which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 117 of the Higher Education Act of 1965 to clarify the enforcement of such section, and for other purposes.</official-title></form><legis-body id="H6E4C300E5B4D4EF6BB5F931E1AA0956D" style="OLC"><section id="HE88FD4D1F55F47F2B3563C5B125E60A5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Requiring Education Providers to Observe Requirements or Trigger Fines Act</short-title></quote> or the <quote><short-title>REPORT Fines Act</short-title></quote>.</text></section><section id="HD3812374D1DC48E4821FC0B8D0ADE535"><enum>2.</enum><header><editorial></editorial>Disclosures of foreign gifts</header><subsection id="H5F76B658C00A48B58991A1D2EDA266F9"><enum>(a)</enum><header>Disclosure report</header><text display-inline="yes-display-inline">Section 117(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f(a)</external-xref>) is amended by striking <quote>the value of which is $250,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year</quote> and inserting <quote>the value of which is $50,000 or more within a calendar year</quote>. </text></subsection><subsection id="H1888399DF9B845E3B118366F2E8E5032"><enum>(b)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 117(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f(f)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="H3ACEC4819A2C4ADCB86BB0F0AB9DF3F4" display-inline="no-display-inline"><subsection id="H64FA0D719797448BB5301FFDFED63B7B"><enum>(f)</enum><header>Enforcement</header><paragraph id="H92929EE778574B97B307E6F3D27277B3"><enum>(1)</enum><header>System of Penalties</header><subparagraph id="H9C0BFCC306AB4942BE6361A6B24568A4"><enum>(A)</enum><header>First instance of failure</header><text display-inline="yes-display-inline">Whenever it appears that an institution has failed to comply with the requirements of this section for the first time in a 3-year period, and except in a case in which a civil action is brought against an institution under paragraph (3)—</text><clause id="H60F65CE47BC9476CBF5CB60FE9868621"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary shall issue a written warning to such institution that sets forth each failure of compliance, each corrective action that the institution shall take to be in compliance, and the requisite time period in which the institution must take such corrective action; and</text></clause><clause id="H69BC6E423F0C4BB7BFEE72ED7359B817"><enum>(ii)</enum><text display-inline="yes-display-inline">the institution shall be provided the opportunity to respond to the Secretary not later than 60 days after the date on which the warning is received by the institution.</text></clause></subparagraph><subparagraph id="H9FE0C7B4FAC7443BB56995337FB7BF48"><enum>(B)</enum><header>Second instance of failure</header><text>In a case in which an institution received a written warning under subparagraph (A), and the institution appears to have failed to comply with the requirements of this section for the second time during the 3-year period beginning on the date on which such warning was received by the institution under subparagraph (A), upon a judicial finding that such institution has failed to comply with the requirements of this section, including any rule or regulation promulgated under this section, the Court shall impose a civil penalty in an amount that does not exceed amount of funds provided by the foreign source to the institution and which is the subject of the institution’s failure under this subparagraph.</text></subparagraph><subparagraph id="HAEFB21C9E4AB432BAAA848459AB203D3"><enum>(C)</enum><header>Third or subsequent instance of failure</header><clause id="HA166B7929F09419F8B68562B3E71AFF3"><enum>(i)</enum><header>Judicial finding</header><text display-inline="yes-display-inline">In a case of an institution on which a civil penalty was imposed under subparagraph (B), and such institution appears to have failed to comply with the requirements of this section for a third time, or any time thereafter, during the 3-year period beginning on the date on which a warning was received under subparagraph (A), upon a judicial finding that an institution has failed to comply with the requirements of this section, including any rule or regulation promulgated under this section, the Court shall impose a civil penalty in an amount equal to the amount of funds provided by the foreign source to the institution and which is the subject of the institution’s failure under this subparagraph.