which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to provide for the establishment of a Task Force on Maternal Mental Health, and for other purposes.</official-title></form><legis-body id="H6F38D125C9704BBCB36E1F4BC854AFE3" style="OLC"><section id="H9B036187BED54815BCEB6446D171B4FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Taskforce Recommending Improvements for Unaddressed Mental Perinatal &amp; Postpartum Health for New Moms Act of 2021</short-title></quote> or the <quote><short-title>TRIUMPH for New Moms Act of 2021</short-title></quote>.</text></section><section id="HC5FDA0CF8E394145BD0BE7DBE66F554A"><enum>2.</enum><header>Task Force on Maternal Mental Health</header><text display-inline="no-display-inline">Part B of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/243">42 U.S.C. 243 et seq.</external-xref>) is amended by inserting after section 317L–1 (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-13a">42 U.S.C. 247b–13a</external-xref>) the following:</text><quoted-block id="H1EF1919AB804405A9A553BEE8A9D5088" style="OLC"><section id="H2E8BDC27A4B6425B8F228600340816CD"><enum>317L–2.</enum><header>Task Force on Maternal Mental Health</header><subsection id="H4845242B1D3D4B6EA1B5578DA364A0C1"><enum>(a)</enum><header>Establishment</header><text>Not later than 90 days after the date of enactment of the <short-title>TRIUMPH for New Moms Act of 2021</short-title>, the Secretary shall establish a task force, to be known as the Task Force on Maternal Mental Health (in this section referred to as the <quote>Task Force</quote>) to identify, evaluate, and make recommendations to coordinate and improve, Federal responses to maternal mental health conditions.</text></subsection><subsection id="H79D7F8D6C19244D7B6168DC1C88ACD6C"><enum>(b)</enum><header>Membership</header><paragraph id="H75A53C00E3DF4DD7A58C6D9E7B7A4000"><enum>(1)</enum><header>Composition</header><text display-inline="yes-display-inline">The Task Force shall be composed of—</text><subparagraph id="H13698CC0ADCB453AA33B0456CFA4A7FE"><enum>(A)</enum><text>the Assistant Secretary for Health of the Department of Health and Human Services (or the Assistant Secretary’s designee) who shall serve as the Chair of the Task Force;</text></subparagraph><subparagraph id="HA2B38FD5AE5245AD989661FBC80AD8C9"><enum>(B)</enum><text>the Federal members under paragraph (2); and</text></subparagraph><subparagraph id="H999AC7E9E4054E649566A9213683E456"><enum>(C)</enum><text>the non-Federal members under paragraph (3).</text></subparagraph></paragraph><paragraph id="H763C66A5C3FC443EB6D516E19B5F95DE"><enum>(2)</enum><header>Federal members</header><text>In addition to the Assistant Secretary for Health, the Federal members of the Task Force shall consist of the heads of the following Federal departments and agencies (or their designees):</text><subparagraph id="H335B77CFA2C1473EBF77C5EB447D3C85"><enum>(A)</enum><text>The Administration for Children and Families.</text></subparagraph><subparagraph id="H1286F98D9A1F4B1BA7478533CF7A03DF"><enum>(B)</enum><text>The Agency for Healthcare Research and Quality.</text></subparagraph><subparagraph id="H7C7EF9C37E9D4982ABEF0C48CE143C64"><enum>(C)</enum><text>The Centers for Disease Control and Prevention.</text></subparagraph><subparagraph id="HA4B4F00EEFFD4B40A9406E1863DA47D7"><enum>(D)</enum><text>The Centers for Medicare &amp; Medicaid Services.</text></subparagraph><subparagraph id="HE87E62518DF64F028F5A31E96C35B1FD"><enum>(E)</enum><text>The Health Resources and Services Administration.</text></subparagraph><subparagraph id="H671CC3D97AA64ADF86B816BAC3D22F7A"><enum>(F)</enum><text>The Food and Drug Administration.</text></subparagraph><subparagraph id="H85992F0BFD5D4F9C8276DD9796B5A1BC"><enum>(G)</enum><text>The Indian Health Service.</text></subparagraph><subparagraph id="H656CB5021C9B4A3BBA417481BDAD76AB"><enum>(H)</enum><text>The Office of the Assistant Secretary for Planning and Evaluation of the Department of Health and Human Services.</text></subparagraph><subparagraph id="H19E3EDEECC9A48C981105937566FAB68"><enum>(I)</enum><text>The Office of Minority Health of the Department of Health and Human Services.</text></subparagraph><subparagraph id="HCD1B3247EEFF4C77A618363633EB897E"><enum>(J)</enum><text>The Office of the Surgeon General of the Department of Health and Human Services.</text></subparagraph><subparagraph id="HEB683A3D9F2B4A79BC1343A3E4912E8A"><enum>(K)</enum><text>The Office of Women’s Health of the Department of Health and Human Services.</text></subparagraph><subparagraph id="H8AAF8819C0CF4BE0BEEA15B025EA502F"><enum>(L)</enum><text>The National Institutes of Health.</text></subparagraph><subparagraph id="H46B8BDE6C2174675B727C6E65A4A3503"><enum>(M)</enum><text>The Substance Abuse and Mental Health Services Administration.