Russell National School Lunch Act to establish the Food and Nutrition Education in Schools Pilot Program, and for other purposes.</official-title></form><legis-body id="H02641CA6CE96437E8CD215CEBD27CB65" style="OLC"><section id="HA3A660186A2242B083D118E10540A0FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food and Nutrition Education in Schools Act of 2021</short-title></quote>.</text></section><section id="HBF81B47914714A869E522D797BE92C8F"><enum>2.</enum><header>Food and nutrition education in schools pilot program</header><text display-inline="no-display-inline">Section 18 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HB12A8D1E34EA4113901F20FA3B1AEFCC" style="OLC"><subsection id="HCDDC01E314404B118C181D63AF1F8268"><enum>(l)</enum><header>Food and nutrition education in schools pilot program</header><paragraph id="H8C332366F066470AA0FEA03C91905E6B"><enum>(1)</enum><header>Purpose</header><text>The purpose of this subsection is to provide local educational agencies with personnel dedicated to implementing integrated, hands-on food and nutrition education in schools with the goal of increasing acceptance and consumption of healthy, high-quality meals and snacks by students.</text></paragraph><paragraph id="H94A5CC60565B44B69EA38F35C113B75A"><enum>(2)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this subsection, the Secretary shall establish a pilot program, to be known as the <quote>Food and Nutrition Education in Schools Pilot Program</quote> (referred to in this subsection as the <quote>pilot program</quote>), under which the Secretary shall award grants to local educational agencies for—</text><subparagraph id="HBCED57AF5B4A44528699CB5640C33FBC"><enum>(A)</enum><text>projects that hire qualified, full-time food and nutrition educators to carry out programs in schools that have the goal of improving student health and nutrition; and</text></subparagraph><subparagraph id="H89E7A986668343BE9782B7FEEEE7E1E2"><enum>(B)</enum><text>projects that fund school gardens or other evidence-based interventions relating to student health and nutrition, aligned with the latest school nutrition standards, to create hands-on learning opportunities for students.</text></subparagraph></paragraph><paragraph id="HC38F01E1DAB84495AA589119D64B8D2E"><enum>(3)</enum><header>Joint partnerships</header><text>The Secretary shall encourage, to the maximum extent practicable, joint partnership projects under the pilot program among—</text><subparagraph id="H4C78BCA089F44C07A823E74F8B2DE162"><enum>(A)</enum><text>local educational agencies;</text></subparagraph><subparagraph id="HE01D8ACC0AB34136B017183DDB75B7E3"><enum>(B)</enum><text>nonprofit organizations, including out-of-school-time youth development providers;</text></subparagraph><subparagraph id="HF260CD6874464837B3CC4C16AD02478C"><enum>(C)</enum><text>postsecondary institutions that offer programs on nutrition, food preparation, or agricultural science;</text></subparagraph><subparagraph id="HC3F4C88B8D33441CA025CB1903E702FA"><enum>(D)</enum><text>food-service businesses (such as local farms, restaurants, and food distributors);</text></subparagraph><subparagraph id="H6D5DF04D95D5451091564AAA9160A243"><enum>(E)</enum><text>beginning farmers and ranchers (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>));</text></subparagraph><subparagraph id="HBB47D57001DD4CF28DC266FAAA12438F"><enum>(F)</enum><text>veteran farmers and ranchers (as defined in that section);</text></subparagraph><subparagraph id="HFFB28315150F457486AF99F2A119909D"><enum>(G)</enum><text>socially disadvantaged farmers or ranchers (as defined in section 355(e) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2003">7 U.S.C. 2003(e)</external-xref>)); and</text></subparagraph><subparagraph id="HE7F8B09854AE4646A03587C941BED474"><enum>(H)</enum><text>State and local government agencies.</text></subparagraph></paragraph><paragraph id="H380798EC46A84176B91138C59E1F1D74"><enum>(4)</enum><header>Coordination</header><text>In establishing the pilot program, the Secretary shall consult and ensure coordination with the heads of other appropriate Federal agencies and programs that deliver nutrition education.</text></paragraph><paragraph id="HDC8C10045B7845C19A9E77A0002AAB7D"><enum>(5)</enum><header>Project proposals</header><subparagraph id="H41E791DD3C4E4455A9003E66B3A464D4"><enum>(A)</enum><header>In general</header><text>The Secretary shall annually solicit from local educational agencies the submission of project proposals for grants under the pilot program.