which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to prohibit certain donations to Inaugural Committees, to establish limitations on donations to Inaugural Committees, to require certain reporting by Inaugural Committees, and for other purposes.</official-title></form><legis-body id="HE34B7CD3A41A4230BA916D4DBEFB669D" style="OLC"><section id="H8091DC0DC14D4FC294BB82E5BDB91E89" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inaugural Fund Integrity Act</short-title></quote>.</text></section><section id="HD82599A347C24D539F3AE3FBF264A284" section-type="subsequent-section"><enum>2.</enum><header>Limitations and disclosure of certain donations to, and disbursements by, Inaugural Committees</header><subsection id="H6D188F1016CC4A169B891FD665148EEE"><enum>(a)</enum><header>Requirements for Inaugural Committees</header><text display-inline="yes-display-inline">Title III of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HB25A9D3AF8CB481087866341BDCB0452" style="OLC"><section id="HB430D96213A84D2A821F893C3C43EABD"><enum>325.</enum><header>Inaugural committees</header><subsection id="HB9F0810F4FBA4C8E8F7B4C8414958F60"><enum>(a)</enum><header>Prohibited donations</header><paragraph id="HE05D7C2898E24F52B4B6B5F0F2F1DE35"><enum>(1)</enum><header>In general</header><text>It shall be unlawful—</text><subparagraph id="HA6245C0BB49048A1B24B2571A1472F40"><enum>(A)</enum><text>for an Inaugural Committee—</text><clause id="H726527E6CA9B488794A58DAAD393891F"><enum>(i)</enum><text>to solicit, accept, or receive a donation from a person that is not an individual; or</text></clause><clause id="H69C42D6512F249A9B1FBA9EEF628E4C1"><enum>(ii)</enum><text display-inline="yes-display-inline">to solicit, accept, or receive a donation from a foreign national;</text></clause></subparagraph><subparagraph id="HF92447B34FB24613840F5C06D7991F3B"><enum>(B)</enum><text>for a person—</text><clause id="HD2C395E293F14B758323BE1ED3374B5B"><enum>(i)</enum><text>to make a donation to an Inaugural Committee in the name of another person, or to knowingly authorize his or her name to be used to effect such a donation;</text></clause><clause id="HB0148CE2C84A4DEC91CE3D28F1809FC6"><enum>(ii)</enum><text>to knowingly accept a donation to an Inaugural Committee made by a person in the name of another person; or</text></clause><clause id="H167FAEE29DE341EE821B0E96D3453DE6"><enum>(iii)</enum><text>to convert a donation to an Inaugural Committee to personal use as described in paragraph (2); and</text></clause></subparagraph><subparagraph id="HE0C303ED099A4A4986D073B6FF0E4FDF"><enum>(C)</enum><text>for a foreign national to, directly or indirectly, make a donation, or make an express or implied promise to make a donation, to an Inaugural Committee.</text></subparagraph></paragraph><paragraph id="H2F79207C4B6A423B9ED9B6489324CE3A"><enum>(2)</enum><header>Conversion of donation to personal use</header><text>For purposes of paragraph (1)(B)(iii), a donation shall be considered to be converted to personal use if any part of the donated amount is used to fulfill a commitment, obligation, or expense of a person that would exist irrespective of the responsibilities of the Inaugural Committee under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/5">chapter 5</external-xref> of title 36, United States Code.</text></paragraph><paragraph id="HBE54BBEE688A4AE5853386A657585CE0"><enum>(3)</enum><header>No effect on disbursement of unused funds to nonprofit organizations</header><text>Nothing in this subsection may be construed to prohibit an Inaugural Committee from disbursing unused funds to an organization which is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code.</text></paragraph></subsection><subsection id="H122E659DEBC74A408A3EDB9866ED2F11"><enum>(b)</enum><header>Limitation on donations</header><paragraph id="HC6B99C4DEC7647DFA6CFE75EA74D38D1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for an individual to make donations to an Inaugural Committee which, in the aggregate, exceed $50,000.</text></paragraph><paragraph id="HBCE80D1BD86E48B98B03A901EE76ED2D"><enum>(2)</enum><header>Indexing</header><text>At the beginning of each Presidential election year (beginning with 2028), the amount described in paragraph (1) shall be increased by the cumulative percent difference determined in section 315(c)(1)(A) since the previous Presidential election year. If any amount after such increase is not a multiple of $1,000, such amount shall be rounded to the nearest multiple of $1,000.</text></paragraph></subsection><subsection id="H50E1064B3AC74EC7831FE9715AB46951"><enum>(c)</enum><header>Disclosure of certain donations and disbursements</header><paragraph id="H96ECE8BB0FB04924BBA611B0BCA56070"><enum>(1)</enum><header>Donations over $1,000</header><subparagraph id="H02BA0694A6004D3CB9DE6F5A5F9A975C"><enum>(A)</enum><header>In general</header><text>An Inaugural Committee shall file with the Commission a report disclosing any donation by an individual to the committee in an amount of $1,000 or more not later than 24 hours after the receipt of such donation.</text></subparagraph><subparagraph id="HF1D9657B191F4C4AB8208E63BE724FA2"><enum>(B)</enum><header>Contents of report</header><text>A report filed under subparagraph (A) shall contain—</text><clause id="HC427C882B0204F198CE55DE785FFF3E9"><enum>(i)</enum><text>the amount of the donation;</text></clause><clause id="H5271BDCF288F4294BBC15B47D1CCF6F5"><enum>(ii)</enum><text>the date the donation is received; and</text></clause><clause id="H4C0CC24D1CB84A478D4652C0161181C3"><enum>(iii)</enum><text>the name and address of the individual making the donation.