</text></clause><clause id="HD62044D4385C4F789B64906CEB8A0BAF"><enum>(ii)</enum><header>Ineligibility</header><text display-inline="yes-display-inline">In a case in which the court finds that an institution has failed to comply with the requirements of this section for a third time, or any time thereafter, during the 3-year period beginning on the date on which a warning was received under subparagraph (A), including any rule or regulation promulgated under this section, the institution shall be ineligible for new Federal research funding during the fiscal year following such a finding.</text></clause></subparagraph></paragraph><paragraph id="H60528659869B4CC3A57DCD993609B9A4"><enum>(2)</enum><header>Accelerated penalties</header><subparagraph id="HF08790697018482D8DF1FAABDA77F64D"><enum>(A)</enum><header>In general</header><text>In any instance in which a court determines under subparagraph (B) or (C) of paragraph (1) that an institution received funding, and the funding was from a foreign adversary, or any entity associated with a foreign adversary, such institution shall immediately be assessed a civil penalty under paragraph (1)(C).</text></subparagraph><subparagraph id="H3E2D0C0DD41C476E8F5692A39F08D189"><enum>(B)</enum><header>Foreign adversary defined</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <term>foreign adversary</term> has the meaning given the term in the rule issued by the Department of Commerce entitled <quote>Securing the Information and Communications Technology and Services Supply Chain</quote> (86 Fed. Reg. 4913 (January 19, 2021)). Such foreign adversaries include—</text><clause id="HEB8E9EAB34B64237BC89640250F549CA"><enum>(i)</enum><text>the People’s Republic of China, including the Hong Kong Special Administrative Region (China);</text></clause><clause id="HED2350BBC88648AE9D8F9A8315CD3633"><enum>(ii)</enum><text>the Republic of Cuba (Cuba);</text></clause><clause id="H5E4E6D055921470ABAD689C6D2705E56"><enum>(iii)</enum><text>the Islamic Republic of Iran (Iran);</text></clause><clause id="H6AEBCDF0DC7049F3BEA3A6F9C46687B1"><enum>(iv)</enum><text>the Democratic People’s Republic of Korea (North Korea); the Russian Federation (Russia); and</text></clause><clause id="H187B087778EE4114B1406E3112BEF8D8"><enum>(v)</enum><text>Venezuelan politician Nicolas Maduro (Maduro Regime).</text></clause></subparagraph></paragraph><paragraph id="H27BC8E42F9844F7C836298A9128556A5"><enum>(3)</enum><header>Court Orders</header><text display-inline="yes-display-inline">Whenever it appears that an institution violated this section, other than in a case in which such institution receives a warning under paragraph (1)(A), a civil action shall be brought by the Attorney General, at the request of the Secretary, in an appropriate district court of the United States, or the appropriate United States court of any territory or other place subject to the jurisdiction of the United States, to request such court compel compliance with the requirements of this section and impose civil penalties, as appropriate.</text></paragraph><paragraph id="H799B9AB71BF148278E55FEBA4AC18918"><enum>(4)</enum><header>Costs</header><text>For any failure to comply with the requirements of this section, including any rule or regulation promulgated thereunder, the institution shall pay to the Treasury of the United States the full costs to the United States of obtaining compliance, including all associated costs of investigation and enforcement.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HD693D53341974F0CB860CB5FA00BEF50"><enum>3.</enum><header>Rules</header><subsection id="H50000D7752DC41A68E4D3DCEBF4E83C1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the Secretary of Education shall promulgate rules to clarify the amendments made by section 2.</text></subsection><subsection id="H29049F9BD66D4C09B3CE29D49E9BB11D" commented="no"><enum>(b)</enum><header>Rulemaking requirements</header><text display-inline="yes-display-inline">The amendments made by section 2 shall not—</text><paragraph id="H4A32782BDB924347801A932A730D119C" commented="no"><enum>(1)</enum><text>be subject to the master calendar requirements under section 482 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089</external-xref>); or</text></paragraph><paragraph id="H5D8AB5228BB048B8BFC8E15ECC90C6B7" commented="no"><enum>(2)</enum><text>the public involvement and negotiated rulemaking requirements under section 492 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1098a">20 U.S.C. 1098a</external-xref>). </text></paragraph></subsection></section></legis-body></bill>
