<official-title display="yes">To amend title 5, United States Code, to direct the Director of the Office of Personnel Management to make publicly available demographic information regarding political appointees, and for other purposes.</official-title>

<section id="H2D31B6C4BE9C4EB386A8C2C4D305ED53" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Political Appointments Inclusion and Diversity Act</short-title></quote>. </text></section> <section id="HDE5FF0994EDD45E5B9F79894CCCDD39B"><enum>2.</enum><header>Demographic data on political appointees</header> <subsection id="H891BCD903A7C431487AAB3244A3CC4B4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<section id="H3502DA3DACC34B6BB0506AC84DD846FB"><enum>3330f.</enum><header>Availability of demographic data on political appointees</header>
<subsection id="HFB38F2399F8441C585E9924D64A248C8"><enum>(a)</enum><header>Publication</header>
<paragraph id="HC939699EC61E4069B7C0B0D1AEAFFD65"><enum>(1)</enum><header>In general</header><text>Not less frequently than one year after the date of enactment of this section and not less than annually thereafter, the Director of the Office of Personnel Management, in coordination with the White House Office of Presidential Personnel, shall publish a report on the public website of the Office that contains summary level information on the demographics of appointees.</text></paragraph> <paragraph id="HC821BBDAE9F647E39818905C723AFF4A"><enum>(2)</enum><header>Data</header><text>Any report published under paragraph (1) shall provide such information in a structured data format that is searchable, sortable, and downloadable, makes use of common identifiers wherever possible, and contains current and historical data regarding such information.</text></paragraph></subsection>
<subsection id="H54A60DACE73343849C466CCC220495AC"><enum>(b)</enum><header>Contents</header>
<paragraph id="HA6E94E1ACFA8469CBA388800775C7826"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each report published under subsection (a) shall include self-identified data on race, ethnicity, tribal affiliation, gender, disability, sexual orientation, veteran status, and whether the appointee is over the age of 40 with respect to each type of appointee. Such a report shall allow for users of the Office’s website to view the type of appointee by agency or component, along with these self-identified data, alone and in combination, to the greatest level detail possible without allowing the identification of individual appointees. </text></paragraph> <paragraph id="H3FEED4F7E43840C887E4BEBAB52E40C5"><enum>(2)</enum><header>Option to not specify</header><text>When collecting each category of data described in paragraph (1), each appointee shall be allowed an option to not specify with respect to any such category.</text></paragraph>
<paragraph id="H5CA65A5629C04CBC8E3F4C3525F3EEA2"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall consult with the Committee on Oversight and Reform of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate regarding reports published under this section and the information in such reports to determine whether the intent of this section is being fulfilled and if additional information or other changes are needed for such reports.</text></paragraph></subsection> <subsection id="HDD4CA8D7D2DD46638128A817C90C7696"><enum>(c)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="H754F13B0A3F6462DB56EA9E177D61F13"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means—</text> <subparagraph id="H2D103ABC0A8F4A5DA4472FEFB0F546E5"><enum>(A)</enum><text>any Executive agency, the United States Postal Service, and the Postal Regulatory Commission;</text></subparagraph>
<subparagraph id="HEBE69DB7C3AD48C0A07C9CF8741C3EDD"><enum>(B)</enum><text>the Architect of the Capitol, the Government Accountability Office, the Government Publishing Office, and the Library of Congress; and</text></subparagraph> <subparagraph id="H97D7DF32F4E54E5A9830DA50111F624C"><enum>(C)</enum><text>the Executive Office of the President and any component within such Office (including any successor component), including—</text>
