which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary concerned to coordinate with impacted parties when conducting a forest management activity, and for other purposes.</official-title></form><legis-body id="H80D3662C16C24F94BB6133848E748080" style="OLC"><section id="H43BC746CDE8944C7B5E2C1AD4E97DBE8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Proven Forest Management Act of 2021</short-title></quote>.</text></section><section id="HA71EA27C4FED4AA5AC88B065C1DF9D58"><enum>2.</enum><header>Forest management activities for National Forest System land</header><subsection id="H15824B0E6AD5400BA4FD4DC9AF22ED31"><enum>(a)</enum><header>Coordination</header><text display-inline="yes-display-inline">In conducting a forest management activity on National Forest System land, the Secretary concerned shall, as appropriate, coordinate with impacted parties to increase efficiency and maximize the compatibility of management practices across National Forest System land.</text></subsection><subsection id="H29DFB355CBCC400CB93CA733A258D773"><enum>(b)</enum><header>Forest management activities</header><paragraph id="HFF8AA5C285BB4604B2755D61D33FFAA7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), in conducting a forest management activity on National Forest System land, the Secretary concerned shall conduct such activity in a manner that attains multiple ecosystem benefits, including—</text><subparagraph display-inline="no-display-inline" id="HF045C6EAC65F4A04AF6609AEDEC99ECE"><enum>(A)</enum><text>reducing forest fuels;</text></subparagraph><subparagraph id="H4DE133692D59445D84C3C953B5CD234D"><enum>(B)</enum><text>maintaining biological diversity;</text></subparagraph><subparagraph id="H6553F306BB7C4E0EBCB6B574BD924D2C"><enum>(C)</enum><text>improving wetland and water quality, including in Stream Environment Zones; and</text></subparagraph><subparagraph id="H9C4BC3D1B7FE47EEA34744011F0F592F"><enum>(D)</enum><text>increasing resilience to changing water temperature and precipitation.</text></subparagraph></paragraph><paragraph id="H922A4D432C0942088EF0F6A136E0E3D7"><enum>(2)</enum><header>Exception for cost</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply if the Secretary concerned determines that the costs associated with attaining multiple ecosystem benefits are excessive.</text></paragraph></subsection><subsection id="H16200083DE0848688511ECB2D737FA40"><enum>(c)</enum><header>Ground disturbance</header><text display-inline="yes-display-inline">Consistent with applicable Federal law and the forest plan developed for the relevant National Forest System land, the Secretary concerned shall—</text><paragraph id="HB493E07635A746C49A5E086D06D1D8D3"><enum>(1)</enum><text>establish any post-program ground condition criteria for a ground disturbance caused by a forest management activity required by such plan; and</text></paragraph><paragraph id="H53E90477615F489BBD7CDFE3C6CA28CF"><enum>(2)</enum><text>provide for monitoring to ascertain the attainment of relevant post-program conditions.</text></paragraph></subsection><subsection id="HC697972ACA9445BAB9B59E8A58F6B25C"><enum>(d)</enum><header>Availability of categorical exclusion for certain forest management activities</header><text display-inline="yes-display-inline">A forest management activity conducted on National Forest System land for the purpose of reducing forest fuels is categorically excluded from the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) if the forest management activity—</text><paragraph id="HCB98D34AAA324CFCB8AC7298D8219E74"><enum>(1)</enum><text>notwithstanding section 423 of the Department of the Interior, Environment, and Related Agencies Appropriations Act, 2009 (division E of <external-xref legal-doc="public-law" parsable-cite="pl/111/8">Public Law 111–8</external-xref>; 123 Stat. 748), does not exceed 10,000 acres, including not more than 3,000 acres of mechanical thinning;</text></paragraph><paragraph id="H9C239DABD67B49C1BBB5E5939701312B"><enum>(2)</enum><text>is developed—</text><subparagraph id="HE007DDFBE74849EF88323CB0B860F696"><enum>(A)</enum><text display-inline="yes-display-inline">in coordination with impacted parties, specifically including representatives of local governments, such as county supervisors or county commissioners; and</text></subparagraph><subparagraph id="H47794C9C70D04D7A9960F5AD030823BA"><enum>(B)</enum><text>in consultation with other interested entities; and</text></subparagraph></paragraph><paragraph id="HBE6589CCA8314DCFAE72E09AD75C3FF5"><enum>(3)</enum><text display-inline="yes-display-inline">is consistent with the forest plan developed for the relevant National Forest System land.</text></paragraph></subsection><subsection id="H5DC78207F54E44BA89E66D5F9A0F8B0B"><enum>(e)</enum><header>Cooperative Authorities</header><text display-inline="yes-display-inline">The Secretary concerned, in conjunction with land adjustment programs, may enter into contracts and cooperative agreements with a qualified entity to provide for fuel reduction, erosion control, reforestation, Stream Environment Zone restoration, and similar management activities on Federal land and non-Federal land within the programs.</text></subsection><subsection id="HCBEA535075814FA6B99C0BA70A94489E"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA68DD05C848548F38AEA9F2F9F2EFB77"><enum>(1)</enum><header>Interested entities</header><text display-inline="yes-display-inline">The term <term>interested entities</term> includes—</text><subparagraph id="H324E6E4C30D54486B21BE31B49BE553E"><enum>(A)</enum><text>the Administrator of the National Oceanic and Atmospheric Administration;</text></subparagraph><subparagraph id="HB0025314199E4E21BF7AA961F56D1FD0"><enum>(B)</enum><text>State, local, and Tribal governments;</text></subparagraph><subparagraph id="H01B3A1AD192D4B1FA0AC5D3BEF5E59F9"><enum>(C)</enum><text>local fire departments; and</text></subparagraph><subparagraph id="H7F1ED3ACE5244D289698B6DA52FB9186"><enum>(D)</enum><text>other relevant volunteer groups.</text></subparagraph></paragraph><paragraph id="H55D09433FC7145FFB34FFD6E814AC46D"><enum>(2)</enum><header>Forest management activity</header><text display-inline="yes-display-inline">The term “forest management activity” means a project or activity carried out by the Secretary concerned on National Forest System land and consistent with the forest plan covering such land.</text></paragraph><paragraph id="HC38B6E20822F46B4B8471F1F11C60E1A"><enum>(3)</enum><header>National forest system</header><text display-inline="yes-display-inline">The term “National Forest System” has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H502C782EB1724F38AF19CDE04B1B45C5"><enum>(4)</enum><header>Public lands</header><text display-inline="yes-display-inline">The term “public lands” has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>), except that the term includes Coos Bay Wagon Road Grant lands and Oregon and California Railroad Grant lands.</text></paragraph><paragraph id="HB9782603E5234DC0B78C700C56142FAD"><enum>(5)</enum><header>Secretary Concerned</header><text display-inline="yes-display-inline">The term <term>Secretary concerned</term> means—</text><subparagraph id="H054467CDB45A4253B4D0F301633075F2"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System land; and</text></subparagraph><subparagraph id="HEC2711DEC92849EB8AF8623D80CF5675"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands.</text></subparagraph></paragraph><paragraph id="H8C11E95E80E248AD8A2296CB7D768D6E"><enum>(6)</enum><header>Stream Environment Zone</header><text>The term <term>Stream Environment Zone</term> means an area that generally owes the biological and physical characteristics of the area to the presence of surface water or groundwater.</text></paragraph></subsection></section></legis-body></bill>
