which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Animal Health Protection Act with respect to the importation of live dogs, and for other purposes.</official-title></form><legis-body id="H18804994940E403094F077A7CDB0E0E7" style="OLC"><section id="H70EDEA62A68142AD9DA3E1F6FD877A96" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Healthy Dog Importation Act</short-title></quote>.</text></section><section id="H5AF83BED21BD4B9A924184A38C6FEEDF"><enum>2.</enum><header>Importation of live dogs</header><subsection id="H56E4BBAEB70745D2B178164DB9C0F52A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8301">7 U.S.C. 8301 et seq.</external-xref>) is amended by inserting after section 10404 (<external-xref legal-doc="usc" parsable-cite="usc/7/8303">7 U.S.C. 8303</external-xref>) the following:</text><quoted-block style="OLC" id="H2F29A761C91C48B48346EE95A7E95160" display-inline="no-display-inline"><section id="H78131237DFC745EEB900B80D05445016"><enum>10404A.</enum><header>Importation of live dogs</header><subsection id="H24717094E0924104928C8C1DC09FA336"><enum>(a)</enum><header>Requirements</header><paragraph id="H0552C29D27A6424EB2F98E503BC2E36D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), no person shall import a dog into the United States unless, as determined by the Secretary, the dog—</text><subparagraph id="H885C6447EFFD47D7803D0CE4B5C0DD97"><enum>(A)</enum><text>is in good health; </text></subparagraph><subparagraph id="H23B3BCDC45404EEE9B675E4208EDF082"><enum>(B)</enum><text display-inline="yes-display-inline">has received all necessary vaccinations and demonstrated negative test results required by the Secretary, as evidenced by a certificate—</text><clause id="HFA096859EBCB453FAF1D17E6C90268BF"><enum>(i)</enum><text>issued by a licensed veterinarian accredited by a competent veterinary authority recognized by the Secretary; and</text></clause><clause id="HCF956BD69DEA4FE5BD25ADDB3C104DDB"><enum>(ii)</enum><text display-inline="yes-display-inline">endorsed by such authority representing that the veterinarian issuing the certificate was authorized to do so; and</text></clause></subparagraph><subparagraph id="HDE48DDD0331F4E47B447C3A55A2BEAF5"><enum>(C)</enum><text display-inline="yes-display-inline">is officially identified by a permanent method approved by the Secretary.</text></subparagraph></paragraph><paragraph id="HD4623E767AD44FC8AB0E4AF4A9191563"><enum>(2)</enum><header>Transfer</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), no person shall import or cause the transportation of a dog into the United States from a foreign country for the purpose of transfer unless, as determined by the Secretary, the dog—</text><subparagraph id="HCFB4902C99154271893DF249213739A6"><enum>(A)</enum><text>meets the criteria specified in paragraph (1);</text></subparagraph><subparagraph id="H4CBBD4515C6C4EBD8E726B30E37AFB5B"><enum>(B)</enum><text>is at least 6 months old; and</text></subparagraph><subparagraph id="H648EB047FF744974A61B5C4042CF602B"><enum>(C)</enum><text>is accompanied by an import permit issued by the Secretary under this Act.</text></subparagraph></paragraph><paragraph id="HFF0AEDBDE15C480EB8671476242D6195"><enum>(3)</enum><header>Exceptions</header><text>The Secretary, by regulation, shall provide an exception to any requirement under this Act in any case in which a dog is imported for purposes of transfer for—</text><subparagraph id="H8ED04C2C0F73435B86E8815E16426712"><enum>(A)</enum><text>research purposes;</text></subparagraph><subparagraph id="H146E6E1E6D6A47FB8CDB9ED1A123B0FC"><enum>(B)</enum><text display-inline="yes-display-inline">veterinary treatment, paid for by the importer, provided that the dog is taken directly to a veterinary facility for treatment with appropriate quarantine until the dog meets the criteria specified in paragraph (1) and is then exported to its country of origin; or</text></subparagraph><subparagraph id="H9C8DF168465F4CF2910BFF45CDE56576"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a dog that is less than 6 months old, lawful importation into the State of Hawaii in compliance with the regulations of the State of Hawaii and the other requirements of this section if the dog is not transported out of the State of Hawaii for resale at less than 6 months of age.