which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committees on <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, <committee-name committee-id="HBU00">the Budget</committee-name>, and <committee-name committee-id="HRU00">Rules</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent energy poverty in at-risk communities, and for other purposes.</official-title></form><legis-body id="H24F121733AA04FC3AA0AAC3009D6428F" style="OLC"><section id="H63183E3B54BE4FB3AE95FD5842B6F923" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Energy Poverty Prevention and Accountability Act</short-title></quote>.</text></section><section id="H6DEC8451CEEA467ABA3DF2A1430C62DD"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States that—</text><paragraph id="HD5C0A647841D4B9AA006C2643D581819"><enum>(1)</enum><text display-inline="yes-display-inline">all citizens should have equal access to affordable and reliable energy to maintain personal health and economic security;</text></paragraph><paragraph id="HFF7F3692B1EE4B7C8246C16307CDF682"><enum>(2)</enum><text display-inline="yes-display-inline">the United States should mitigate the disparate impact of increases in the cost of energy on at-risk communities because such communities are more likely to have a fixed income and spend a higher percentage of their income on energy than the general population; and</text></paragraph><paragraph id="H556D9191C0924835A2AC929274AEDD21"><enum>(3)</enum><text display-inline="yes-display-inline">to prevent energy poverty and to ensure that each at-risk community has access to affordable energy, the United States should ensure that laws relating to environmental and energy policy, including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), and the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703 et seq.</external-xref>), do not have the effect of increasing the cost of energy for any at-risk community.</text></paragraph></section><section id="H9A4C99D446CF4714BA39B41BB4B7993B"><enum>3.</enum><header>Department of the Interior report on access to reliable and affordable energy</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary of the Interior shall submit to Congress a report that—</text><paragraph id="H591B6D45E31049CBA378D91007176E81"><enum>(1)</enum><text display-inline="yes-display-inline">identifies barriers to the ability of at-risk communities that live on or near Federal land or Tribal land to access reliable and affordable energy, including how the presence of adequate energy transmission infrastructure affects such access; and</text></paragraph><paragraph id="H8437821DAE0D401CABB57BF823EFFC04"><enum>(2)</enum><text>recommends actions that the Secretary of the Interior and the Chief of the Forest Service could take to reduce the barriers described in paragraph (1), including by—</text><subparagraph id="HAA59015E7D3B4C0B9342B3B5BC7FAE49"><enum>(A)</enum><text>establishing lower fees or lowering other costs;</text></subparagraph><subparagraph id="H26918CEF2AF940898BF172FDB1A43F1D"><enum>(B)</enum><text>streamlining the approval of rights-of-way on Federal land and Tribal land;</text></subparagraph><subparagraph id="HECCBA1BC95EE42A6A052BB1347AC9FA6"><enum>(C)</enum><text display-inline="yes-display-inline">encouraging private energy sector investment in Federal land and Tribal land; and</text></subparagraph><subparagraph id="HEE06ECBE939A4F1F8D608D849E61B6E2"><enum>(D)</enum><text>rapidly developing electric transmission and delivery systems in remote areas.</text></subparagraph></paragraph></section><section id="H82CB22E06C924A0FB1B482B5297D6AF1"><enum>4.</enum><header>Congressional Budget Office estimates for effects on energy prices</header><text display-inline="no-display-inline">The Director of the Congressional Budget Office shall include in each applicable estimate required under section 402 of the Congressional Budget and Impoundment Control Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/653">2 U.S.C. 653</external-xref>) an estimate of how the bill or resolution will affect the cost of energy for at-risk communities.</text></section><section id="H0C1E4F680A62489D88C154CDC628DAAA"><enum>5.</enum><header>Government Accountability Office identification of energy poverty</header><subsection id="HBFC0AEC6090240958B8BD6DDBF04D43D" commented="no"><enum>(a)</enum><header>Analysis</header><paragraph id="HCA9D9FEE60AE48DB978BD3FDF06CE4FA" commented="no"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall conduct an analysis of Federal energy and environmental laws, regulations issued by the Secretary of the Interior and the Chief of the Forest Service that relate to energy and environmental policy, and State renewable portfolio standards to determine how such laws, regulations, and standards affected the following for at-risk communities during the preceding fiscal year:</text><subparagraph id="H1ABDFB4C83594446AA34E653E35C3882" commented="no"><enum>(A)</enum><text>Electricity prices.