</text></subparagraph><subparagraph id="H2211449C50BA4381AB14DF9902C1CC03"><enum>(B)</enum><header>Required elements for project proposal</header><text>A project proposal submitted under subparagraph (A) shall include—</text><clause id="HF0CB139F622F4A8886B921EAAEB4AAA0"><enum>(i)</enum><text>a statement of the purposes of the project;</text></clause><clause id="HC8010A3E331B4D689E577DF9BD9B70F6"><enum>(ii)</enum><text>a description of—</text><subclause id="HE1B677FB03524816AF29CF2145B420D4"><enum>(I)</enum><text>the entity or individual with overall responsibility for the project;</text></subclause><subclause id="HA680431CB33E43E2B6AD7C60F04CB0C9"><enum>(II)</enum><text>the qualifications of that entity or individual;</text></subclause><subclause id="H2573A0530E994F5791D3B3A0CD327DCC"><enum>(III)</enum><text>community stakeholder engagement for the project;</text></subclause><subclause id="H89F0DDFCB4E0406D96F7F0F9D5D25E3A"><enum>(IV)</enum><text>the logistics of the project; and</text></subclause><subclause id="HDE1347E2CB9648EB9C05E1A35E48CC5E"><enum>(V)</enum><text>the methods to be used to evaluate student learning, such as through a project, presentation, or other form of assessment;</text></subclause></clause><clause id="H1D7E4723AF374C61B5A5D4BD13F90220"><enum>(iii)</enum><text>a proposed budget for the funds and time required to carry out the project;</text></clause><clause id="H3EB273F48059496A955850F6ADEC18D4"><enum>(iv)</enum><text>information regarding the source and amount of any matching funding available for the project;</text></clause><clause id="H7F26439F37A24E15B7AF0A093DEADE39"><enum>(v)</enum><text>an implementation plan, including efforts by the school food authority associated with the local educational agency to integrate activities carried out under the project with other efforts by schools to promote student health and nutrition;</text></clause><clause id="H4769EFF244704FAAADEA82D9D378E061"><enum>(vi)</enum><text>information that demonstrates the clear potential of the project to contribute to implementing integrated, hands-on food and nutrition education in schools, aligned with the latest school nutrition standards, with the goal of increasing acceptance and consumption of healthy, high-quality meals and snacks;</text></clause><clause id="HD3DD962D12094168807F635BFA34B5F0"><enum>(vii)</enum><text>a description of a mechanism that will be used to broadly share project results and implementation strategies; and</text></clause><clause id="HD2336B875BA245E48D8D2D9F35AE4749"><enum>(viii)</enum><text>any other information that the Secretary considers necessary.</text></clause></subparagraph><subparagraph id="H13DD7014419A4E5BA30B1FBD97CA3BE1"><enum>(C)</enum><header>Criteria for approval</header><text>The Secretary may award a grant for a project proposal submitted under subparagraph (A) if the project—</text><clause id="H1296792CF92B48B69D8212FCC1C89D09"><enum>(i)</enum><text>incorporates evidence-based practices proven to increase healthy food consumption by students;</text></clause><clause id="H658A0B8266EC4FF49A5C28FAAE66A383"><enum>(ii)</enum><text>includes hands-on, experiential learning;</text></clause><clause id="HCC8867DB36CE4D3481C12645F6443E93"><enum>(iii)</enum><text>implements school gardens, taste tests, student engagement, or other farm-to-school practices;</text></clause><clause id="H02C1CBE35D70466692C4AB9250182209"><enum>(iv)</enum><text>demonstrates the commitment of the local educational agency—</text><subclause id="HBC8385015AA34057ACF64C3D67034D80"><enum>(I)</enum><text>to improving the nutritional value of school meals;</text></subclause><subclause id="H8605D9C615084989BD8E8DA16622C0D0"><enum>(II)</enum><text>to carrying out innovative programs that improve the health and wellness of schoolchildren, such as farm-to-school programs; and</text></subclause><subclause id="HD459908A5CB54B50B7F7731514BFE25B"><enum>(III)</enum><text>to accounting for the culture, input, and needs of the community;</text></subclause></clause><clause id="H6B66DB0EC05A442D9B533316308BEF5A"><enum>(v)</enum><text>provides for project oversight by a qualified nutrition professional; and</text></clause><clause id="H5B7BFBE24E98482594FD84DAECC996A1"><enum>(vi)</enum><text>meets any other requirement established by the Secretary.</text></clause></subparagraph><subparagraph id="HCCF4658B7B2B4F38A22A043E4AA85B98"><enum>(D)</enum><header>Priority</header><text>To the maximum extent practicable, in awarding grants under the pilot program, the Secretary shall give priority to projects that—</text><clause id="H502BB83F9A154F848AD9B55CAD866AD5"><enum>(i)</enum><text>serve schools or districts—</text><subclause id="HC946A0CD4FC84CA896A748F05162D77E"><enum>(I)</enum><text>in which not less than 40 percent of students qualify for free or reduced-price meals under this Act or the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>); or</text></subclause><subclause id="HE8BA7D7B860C42589B4A4EFC75601967"><enum>(II)</enum><text>that include neighborhoods with high rates of childhood obesity or other diet-related diseases;</text></subclause></clause><clause id="HDE746F00D19644D181ABEA9280F3A99E"><enum>(ii)</enum><text>provide programming in summer months; and</text></clause><clause id="HE809018CE93143809ACCA627FAE21272"><enum>(iii)</enum><text>are joint partnership projects as described in paragraph (3).