which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit digital platforms from using information about a user unless the user consents to such use, to ensure personal information is considered a property right, and for other purposes.</official-title></form><legis-body id="H0A6D373C45FD48D0A23E531F55C22ED7" style="OLC"><section id="H033B4C7E2A2640EABC9CA8C67FFDA350" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>User Data Protection Act</short-title></quote>.</text></section><section id="HD5B38EEEB8284E41912665FF90E78F36"><enum>2.</enum><header>Prohibition on requirement to accept cookies</header><subsection id="H8AB9AFBCE0DA4926B793B4783EABB484"><enum>(a)</enum><header>In general</header><paragraph id="HCE4FA973CC4E4158BC4B9CB6E86AE670"><enum>(1)</enum><header>Tracking and user property rights</header><text display-inline="yes-display-inline">It shall be unlawful for the operator of a digital platform or any third-party platform to do any of the following:</text><subparagraph id="HCEF0209552F94E2FA94998468C8CC702"><enum>(A)</enum><text>Without the consent of the user—</text><clause id="HCC9D38D90810401E8AD8B68431FA4202"><enum>(i)</enum><text>use cookies for the digital platform;</text></clause><clause id="H8A6DE78EA4F245949E73E67496ABF65C"><enum>(ii)</enum><text>collect and store any information about the user, including any habit or preference of the user; and</text></clause><clause id="HEB86EB1730BB4652B2C96D5FB1573A1C"><enum>(iii)</enum><text>deliver content to the user that corresponds with any of the personal information of the user.</text></clause></subparagraph><subparagraph id="H4C99427FCE23437AA978DC3716A1338D"><enum>(B)</enum><text>Restrict a user from using a digital platform if the user declines to consent to any of the activities described in subparagraph (A).</text></subparagraph><subparagraph id="H0A32E94B5D66499B8284A60343650633" commented="no"><enum>(C)</enum><text>Use tracking pixels. </text></subparagraph><subparagraph id="H1F05DCA867604682B00AF461BF7DA92F"><enum>(D)</enum><text display-inline="yes-display-inline">Share information about a user with other digital platforms or online businesses.</text></subparagraph></paragraph><paragraph id="H706FF105A60D442599A8589DEF1C81A2"><enum>(2)</enum><header>Property rights for user information</header><text display-inline="yes-display-inline">The operator of a digital platform shall do the following:</text><subparagraph id="HE7060DCCA71F4C8AB516BFA5AC684F3A"><enum>(A)</enum><text display-inline="yes-display-inline">If a user consents to the digital platform collecting, storing, or using the information about the user, provide a disclosure statement—</text><clause id="H7E7380A3481A48AFA903D1D5FD3BE820"><enum>(i)</enum><text>that includes a description of the information that the digital platform intends to collect, store, or use, what the information will be used for, and what the digital platform determines the economic value of the information to be; </text></clause><clause id="H1BCF8C99B16B485387A4CE16A64739FC"><enum>(ii)</enum><text>that is consistent across all digital platforms; and</text></clause><clause id="HC64013398E0747F8ABABA928EB3CB8A9"><enum>(iii)</enum><text>the form of which shall be determined by the Commission.</text></clause></subparagraph><subparagraph id="HFE55585630D74824B24454938D213053"><enum>(B)</enum><text>Make the disclosure statement accessible to the individual on the platform.</text></subparagraph><subparagraph id="H6B950A0C2C7C4D6DA433425C0EB7153F"><enum>(C)</enum><text display-inline="yes-display-inline">Treat any information collected, stored, or used by the digital platform or information that a user generates on the digital platform as an exclusive property right owned by that user.</text></subparagraph><subparagraph id="HF849A296A8E94D9CB46FC3509F3D06A5"><enum>(D)</enum><text display-inline="yes-display-inline">Determine the economic value of the information described under subparagraph (A) as a property right. </text></subparagraph><subparagraph id="H6EB4C95E42CF43259A164D9969880E0C"><enum>(E)</enum><text display-inline="yes-display-inline">Provide an update to users if there is any change in the collection, storage, or use of the information described under subparagraph (A) or the economic value determined under subparagraph (D).</text></subparagraph></paragraph></subsection><subsection id="H1F5A437750C44E9C9262831C4FDD843A"><enum>(b)</enum><header>Enforcement</header><paragraph id="H0FFD67155B1D4E86BF51A93F568B969D"><enum>(1)</enum><header>Enforcement by the Federal Trade Commission</header><subparagraph id="HC7C99B83A5A4429C900DC0328F3B376C"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of subsection (a) shall be treated as a violation of a regulation under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subparagraph><subparagraph id="HA5578CF8B6B449D197581FCA2158865C"><enum>(B)</enum><header>Powers of commission</header><text>The Commission shall enforce subsection (a) in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act. Any person who violates such subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></subparagraph></paragraph><paragraph id="H2A62C601F00E452B9D19FC26B4EBC7D6"><enum>(2)</enum><header>Effect on other laws</header><text display-inline="yes-display-inline">Nothing in this section shall be construed in any way to limit the authority of the Commission under any other provision of law or to limit the application of any Federal or State law.