<clause id="HF314F58B8BF94C5B8A3A4179BE34F6F3"><enum>(i)</enum><text>the Council of Economic Advisors;</text></clause> <clause id="H7ECA05492A5247E7B7E86779AF2FF150"><enum>(ii)</enum><text>the Council on Environmental Quality;</text></clause>
<clause id="H0C215F057246422EAD998FE7DD9C56D5"><enum>(iii)</enum><text>the National Security Council;</text></clause> <clause id="H96876DC8140A4048943CB6D17D034BAD"><enum>(iv)</enum><text>the Office of the Vice President;</text></clause>
<clause id="H898FD51FC841414F98CC53AD1762539D"><enum>(v)</enum><text>the Office of Policy Development;</text></clause> <clause id="H966886529A724660BB98E740E435419A"><enum>(vi)</enum><text>the Office of Administration;</text></clause>
<clause id="H22CE849C6D9C4444A034112EF8988079"><enum>(vii)</enum><text>the Office of Management and Budget;</text></clause> <clause id="H264A700BE19344769FAD0857EBC5F440"><enum>(viii)</enum><text>the Office of the United States Trade Representative;</text></clause>
<clause id="H93C58C173F6F4628A8BFD05ADBE2635F"><enum>(ix)</enum><text>the Office of Science and Technology Policy;</text></clause> <clause id="HA9422FA960F0494692BC6C610BD25948"><enum>(x)</enum><text>the Office of National Drug Control Policy; and</text></clause>
<clause id="H9B2D32316B834E4AA4840AC8D25A004A"><enum>(xi)</enum><text display-inline="yes-display-inline">the White House Office, including the White House Office of Presidential Personnel;</text></clause></subparagraph></paragraph> <paragraph id="HB3E3A860CDFB469281FF28FC04DF4018"><enum>(2)</enum><text>the term <term>appointee</term>—</text>
<subparagraph id="HF8003D48316C4F6AA9F1C0ACCE709AFF"><enum>(A)</enum><text display-inline="yes-display-inline">means an individual serving in a policy and supporting position at an agency; and</text></subparagraph> <subparagraph id="H30CC9739432A421390B6BEB54DCA26BD"><enum>(B)</enum><text display-inline="yes-display-inline">includes an individual serving in such a position temporarily in an acting capacity in accordance with—</text>
<clause id="H59A27A3A484B4242BCE34D7E72EC8222"><enum>(i)</enum><text>sections 3345 through 3349d (commonly referred to as the <quote>Federal Vacancies Reform Act of 1998</quote>);</text></clause> <clause id="H300E4F552A2A4F8E9ED471DBA9DC5EE5"><enum>(ii)</enum><text>any other statutory provision described in section 3347(a)(1); or</text></clause>
<clause id="H8B6A86F538D74B0AA549C4730975A254"><enum>(iii)</enum><text>a Presidential appointment described in section 3347(a)(2); and</text></clause></subparagraph></paragraph> <paragraph id="HE048704600284A2F9AC48172F82F2CD8" commented="no"><enum>(3)</enum><text>the term <term>policy and supporting position</term> means—</text>
<subparagraph id="HA0C06C05DF154F618346D7E94DAA61F1" commented="no"><enum>(A)</enum><text>a position that requires appointment by the President, by and with the advice and consent of the Senate;</text></subparagraph> <subparagraph id="H28B34334037E495484A2F2E6E2CBC67F" commented="no"><enum>(B)</enum><text>a position that requires or permits appointment by the President or Vice President, without the advice and consent of the Senate;</text></subparagraph>
<subparagraph id="H9441F4E6A24F4E2EA7E2D551BF00CFA5" commented="no"><enum>(C)</enum><text>a position occupied by a limited term appointee, limited emergency appointee, or noncareer appointee in the Senior Executive Service, as defined under paragraphs (5), (6), and (7), respectively, of section 3132(a);</text></subparagraph> <subparagraph id="H11BBA1011EC94F7DBE6FEFDB8E23DCEA" commented="no"><enum>(D)</enum><text>a position of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations, or any successor regulation;</text></subparagraph>
<subparagraph id="HBE6B7B27F6C74D7BBDF797B631905CE8" commented="no"><enum>(E)</enum><text>a position in the Senior Foreign Service; and</text></subparagraph> <subparagraph id="HC8150B68858C4D6D95172BD6BE2633C2" commented="no"><enum>(F)</enum><text>any other position classified at or above level GS–14 of the General Schedule (or equivalent) that is excepted from the competitive service by law because of the confidential or policy-determining nature of the position duties. </text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