</text></clause></subparagraph></paragraph><paragraph id="H0A7F2B587EBE4780B2B3AD00AF5B37E7"><enum>(6)</enum><header>Administration</header><subparagraph id="H48962DBEACDF4CE79B05423DD9D76F82"><enum>(A)</enum><header>Diversity</header><text>In awarding grants under the pilot program, the Secretary shall ensure that projects are located in diverse demographic, geographic, rural, urban, and suburban settings.</text></subparagraph><subparagraph id="HD7C13A1C749B4C9494492AAF1088C69F"><enum>(B)</enum><header>Indian tribes</header><text>The Secretary shall ensure that not fewer than 1 project receiving a grant under the pilot program—</text><clause id="HA10A24114BC04ECF86EB29EE1A9F76B5"><enum>(i)</enum><text>is located on an Indian reservation; or</text></clause><clause id="H82471110BC3345B2A7B078DF9942311D"><enum>(ii)</enum><text>serves a school in which the majority of the students are members of an Indian tribe.</text></clause></subparagraph></paragraph><paragraph id="H4FF7EF30D69D4FB19F334E360BDFC3FC"><enum>(7)</enum><header>Reports</header><subparagraph id="H4C46CE1143F94E589BD3792932800475"><enum>(A)</enum><header>Reports to secretary</header><clause id="HC3660FDC11F14E85A2BAF6F2785EBA38"><enum>(i)</enum><header>In general</header><text>A local educational agency that receives a grant under the pilot program shall periodically submit to the Secretary a report that includes any information that the Secretary determines is necessary to evaluate the progress and success of the project, including evidence of student learning under the project, to ensure positive results, assess problems, and foster improvements.</text></clause><clause id="H0622382E24DA4083A3B2FDBD833BC98B"><enum>(ii)</enum><header>Availability to the public</header><text>Reports under clause (i), and any other documents of the local educational agency relating to a project carried out using a grant awarded under the pilot program, shall be made available electronically to the public in a timely manner.</text></clause></subparagraph><subparagraph id="H4490035561DA43DA8618B493DE8D2FB3"><enum>(B)</enum><header>Reports to congress</header><text>Not later than 5 years after the date of enactment of this subsection, and annually thereafter, the Secretary shall submit to Congress a report that includes—</text><clause id="H45DE22AD27F2481A908C71EE26A70C8C"><enum>(i)</enum><text>a description of the results and effectiveness of each project carried out under the pilot program;</text></clause><clause id="H69E2CCD6FE084CB4BDCCDA7991593308"><enum>(ii)</enum><text>an examination of the impact of each project on—</text><subclause id="H878BEFF27C8E4246BBEB5DC230884023"><enum>(I)</enum><text>student diet and dietary practices;</text></subclause><subclause id="HB21371C1BC8743808100427B26054A3E"><enum>(II)</enum><text>student performance and behavior;</text></subclause><subclause id="H9287E65DA0BF4161A9F53DEC75A47C05"><enum>(III)</enum><text>food consumption;</text></subclause><subclause id="H34AED98746AE4FC78CA08C6CE895D5A6"><enum>(IV)</enum><text>changes in cafeterias and the school food environment;</text></subclause><subclause id="H61633D39428E40C6A6635EB12F31FA62"><enum>(V)</enum><text>school meal participation by students; and</text></subclause><subclause id="HCFA5780A6902426DA6323AB42B07FEF2"><enum>(VI)</enum><text>other indicators as determined by the Secretary;</text></subclause></clause><clause id="H4577C1BEA6564AF2878877C7E8ABEC5B"><enum>(iii)</enum><text>demographic data on the schools and communities served by the pilot program;</text></clause><clause id="HEC98852468334718844A1729E3F0E507"><enum>(iv)</enum><text>a summary of the activities conducted by each local educational agency after receiving a grant under the pilot program and the number of children served by that local educational agency; and</text></clause><clause id="HF5DAC922BEF14D8C9A40A3895BE46270"><enum>(v)</enum><text>recommendations on how the pilot program may be improved and whether funding for the pilot program should be continued.</text></clause></subparagraph></paragraph><paragraph id="H55566282EB5F459D9B0E7A370FC2716C"><enum>(8)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this subsection $10,000,000 for each of fiscal years 2021 through 2025.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