</text></subparagraph><subparagraph id="H1267C90F1EEF4C388616A8C30C6FE576"><enum>(N)</enum><text display-inline="yes-display-inline">Such other Federal departments and agencies as the Secretary determines that serve individuals with maternal mental health conditions, such as the Department of Veterans Affairs, the Department of Justice, the Department of Labor, the Department of Housing and Urban Development, and the Department of Defense.</text></subparagraph></paragraph><paragraph id="H7B01CB2B623241DEA2276758700F3340"><enum>(3)</enum><header>Non-Federal members</header><text>The non-Federal members of the Task Force shall—</text><subparagraph id="H465E98D8778A4640B96AC983F3E79DD5"><enum>(A)</enum><text>compose not more than one-half, and not less than one-third, of the total membership of the Task Force;</text></subparagraph><subparagraph id="HAE3A6D2047F24EA5BD1F206B320C2237"><enum>(B)</enum><text>be appointed by the Secretary; and</text></subparagraph><subparagraph id="HFEED090054234FD9B946EE5E15141FAA"><enum>(C)</enum><text>include—</text><clause id="H79B9230BE1994A1CACADDF02C73CB23D"><enum>(i)</enum><text>representatives of medical societies with expertise in maternal or mental health;</text></clause><clause id="HAF49E84E574D4FE3ABCA7A6B7BB4ACD1"><enum>(ii)</enum><text>representatives of nonprofit organizations with expertise in maternal or mental health;</text></clause><clause id="H0F5ABE9353974C82984669FA25E76151"><enum>(iii)</enum><text>relevant industry representatives; and</text></clause><clause id="H8C5EDCB36DC3413D87D77C3D287CBF41"><enum>(iv)</enum><text>other representatives, as appropriate.</text></clause></subparagraph></paragraph><paragraph id="HC9086D080EC34999811B2369B86048AB"><enum>(4)</enum><header>Deadline for designating designees</header><text display-inline="yes-display-inline">If the Assistant Secretary for Health, or the head of a Federal department or agency serving as a member of the Task Force under paragraph (2), chooses to be represented on the Task Force by a designee, the Assistant Secretary or head shall designate such designee not later than 90 days after the date of the enactment of the <short-title>TRIUMPH for New Moms Act of 2021</short-title>.</text></paragraph></subsection><subsection id="H5E85075D21194E52BDFC91AF424CBF3A"><enum>(c)</enum><header>Duties</header><text>The Task Force shall—</text><paragraph id="H557177D3FE28445294A318882B9E3BCA"><enum>(1)</enum><text>create and regularly update a report that identifies, analyzes, and evaluates the state of national maternal mental health policy and programs at the Federal, State, and local levels, and identifies best practices including—</text><subparagraph id="H3E63087B6EFC44B0BE2EF83C39D424B3"><enum>(A)</enum><text>a set of evidence-based, evidence-informed, and promising practices with respect to—</text><clause id="H2D4C05918DB94221AA0A7650BC30E7AF"><enum>(i)</enum><text>prevention strategies for individuals at risk of experiencing a maternal mental health condition, including strategies and recommendations to address social determinants of health;</text></clause><clause id="HF551654F84EE42EA8767E1FD5DDB273C"><enum>(ii)</enum><text display-inline="yes-display-inline">the identification, screening, diagnosis, intervention, and treatment of individuals and families affected by a maternal mental health condition;</text></clause><clause id="H3492E27B42DB4637A7CE941B9F85F85D"><enum>(iii)</enum><text>the expeditious referral to, and implementation of, practices and supports that prevent and mitigate the effects of a maternal mental health condition, including strategies and recommendations to eliminate the racial and ethnic disparities that exist in maternal mental health; and</text></clause><clause id="H624714A9C8744019B6F19C2028494C03"><enum>(iv)</enum><text>community-based or multigenerational practices that support individuals and families affected by a maternal mental health condition; and</text></clause></subparagraph><subparagraph id="HD684A7B1769C41F19C9CFFB17A5F7954"><enum>(B)</enum><text>Federal and State programs and activities to prevent, screen, diagnose, intervene, and treat maternal mental health conditions;</text></subparagraph></paragraph><paragraph id="HF2100CEAB3B14393B0F7C2C03D0F2AE1"><enum>(2)</enum><text>develop and regularly update a national strategy for maternal mental health, taking into consideration the findings of the reports under paragraph (1), on how the Task Force and Federal departments and agencies represented on the Task Force will prioritize options for, and implement a coordinated approach to, addressing maternal mental health conditions, including by—</text><subparagraph id="H4DB13F54BD0A4F1283AF2B420A53ECF0"><enum>(A)</enum><text>increasing prevention, screening, diagnosis, intervention, treatment, and access to care, including clinical and nonclinical care such as peer-support and community health workers, through the public and private sectors;</text></subparagraph><subparagraph id="HE4CB24E5F37E4E689D03DA0D75319B51"><enum>(B)</enum><text display-inline="yes-display-inline">providing support for pregnant or postpartum