R. 4196</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210628">June 28, 2021</action-date><action-desc><sponsor name-id="D000615">Mr. Duncan</sponsor> (for himself, <cosponsor name-id="K000395">Mr. Keller</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, <cosponsor name-id="B001305">Mr. Budd</cosponsor>, <cosponsor name-id="H001086">Mrs. Harshbarger</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, and <cosponsor name-id="P000605">Mr. Perry</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To nullify the order issued by the Centers for Disease Control and Prevention titled <quote>Temporary Halt in Residential Evictions To Prevent the Further Spread of COVID–19</quote>.</official-title></form><legis-body id="H6773785376B24588B2964CF07D090644" style="OLC"><section id="H0C31A4D3BE13410D92205D032E23BE2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restore the Rights of Property Owners under the Eviction Moratorium Issued by the CDC Act of 2021</short-title></quote>. </text></section><section id="H887D5CA44F494C2FABD45E8483564348"><enum>2.</enum><header>Nullification of order halting residential evictions</header><subsection id="H0938984676FC46B5AEA964B3D90D78A1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Effective beginning on July 1, 2021, the order issued by the Centers for Disease Control and Prevention under section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>), entitled <quote>Temporary Halt in Residential Evictions To Prevent the Further Spread of COVID–19</quote> (85 Fed. Reg. 55292 (September 4, 2020)), including the extension of such order issued on March 31, 2021 (86 Fed. Reg. 16731), and any other extensions thereto, shall have no force or effect.</text></subsection><subsection id="HAAD305E7C98C45BC8EAF58348850F31E"><enum>(b)</enum><header>No reissued or new order</header><text display-inline="yes-display-inline">The order nullified by subsection (a) may not be reissued in substantially the same form, and a new order that is substantially the same as such order may not be issued, unless the reissued or new order is specifically authorized by a law enacted after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