</text></subparagraph></paragraph></subsection><subsection id="H23D868738B5C47D894B9764DD925B1A2"><enum>(b)</enum><header>Implementation and Regulations</header><text display-inline="yes-display-inline">The Secretary, the Secretary of Health and Human Services, the Secretary of Commerce, and the Secretary of Homeland Security, shall—</text><paragraph id="H8B7AAB47724B4DA5AE66E0FB7BF2C8B9"><enum>(1)</enum><text>promulgate such regulations as the Secretaries determine to be necessary to implement and enforce this section;</text></paragraph><paragraph id="H29D5C29B3B0441EFA2BA4A23C23E2946"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate electronic submission of all required documentation and make the submitted information available to the Secretary, the Secretary of Health and Human Services, the Secretary of Commerce, and the Secretary of Homeland Security for verification upon arrival; and</text></paragraph><paragraph id="HB994405FF7D144EDB829AF0B0797BE7D"><enum>(3)</enum><text>determine and establish such fees for the issuance of permits and the inspection with respect to dog importation as necessary to fund implementation and enforcement of this section.</text></paragraph></subsection><subsection id="HDEBBC95B0C604642B0DCC36CB95675F5"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in subsection (b)(3) shall be construed as limiting the availability of funding made available under section 10417 to carry out this section.</text></subsection><subsection id="H6445CBFB49AC4F11B8222EE1D070C3AE"><enum>(d)</enum><header>Enforcement</header><paragraph id="H081838F0EEEC4E848E3D268FD4203215"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary shall have the authority granted under section 10414 to enforce this section.</text></paragraph><paragraph id="H96DAF4D572874A05810328FB467BFFEB"><enum>(2)</enum><header>Penalties</header><text>An importer that fails to comply with this section shall—</text><subparagraph id="H62EDC63864D14857AD07BE72CC4D8A33"><enum>(A)</enum><text>be subject to penalties under section 10414; and</text></subparagraph><subparagraph id="H97E94005940C408FBCA05CC281BA8CF6"><enum>(B)</enum><text display-inline="yes-display-inline">if such importer is a dealer, provide, as the Secretary may determine, at the expense of the importer, for the care (including appropriate veterinary care), forfeiture, quarantine, and removal from the United States and return to its place of export with due care for the welfare of each applicable dog.</text></subparagraph></paragraph></subsection><subsection id="HF8ADDABA586D470D9FDFD647D526C4FE"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H60660D4E54CB4AEC8905BE2CF57E4545"><enum>(1)</enum><header>Importer</header><text>The term <term>importer</term> means any person who transports or causes the transportation of a dog into the United States from a foreign country.</text></paragraph><paragraph id="H68FDDFF4DCC94BA5A7691550671D0B48"><enum>(2)</enum><header>Transfer</header><text display-inline="yes-display-inline">The term <term>transfer</term> means a change of ownership or control of an imported dog to another person, including by sale, adoption, exchange, or donation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF395D61CD67440D69BBE0D30437F8848"><enum>(b)</enum><header>Conforming repeal</header><text>Section 18 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2148">7 U.S.C. 2148</external-xref>) is repealed.</text></subsection></section><section id="HCFEB7A80D2084C2D9D7EB9E9AE3263EF"><enum>3.</enum><header>Transportation</header><subsection id="HDB17A90D19A0479B956BE6322DDB194E"><enum>(a)</enum><header>Definition of transporter</header><text display-inline="yes-display-inline">Section 2 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2132">7 U.S.C. 2132</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HE797195554664DC48A0D7E7C8E140A11" display-inline="no-display-inline"><subsection id="H466DE6E013D74CDF8C4AF01E03B9510F"><enum>(p)</enum><text display-inline="yes-display-inline">The term <term>transporter</term> means any person, department, agency, or instrumentality of the United States or of any State or local government, other than a carrier or intermediate handler, who receives an animal from any importer, dealer, research facility, exhibitor, operator of an auction sale, or department, agency, or instrumentality of the United States or of any State or local government and receives compensation for moving such animal in commerce.