</text></paragraph><paragraph id="H82C4CE1F55C04AE8B3242F64DFEE357F"><enum>(3)</enum><header>Enforcement by State attorneys general</header><subparagraph id="H65DD803B2FFC451DA9D8C424C9BA6175"><enum>(A)</enum><header>In general</header><text>If the chief law enforcement officer of a State, or an official or agency designated by a State, has reason to believe that any person has violated or is violating subsection (a), the attorney general, official, or agency of the State, in addition to any authority it may have to bring an action in State court under its consumer protection law, may bring a civil action in any appropriate United States district court or in any other court of competent jurisdiction, including a State court, to—</text><clause id="H43D8202EEED84202937265BB8AF26731"><enum>(i)</enum><text>enjoin further such violation by such person;</text></clause><clause id="H8FFCBD11B52643C3BE175C5FACBE28E4"><enum>(ii)</enum><text>enforce compliance with such subsection;</text></clause><clause id="H582C35FBB126477CB23F071C4F215CE2"><enum>(iii)</enum><text>obtain civil penalties; and</text></clause><clause id="H689A881C5A8E4196BB8DC2F6AB428124"><enum>(iv)</enum><text>obtain damages, restitution, or other compensation on behalf of residents of the State.</text></clause></subparagraph><subparagraph id="H3D25569B30814404805E668CA4DAFE74"><enum>(B)</enum><header>Notice and intervention by the Federal Trade Commission</header><text>The attorney general of a State shall provide prior written notice of any action under subparagraph (A) to the Commission and provide the Commission with a copy of the complaint in the action, except in any case in which such prior notice is not feasible, in which case the attorney general shall serve such notice immediately upon instituting such action. The Commission shall have the right—</text><clause id="HB13E18FF17D64B39958357044DCAC9DE"><enum>(i)</enum><text>to intervene in the action;</text></clause><clause id="HCD093F269C72407C8379918A99516652"><enum>(ii)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></clause><clause id="HF46EF1C625644E008A7E33C8F9130CA4"><enum>(iii)</enum><text>to file petitions for appeal.</text></clause></subparagraph><subparagraph id="H8AE1F996F0564DD19E40AEC16E1B1E0F"><enum>(C)</enum><header>Limitation on State action while Federal action is pending</header><text>If the Commission has instituted a civil action for violation of this section, no State attorney general, or official or agency of a State, may bring an action under this paragraph during the pendency of that action against any defendant named in the complaint of the Commission for any violation of this section alleged in the complaint.</text></subparagraph></paragraph></subsection><subsection id="H2CABABA6236B4D909A6B87A5488F9C85" commented="no"><enum>(c)</enum><header>Private cause of action</header><paragraph id="HD56472222BB948E780BFCA83F58D98DC"><enum>(1)</enum><header>Action</header><text display-inline="yes-display-inline">A user who suffers harm as a result of a violation of subsection (a) may bring an action against the operator of a digital platform in the appropriate district court of the United States to enjoin such violation and for damages.</text></paragraph><paragraph id="H14DFD2733AA543328BE3B8721799E9D4"><enum>(2)</enum><header>Damages</header><text display-inline="yes-display-inline">A user who suffers harm as a result of a violation of subsection (a) shall not receive less than 90 percent of total damages.</text></paragraph><paragraph id="H5F89938BFE4D4F48BCF020234C0AEA74"><enum>(3)</enum><header>Attorney’s fees</header><text>The amount of an award of attorney’s fees under this subsection may not exceed an amount equal to 33 percent of the damages awarded to the user. </text></paragraph></subsection><subsection id="HECC95B8033744473AACC4D35729D469B"><enum>(d)</enum><header>Federal preemption</header><text>This Act preempts any State law relating to the requirements described under this Act. </text></subsection><subsection id="H4153CCA6ECA441CA8E1FD3E0D4694EF6"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HE7273EB999AF442DBFE9BF075BA12105"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="H6A2B0C2C9D104F3BA667C8D7764FD3A0"><enum>(2)</enum><header>Cookies</header><text>The term <term>cookies</term> means information saved by a web browser that allows the browser to recognize a device and track a user over time.</text></paragraph><paragraph id="H0FE9489ADF0841B18B3F8C365835C0BF" commented="no"><enum>(3)</enum><header>Digital platform</header><text display-inline="yes-display-inline">The term <term>digital platform</term> means any technology-enabled content producer and includes a website, an online business, and an application for a device.</text></paragraph><paragraph id="H233BF55620754D4E82B5341024A03829" commented="no"><enum>(4)</enum><header>Third-party platform</header><text>The term <term>third-party platform</term> means an entity that contracts with a digital platform to use their website, online business, or application for a device for advertising or other purposes. </text></paragraph><paragraph id="HEF82F03BCA4B4A2685E8DCA7DA865BB7" commented="no"><enum>(5)</enum><header>Tracking pixel</header><text display-inline="yes-display-inline">The term <term>tracking pixel</term> means a tiny pixel-sized image, hidden or embedded in an online page and used for collecting data about a user. </text></paragraph></subsection></section></legis-body></bill>
