which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To extend the protections of the Fair Housing Act to persons suffering discrimination on the basis of sex or sexual orientation, and for other purposes.</official-title></form><legis-body id="HB776F502A84146A6983CFE9B1ECF6574" style="OLC"><section id="HE1A81B20F83F4710B5FB214AE344AA09" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair and Equal Housing Act of 2021</short-title></quote>.</text></section><section id="H9175DC07A7A942C79F01F5865920A080"><enum>2.</enum><header>Housing</header><subsection id="H82CF4ECA5FF8440EA0242E96F93E9FAD"><enum>(a)</enum><header>Fair Housing Act</header><text display-inline="yes-display-inline">The Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>) is amended—</text><paragraph id="HF480EB5CF7964A8C9FF579F614C02B8D"><enum>(1)</enum><text>in section 802, by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H8778E1D1A22C446DA9440865DCFFD6AD" style="OLC"><subsection id="H38436EF3C2184C75B2574189BCC4AA0E"><enum>(p)</enum><text display-inline="yes-display-inline"><term>Race</term>, <term>color</term>, <term>religion</term>, <term>sex</term> (including sexual orientation and gender identity), <term>handicap</term>, <term>familial status</term>, or <term>national origin</term>, used with respect to an individual, includes—</text><paragraph id="HD58E7FEC406B47419027FEAC3F8F3909"><enum>(1)</enum><text display-inline="yes-display-inline">the race, color, religion, sex (including sexual orientation and gender identity), handicap, familial status, or national origin, respectively, of another person with whom the individual is associated or has been associated; and</text></paragraph><paragraph id="HEE69E88FDAA444DD8307E2463268217F"><enum>(2)</enum><text display-inline="yes-display-inline">a perception or belief, even if inaccurate, concerning the race, color, religion, sex (including sexual orientation and gender identity), handicap, familial status, or national origin, respectively, of the individual.</text></paragraph></subsection><subsection id="H04C3CF2BED0C4BF19E2BC6F20769AE30"><enum>(q)</enum><text display-inline="yes-display-inline"><term>Gender identity</term> means the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual, without regard to the individual’s designated sex at birth.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC1149D1A5F9B4B06ABAEBA786BAAEF3A"><enum>(r)</enum><text><term>Sexual orientation</term> means homosexuality, heterosexuality, or bisexuality.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H53B2B1848CEC4690A6958D6B104FB4C3"><enum>(2)</enum><text>in section 804, by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote> each place that term appears;</text></paragraph><paragraph id="H5A7E1A961B3B490A997CF2EA41AEABA6"><enum>(3)</enum><text display-inline="yes-display-inline">in section 805, by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote> each place that term appears;</text></paragraph><paragraph id="HC16A2EBBD94C4F1696319FFC092B1B84"><enum>(4)</enum><text display-inline="yes-display-inline">in section 806, by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote> each place that term appears; and</text></paragraph><paragraph id="HF49E0B25CCE64D0D8D9313EA7C7C722F"><enum>(5)</enum><text display-inline="yes-display-inline">in section 808(e)(6), by inserting <quote>(including sexual orientation and gender identity)</quote> after <quote>sex</quote>.</text></paragraph></subsection><subsection id="HF9266C6970A749CAB3FD28CC3AC2328C"><enum>(b)</enum><header>Prevention of intimidation in fair housing cases</header><text>Section 901 of the Civil Rights Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>) is amended by inserting <quote>(including sexual orientation (as such term is defined in section 802 of this Act) and gender identity (as such term is defined in section 802 of this Act))</quote> after <quote>sex</quote> each place that term appears.</text></subsection></section></legis-body></bill>
