R. 4278</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210630">June 30, 2021</action-date><action-desc><sponsor name-id="M001210">Mr. Murphy of North Carolina</sponsor> (for himself and <cosponsor name-id="H001086">Mrs. Harshbarger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Comptroller General of the United States to conduct a study on how direct-to-consumer pharmaceutical advertising negatively impacts drug costs to consumers, and for other purposes.</official-title></form><legis-body id="HDC2EBE4565484B3DA65DE1C341C6CFF9" style="OLC"><section id="H862F5B7E2641485AB7427B19A1C95107" section-type="section-one"><enum>1.</enum><header>GAO study on how direct-to-consumer pharmaceutical advertising negatively impacts drug costs to consumers</header><subsection id="HC4FC536CBDB24EA598AD684BD6DAF5C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall conduct a study on how direct-to-consumer pharmaceutical advertising negatively impacts drug costs to consumers. Such study shall focus on—</text><paragraph id="H44A397A2329F4200AD8F893FC5541175"><enum>(1)</enum><text display-inline="yes-display-inline">what steps may be taken by pharmaceutical drug manufacturers and distributors to reduce the higher drug costs paid by consumers as a result of such advertising by splitting the cost of advertising between each organization developing a particular drug; <italic></italic></text></paragraph><paragraph id="H5A79E768720A4D888AC62AEB3594F8EB"><enum>(2)</enum><text display-inline="yes-display-inline">the expectations of consumers and patients with respect to the drugs so advertised; and</text></paragraph><paragraph id="HCDE4618125B24B3284C2451A749E4296"><enum>(3)</enum><text>the role such advertisements play in promoting medication to patients for whom such medication may not be necessary. <italic></italic></text></paragraph></subsection><subsection id="HF1E0E99FF45A45E2998CF4AEAC40C219"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Comptroller General shall—</text><paragraph id="H2805249736354977B69775A23962B63A"><enum>(1)</enum><text>submit a report containing the results of the study to—</text><subparagraph id="HA7034259AA8D4FF7A96F4F75943D04FD"><enum>(A)</enum><text>the Committee on the Judiciary and the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="H8C066BE87EFF4ECAA4E4D325776D55A4"><enum>(B)</enum><text>the Committee on the Judiciary and the Committee on Health, Education, Labor, and Pensions of the Senate; and</text></subparagraph></paragraph><paragraph id="H2F3066CE01D648B9B60906FF5022DF4B"><enum>(2)</enum><text display-inline="yes-display-inline">make such report publicly available. </text></paragraph></subsection></section></legis-body></bill>