individuals who are at risk for or experiencing a maternal mental health condition, and their families as appropriate;</text></subparagraph><subparagraph id="HCB305DA0D1DB4074A967B309DB92E693"><enum>(C)</enum><text>reducing racial, ethnic, geographic, and other health disparities for prevention, diagnosis, intervention, treatment, and access to care;</text></subparagraph><subparagraph id="H5D7F62E3F4A3466694C742D09101C723"><enum>(D)</enum><text>identifying opportunities for local- and State-level partnerships;</text></subparagraph><subparagraph id="H9859A08976EF4976881118494DDB981B"><enum>(E)</enum><text display-inline="yes-display-inline">identifying options for modifying, strengthening, and coordinating Federal programs and activities, including existing infant and maternity programs, such as the Medicaid program under title XIX of the Social Security Act and the State Children’s Health Insurance Program under title XXI of such Act, in order to increase research, prevention, identification, intervention, and treatment with respect to maternal mental health;</text></subparagraph><subparagraph id="HCB279FDFB4854B04B14309E2A7A6B9AC"><enum>(F)</enum><text>providing recommendations to ensure research, services, supports, and prevention activities are not unnecessarily duplicative; and</text></subparagraph><subparagraph id="H6EB1E19038824997BB6E7A53D843B96B"><enum>(G)</enum><text>planning, data sharing, and communication within and across Federal departments, agencies, offices, and programs;</text></subparagraph></paragraph><paragraph id="H3779133EDE0E47A987AAF5DF4C71D00B"><enum>(3)</enum><text>solicit public comments from stakeholders for the report under paragraph (1) and the national strategy under paragraph (2), including comments from frontline service providers, mental health professionals, researchers, experts in maternal mental health, institutions of higher education, public health agencies (including maternal and child health programs), and industry representatives, in order to inform the activities and reports of the Task Force; and</text></paragraph><paragraph id="H811EBEA5503C4E2BB1C4A32B0A0E7F16"><enum>(4)</enum><text>disaggregate any data collected under this section by race, ethnicity, geographical location, age, marital status, socioeconomic level, and other factors as determined appropriate by the Secretary.</text></paragraph></subsection><subsection id="H2875DBFC96EC41B59F4456931B78A750"><enum>(d)</enum><header>Meetings</header><text>The Task Force shall—</text><paragraph id="H8443A1DA5DC94415BDC7BFBD90373B51"><enum>(1)</enum><text>meet not less than two times each year; and</text></paragraph><paragraph id="HF56B2BBCD80C40F8BC44565452AC8D4D"><enum>(2)</enum><text>convene public meetings, as appropriate, to fulfill its duties under this section.</text></paragraph></subsection><subsection id="HAC77D77A5AB2487CA010A674D2B04AEE"><enum>(e)</enum><header>Reports to public and Federal leaders</header><text>The Task Force shall make publicly available and submit to the heads of relevant Federal departments and agencies, the Committee on Energy and Commerce of the House of Representatives, the Committee on Health, Education, Labor, and Pensions of the Senate, and other relevant congressional committees, the following:</text><paragraph id="H5B1ADBE981F54BE3A7D646D2CBB1B7DD"><enum>(1)</enum><text>Not later than 1 year after the first meeting of the Task Force, an initial report under subsection (c)(1).</text></paragraph><paragraph id="HA36C8EF094134C8EB0A23499DC39F47C"><enum>(2)</enum><text>Not later than 2 years after the first meeting of the Task Force, an initial national strategy under subsection (c)(2).</text></paragraph><paragraph id="HE109F59E901F438D9CB0B4CB6CF8C0BF"><enum>(3)</enum><text>Each year thereafter—</text><subparagraph id="H9B799BD188804755AA938DC51985D258"><enum>(A)</enum><text>an updated report under subsection (c)(1);</text></subparagraph><subparagraph id="H6754D5D354694ACB8842E9B9D2A17694"><enum>(B)</enum><text>an updated national strategy under subsection (c)(2); or</text></subparagraph><subparagraph id="H53BA56E9F2024737BD2C563872AD54F0"><enum>(C)</enum><text>if no such update is made, a report summarizing the activities of the Task Force. </text></subparagraph></paragraph></subsection><subsection id="H622F4D79AB48427C9A94E0FC8F7E0EF0"><enum>(f)</enum><header>Reports to Governors</header><text>Upon finalizing the initial national strategy under subsection (c)(2), and upon making relevant updates to such strategy, the Task Force shall submit a report to the Governors of all States describing opportunities for local- and State-level partnerships identified under subsection (c)(2)(D).</text></subsection><subsection id="HB70B63CD9C93492894636FF3609B354E"><enum>(g)</enum><header>Sunset</header><text>The Task Force shall terminate on the date that is 6 years after the date on which the Task Force is established under subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