</text></subparagraph><subparagraph id="HAEC93EC5C7534466AA5A1834AD78BDC9" commented="no"><enum>(B)</enum><text>Home heating prices.</text></subparagraph><subparagraph id="H6D71D60F5ABE4C17A1C151EDA969F7B8" commented="no"><enum>(C)</enum><text>Gasoline prices.</text></subparagraph><subparagraph id="H1D4284A9DD8B4B969FB7282E136A39E3" commented="no"><enum>(D)</enum><text>Motor vehicle prices.</text></subparagraph><subparagraph id="HF9FD6D9651F5430598156178F6D8356A" commented="no"><enum>(E)</enum><text>Natural gas prices.</text></subparagraph><subparagraph id="H04529EE78C4F473AACFE6D0F8EF1577B" commented="no"><enum>(F)</enum><text>Household appliance prices.</text></subparagraph></paragraph><paragraph id="H78E9E380BA39466C84646D1074B33874" commented="no"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Comptroller General of the United States shall submit to Congress a report on the analysis conducted under paragraph (1).</text></paragraph></subsection><subsection id="HF1F763FDB71E476C84169CFA22011816"><enum>(b)</enum><header>Energy poverty</header><paragraph id="H8A0139E2BEAB423FAF2DBE41944B82F6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall develop criteria to determine whether an at-risk community is experiencing energy poverty.</text></paragraph><paragraph id="HDB45606AA25647CA92CAE8AA89AECC6E"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Comptroller General of the United States shall submit to Congress a report that—</text><subparagraph id="H7B2585DC3C3349699C62915A4E921E86"><enum>(A)</enum><text>identifies, by location and type of at-risk community, which at-risk communities are experiencing energy poverty; and</text></subparagraph><subparagraph id="HC249F6D0B2C94413B1C7A36E36AFA091"><enum>(B)</enum><text>provides recommendations on how to reduce such energy poverty.</text></subparagraph></paragraph></subsection></section><section id="H44770FD7FF89443AA0D43C92272E2E1C"><enum>6.</enum><header>Office of Management and Budget review of energy regulations</header><subsection id="H12B4EBE71595496BBD567F59E2344AD0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall review each applicable energy regulation to determine if any applicable energy regulation imposes, relative to the general population, disproportionate costs on at-risk communities.</text></subsection><subsection id="H8EDFD41A288A4BEE9A8DA1C08977B7A8" commented="no"><enum>(b)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Director of the Office of Management and Budget shall publish in the Federal Register the results of the review required under subsection (a).</text></subsection></section><section id="H40A7537A810041CBA81CA3F2B1508223" commented="no"><enum>7.</enum><header>Energy poverty study required for certain Executive action</header><subsection id="HF3B0663850BA4CAF8BFABE54F5A0FD06" commented="no"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the President or a designee of the President may only carry out an activity described in subsection (b) if the Secretary of the Interior has fulfilled the requirements described in subsection (c) with respect to such activity.</text></subsection><subsection id="H05B4B889722742B492AA83EFC5F1912D"><enum>(b)</enum><header>Activities</header><text>An activity, as referred to in subsection (a), is one or more of the following: </text><paragraph id="H9781372D71A2411DB7601FA34B957549" commented="no"><enum>(1)</enum><text>Declaration of a moratorium on the leasing of Federal lands for the drilling, mining, or collection of oil, gas, or coal, or related activities unless such moratorium is authorized by Federal statute. </text></paragraph><paragraph id="HF70ED70B8F3A450CAD1C3872690DC034" commented="no"><enum>(2)</enum><text>An action that would prohibit or substantially delay, with respect to Federal land, the issuance of—</text><subparagraph id="H83115D3D9EFC47FF9B5594431159EA39" commented="no"><enum>(A)</enum><text>a new oil and gas lease, drill permit, approval, or authorization;</text></subparagraph><subparagraph id="H6BC1F74DCF8D4448B1237F34486AAB77" commented="no"><enum>(B)</enum><text>a new coal lease, permit, approval, or authorization; or</text></subparagraph><subparagraph id="H3BD605A2884C41DD8BC55843B8BFF1F6" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">a new hard rock (including the list of critical minerals published in the notice of the Secretary of the Interior entitled <quote>Final List of Critical Minerals 2018</quote> (83 Fed. Reg. 23295 (May 18, 2018))) lease, permit, approval, or authorization.