</text></subsection><subsection id="H954487B2D25048ADBBA384DEC76B325C"><enum>(q)</enum><text display-inline="yes-display-inline">The term <term>compensation</term> means any act or consideration or thing of value received by a person directly, including cash or noncash benefits, cost-avoidance, obtaining positive or avoiding negative publicity, an exchange of services, or maintaining a license issued under local, State, or Federal government authority.</text></subsection><subsection id="H9BAACBCE0E034B84889FC5ABB3971923"><enum>(r)</enum><text display-inline="yes-display-inline">The term <term>sell</term> or <term>resell</term> means to transfer of ownership or control of an animal, including by sale, adoption, exchange, or donation.<italic></italic></text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5746BD1419234698B69EC9C1F38AEC3C"><enum>(b)</enum><header>Humane standards</header><text display-inline="yes-display-inline">Section 13 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2143">7 U.S.C. 2143</external-xref>) is amended—</text><paragraph id="HD701EA9B91E1411691740FC6B2AA1B41"><enum>(1)</enum><text>in subsection (a)(4)—</text><subparagraph id="HE32C5B49B2FE44F1A93A7428325AEAEE"><enum>(A)</enum><text>in the first sentence, by striking <quote>air carriers,</quote> and inserting <quote>transporters, air carriers,</quote>; and</text></subparagraph><subparagraph id="HF24F3811EB574AD8B21A40A03BB8A946"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following: <quote>The Secretary shall provide, by regulation, that each transporter, intermediate handler, or carrier receiving a certificate of veterinary inspection required under this section shall submit a copy of the certificate to the Secretary, who shall record the information in a centralized, publicly available database.</quote>; and</text></subparagraph></paragraph><paragraph id="H2DEE5D3CDD1945A8ACD789DDF0A2F467"><enum>(2)</enum><text>by redesignating subsections (g) and (h) as subsections (h) and (i), respectively; and</text></paragraph><paragraph id="H2B13E87CAE334674B976512C0BF3CCC9"><enum>(3)</enum><text>by striking <quote>(f) No dogs or cats</quote> and inserting <quote>(g) No dogs or cats</quote>;</text></paragraph><paragraph id="H99066595C9794F019831E1F64B5A4031"><enum>(4)</enum><text>in subsection (g), as redesignated by paragraph (3)—</text><subparagraph id="HB8F33BAAF36E4B4FB7DAA094B2B6C5BE"><enum>(A)</enum><text>in the first sentence—</text><clause id="HE78378578ACE4075890451B915655FFB"><enum>(i)</enum><text>by inserting <quote>importer,</quote> before <quote>dealer</quote>; and</text></clause><clause id="H4CA37716A37B42E8BBF4851D0111732A"><enum>(ii)</enum><text>by inserting <quote>, transporter,</quote> after <quote>intermediate handler</quote> each place it appears; and</text></clause></subparagraph><subparagraph id="H8B17A37B91FB4A81AA641FDD2E76A524"><enum>(B)</enum><text>in the second sentence—</text><clause id="H76885A49AC52473D81D11C5E90EBFBFD"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>, transporters,</quote> after <quote>intermediate handlers</quote>; and</text></clause><clause id="H0AFAA65914BE4FE1A354A197F38AC0BB"><enum>(ii)</enum><text>by striking <quote>section 10 of this Act</quote> and inserting <quote>subsection (a)(4)</quote><italic></italic>. </text></clause></subparagraph></paragraph></subsection></section><section id="H8E736793B66041A984A9917841004A29"><enum>4.</enum><header>Regulations</header><subsection id="H027108A2C5FB4352BFEE0D4327963556"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary of Agriculture shall issue final regulations to implement the amendments made by this Act, including the verification upon arrival that each dog being imported into the United States from a foreign country meets all applicable importation requirements and the denial of entry into the United States of any dog that fails to meet such requirements. </text></subsection><subsection id="H8BA12BBDF24E4044ABB7534E81E9E28B"><enum>(b)</enum><header>Transition period</header><text display-inline="yes-display-inline">Until the date on which final regulations are issued under subsection (a), the importation of live dogs shall be regulated in accordance with the regulations issued under section 18 of the Animal Welfare Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2148">7 U.S.C. 2148</external-xref>) in effect on the day before the date of the enactment of this Act, but only to the extent that such regulations are not in conflict with section 10404A of the Animal Health Protection Act (as added by section 1).</text></subsection></section></legis-body></bill>
