which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Indian Health Care Improvement Act to authorize a special behavioral health program for Indians, and for other purposes.</official-title></form><legis-body id="HC90417A6F1BB406894BEDBCD7887FC4D" style="OLC"><section id="H66E073BB5FA74D1CB44D79E1FAE4F350" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native Behavioral Health Access Improvement Act of 2021</short-title></quote>.</text></section><section id="H5A5553184439471E81F52A0F0DFAF704"><enum>2.</enum><header>Special behavioral health program for Indians</header><subsection id="HF2C47F696AE349D4AD66EA4BB098626E"><enum>(a)</enum><header>In general</header><text>Subtitle A of title VII of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1665">25 U.S.C. 1665 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H4A65252836F7450AA890DE6E34E1B755" style="OLC"><section id="HE7193EF2001041E38F1AB2128958A15F"><enum>716.</enum><header>Special behavioral health program for Indians</header><subsection id="H92B6A11442B04DB3889D28CEB69361B4"><enum>(a)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="HBD179C260AE54403A7B2331D9BAFF600"><enum>(1)</enum><text>any health program administered directly by the Service;</text></paragraph><paragraph id="H499C50F9A7424FA2BF9185BDBC0A992C"><enum>(2)</enum><text display-inline="yes-display-inline">a tribal health program; and </text></paragraph><paragraph id="H480C2FE7BA7E441B964A899A1CA79686"><enum>(3)</enum><text display-inline="yes-display-inline">an Urban Indian health program operated by an Urban Indian organization pursuant to a grant or contract with the Service under title V.</text></paragraph></subsection><subsection id="H43E4CEC2C22D4C47AEA8222572D62614"><enum>(b)</enum><header>Formula grants</header><paragraph id="H8A9FF49130B748638CDB7A272CEB7050"><enum>(1)</enum><header>In general</header><text>The Director of the Service (referred to in this section as the <quote>Director</quote>) shall award grants to eligible entities, in amounts determined pursuant to the formula described in paragraph (2), to be used by the eligible entity to provide services for the prevention of, treatment of, and recovery from mental health and substance use disorders.</text></paragraph><paragraph id="HE62FEABFDB0D4A908DDA32432021C878"><enum>(2)</enum><header>Formula</header><text>The Director, in consultation with Indian tribes and Urban Indian organizations, shall develop a formula to determine the amount of a grant under paragraph (1). </text></paragraph></subsection><subsection id="H9CDA28116A4648699E655691DA3EFB84"><enum>(c)</enum><header>Technical assistance and program evaluation</header><paragraph id="H14BD5251992F46C89809BB9B2F1FA4DA"><enum>(1)</enum><header>In general</header><text>The Director shall—</text><subparagraph id="HA477417663E146BD84E08E63204418CA"><enum>(A)</enum><text>provide technical assistance to applicants and grantees under this section; and</text></subparagraph><subparagraph id="H7EBE36FB71A64309A97A4C9752679B0A"><enum>(B)</enum><text>collect and evaluate information on the program carried out under this section.</text></subparagraph></paragraph><paragraph id="H5B13B930B7264D0AA645E9B7E78157B6"><enum>(2)</enum><header>Consultation</header><text>The Director shall consult with eligible entities under this section for purposes of developing evaluation measures and data submission and reporting requirements for purposes of the collection and evaluation of information under paragraph (1)(B).</text></paragraph><paragraph id="H72A8908AAD384714B544C813E93EC31F"><enum>(3)</enum><header>Data submission and reporting</header><text>As a condition on receipt of a grant under this section, an applicant shall agree to submit data and reports consistent with the data submission and reporting requirements developed under paragraph (2).</text></paragraph></subsection><subsection id="HB96E96B4080445EDB5A5EEBB7DFC3F07"><enum>(d)</enum><header>Funding</header><text>To carry out this section, there is authorized to be appropriated, and there is appropriated, out of any money in the Treasury not otherwise appropriated, $200,000,000 for each of fiscal years 2022 through 2026.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5E9675FFF3094FF894F840CFD6AE725B"><enum>(b)</enum><header>Technical amendment</header><text>Section 4(26) of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603(26)</external-xref>) is amended by striking <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)</quote> and inserting <quote>(<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)</quote>.</text></subsection></section><section id="HD7E478917E48483CA8B474D2C4A8A394"><enum>3.