</text></subparagraph></paragraph><paragraph id="H9C850AF1D4E64C8C90E63C8459F5BC2D" commented="no"><enum>(3)</enum><text>Withdrawal of Federal land from—</text><subparagraph id="H0D2E654881AF426EB4960503FECF54F5"><enum>(A)</enum><text>forms of entry, appropriation, or disposal under the public land laws;</text></subparagraph><subparagraph id="HD10C573F2ED347F5990531B55F695A66"><enum>(B)</enum><text>location, entry, and patent under the mining laws; or</text></subparagraph><subparagraph id="HC3A17F41CBDA4170A2830B6308BE5DDE"><enum>(C)</enum><text>disposition under laws pertaining to mineral and geothermal leasing or mineral materials.</text></subparagraph></paragraph></subsection><subsection id="HF5BF282ADA4748B797C53F8D63974C21"><enum>(c)</enum><header>Requirements</header><text>To fulfill the requirements described in subsection (a) with regard to an activity described in subsection (b), the Secretary of the Interior shall—</text><paragraph id="H74CE62B5AF1C4EA38B2F4909ED4D1C08"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study to determine if the activity, relative to the general population, is likely to—</text><subparagraph id="H73D65479FB0A4669AEE5913A4E84557D"><enum>(A)</enum><text>impose disproportionate costs on at-risk communities; or</text></subparagraph><subparagraph id="HC80E73A68DBE48FC9FF4CCCF8942444A"><enum>(B)</enum><text>increase the likelihood that at-risk communities will experience energy poverty and job losses;</text></subparagraph></paragraph><paragraph id="H163352929BF44792AB17621F5DB567BA"><enum>(2)</enum><text>publish such study on a public website of the Department of the Interior; and </text></paragraph><paragraph id="HD6B257158F544D7B95CA6C9735ED258F"><enum>(3)</enum><text>transmit a report on such study to Congress.</text></paragraph></subsection><subsection id="HA585543FA77B4C4D9AA446B8EE46119C" commented="no"><enum>(d)</enum><header>Energy poverty study</header><paragraph id="H8605FCD6E6AC4CF2B51FA1E62C12A783" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (3), upon request from an entity described in paragraph (2), a lead Federal department or agency responsible for leasing or permitting an energy or mineral development project, pipeline project, or transmission project on Federal land, in consultation with any other Federal department or agency with jurisdiction over such project, shall conduct a study relating to how such project is likely to alleviate energy poverty in at-risk communities, including by—</text><subparagraph id="H94A818147C8F4657BC93827207097147"><enum>(A)</enum><text>creating jobs;</text></subparagraph><subparagraph id="H75AFD7E6F9A347D78A8A9990A5A9ACF9"><enum>(B)</enum><text>reducing energy prices; and</text></subparagraph><subparagraph id="H2147FD02612B4081B27885425AB2C811"><enum>(C)</enum><text>other relevant measures identified by the lead Federal department or agency or the requestor the study. </text></subparagraph></paragraph><paragraph id="H0144F620FDC8485EAEFE8EEF652D7957"><enum>(2)</enum><header>Requestors</header><text>The following entities may compel a study by request under paragraph (1):</text><subparagraph id="H4C753CB206714EAA867A918A8C933EDB"><enum>(A)</enum><text display-inline="yes-display-inline">The sponsor of the energy or mineral project, pipeline project, or transmission project on Federal land regarding which the study is being conducted.</text></subparagraph><subparagraph id="H31515E90C2C84D22952D94D92E392ECF"><enum>(B)</enum><text>A State or local government.</text></subparagraph><subparagraph id="HBCEC6447093749C1900032C052528187"><enum>(C)</enum><text>An Indian Tribe. </text></subparagraph><subparagraph id="H403D7E47D3E6427BAA04CB28DB0DC4A6"><enum>(D)</enum><text>An entity determined appropriate by the lead agency for the relevant project. </text></subparagraph></paragraph><paragraph id="HD00366C8546746228AFC9377BE47DE90" commented="no"><enum>(3)</enum><header>Memorandum of understanding</header><text>The lead Federal department or agency with respect to the project to be studied under paragraph (1) may not begin the study until that lead Federal department or agency has entered into a memorandum of understanding with the requestor of the study. A memorandum of understanding entered into under this paragraph shall include—</text><subparagraph id="HDF96E80159CB4C53A3248D9209345003" commented="no"><enum>(A)</enum><text>an agreement regarding a neutral third party to conduct the study;</text></subparagraph><subparagraph id="H1D178545E57B4FEABB66EA7937B598C5" commented="no"><enum>(B)</enum><text>a determination of what entity (with the consent of that entity) will bear the cost of the study, which may include stakeholders other than the requestor; and</text></subparagraph><subparagraph id="H11E6E78EDBF6415185BDB86463C0AAD8"><enum>(C)</enum><text>such other aspects of the study that the lead Federal department or agency and the requestor consider appropriate.