</text></clause></subparagraph></paragraph><paragraph id="HBB72C5288DAE4E09AC5E3208623A641B"><enum>(2)</enum><header>Final report</header><text>Not later than the date that is 90 days after the date of the Presidential inaugural ceremony, the Inaugural Committee shall file with the Commission a report containing the following information:</text><subparagraph id="HCB79FDF6654F40138ED3F005F57E4C0E"><enum>(A)</enum><text>For each donation of money or anything of value made to the committee in an aggregate amount equal to or greater than $200—</text><clause id="H8DA51104F4DC4EC19D435F02BED66265"><enum>(i)</enum><text>the amount of the donation;</text></clause><clause id="HB72BCE1437BB4F62A8A05B9461C92D74"><enum>(ii)</enum><text>the date the donation is received; and</text></clause><clause id="H171D8AB1C52B4FFCBDE699F783C9A50C"><enum>(iii)</enum><text>the name and address of the individual making the donation.</text></clause></subparagraph><subparagraph id="H91BAB8A4BB8C4CBFA46AEF2789E0A46D"><enum>(B)</enum><text>The total amount of all disbursements, and all disbursements in the following categories:</text><clause id="H244C6CE4DCC749EFA8ED18A54CFD183A"><enum>(i)</enum><text>Disbursements made to meet committee operating expenses.</text></clause><clause id="HEDCC07A2CB5D40C59777B2B7646870DE"><enum>(ii)</enum><text>Repayment of all loans.</text></clause><clause id="HABB23050BC4744FCA95C8DC03EEEB833"><enum>(iii)</enum><text>Donation refunds and other offsets to donations.</text></clause><clause id="H28E48F9856704B6EA23B6B7788C4874D"><enum>(iv)</enum><text>Any other disbursements.</text></clause></subparagraph><subparagraph id="H59AEA78925734E64A031E2930F332E73"><enum>(C)</enum><text>The name and address of each person—</text><clause id="H9F1C59ACF4EC45A6A12518262016DDD4"><enum>(i)</enum><text display-inline="yes-display-inline">to whom a disbursement in an aggregate amount or value in excess of $200 is made by the committee to meet a committee operating expense, together with date, amount, and purpose of such operating expense;</text></clause><clause id="H9B57AB9ED1E54817BCB77301F4C726E6"><enum>(ii)</enum><text>who receives a loan repayment from the committee, together with the date and amount of such loan repayment;</text></clause><clause id="H25856673CA594DD595E9CED24804371F"><enum>(iii)</enum><text>who receives a donation refund or other offset to donations from the committee, together with the date and amount of such disbursement; and</text></clause><clause id="H21B547D920424C6A82ECC19D385F34CE"><enum>(iv)</enum><text>to whom any other disbursement in an aggregate amount or value in excess of $200 is made by the committee, together with the date and amount of such disbursement.</text></clause></subparagraph></paragraph></subsection><subsection id="H3DDADACEE0A847B698EE4ECAA460744B"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph id="H929364832C1A44A78C3D9DBA368C9DD4"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5D3259229B6F42A4A51C865D369D9FA8"><enum>(A)</enum><text>The term <term>donation</term> includes—</text><clause id="H2D1E8A168D35443AB75B374FDB0E075F" indent="up1"><enum>(i)</enum><text>any gift, subscription, loan, advance, or deposit of money or anything of value made by any person to the committee; or</text></clause><clause id="HC32D396B3A9B403DA952B026F9BBBEE5" indent="up1"><enum>(ii)</enum><text>the payment by any person of compensation for the personal services of another person which are rendered to the committee without charge for any purpose.</text></clause></subparagraph><subparagraph id="H94B859BEE2714AED9A5AF5476A183F47" indent="up1"><enum>(B)</enum><text>The term <term>donation</term> does not include the value of services provided without compensation by any individual who volunteers on behalf of the committee.</text></subparagraph></paragraph><paragraph id="H77D6579C6F204B1295BC26A5B731DFAD"><enum>(2)</enum><text>The term <term>foreign national</term> has the meaning given that term by section 319(b).</text></paragraph><paragraph id="H94F20D0FA8294D84809A92C70598BF95"><enum>(3)</enum><text>The term <term>Inaugural Committee</term> has the meaning given that term by section 501 of title 36, United States Code.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H98902C25C3E14090AAC6BF2CAE4839F8"><enum>(b)</enum><header>Confirming amendment related to reporting requirements</header><text>Section 304 of the Federal Election Campaign Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104</external-xref>) is amended—</text><paragraph id="HACE25B9F0E9845BDA4671572B3193B45"><enum>(1)</enum><text>by striking subsection (h); and</text></paragraph><paragraph id="HBD941E636EF04768821048337A6508B6"><enum>(2)</enum><text>by redesignating subsection (i) as subsection (h).</text></paragraph></subsection><subsection id="H094B239DDE97415F9723B6ECD6E2046B"><enum>(c)</enum><header>Conforming amendment related to status of committee</header><text display-inline="yes-display-inline">Section 510 of title 36, United States Code, is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H37F050DD036A49EFBDDFE7D5B9440210" style="USC"><section id="H7C8FB8B13777471FA24D930F06F3DE19"><enum>510.</enum><header>Disclosure of and prohibition on certain donations</header><text display-inline="no-display-inline">A committee shall not be considered to be the Inaugural Committee for purposes of this chapter unless the committee agrees to, and meets, the requirements of section 325 of the Federal Election Campaign Act of 1971.</text></section><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H5D450D4E8CC7457EB7B9B1F6A7545930"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this Act shall apply with respect to Inaugural Committees established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/36/5">chapter 5</external-xref> of title 36, United States Code, for inaugurations held in 2025 and any succeeding year.</text></subsection></section></legis-body></bill>