</enum><header>Indian defined in PPACA</header><subsection id="HDBFA2395D3E54F2E9D09CCDAEF5CA2D2"><enum>(a)</enum><header>Indian defined in PPACA</header><paragraph id="H22EC8A3D7B8643BFA94DC8F3AC6153F2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1304 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18024">42 U.S.C. 18024</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="HD923117608AF4FFDB52CE064CFDFF4A5" style="OLC"><subsection id="HD43EC719AC034C18BB8210431C5F8D44"><enum>(f)</enum><header>Indian</header><paragraph id="HA693AEC282684D44A9CBC645E2C3A80C"><enum>(1)</enum><header>In general</header><text>In this title, the term <term>Indian</term> means any individual—</text><subparagraph id="H2018E701F0E8426195492DD4A5BF3657"><enum>(A)</enum><text>described in paragraph (13) or (28) of section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>);</text></subparagraph><subparagraph id="HE3DFC150125447189594C63BA45E1A5C"><enum>(B)</enum><text>who is eligible for health services provided by the Indian Health Service under section 809 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1679">25 U.S.C. 1679</external-xref>);</text></subparagraph><subparagraph id="HF0B8AAAEF3914CF19AB896A6AF86C977"><enum>(C)</enum><text>who is of Indian descent and belongs to the Indian community served by the local facilities and program of the Indian Health Service; or</text></subparagraph><subparagraph id="H28BAC8E5BBDA49069AB2591ACB49A2C2"><enum>(D)</enum><text>who is described in paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" id="H06311840DEF1437FA6FD763D677331D4"><enum>(2)</enum><header>Included individuals</header><text>For purposes of this title, the following individuals shall be considered to be an <quote>Indian</quote>:</text><subparagraph commented="no" id="H3C5A43C98FD04177853B386F52671C93"><enum>(A)</enum><text>A member of a Federally recognized Indian tribe.</text></subparagraph><subparagraph commented="no" id="HC02C112B7D9C47369CF69915E1A9EAD3"><enum>(B)</enum><text>A resident of an urban center who meets one or more of the following four criteria:</text><clause commented="no" id="H050947B14EC7422E89666DD6E5042E37"><enum>(i)</enum><text>Membership in a Tribe, band, or other organized group of Indians, including those Tribes, bands, or groups terminated since 1940 and those recognized by the State in which they reside, or being a descendant, in the first or second degree, of any such member.</text></clause><clause commented="no" id="HC66AF75F226F4266ADC921A74F7AB8AB"><enum>(ii)</enum><text>Is an Eskimo or Aleut or other Alaska Native.</text></clause><clause commented="no" id="H3E0691C987564E6399870C98691DD77A"><enum>(iii)</enum><text>Is considered by the Secretary of the Interior to be an Indian for any purpose.</text></clause><clause commented="no" id="H255FDA5F494D4925884E972FFE8355C5"><enum>(iv)</enum><text>Is determined to be an Indian under regulations promulgated by the Secretary.</text></clause></subparagraph><subparagraph commented="no" id="H98CAC49A9B204CE78478D3C27DF7DD45"><enum>(C)</enum><text>An individual who is considered by the Secretary of the Interior to be an Indian for any purpose.</text></subparagraph><subparagraph commented="no" id="HD303A2ADCE51486488FF3736C3970D61"><enum>(D)</enum><text>An individual who is considered by the Secretary to be an Indian for purposes of eligibility for Indian health care services, including as a California Indian, Eskimo, Aleut, or other Alaska Native.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HD94AC90438604620B149B6A43FA318C7"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="HDF11943C56E44B1FBAA468652690584D"><enum>(A)</enum><header>Affordable choices health benefit plans</header><text display-inline="yes-display-inline">Section 1311(c)(6)(D) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031(c)(6)(D)</external-xref>) is amended by striking <quote>section 4 of the Indian Health Care Improvement Act</quote> and inserting <quote>section 1304(f)</quote>.</text></subparagraph><subparagraph id="H49883512153A4E3B9B4D8ECA79CFF626"><enum>(B)</enum><header>Reduced cost-sharing for individuals enrolling in qualified health plans</header><text>Section 1402(d) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18071">42 U.S.C. 18071(d)</external-xref>) is amended—</text><clause id="H30BBEDA5023F4A1986BBEC794AE107D9"><enum>(i)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>section 4(d) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(d)</external-xref>)</quote> and inserting <quote>section 1304(f)</quote>; and</text></clause><clause id="HFA50C5B7D12A4C979C0EFAC4B6C89D3A"><enum>(ii)</enum><text>in paragraph (2), in the matter preceding subparagraph (A), by striking <quote>(as so defined)</quote> and inserting <quote>(as defined in section 1304(f))</quote>.</text></clause></subparagraph></paragraph><paragraph id="HA068BABD82C444019595087D9B3312D2"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to plan years beginning on or after January 1, 2023.</text></paragraph></subsection><subsection id="H5DBED55559B8475C9E804510FF777632"><enum>(b)</enum><header>Technical amendments</header><text display-inline="yes-display-inline">Section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>) is amended—</text><paragraph id="H3C9944FE2704442A8D7994C7CAD10E5D"><enum>(1)</enum><text>in paragraph (13), by striking <quote>as defined in subsection (d) hereof</quote> and inserting <quote>as defined in paragraph (14)</quote>; and</text></paragraph><paragraph id="HB463A3BCF3DA4A0699C450CCBA676DC4"><enum>(2)</enum><text>in paragraph (28)—</text><subparagraph id="H21EBDF67599F44368EFA2C556D488C99"><enum>(A)</enum><text>by striking <quote>as defined in subsection (g) hereof</quote> and inserting <quote>as defined in paragraph (27)</quote>; and</text></subparagraph><subparagraph id="H30CF660559244A7EA532C3A4824DB694"><enum>(B)</enum><text>by striking <quote>subsection (c)(1) through (4)</quote> and inserting <quote>subparagraphs (A) through (D) of paragraph (13)</quote>.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