</text></subparagraph></paragraph></subsection></section><section id="H09C0CE99E4B444E28E435C9617C5DC1E"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HF255859D52A44DE7BEC8ED7D79A68751"><enum>(1)</enum><header>At-risk community</header><text display-inline="yes-display-inline">The term <term>at-risk community</term> means each of the following:</text><subparagraph id="H90245E8AD72148E895EA4033704912AB"><enum>(A)</enum><text>A low-income community.</text></subparagraph><subparagraph id="H5D43E7A95E244158804B308D21A66019"><enum>(B)</enum><text>A minority community.</text></subparagraph><subparagraph id="H3BFD0200B6E94980A12186B00C4C3091"><enum>(C)</enum><text>A rural community.</text></subparagraph><subparagraph id="H7E78A3E45B54494592A67A2FBA0B39E8" commented="no"><enum>(D)</enum><text>An elderly community.</text></subparagraph><subparagraph id="HE625D5DF80164A81968F411517DE2B27"><enum>(E)</enum><text>A Native American community.</text></subparagraph></paragraph><paragraph id="HDC2CD5846A6D458FAE1C42FC2202DFE8"><enum>(2)</enum><header>Applicable energy regulation</header><text>The term <term>applicable energy regulation</term> means any Federal regulation that relates to energy and—</text><subparagraph id="H6C60D4181A684C4EA51F9F623C82F4DE"><enum>(A)</enum><text>has an annual effect on the economy of not less than $100,000,000;</text></subparagraph><subparagraph id="H3472F28D4F024AFF8D086650446B7C0A"><enum>(B)</enum><text>results in a major increase in costs or prices for any consumer, industry, government agency, or geographic region; or</text></subparagraph><subparagraph id="HFCEE75DA68C34872838CE9F736F1F9B0"><enum>(C)</enum><text>has a significant adverse effect on competition, employment, investment, productivity, innovation, or the ability of an enterprise based in the United States to compete with a foreign-based enterprise in a domestic or international market.</text></subparagraph></paragraph><paragraph id="H73F3CD6BC225443C99C10E9B30A85071"><enum>(3)</enum><header>Designee of the President</header><text>The term <term>designee of the President</term> includes—</text><subparagraph id="H20C8285C552140A8A673376CD77B19EB"><enum>(A)</enum><text>the Secretary of Agriculture;</text></subparagraph><subparagraph id="HED2EEEADA0D94C85961E13EBD6E9873F"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Energy; and</text></subparagraph><subparagraph id="HCF06E636CC274C79882AABA3B500AEC4"><enum>(C)</enum><text>the Secretary of the Interior. </text></subparagraph></paragraph><paragraph id="H998F2522D29B447989539AC3755633EC" commented="no"><enum>(4)</enum><header>Energy poverty</header><text display-inline="yes-display-inline">The term <term>energy poverty</term> means a condition in which individuals and families do not have access to affordable and reliable energy to maintain economic security. </text></paragraph><paragraph id="H1A9EED0C6B5246C5A02CA61743A26EBD" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Federal land defined</header><text>In this section, the term <term>Federal land</term>—</text><subparagraph id="H975098E4BF2442AA921F36FB394FED82" commented="no"><enum>(A)</enum><text>means—</text><clause id="H61E7A2B2EB624B3986931B39885BD808" commented="no"><enum>(i)</enum><text>National Forest System land;</text></clause><clause id="HC59FBE18779740D9971CBE27A3F1C191" commented="no"><enum>(ii)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>));</text></clause><clause id="HC32F138A00524601A696C51057CC0103" commented="no"><enum>(iii)</enum><text>the outer Continental Shelf (as defined in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>)); and</text></clause><clause id="H91463CF689F046BE8DC840283ED47A66" commented="no"><enum>(iv)</enum><text>land under the jurisdiction of the Secretary of Energy; and</text></clause></subparagraph><subparagraph id="H27C30355BF30448DB7EBD392E600C9F7" commented="no"><enum>(B)</enum><text>includes land described in paragraph (1) for which the rights to the surface estate or subsurface estate are owned by a non-Federal entity.</text></subparagraph></paragraph><paragraph id="H7B911BAA7F664708AC01CC8C8AB6A0F4" display-inline="no-display-inline"><enum>(6)</enum><header>State renewable portfolio standard</header><text>The term <term>State renewable portfolio standard</term> means any State regulation that is designed to increase the use of renewable energy sources, including wind, solar, geothermal, and biomass, to generate electricity.</text></paragraph><paragraph id="H5FDDE07419B84225B2D4A0861C28A1D6"><enum>(7)</enum><header>Tribal land</header><text display-inline="yes-display-inline">The term <term>Tribal land</term> has the meaning given the term <term>Indian land</term> in section 2601 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/25/3501">25 U.S.C. 3501</external-xref>).</text></paragraph></section></legis-body></bill>
