
