R. 4209</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210628">June 28, 2021</action-date><action-desc><sponsor name-id="P000048">Mr. Pfluger</sponsor> (for himself and <cosponsor name-id="L000589">Mrs. Lesko</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To support remediation of illicit cross-border tunnels, and for other purposes.</official-title></form><legis-body id="H102FCD452E6D4F668E114ABC248E38A9" style="OLC"><section id="HCFD3085594FE49D9A781D145ACC7CBAA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Illicit Cross-Border Tunnel Defense Act</short-title></quote>.</text></section><section display-inline="no-display-inline" id="H2CE7431A3650433E84D34A72BA5C6DAA" section-type="subsequent-section"><enum>2.</enum><header>Counter illicit cross-border tunnel operations</header><subsection id="HB2D094B4CCAC436E8CFBDE41C0F7CDB3"><enum>(a)</enum><header>Counter illicit cross-Border tunnel operations strategic plan</header><paragraph id="H1E9DEB8CE49C4C9F9009759B47EE1B23"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Commissioner of U.S. Customs and Border Protection shall develop a strategic plan to address the following:</text><subparagraph id="H6BE7EBF8C61041CFA09EED061533F037"><enum>(A)</enum><text display-inline="yes-display-inline">Risk-based criteria to be used to prioritize the identification, breach, assessment, and remediation of illicit cross-border tunnels.</text></subparagraph><subparagraph id="H12E0D8754452455D82A8A247BB188BE0"><enum>(B)</enum><text display-inline="yes-display-inline">Promote the use of innovative technologies to identify, breach, assess, and remediate illicit cross-border tunnels in a manner that, among other considerations, reduces the impact of such activities on surrounding communities.</text></subparagraph><subparagraph id="HD6DA66725C874E7CAD0EB0D1F587B7FD"><enum>(C)</enum><text display-inline="yes-display-inline">Processes to share relevant illicit cross-border tunnel location, operations, and technical information.</text></subparagraph><subparagraph id="H60206D6C17504FD19248062CE839FF4F"><enum>(D)</enum><text display-inline="yes-display-inline">Indicators of specific types of illicit cross-border tunnels found in each U.S. Border Patrol sector identified through operations to be periodically disseminated to U.S. Border Patrol sector chiefs to educate field personnel.</text></subparagraph><subparagraph id="H906921A13A5A4995A0CD6246E217F522"><enum>(E)</enum><text>A counter illicit cross-border tunnel operations resource needs assessment that includes consideration of the following:</text><clause id="H6B79EEA7CAC44A21B6426A6312FD66F5"><enum>(i)</enum><text>Technology needs.</text></clause><clause id="H1F5E12FA752D4CE69D62F60FF5630493"><enum>(ii)</enum><text>Staffing needs, including the following:</text><subclause id="H80A6B3E2314A425088D5C72A15A7BA62"><enum>(I)</enum><text display-inline="yes-display-inline">A position description for counter illicit cross-border tunnel operations personnel.</text></subclause><subclause id="H62DCEC018BA745D298EA05D606D6EFB6"><enum>(II)</enum><text>Any specialized skills required of such personnel.</text></subclause><subclause id="H21AEA71AE3D645858BA225FF640A5611"><enum>(III)</enum><text>The number of such full time personnel, disaggregated by U.S. Border Patrol sector.</text></subclause></clause></subparagraph></paragraph><paragraph id="H1A5E8EF617A9490484F80EFA86D1A6BE"><enum>(2)</enum><header>Report to Congress on strategic plan</header><text>Not later than one year after the issuance of the strategic plan required under paragraph (1), the Commissioner of U.S. Customs and Border Protection shall submit to the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report on the implementation of paragraph (1).</text></paragraph></subsection><subsection id="H4A1089B925804650A68D600CED1DEDB4"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Commissioner of U.S. Customs and Border Protection $1,000,000 for each of fiscal years 2022 and 2023 to carry out remediation operations of illicit cross-border tunnels.</text></subsection></section></legis-body></bill>
